A Constitutional Crisis

Editor's Note: Following is the text of a speech delivered by Al Gore in Washington, D.C. on January 16. Gore was introduced by former Republican congressman Bob Barr, an arch-conservative advocate of privacy rights.

Congressman Barr and I have disagreed many times over the years, but we have joined together today with thousands of our fellow citizens -- Democrats and Republicans alike -- to express our shared concern that America's Constitution is in grave danger.

In spite of our differences over ideology and politics, we are in strong agreement that the American values we hold most dear have been placed at serious risk by the unprecedented claims of the Administration to a truly breathtaking expansion of executive power.

As we begin this new year, the Executive Branch of our government has been caught eavesdropping on huge numbers of American citizens and has brazenly declared that it has the unilateral right to continue without regard to the established law enacted by Congress to prevent such abuses.

It is imperative that respect for the rule of law be restored.

So, many of us have come here to Constitution Hall to sound an alarm and call upon our fellow citizens to put aside partisan differences and join with us in demanding that our Constitution be defended and preserved.

It is appropriate that we make this appeal on the day our nation has set aside to honor the life and legacy of Dr. Martin Luther King, Jr., who challenged America to breathe new life into our oldest values by extending its promise to all our people.

On this particular Martin Luther King Day, it is especially important to recall that for the last several years of his life, Dr. King was illegally wiretapped -- one of hundreds of thousands of Americans whose private communications were intercepted by the U.S. government during this period.

The FBI privately called King the "most dangerous and effective negro leader in the country" and vowed to "take him off his pedestal." The government even attempted to destroy his marriage and blackmail him into committing suicide.

This campaign continued until Dr. King's murder. The discovery that the FBI conducted a long-running and extensive campaign of secret electronic surveillance designed to infiltrate the inner workings of the Southern Christian Leadership Conference, and to learn the most intimate details of Dr. King's life, helped to convince Congress to enact restrictions on wiretapping.

The result was the Foreign Intelligence and Surveillance Act (FISA), which was enacted expressly to ensure that foreign intelligence surveillance would be presented to an impartial judge to verify that there is a sufficient cause for the surveillance. I voted for that law during my first term in Congress and for almost thirty years the system has proven a workable and valued means of according a level of protection for private citizens, while permitting foreign surveillance to continue.

Yet, just one month ago, Americans awoke to the shocking news that in spite of this long settled law, the Executive Branch has been secretly spying on large numbers of Americans for the last four years and eavesdropping on "large volumes of telephone calls, email messages, and other Internet traffic inside the United States." The New York Times reported that the President decided to launch this massive eavesdropping program "without search warrants or any new laws that would permit such domestic intelligence collection."

During the period when this eavesdropping was still secret, the President went out of his way to reassure the American people on more than one occasion that, of course, judicial permission is required for any government spying on American citizens and that, of course, these constitutional safeguards were still in place.

But surprisingly, the President's soothing statements turned out to be false. Moreover, as soon as this massive domestic spying program was uncovered by the press, the President not only confirmed that the story was true, but also declared that he has no intention of bringing these wholesale invasions of privacy to an end.

At present, we still have much to learn about the NSA's domestic surveillance. What we do know about this pervasive wiretapping virtually compels the conclusion that the President of the United States has been breaking the law repeatedly and persistently.

A president who breaks the law is a threat to the very structure of our government. Our Founding Fathers were adamant that they had established a government of laws and not men. Indeed, they recognized that the structure of government they had enshrined in our Constitution -- our system of checks and balances -- was designed with a central purpose of ensuring that it would govern through the rule of law. As John Adams said: "The executive shall never exercise the legislative and judicial powers, or either of them, to the end that it may be a government of laws and not of men."

An executive who arrogates to himself the power to ignore the legitimate legislative directives of the Congress or to act free of the check of the judiciary becomes the central threat that the Founders sought to nullify in the Constitution -- an all-powerful executive too reminiscent of the King from whom they had broken free. In the words of James Madison, "the accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny."

Thomas Paine, whose pamphlet, "On Common Sense" ignited the American Revolution, succinctly described America's alternative. Here, he said, we intended to make certain that "the law is king."

Vigilant adherence to the rule of law strengthens our democracy and strengthens America. It ensures that those who govern us operate within our constitutional structure, which means that our democratic institutions play their indispensable role in shaping policy and determining the direction of our nation. It means that the people of this nation ultimately determine its course and not executive officials operating in secret without constraint.

The rule of law makes us stronger by ensuring that decisions will be tested, studied, reviewed and examined through the processes of government that are designed to improve policy. And the knowledge that they will be reviewed prevents over-reaching and checks the accretion of power.

