'Real test of our Constitution': Legal analyst predicts Trump chance at jail time 'minuscule at best'

As former President Donald Trump remains the leading 2024 GOP nominee, the MAGA hopeful could end up in the White House in the near future — or the jail house.
MSNBC's Alex Witt asked NBC News legal analyst Lisa Rubin Sunday "how concerned" voters should be about the possibility of a jailed Trump ahead of next year's election.
"You mean, about Trump going to prison during the campaign, or at some point there after? I think if we're talking about during the campaign, I would personally predict that the chances of Donald Trump going to jail at some point before the close of 2024 is minuscule at best," Rubin said. "I think to the extent that Donald Trump goes to jail, it will be because he violates a gag order imposed on him right now, the gag order in New York is back in place. so i'm really curious to see on the 11th how he behaves on the stand, and whether he invites judge — in New York to do more than find him by violating that order. but if we're talking about his actual criminal liability,I think he'll go to jail before the end of 2024? No. And of course, if he is re-elected as president, he will say that any criminal proceedings that are then going on and have been completed, have to stop. Because as a sitting president, he's entitled to be free from criminal process, and we'll have to see where that goes. It could be a real test of our Constitution, Alex."
