Freshman in a Faceoff

For a while, life as a political newbie must have been a real drag for Tom Gallagher.

First there was that press event at Enterprise Library one cloudy afternoon in September. It was as if Karl Rove had a weather machine: Just before the news conference, a cloudburst sent down violent sheets of rain. After dashing inside, attendees spent moments between sound bites pushing wet strands of hair from foreheads.

Then there was the Sept. 19 debate at Congregation Ner Tamid. Gallagher had a cold and seemed to goad himself through what ended up being a half-hearted verbal skirmish with freshman Rep. Jon Porter.

And, oh, the woes of name recognition: Tom who? Already off to a late start when he began his campaign in March, Gallagher found polls revealed that mention of his name in District 3 elicited more shrugs than nods. What was a rich former gaming exec to do?

But as the season has changed, so have Gallagher's fortunes. With less than a month until the Nov. 2 election, the former Park Place Entertainment CEO has made monster strides better befitting a titan of industry, more than halving a 24-point gap in a Review-Journal-commissioned telephone poll. He's continually hammered Porter at news conferences and in ads as a GOP rubber stamp more interested in appeasing party leaders than constituents; meanwhile, Gallagher's also handily parried a particularly potent set of attack ads produced by the Porter camp. In short, the infant District 3 – which Porter snatched from Dario Herrera in 2002 as the would-be golden boy foundered amid ethics woes – is home to the most watched statewide race this year.

And not just within the state. House Democrats have flagged the Porter-Gallagher race as one of nine House seats held by Republicans that are considered vulnerable; Democrats need to win 12 to take the House. District 3, many say, is crucial – and for Nevada Democrats, a second chance.

"If Democrats don't pick up this seat in Nevada," says Rep. Shelley Berkley, "I think it will be very hard to take back the House."

So Porter – Mr. Nice Guy, former Boulder City mayor and state senator – has a set of crosshairs trained on him this election. But wrinkles in this race abound. One is the fact that the district – a sort of propeller-shaped inkblot spreading across urban and rural Clark County – isn't exactly easy to get a bead on.

"The interesting thing about it is that when it was divided [to create District 3], my district, which was the urban core of Las Vegas, was supposed to trend Democratic. And through the years, it has," Berkley observes. "District 3 was drawn to trend more Republican, which it hasn't. Now there are more Democrats than Republicans in the 3rd Congressional District."

As of this writing, about 3,000 more. It's a district many politicians characterize as voting across party lines, with more than 50,000 registered as nonpartisan – both signs of issue-minded voters – and with higher-than-average turnout at the polls.

It's just one quirk that might make this race more than a mere contest of Mr. Invisible vs. Mr. Inexperienced. Sure, the attack ads have been rolled out; rumors abound of candidates having substantial differences of opinions on policy matters. But most interestingly, both candidates come with their own baggage – and a few ideas.

If elected, Gallagher says his top priority will be health care.

"It cuts across everybody's lives, and is a huge problem," he says. "It gets worse every day. We've got 400,000 people in this state without health care. It's the thing I worked hardest at at Park Place. We hired a world-class adviser on that stuff. We did some extraordinary things in terms of doing a much better job at delivering health benefits, and we did some really creative things in terms of trying to encourage people to take care of themselves." He tells of kicking off a program in which teams competed to lose weight. "Health care is one of the most difficult problems we face as a society, as a government, as individuals, and that's where I put a huge priority in terms of this campaign."

Porter's agenda? Who knows. A scheduled phone interview with the first-term congressman did not materialize. Porter simply didn't call at the appointed time. After repeated phone calls from this reporter over the course of three hours, Porter press secretary Adam Mayberry explained that he'd thought an interview with campaign consultant Mike Slanker would suffice for some Porter quotes. Could it be that Porter's image as the Invisible Man is, in fact, the most palpable thing about him?