A commitment to openness, truthfulness and accountability also helps our country avoid many serious mistakes. Recently, for example, we learned from recently classified declassified documents that the Gulf of Tonkin Resolution, which authorized the tragic Vietnam war, was actually based on false information. We now know that the decision by Congress to authorize the Iraq War, 38 years later, was also based on false information. America would have been better off knowing the truth and avoiding both of these colossal mistakes in our history. Following the rule of law makes us safer, not more vulnerable.

The President and I agree on one thing. The threat from terrorism is all too real. There is simply no question that we continue to face new challenges in the wake of the attack on September 11th and that we must be ever-vigilant in protecting our citizens from harm.

Where we disagree is that we have to break the law or sacrifice our system of government to protect Americans from terrorism. In fact, doing so makes us weaker and more vulnerable.

Once violated, the rule of law is in danger. Unless stopped, lawlessness grows. The greater the power of the executive grows, the more difficult it becomes for the other branches to perform their constitutional roles. As the executive acts outside its constitutionally prescribed role and is able to control access to information that would expose its actions, it becomes increasingly difficult for the other branches to police it. Once that ability is lost, democracy itself is threatened and we become a government of men and not laws.

The President's men have minced words about America's laws. The Attorney General openly conceded that the "kind of surveillance" we now know they have been conducting requires a court order unless authorized by statute. The Foreign Intelligence Surveillance Act self-evidently does not authorize what the NSA has been doing, and no one inside or outside the Administration claims that it does. Incredibly, the Administration claims instead that the surveillance was implicitly authorized when Congress voted to use force against those who attacked us on September 11th.

This argument just does not hold any water. Without getting into the legal intricacies, it faces a number of embarrassing facts. First, another admission by the Attorney General: he concedes that the Administration knew that the NSA project was prohibited by existing law and that they consulted with some members of Congress about changing the statute. Gonzalez says that they were told this probably would not be possible. So how can they now argue that the Authorization for the Use of Military Force somehow implicitly authorized it all along? Second, when the Authorization was being debated, the Administration did in fact seek to have language inserted in it that would have authorized them to use military force domestically -- and the Congress did not agree. Senator Ted Stevens and Representative Jim McGovern, among others, made statements during the Authorization debate clearly restating that that Authorization did not operate domestically.

When President Bush failed to convince Congress to give him all the power he wanted when they passed the AUMF, he secretly assumed that power anyway, as if congressional authorization was a useless bother. But as Justice Frankfurter once wrote: "To find authority so explicitly withheld is not merely to disregard in a particular instance the clear will of Congress. It is to disrespect the whole legislative process and the constitutional division of authority between President and Congress."

This is precisely the "disrespect" for the law that the Supreme Court struck down in the steel seizure case.

It is this same disrespect for America's Constitution which has now brought our republic to the brink of a dangerous breach in the fabric of the Constitution. And the disrespect embodied in these apparent mass violations of the law is part of a larger pattern of seeming indifference to the Constitution that is deeply troubling to millions of Americans in both political parties.

For example, the President has also declared that he has a heretofore unrecognized inherent power to seize and imprison any American citizen that he alone determines to be a threat to our nation, and that, notwithstanding his American citizenship, the person imprisoned has no right to talk with a lawyer -- even to argue that the President or his appointees have made a mistake and imprisoned the wrong person.

The President claims that he can imprison American citizens indefinitely for the rest of their lives without an arrest warrant, without notifying them about what charges have been filed against them, and without informing their families that they have been imprisoned.

At the same time, the Executive Branch has claimed a previously unrecognized authority to mistreat prisoners in its custody in ways that plainly constitute torture in a pattern that has now been documented in U.S. facilities located in several countries around the world.

Over 100 of these captives have reportedly died while being tortured by Executive Branch interrogators and many more have been broken and humiliated. In the notorious Abu Ghraib prison, investigators who documented the pattern of torture estimated that more than 90 percent of the victims were innocent of any charges.

This shameful exercise of power overturns a set of principles that our nation has observed since General Washington first enunciated them during our Revolutionary War and has been observed by every president since then -- until now. These practices violate the Geneva Conventions and the International Convention Against Torture, not to mention our own laws against torture.

The President has also claimed that he has the authority to kidnap individuals in foreign countries and deliver them for imprisonment and interrogation on our behalf by autocratic regimes in nations that are infamous for the cruelty of their techniques for torture.

