Possibility of Trump nominating a Fox host for Supreme Court 'not a lunatic thought': expert

Although Democrats have won the popular vote in seven of the United States' last nine presidential elections (2004 and 2024), they haven't had good luck with the U.S. Supreme Court — where GOP nominees have a hard-right 6-3 supermajority. One third of the High Court now consists of Donald Trump appointees: Justices Brett Kavanaugh, Amy Coney Barrett and Neil Gorsuch.

Moreover, President Trump will have a chance to nominate some more High Court justices if any seats become available. And his nominees tend to be far-right social conservatives, not more nuanced GOP-appointed justices like Anthony Kennedy and the late Sandra Day O'Connor (both Ronald Reagan appointees).

In an article published on March 8, The Guardian's Martin Pengelly examines the possibility of Trump nominating a Fox News host for SCOTUS.

Pengelly notes that Mark Tushnet, a law professor at Harvard University in Cambridge, Massachusetts, discusses Trump's SCOTUS nominees in his new book, "Who Am I to Judge? Judicial Craft Versus Constitutional Theory." Tushnet said he "wouldn't rule out" the possibility of Trump nominating Fox News host Jeanine Pirro for the High Court.

Tushnet told The Guardian, "I have thought about potential Trump nominees, and actually, what comes to mind is the equivalent of Pete Hegseth — a Fox News legal commentator."

Hegseth, a former Fox News host, is now secretary of defense on the second Trump Administration.

The Harvard law professor said of a possible Pirro nomination for the High Court, "I don't think it’s highly likely, but given the way those things work, and given the idea that you want people who aren't simply judges, it's not a lunatic thought, I guess."
