'Very weak': Conservative lawyer tears apart Trump’s 'bizarre' appeal of Colorado ruling

Some of 2024 GOP presidential frontrunner Donald Trump's foes, including conservative former judge J. Michael Luttig, have been arguing that he is prohibited from seeking the presidency under Section 3 of the U.S. Constitution's 14th Amendment — which states that an "officer" who has engaged in "insurrection" is barred from certain political positions.
The Colorado Supreme Court and Maine Secretary of State Shenna Bellows have agreed with that argument, deciding that Trump should be excluded from their state ballots based on Section 3. Michigan and deep blue California, however, have disagreed and decided that Trump can remain on their ballots.
Trump's legal team is hoping that the U.S. Supreme Court will eventually rule on the case and agree with Michigan and California rather than Colorado and Maine. But conservative George Conway, during a January 4 appearance on MSNBC's "Morning Joe," was vehemently critical of the arguments that Trump and his lawyers make in a court filing challenging the Colorado decision.

Conway told host Mika Brzezinski, "This is a bizarre document, and I think it reflects the weakness of Trump's position, actually. Let me explain why. If you took a seminar on appellate advocacy, the first thing they may tell you is you have to focus an appellate court, at any level, on the two or three…. key issues, the ones that you think are the weak spots in the decision that you're challenging. And that's on steroids when you go up to the Supreme Court of the United States and file a petition for a writ of certiorari."
The conservative attorney went on to say that instead of offering a strong, concise argument against the Colorado decision, Trump is "basically just throwing stuff up against the wall" and "seeing what would stick."
Conway told Brzezinski, "His arguments are very, very weak…. When you go through the issues, one by one by one — the way lawyers are supposed to, his case looks terrible."