Some of our traditional allies have been shocked by these new practices on the part of our nation. The British Ambassador to Uzbekistan -- one of those nations with the worst reputations for torture in its prisons -- registered a complaint to his home office about the senselessness and cruelty of the new U.S. practice: "This material is useless -- we are selling our souls for dross. It is in fact positively harmful."

Can it be true that any president really has such powers under our Constitution? If the answer is "yes" then under the theory by which these acts are committed, are there any acts that can on their face be prohibited? If the President has the inherent authority to eavesdrop, imprison citizens on his own declaration, kidnap and torture, then what can't he do?

The Dean of Yale Law School, Harold Koh, said after analyzing the Executive Branch's claims of these previously unrecognized powers: "If the President has commander-in-chief power to commit torture, he has the power to commit genocide, to sanction slavery, to promote apartheid, to license summary execution."

The fact that our normal safeguards have thus far failed to contain this unprecedented expansion of executive power is deeply troubling. This failure is due in part to the fact that the Executive Branch has followed a determined strategy of obfuscating, delaying, withholding information, appearing to yield but then refusing to do so and dissembling in order to frustrate the efforts of the legislative and judicial branches to restore our constitutional balance.

For example, after appearing to support legislation sponsored by John McCain to stop the continuation of torture, the President declared in the act of signing the bill that he reserved the right not to comply with it.

Similarly, the Executive Branch claimed that it could unilaterally imprison American citizens without giving them access to review by any tribunal. The Supreme Court disagreed, but the President engaged in legal maneuvers designed to prevent the Court from providing meaningful content to the rights of its citizens.

A conservative jurist on the Fourth Circuit Court of Appeals wrote that the Executive Branch's handling of one such case seemed to involve the sudden abandonment of principle "at substantial cost to the government's credibility before the courts."

As a result of its unprecedented claim of new unilateral power, the Executive Branch has now put our constitutional design at grave risk. The stakes for America's representative democracy are far higher than has been generally recognized.

These claims must be rejected and a healthy balance of power restored to our Republic. Otherwise, the fundamental nature of our democracy may well undergo a radical transformation.

For more than two centuries, America's freedoms have been preserved in part by our founders' wise decision to separate the aggregate power of our government into three co-equal branches, each of which serves to check and balance the power of the other two.

On more than a few occasions, the dynamic interaction among all three branches has resulted in collisions and temporary impasses that create what are invariably labeled "constitutional crises." These crises have often been dangerous and uncertain times for our Republic. But in each such case so far, we have found a resolution of the crisis by renewing our common agreement to live under the rule of law.

The principle alternative to democracy throughout history has been the consolidation of virtually all state power in the hands of a single strongman or small group who together exercise that power without the informed consent of the governed.

It was in revolt against just such a regime, after all, that America was founded. When Lincoln declared at the time of our greatest crisis that the ultimate question being decided in the Civil War was "whether that nation, or any nation so conceived, and so dedicated, can long endure," he was not only saving our union but also was recognizing the fact that democracies are rare in history. And when they fail, as did Athens and the Roman Republic upon whose designs our founders drew heavily, what emerges in their place is another strongman regime.

There have of course been other periods of American history when the Executive Branch claimed new powers that were later seen as excessive and mistaken. Our second president, John Adams, passed the infamous Alien and Sedition Acts and sought to silence and imprison critics and political opponents.

When his successor, Thomas Jefferson, eliminated the abuses he said: "[The essential principles of our Government] form the bright constellation which has gone before us and guided our steps through an age of revolution and reformation... [S]hould we wander from them in moments of error or of alarm, let us hasten to retrace our steps and to regain the road which alone leads to peace, liberty and safety."

Our greatest President, Abraham Lincoln, suspended habeas corpus during the Civil War. Some of the worst abuses prior to those of the current administration were committed by President Wilson during and after WWI with the notorious Red Scare and Palmer Raids. The internment of Japanese Americans during WWII marked a low point for the respect of individual rights at the hands of the executive. And, during the Vietnam War, the notorious COINTELPRO program was part and parcel of the abuses experienced by Dr. King and thousands of others.

But in each of these cases, when the conflict and turmoil subsided, the country recovered its equilibrium and absorbed the lessons learned in a recurring cycle of excess and regret.

There are reasons for concern this time around that conditions may be changing and that the cycle may not repeat itself. For one thing, we have for decades been witnessing the slow and steady accumulation of presidential power. In a global environment of nuclear weapons and cold war tensions, Congress and the American people accepted ever enlarging spheres of presidential initiative to conduct intelligence and counter intelligence activities and to allocate our military forces on the global stage. When military force has been used as an instrument of foreign policy or in response to humanitarian demands, it has almost always been as the result of presidential initiative and leadership. As Justice Frankfurter wrote in the Steel Seizure Case, "The accretion of dangerous power does not come in a day. It does come, however slowly, from the generative force of unchecked disregard of the restrictions that fence in even the most disinterested assertion of authority."

