Former President Donald Trump and his lawyers have been slamming Judge Tanya Chutkan's limited gag order in special counsel Jack Smith's election interference case as an attack on his First Amendment rights. A three-judge panel evaluated the gag order, which is on hold, during a Monday, November 20 session.

Later in the day, attorney Ty Cobb — who served as a White House lawyer during Trump's presidency — discussed that session with CNN's Erin Burnett. And he predicted that the former president will be imperiled by his own "narcissism."

Cobb told Burnett, "I don't think his first or second violation of the gag order will find him sent to jail, but I think ultimately, his narcissism will get the best of him. And he will violate it until he finds out what the limits of Judge Chutkan's patience are."

POLL: Should Trump be allowed to hold office again?

When the D.C. Circuit Court of Appeals issues its ruling, Trump and his legal team will know whether or not Chutkan's limited gag order remains. Cobb believes the court will uphold the gag order as constitutional but is likely to "tweak" it.

Cobb told Burnett, "They will tweak the existing gag order, and I think the tweaking will be around the word 'targeting' — or 'target' as it's used in the existing gag order, refining that in a way that makes plain that yes, Jack Smith can be criticized…. by name, but that he can't be the subject of incitement or invited violence."
