During a Tuesday, October 22 interview with radio host Hugh Hewett, former President Donald Trump vowed to fire special counsel Jack Smith "in two seconds" if he wins the 2024 election and returns to the White House in January 2025.

When Trump appeared on WABC-AM's "Cats & Cosby Show" in New York City two days later, he went a step further and told hosts John Catsimatidis and Rita Cosby that Smith is "mentally deranged" and should be "thrown out of the country."

Smith indicted Trump on federal charges in two separate cases: the Mar-a-Lago classified documents case — which Judge Aileen Cannon dismissed — and the election interference case. Because the U.S. Department of Justice (DOJ) has a longstanding policy against indicting a sitting president, Smith's work as special counsel would end if Trump defeated Democratic presidential nominee Kamala Harris on November 5.

In addition to a variety of civil lawsuits, Trump has faced four criminal indictments — two of them federal, two at the state level — since leaving the White House.

Fulton County, Georgia District Attorney Fani Willis' election interference case remains in limbo. And Justice Juan Merchan has postponed sentencing in Manhattan District Attorney Alvin Bragg Jr.'s hush money/falsified business records case until after the election.

A Manhattan jury convicted Trump on 34 criminal counts in Bragg's case. And sentencing is now set for November 26.

Bragg's case is the only one of the four that went to trial before the election.