A second reason to believe we may be experiencing something new is that we are told by the Administration that the war footing upon which he has tried to place the country is going to "last for the rest of our lives." So we are told that the conditions of national threat that have been used by other Presidents to justify arrogations of power will persist in near perpetuity.

Third, we need to be aware of the advances in eavesdropping and surveillance technologies with their capacity to sweep up and analyze enormous quantities of information and to mine it for intelligence. This adds significant vulnerability to the privacy and freedom of enormous numbers of innocent people at the same time as the potential power of those technologies. These techologies have the potential for shifting the balance of power between the apparatus of the state and the freedom of the individual in ways both subtle and profound.

Don't misunderstand me: the threat of additional terror strikes is all too real and their concerted efforts to acquire weapons of mass destruction does create a real imperative to exercise the powers of the Executive Branch with swiftness and agility. Moreover, there is in fact an inherent power that is conferred by the Constitution to the President to take unilateral action to protect the nation from a sudden and immediate threat, but it is simply not possible to precisely define in legalistic terms exactly when that power is appropriate and when it is not.

But the existence of that inherent power cannot be used to justify a gross and excessive power grab lasting for years that produces a serious imbalance in the relationship between the executive and the other two branches of government.

There is a final reason to worry that we may be experiencing something more than just another cycle of overreach and regret. This Administration has come to power in the thrall of a legal theory that aims to convince us that this excessive concentration of presidential authority is exactly what our Constitution intended.

This legal theory, which its proponents call the theory of the unitary executive but which is more accurately described as the unilateral executive, threatens to expand the president's powers until the contours of the constitution that the Framers actually gave us become obliterated beyond all recognition. Under this theory, the President's authority when acting as Commander-in-Chief or when making foreign policy cannot be reviewed by the judiciary or checked by Congress. President Bush has pushed the implications of this idea to its maximum by continually stressing his role as Commander-in-Chief, invoking it has frequently as he can, conflating it with his other roles, domestic and foreign. When added to the idea that we have entered a perpetual state of war, the implications of this theory stretch quite literally as far into the future as we can imagine.

This effort to rework America's carefully balanced constitutional design into a lopsided structure dominated by an all powerful Executive Branch with a subservient Congress and judiciary is -- ironically -- accompanied by an effort by the same administration to rework America's foreign policy from one that is based primarily on U.S. moral authority into one that is based on a misguided and self-defeating effort to establish dominance in the world.

The common denominator seems to be based on an instinct to intimidate and control.

This same pattern has characterized the effort to silence dissenting views within the Executive Branch, to censor information that may be inconsistent with its stated ideological goals, and to demand conformity from all Executive Branch employees.

For example, CIA analysts who strongly disagreed with the White House assertion that Osama bin Laden was linked to Saddam Hussein found themselves under pressure at work and became fearful of losing promotions and salary increases.

Ironically, that is exactly what happened to FBI officials in the 1960s who disagreed with J. Edgar Hoover's view that Dr. King was closely connected to Communists. The head of the FBI's domestic intelligence division said that his effort to tell the truth about King's innocence of the charge resulted in he and his colleagues becoming isolated and pressured. "It was evident that we had to change our ways or we would all be out on the street. ... The men and I discussed how to get out of trouble. To be in trouble with Mr. Hoover was a serious matter. These men were trying to buy homes, mortgages on homes, children in school. They lived in fear of getting transferred, losing money on their homes, as they usually did. ... so they wanted another memorandum written to get us out of the trouble that we were in."

The Constitution's framers understood this dilemma as well, as Alexander Hamilton put it, "a power over a man's support is a power over his will." (Federalist No. 73)

Soon, there was no more difference of opinion within the FBI. The false accusation became the unanimous view. In exactly the same way, George Tenet's CIA eventually joined in endorsing a manifestly false view that there was a linkage between al Qaeda and the government of Iraq.

In the words of George Orwell: "We are all capable of believing things which we know to be untrue, and then, when we are finally proved wrong, impudently twisting the facts so as to show that we were right. Intellectually, it is possible to carry on this process for an indefinite time: the only check on it is that sooner or later a false belief bumps up against solid reality, usually on a battlefield."