There are plenty of vulnerabilities to go around. Porter hasn't made many enemies, but neither has his record made him the toast of the town. In his brief congressional tenure, he's established a decent pork pipeline to Nevada – his pamphlets hype money for Nevada State College in Henderson, UNLV, more federal funds for schools – but he's saddled with a reputation as a party robot, going with the GOP on most major issues, including Bush's controversial 2003 energy bill and Medicare reform. Both were roundly criticized as sops to the energy and pharmaceutical industries. (Boulder City Mayor Bob Ferraro, when asked to characterize Porter's service to Boulder City, says he was "very responsive to my requests and concerns." When asked what Porter's best-known contribution to Boulder City is, he says, "Let me think...no, not dredging anything up.")

It hasn't been hard for Gallagher, in a surprisingly substantive ad campaign, to make a case that Porter is a party-pleaser (or, to use Gallagher's fave term, rubber stamp). He points out Porter's nod to giving $167 million in tax credits to power companies exploring nuclear power (read: more nuke waste). Just another facet of that go-along, get-along Porter panache, they say.

Meanwhile, the Porter camp has fired back, painting Gallagher as a carpetbagger, a bored rich guy with fickle political aspirations. If Porter's congressional record is vanilla, Gallagher's record as a businessman is downright sour, says Slanker, Porter's campaign consultant.

"The fact of the matter is that when tens of thousands of Nevadans were out of work, Gallagher made millions of dollars," says Slanker, referring to a TV ad that portrays Gallagher as prospering in the wake of 9/11.

Gallagher balks. "[Porter's] a guy who didn't lift a finger after 9/11 – who in fact disappeared and who, by the way, has voted against extending unemployment compensation for people that lose their jobs. He's criticizing me, where I'm the one that set up a foundation to try to do everything possible to help people who were temporarily out of work." He says during his two-year stint as CEO of Park Place, he oversaw a $1.8 million plan to extend health benefits for laid-off workers, and has one of the best records when it came to post-9/11 layoffs. "When you look at Park Place compared to every other company, we did the best job. For Porter to be criticizing me is just hypocritical."

Gallagher has spent much of his considerable investment on ads to debunk what he says is the Porter team's access to an "unlimited supply of lies."

Then again, they just might do themselves in. Gallagher campaign consultant Dan Hart wonders whether Porter's 9/11 ads – which depict Gallagher grimly winking at the camera ("I can't believe he winked at the camera," says Slanker, who filmed Gallagher at his first debate with Porter) – will backfire.

"It's savage, it's over the top," Hart says of the ad. "I think it's a sign of desperation. Why run such negative ads which could potentially disgrace Porter's persona, his good-guy attitude? We want to keep the race about the issues. Some of that [negative] stuff backfires. Using 9/11 in political ads – I don't think that helps you in the long term." (Slanker counters: "We're just trying to get the truth out there. We're merely referencing 9/11 to take people back three years. It's not exploitation at all.")

But in this case, the personal is political. Slanker and crew persist in their criticism that Gallagher's Southern Nevada roots don't run very deep. "He started with a huge advantage, doing 10 weeks of TV and half a million dollars, trying to sell something that he isn't, saying he fought for the little guy," Slanker says. "His commitment to the district is amazing. He moved from Lake Tahoe and rented a house in Henderson. He owns homes all over the country and doesn't bother to buy in the district? He's an opportunist, a multimillionaire several times over. He makes this proclamation that he's lived in Nevada for seven years. Notice they say Nevada – he was in Lake Tahoe. He's trying to buy the race. Less than 13 percent of his contributors are Nevadans, and besides that he's writing personal checks."

Indeed, perhaps one of Gallagher's biggest liabilities is that he's rich – worth between $8.9 million and $33.7 million, according to financial disclosure statements – a fact fashioned into a "rich carpetbagger" tag by the Porter campaign. But Gallagher thinks the fact that he's tapped his own coffers for the campaign – upwards of $400,000, he says – ultimately works in his favor.

