Schumer just dropped a preelection bombshell on Trump’s criminal enterprise

Senate Minority Leader Chuck Schumer understands better than anyone the difference between, on the one hand, a Department of Homeland Security whistleblower’s “bombshell” revelations about Trump administration schemes to rig the 2026 midterm elections and, on the other hand, old, “trumped-up,” ultimately wrong charges of election fraud that were brought against Schumer in 1982 by over-zealous Republican federal prosecutors in New York.

The long-discredited case against Schumer was killed by none other than the Reagan Justice Department, thanks partly to columns that I wrote for a now-long-defunct Brooklyn weekly, The Prospect Press, which was never online, and thanks to an affidavit that I submitted at the behest of Schumer’s pro-bono defense counsel, Arthur Liman.

Suffice it to say here that, in that infamous "Schumer case,” in 1982, New York federal prosecutors were earnest but over-zealous, probably for somewhat-partisan reasons. But now Schumer and California Senator Alex Padilla have made clear

that what's truly indictable and probably criminal are moves by the Trump administration to rig the coming mid-term elections against state officials’ constitutional obligations and prerogatives and against countless voters’ rights.

Nothing short of massive public organizing will stop Trump’s latest coup attempt. Every conscientious young lawyer (including many a former Yale student of mine) who's working in a law firm or public agency should be assigned to “pro bono” work against the coup or should take “leave time” for it in the coming six weeks to rescue the American republic. Retired Federal Judge Michael Luttig, a former Republican, makes clear has explained what happened to his party, what's at stake for the country, and what must be done, now or never. Heed him.