Whenever power is unchecked and unaccountable it almost inevitably leads to mistakes and abuses. In the absence of rigorous accountability, incompetence flourishes. Dishonesty is encouraged and rewarded.

Last week, for example, Vice President Cheney attempted to defend the Administration's eavesdropping on American citizens by saying that if it had conducted this program prior to 9/11, they would have found out the names of some of the hijackers.

Tragically, he apparently still doesn't know that the Administration did in fact have the names of at least 2 of the hijackers well before 9/11 and had available to them information that could have easily led to the identification of most of the other hijackers. And yet, because of incompetence in the handling of this information, it was never used to protect the American people.

It is often the case that an Executive Branch beguiled by the pursuit of unchecked power responds to its own mistakes by reflexively proposing that it be given still more power. Often, the request itself it used to mask accountability for mistakes in the use of power it already has.

Moreover, if the pattern of practice begun by this Administration is not challenged, it may well become a permanent part of the American system. Many conservatives have pointed out that granting unchecked power to this President means that the next President will have unchecked power as well. And the next President may be someone whose values and belief you do not trust. And this is why Republicans as well as Democrats should be concerned with what this President has done. If this President's attempt to dramatically expand executive power goes unquestioned, our constitutional design of checks and balances will be lost. And the next President or some future President will be able, in the name of national security, to restrict our liberties in a way the framers never would have thought possible.

The same instinct to expand its power and to establish dominance characterizes the relationship between this Administration and the courts and the Congress.

In a properly functioning system, the Judicial Branch would serve as the constitutional umpire to ensure that the branches of government observed their proper spheres of authority, observed civil liberties and adhered to the rule of law. Unfortunately, the unilateral executive has tried hard to thwart the ability of the judiciary to call balls and strikes by keeping controversies out of its hands -- notably those challenging its ability to detain individuals without legal process -- by appointing judges who will be deferential to its exercise of power and by its support of assaults on the independence of the third branch.

The President's decision to ignore FISA was a direct assault on the power of the judges who sit on that court. Congress established the FISA court precisely to be a check on executive power to wiretap. Yet, to ensure that the court could not function as a check on executive power, the President simply did not take matters to it and did not let the court know that it was being bypassed.

The President's judicial appointments are clearly designed to ensure that the courts will not serve as an effective check on executive power. As we have all learned, Judge Alito is a longtime supporter of a powerful executive -- a supporter of the so-called unitary executive, which is more properly called the unilateral executive. Whether you support his confirmation or not -- and I do not -- we must all agree that he will not vote as an effective check on the expansion of executive power. Likewise, Chief Justice Roberts has made plain his deference to the expansion of executive power through his support of judicial deference to executive agency rulemaking.

And the Administration has supported the assault on judicial independence that has been conducted largely in Congress. That assault includes a threat by the Republican majority in the Senate to permanently change the rules to eliminate the right of the minority to engage in extended debate of the President's judicial nominees. The assault has extended to legislative efforts to curtail the jurisdiction of courts in matters ranging from habeas corpus to the pledge of allegiance. In short, the Administration has demonstrated its contempt for the judicial role and sought to evade judicial review of its actions at every turn.

But the most serious damage has been done to the legislative branch. The sharp decline of congressional power and autonomy in recent years has been almost as shocking as the efforts by the Executive Branch to attain a massive expansion of its power.

I was elected to Congress in 1976 and served eight years in the house, 8 years in the Senate and presided over the Senate for 8 years as Vice President. As a young man, I saw the Congress first hand as the son of a Senator. My father was elected to Congress in 1938, 10 years before I was born, and left the Senate in 1971.

The Congress we have today is unrecognizable compared to the one in which my father served. There are many distinguished Senators and Congressmen serving today. I am honored that some of them are here in this hall. But the legislative branch of government under its current leadership now operates as if it is entirely subservient to the Executive Branch.

Moreover, too many Members of the House and Senate now feel compelled to spend a majority of their time not in thoughtful debate of the issues, but raising money to purchase 30 second TV commercials.

There have now been two or three generations of congressmen who don't really know what an oversight hearing is. In the 70s and 80s, the oversight hearings in which my colleagues and I participated held the feet of the Executive Branch to the fire -- no matter which party was in power. Yet oversight is almost unknown in the Congress today.

The role of authorization committees has declined into insignificance. The 13 annual appropriation bills are hardly ever actually passed anymore. Everything is lumped into a single giant measure that is not even available for Members of Congress to read before they vote on it.

Members of the minority party are now routinely excluded from conference committees, and amendments are routinely not allowed during floor consideration of legislation.