"[Porter's] a guy who's taken almost a million dollars from tobacco, oil and gas, nuclear power, pharmaceutical companies, insurance companies," says Gallagher. "If you want to look at what proportion of his campaign has been funded by those guys, as a voter I'm much more worried about that than I am about anybody putting his own money where his mouth is. I decided to [fund portions of my own campaign] because I felt if I was going to ask other people to contribute to make this run, that it was important for me to demonstrate that I wasn't trying to do that on just their dollars.

"There's no question that I've worked very hard and been very, very fortunate," Gallagher says. "I've said to people over and over again, 'That's the reason I got in this race, because Nevada has been very good to me.' And that's my answer."

The Race Card

Anybody who knows Clark County Commissioner Lynette Boggs McDonald knows she's not shy about sharing her feelings. She once got so worked up about a political slight that she went on a religious tirade that ended with sending her enemies back into the fire in the name of Jesus Christ.

Sitting in the audience furiously scribbling notes, I remember thinking only "Jesus Christ." While it was good political theater, the topic of religion had been introduced by Boggs McDonald, and nobody else.

And now, one appointment to the Clark County Commission later, she's done it again, bringing up race in a political contest where it wasn't even an issue. (Boggs McDonald is black; her Democratic opponent, Assemblyman David Goldwater, is Jewish.)

"From my perspective, there is one last plantation in America, and it's called the Democratic Party," she told the Las Vegas Sun.

She didn't back off when asked for a comment by the Review-Journal: "One party believes they're [black voters] owned, and that's the Democratic Party. My party doesn't do enough, but at least it doesn't presume that African American voters are along for the ride. I have always earned my votes from African Americans."

Indeed, Boggs McDonald delighted in telling would-be voters that if she was elected to Congress in 2002 – when she ran against Rep. Shelley Berkley – she would have been the first black, female Republican member of the House in history. (The party label was necessary, since the Democrats elected their first black woman decades ago.)

It's not like Boggs McDonald hates the Democratic plantation; after all, she used to be on it. She ran for the state Assembly as a Democrat in 1998, but lost to Republican Merle Berman by just 306 votes. She changed parties to become a Republican in 1999, and got appointed to the Las Vegas City Council. (The party switch still irks some grudge-holding Democrats who worked on her Assembly race.)

She won election to a term on the council in her own right, and was appointed to the County Commission this year when ex-Commissioner Mark James stepped down in his first term.

Boggs McDonald is partly right and partly wrong in her allegation that the Democrats take minorities for granted. The party has done some mighty things for minorities, not the least of which are the Civil Rights Act and the Voting Rights Act. (Where was the GOP on those?) And the party's agenda of social programs, justice reform and economic development speaks more to minority communities than does Republican rhetoric.

And we shouldn't forget what one black elected official told me long ago: Minorities can go farther in the Republican Party, because there are fewer of them, and the GOP wants at least to appear diverse. Instead of presuming they're along for the ride, as Boggs McDonald accused Democrats of doing, Republicans let them ride in the front seat.

Just not the driver's seat.

A Tale of Two Petitions

Signature-seekers have been swarming public gathering places lately, urging voters to support a variety of initiatives. Two of the petitions have diametrically opposed goals. One aims to make life better for the poor, the other to make life better for the rich. Can you guess which one will be endorsed here?

Assemblywoman Sharron Angle, R-Reno, is spearheading a petition modeled on Proposition 13, the property tax rollback approved by California voters in 1978. Her proposed constitutional amendment would freeze Nevada's property tax rate, limit future increases and require a two-thirds vote to approve a tax override, such as a school construction bond issue.

The fact that Prop. 13 was a fiscal nightmare for California does not seem to faze Angle and other supporters. There are numerous reasons why Nevada should not follow in the Golden State's footsteps.

