'Collision course' with DOJ: Ari Melber explains why Jack Smith sent Trump his own interviews in new filing

In a civil or criminal case, "discovery" is the process in which attorneys on opposing sides share evidence. Discovery is underway in special counsel Jack Smith's 37-count federal criminal case against former President Donald Trump; Smith's team for the U.S. Department of Justice (DOJ) is letting Trump's lawyers know what evidence they have, and vice versa.

During a June 22 commentary, MSNBC host Ari Melber (who is an attorney) laid out reasons why Trump's defense lawyers should be nervous about the evidence that Smith and his associates are sharing with them via discovery — including a new Smith filing.

Melber told viewers, "This kind of filing reminds Donald Trump and his evolving team of lawyers (that) they are on a collision course with Jack Smith's aggressive office, barelling towards a trial slated to start in August…. This filing that we just got outlines the new evidence that Donald Trump's team will get. That includes interviews of defendant Trump conducted by non-government entities obtained by the special counsel's office. The key word here is: interviews. Plural."

The MSNBC host added, "It means that Smith has at least one more recording… DOJ is giving this material to Trump so that he can review it, prepare his defense."

Smith's filing, Melber noted, means that "Trump will learn who is testifying against him."

Melber observed, "Trump has made so many incriminating claims in public that they are now literally part of the criminal evidence int his case."