In the United States Senate, which used to pride itself on being the "greatest deliberative body in the world," meaningful debate is now a rarity. Even on the eve of the fateful vote to authorize the invasion of Iraq, Senator Robert Byrd famously asked: "Why is this chamber empty?"

In the House of Representatives, the number who face a genuinely competitive election contest every two years is typically less than a dozen out of 435.

And too many incumbents have come to believe that the key to continued access to the money for re-election is to stay on the good side of those who have the money to give; and, in the case of the majority party, the whole process is largely controlled by the incumbent president and his political organization.

So the willingness of Congress to challenge the Administration is further limited when the same party controls both Congress and the Executive Branch.

The Executive Branch, time and again, has co-opted Congress' role, and often Congress has been a willing accomplice in the surrender of its own power.

Look for example at the Congressional role in "overseeing" this massive four year eavesdropping campaign that on its face seemed so clearly to violate the Bill of Rights. The President says he informed Congress, but what he really means is that he talked with the chairman and ranking member of the House and Senate intelligence committees and the top leaders of the House and Senate. This small group, in turn, claimed that they were not given the full facts, though at least one of the intelligence committee leaders handwrote a letter of concern to VP Cheney and placed a copy in his own safe.

Though I sympathize with the awkward position in which these men and women were placed, I cannot disagree with the Liberty Coalition when it says that Democrats as well as Republicans in the Congress must share the blame for not taking action to protest and seek to prevent what they consider a grossly unconstitutional program.

Moreover, in the Congress as a whole-both House and Senate-the enhanced role of money in the re-election process, coupled with the sharply diminished role for reasoned deliberation and debate, has produced an atmosphere conducive to pervasive institutionalized corruption.

The Abramoff scandal is but the tip of a giant iceberg that threatens the integrity of the entire legislative branch of government.

It is the pitiful state of our legislative branch which primarily explains the failure of our vaunted checks and balances to prevent the dangerous overreach by our Executive Branch which now threatens a radical transformation of the American system.

I call upon Democratic and Republican members of Congress today to uphold your oath of office and defend the Constitution. Stop going along to get along. Start acting like the independent and co-equal branch of government you're supposed to be.

But there is yet another Constitutional player whose pulse must be taken and whose role must be examined in order to understand the dangerous imbalance that has emerged with the efforts by the Executive Branch to dominate our constitutional system.

We the people are -- collectively -- still the key to the survival of America's democracy. We -- as Lincoln put it, "[e]ven we here" -- must examine our own role as citizens in allowing and not preventing the shocking decay and degradation of our democracy.

Thomas Jefferson said: "An informed citizenry is the only true repository of the public will."

The revolutionary departure on which the idea of America was based was the audacious belief that people can govern themselves and responsibly exercise the ultimate authority in self-government. This insight proceeded inevitably from the bedrock principle articulated by the Enlightenment philosopher John Locke: "All just power is derived from the consent of the governed."

The intricate and carefully balanced constitutional system that is now in such danger was created with the full and widespread participation of the population as a whole. The Federalist Papers were, back in the day, widely read newspaper essays, and they represented only one of twenty-four series of essays that crowded the vibrant marketplace of ideas in which farmers and shopkeepers recapitulated the debates that played out so fruitfully in Philadelphia.

Indeed, when the Convention had done its best, it was the people -- in their various States -- that refused to confirm the result until, at their insistence, the Bill of Rights was made integral to the document sent forward for ratification.

And it is "We the people" who must now find once again the ability we once had to play an integral role in saving our Constitution.

And here there is cause for both concern and great hope. The age of printed pamphlets and political essays has long since been replaced by television -- a distracting and absorbing medium which sees determined to entertain and sell more than it informs and educates.

Lincoln's memorable call during the Civil War is applicable in a new way to our dilemma today: "We must disenthrall ourselves, and then we shall save our country."

Forty years have passed since the majority of Americans adopted television as their principal source of information. Its dominance has become so extensive that virtually all significant political communication now takes place within the confines of flickering 30-second television advertisements.

And the political economy supported by these short but expensive television ads is as different from the vibrant politics of America's first century as those politics were different from the feudalism which thrived on the ignorance of the masses of people in the Dark Ages.

The constricted role of ideas in the American political system today has encouraged efforts by the Executive Branch to control the flow of information as a means of controlling the outcome of important decisions that still lie in the hands of the people.

The Administration vigorously asserts its power to maintain the secrecy of its operations. After all, the other branches can't check an abuse of power if they don't know it is happening.