First of all, Nevada is a fast-growing state that needs revenue to provide basic public services to its citizens. Property taxes are a major contributor to schools, police departments and other government services on which we all depend. Under Angle's proposal, property tax revenues could drop by more than $120 million in the first year, leaving a huge funding gap. We saw during last year's contentious legislative session how much of a challenge the state faces in levying sufficient tax revenues to pay for the bare-minimum services it now offers. Angle's proposal would make a difficult situation even worse.

Second, her plan is regressive in nature. Rather than taxing property based on actual value (her plan would reassess a property's value only after it is sold), it would set up an unfair system under which the rich would pay less and the poor would pay more. The state's tax system is regressive enough already without meddling with the one fair part of it.

Nevada has a tortured history of tampering with property taxes. In the wake of California's Prop. 13, the Nevada Legislature enacted the 1981 tax shift – or tax shaft – that reduced property tax collections by 50 percent. This forced the state to adopt a greater reliance on sales taxes, revenues from which fluctuate significantly from year to year, depending on the health of tourism and the overall economy.

As a result of the tax shift, Nevada's property taxes are fairly modest – around the one percent of assessed value that Angle wants to preserve. By contrast, when Californians got agitated enough to pass Prop. 13, they were paying a 2.6 percent rate.

There's no question that recent skyrocketing home prices in Las Vegas will lead to higher property tax bills, posing an additional burden for homeowners (so giddy now over rising values) in the near future. Las Vegas in particular is becoming an expensive place to live, an inevitable and regrettable result of its runaway growth over the past 15 years. And so, from the vantage point of the individual Las Vegas homeowner, Angle's proposal will receive populist support.

But taking a wider view, her plan could put the state in an agonizing bind – and lead to more regressive tax increases in other areas. Jeremy Aguero, a taxation expert, summarized the situation for the Las Vegas Sun: "The property tax is the most stable source of revenue we have in the state. It would dramatically reduce the ability of the state, local governments and special districts such as the school district to remain financially stable in the long run." For this and other reasons, the conservative Nevada Taxpayers Association has decided not to support Angle's petition.

Nobody wants to see his property taxes balloon because of the recent real estate price bubble. Legislative action may be required to deal with it, but Angle's regressive, shortsighted plan is not the solution.

The Nevada AFL-CIO, meanwhile, is gathering signatures for a constitutional amendment to raise the minimum wage by $1 per hour. The federal minimum is $5.15 per hour, set in 1997. States have the option to raise the minimum wage beyond that figure, and a dozen of them, including Washington, Oregon and California, have done so. Some cities also have higher minimum wages.

Not surprisingly, the union-backed plan has met with automatic opposition from business and industry leaders, who relish the fact that they can employ tens of thousands of Nevadans at $5.15 per hour – or $10,712 per year for full-time work.

It is nearly impossible to live in Las Vegas on $5.15 per hour. Knowing this and responding to a competitive marketplace for employees, many businesses are paying more than minimum wage for what traditionally are considered entry-level jobs. But a significant segment of Nevada's work force – the AFL-CIO estimates 50,000 people – is coming home from an exhausting eight-hour shift having earned $41.20 – minus taxes.

Paying this paltry sum takes advantage of thousands of hard-working Nevadans and contributes to growing pockets of poverty in the state. A legislative remedy is needed to bring basic fairness to the job market. Frankly, considering inflation, the minimum wage should be at least $8 per hour to adequately cover the cost of living at subsistence level in 2004. But a $1 increase would be a good start.

Blue State Cheer

For a long time, Randy Soltero's brand of political activism required little more than a hammer, some walking shoes or an apron.

"I've always been involved in politics somehow, but mostly just on a grassroots level. I'd be the guy pounding signs or knocking on doors or barbecuing," says Soltero, an organizer for the local sheet metal workers union. "That's always what I did. I was always very much in the background." He counts off campaigns he worked on: Clinton, Gore, a host of local races. "If you needed a guy on a Saturday to pound signs, I was him. I like to say I did all the stuff that wasn't sexy. But I get to do something sexy now."