For example, when the Administration was attempting to persuade Congress to enact the Medicare prescription drug benefit, many in the House and Senate raised concerns about the cost and design of the program. But, rather than engaging in open debate on the basis of factual data, the Administration withheld facts and prevented the Congress from hearing testimony that it sought from the principal administration expert who had compiled information showing in advance of the vote that indeed the true cost estimates were far higher than the numbers given to Congress by the President.

Deprived of that information, and believing the false numbers given to it instead, the Congress approved the program. Tragically, the entire initiative is now collapsing -- all over the country -- with the Administration making an appeal just this weekend to major insurance companies to volunteer to bail it out.

To take another example, scientific warnings about the catastrophic consequences of unchecked global warming were censored by a political appointee in the White House who had no scientific training. And today one of the leading scientific experts on global warming in NASA has been ordered not to talk to members of the press and to keep a careful log of everyone he meets with so that the Executive Branch can monitor and control his discussions of global warming.

One of the other ways the Administration has tried to control the flow of information is by consistently resorting to the language and politics of fear in order to short-circuit the debate and drive its agenda forward without regard to the evidence or the public interest. As President Eisenhower said, "Any who act as if freedom's defenses are to be found in suppression and suspicion and fear confess a doctrine that is alien to America."

Fear drives out reason. Fear suppresses the politics of discourse and opens the door to the politics of destruction. Justice Brandeis once wrote: "Men feared witches and burnt women."

The founders of our country faced dire threats. If they failed in their endeavors, they would have been hung as traitors. The very existence of our country was at risk.

Yet, in the teeth of those dangers, they insisted on establishing the Bill of Rights.

Is our Congress today in more danger than were their predecessors when the British army was marching on the Capitol? Is the world more dangerous than when we faced an ideological enemy with tens of thousands of missiles poised to be launched against us and annihilate our country at a moment's notice? Is America in more danger now than when we faced worldwide fascism on the march -- when our fathers fought and won two World Wars simultaneously?

It is simply an insult to those who came before us and sacrificed so much on our behalf to imply that we have more to be fearful of than they. Yet they faithfully protected our freedoms and now it is up to us to do the same.

We have a duty as Americans to defend our citizens' right not only to life but also to liberty and the pursuit of happiness. It is therefore vital in our current circumstances that immediate steps be taken to safeguard our Constitution against the present danger posed by the intrusive overreaching on the part of the Executive Branch and the President's apparent belief that he need not live under the rule of law.

I endorse the words of Bob Barr, when he said, "The President has dared the American people to do something about it. For the sake of the Constitution, I hope they will."

A special counsel should immediately be appointed by the Attorney General to remedy the obvious conflict of interest that prevents him from investigating what many believe are serious violations of law by the President. We have had a fresh demonstration of how an independent investigation by a special counsel with integrity can rebuild confidence in our system of justice. Patrick Fitzgerald has, by all accounts, shown neither fear nor favor in pursuing allegations that the Executive Branch has violated other laws.

Republican as well as Democratic members of Congress should support the bipartisan call of the Liberty Coalition for the appointment of a special counsel to pursue the criminal issues raised by warrantless wiretapping of Americans by the President.

Second, new whistleblower protections should immediately be established for members of the Executive Branch who report evidence of wrongdoing -- especially where it involves the abuse of Executive Branch authority in the sensitive areas of national security.

Third, both Houses of Congress should hold comprehensive -- and not just superficial -- hearings into these serious allegations of criminal behavior on the part of the President. And, they should follow the evidence wherever it leads.

Fourth, the extensive new powers requested by the Executive Branch in its proposal to extend and enlarge the Patriot Act should, under no circumstances be granted, unless and until there are adequate and enforceable safeguards to protect the Constitution and the rights of the American people against the kinds of abuses that have so recently been revealed.

Fifth, any telecommunications company that has provided the government with access to private information concerning the communications of Americans without a proper warrant should immediately cease and desist their complicity in this apparently illegal invasion of the privacy of American citizens.

Freedom of communication is an essential prerequisite for the restoration of the health of our democracy.

It is particularly important that the freedom of the Internet be protected against either the encroachment of government or the efforts at control by large media conglomerates. The future of our democracy depends on it.

I mentioned that along with cause for concern, there is reason for hope. As I stand here today, I am filled with optimism that America is on the eve of a golden age in which the vitality of our democracy will be re-established and will flourish more vibrantly than ever. Indeed I can feel it in this hall.

As Dr. King once said, "Perhaps a new spirit is rising among us. If it is, let us trace its movements and pray that our own inner being may be sensitive to its guidance, for we are deeply in need of a new way beyond the darkness that seems so close around us."