By political standards, anyway. Soltero is a Nevada delegate who will attend the Democratic National Convention July 26-29 in Boston – the event that more or less seals in the flavor of the Dems' push for the White House. There, the party will hammer out its national platform, officially nominate John Kerry and John Edwards and host nearly 5,000 delegates from around the country.

Among those delegates will be elected officials, political rung-climbers and party wonks of every stripe and title. But also in the crowd will be a species of political animal – a bit wider-eyed, a bit more excitable – that will perhaps be more numerous than ever. Call it newbius politicus – the political newbie. At this Democratic confab leading up to the one of the most intense presidential races ever, many attendees will be newcomers to the campaign process on such a level. Scan the list of Nevada's 32 delegates and you'll see retirees, union men, firefighters, gay activists, all of whom have a few things in common: a desire to boot Bush from the White House and a relative newness to the scene. Some have formerly been content to express their political will at the ballot box every four years; some are coming out of a sort of sour retirement after years of disgruntlement; still others, their interest piqued by a tumultuous presidency, want to live the process firsthand. But none of them has ever been active at quite this level – and some are still pinching themselves.

"Never have I seen the energy that's surfaced this season," says Adriana Martinez, chairwoman of the Nevada Democratic Party. "And it's no wonder people are getting fired up. On a daily basis, we hear what Bush is doing for our country – from the war in Iraq to the economy. Every time we hear something new, we get a new round of phone calls at party headquarters."

Discontent as Hell

Dwayne Chesnut was turned off to politics back in 1964, when he and his wife worked for Barry Goldwater's presidential bid. "Partly having grown up in Texas, I saw a lot of baggage that [Lyndon] Johnson had that we were not fond of," he says. He also saw, up close and personal, the ugliness that flows through the pipes of any campaign machine. The Goldwater campaign introduced him to both the giving and receiving end of mudslinging. From there it was all downhill.

"Nixon was the ultimate turnoff. To me, Nixon was the first imperial president," says Chesnut, a retired scientist and engineer who now volunteers for Nevada's Kerry steering committee. "The concentration of power represented by the Republican Party really concerned me."

But his concern spawned not indignation, but rather a sense of impotence. Sure, Chesnut shows up at the polls like a good citizen, but his love for any party began and ended at the ballot box. "I got turned off by the whole political scene," says the alternate at-large delegate. "There was a general feeling of helplessness no matter what you did."

It wouldn't be until Bush took office that Chesnut would feel that spark again. But, like others, he would take a scenic route to ultimately becoming a delegate.

Another delegate, Venicia Considine, wasn't necessarily burned on the political process. In fact, she came around to delegatehood after her own meandering journey, in which she realized not how tainted the process was, but how promising. After her daughter, Sydny, was born in 2000, Considine developed a keen interest in women's issues. She would show up to state National Organization for Women meetings – and was taken aback at the number of empty seats. The realization made her chide herself: Why hadn't she been involved earlier?

Democracy abhors a vacuum; committed to getting more involved in the process – and ticked off at Bush's policies – Considine went up to the Legislature in 2001 to watch for herself the (sometimes broken) clockwork of the lawmaking process; she increased her involvement with NOW, ultimately becoming president of the state chapter in April. "There wasn't a moment of epiphany or anything like that," Considine says. "I just wanted to see how things [in Carson City] were done. And I thought, if I can do this, anybody can." And its inverse: If anybody could do it, why couldn't she?

Delegate Dan Hinkley, founder of the Stonewall Democratic Club of Southern Nevada and secretary of the state party, has two words for his stepped-up involvement this year: Yeah, you guessed it. "When Bush was elected, I knew he would be a bad president, but I didn't realize he would be such a dangerous president," he says. At the time, he was building up the Stonewall club, fostering gay, lesbian, bisexual and transgender community involvement in politics – "The Democrats had walked away from the LGBT community," he says – but even Hinkley didn't suspect his identity as a gay man would figure in to him becoming a national delegate. That and the controversial war in Iraq made for a momentous tipping point. "I have the absolute sense that since Bush went to war, he turned up the amplitude of reasons to be opposed to him. It suddenly got much worse than anybody could have anticipated."

Reason for the Season

Thus began Hinkley's journey into delegate-dom. Like his fellow newbies, he didn't consciously have the party honor in his sights; rather, by a combination of fate and simmering discontent, he fell into the role that, once worn, fit quite comfortably. For Hinkley, the decisive moment came when, as chairman of the party's affirmative action delegate selection committee – formed to groom LGBT and minority delegates – Hinkley realized that one of the ideal candidates for the position was none other than himself. "It was in the back of my mind," he says. "When we wrote the plan for the very first time, our delegate selection language [was written to include] at least one LGBT member, and it's the first time the plan has done that. I was really proud of it."

He also understood that he was the man for the job. He made his pitch April 17 at the state convention at the Riviera – as most delegates must do to be elected to the position – and got it.

Rusty McAllister, a city fire captain, is another delegate who came into the position via a sort of gradual awakening. While firefighters have backed Kerry since early on – McAllister along with them – he's never been quite so involved as this. Again, credit Bush.

"After Sept. 11, he stood at Ground Zero with firefighters and pledged his support, and then in the course of his tenure as president, he's turned around and continually worked to cut the funding for programs that are vital to providing fire service in the U.S.," he says. "He's either zero-funded or severely cut the amount of money that's gone into funding."

You might say it lit a fire under him. "I've been active, just not to this level," says McAllister. "I was involved in the initial stages of planning, and it was just this natural progression. I wanted to continue on and be delegated. For me, personally, I'm really excited about it. I feel like it's a once-in-a-lifetime thing to be involved in it. This election will be historic. And the Democratic Party is energized like we haven't seen for a long time."

Not everyone's quest for the delegate grail dovetailed with a push for Kerry. Many delegates had initially thrown support behind other candidates, cutting their teeth anew on meetups, rallies, barbecues, phone banks. Retired scientist Chesnut – who, besides voting, had absented himself from any meaningful political activism for almost 40 years – was initially a Wesley Clark supporter.

"When Bush was selected by the Supreme Court," Chesnut says, "my initial reaction was extreme disappointment, but I thought, well, I've lived through several bad presidents, I could probably live through another. However, that quickly turned out not to be case. What got me finally galvanized again was reading an open letter from Michael Moore to Wesley Clark, urging him to run for president." Intrigued by this leftie filmmaker pushing a military man for the White House, Chesnut soon found himself hosting Clark meetups and attending "campaign camps" (party activist training sessions). He joined the Kerry crew when exit polls blessed the Massachusetts senator with frontrunner status.

Retiree Chesnut had, in a sense, re-entered the work force. And work is the word when it comes to democracy, Chesnut reminds. "It's really been an interesting learning experience," he says. "You really understand how much it takes to make democracy work. It's not like your plumbing, where there's really not any problem between maintenance calls."

As for Randy Soltero – installer of campaign signs, flipper of burgers, pounder of pavement – he was moved to deeper participation like the rest, but had no idea it would take the form of delegatehood.

"I was working this election cycle with the Kerry campaign, and folks would encourage me. 'You ought to run for national delegate.' I said, 'What's it about?' There was definitely a learning curve. I had never run for delegate – I wasn't even a member of the Clark County Democratic Central Committee. But I felt the issues were getting so much more important. Things are really starting to heat up. I went to the [Democratic] caucuses in 2000, and there were maybe 150 people there. We were in the cafeteria at Chaparral [High School].

"This time, we had to spill out onto the football field. To see the difference between those two times, it's just unreal."