A Moral Moment

Ed. note: The following is a transcript of a speech given by former Vice President Al Gore at Sierra Club's National Environmental Convention and Expo in San Francisco on Sept. 9.

I know that you are deeply concerned, as I am, about the direction in which our country has been moving. About the erosion of social capital. About the lack of respect for a very basic principle, and that is that we, as Americans, have to put ourselves and our ability to seek out the truth because we know it will make us free. And then on the basis of truth, as we share it to the best of our abilities with one another, we act to try to form a more perfect union and provide for the general welfare and make this country worthy of the principles upon which it was founded.

My heart is heavy for another reason today, and many have mentioned this, but I want to tell you personally that my heart is heavy because of the suffering that the people of the Gulf Coast have been enduring. The losses that they've suffered in Louisiana, Mississippi, Alabama, New Orleans in particular, but other cities as well, and rural areas. We are here thinking of them, thinking as well of the many brave men and women who have exceeded the limits of exhaustion as they do their duty in responding to this crisis, to the families of those responders and the families of the victims.

When I received the invitation that you generously extended for me to come and speak to you, I did not at first accept, because I was trying to resolve a scheduling conflict. The Fifty State Insurance Commissioners were meeting in New Orleans, and asked me to speak about global warming and hurricanes.

I was supposed to be there today and tomorrow morning. And of course as we all watched this tragedy unfold, we had a lot of different thoughts and feelings. But then, all those feelings were mixed in with puzzlement at why there was no immediate response; why there was not an adequate plan in place.

We are now told that this is not a time to point fingers, even as some of those saying, "Don't point fingers," are themselves pointing fingers at the victims of the tragedy, who did not -- many of whom could not -- evacuate the city of New Orleans, because they didn't have automobiles, and they did not have adequate public transportation.

We're told this is not a time to hold our national government accountable because there are more important matters that confront us. This is not an either/or choice. They are linked together. As our nation belatedly finds effective ways to help those who have been so hard hit by Hurricane Katrina, it is important that we learn the right lessons of what has happened, lest we are spoon-fed the wrong lessons from what happened. If we do not absorb the right lessons, we are, in the historian's phrase, doomed to repeat the mistakes that have already been made.

All of us know that our nation -- all of us, the United States of America -- failed the people of New Orleans and the Gulf Coast when this hurricane was approaching them, and when it struck. When the corpses of American citizens are floating in toxic floodwaters five days after a hurricane strikes, it is time not only to respond directly to the victims of the catastrophe but to hold the processes of our nation accountable, and the leaders of our nation accountable, for the failures that have taken place. [applause]

The Bible in which I believe, in my own faith tradition, says, "Where there is no vision, the people perish."

Four years ago in August of 2001, President Bush received a dire warning: "Al Qaeda determined to attack inside the US." No meetings were called, no alarms were sounded, no one was brought together to say, "What else do we know about this imminent threat? What can we do to prepare our nation for what we have been warned is about to take place?"

If there had been preparations, they would have found a lot of information collected by the FBI, and CIA and NSA -- including the names of most of the terrorists who flew those planes into the WTC and the Pentagon and the field in Pennsylvania; the warnings of FBI field offices that there were suspicious characters getting flight training without expressing any curiosity about the part of the training that has to do with landing. They would have found directors of FBI field offices in a state of agitation about the fact that there was no plan in place and no effective response. Instead, it was vacation time, not a time for preparation. Or protecting the American people.

Four years later, there were dire warnings, three days before Hurricane Katrina hit NOLA, that if it followed the path it was then on, the levees would break, and the city of New Orleans would drown, and thousands of people would be at risk. It was once again vacation time. And the preparations were not made, the plans were not laid, the response then was not forthcoming.

In the early days of the unfolding catastrophe, the President compared our ongoing efforts in Iraq to World War II and victory over Japan. Let me cite one difference between those two historical events: When imperial Japan attacked us at Pearl Harbor, Franklin Roosevelt did not invade Indonesia [applause].

I personally believe that the very fact that there has been no accountability for the horrendous misjudgments and outright falsehoods that laid the basis for this horrible tragedy that we have ongoing in Iraq, the fact that there was no accountability for those mistakes, misjudgments and dissembling, is one of the principal reasons why there was no fear of being held accountable for a cavalier, lackluster, mistaken, inadequate response to the onrushing tragedy that was clearly visible.

For those who were watching television, for those who were reading the news, what happened was not only knowable, it was known in advance, in great and painstaking detail. They did tabletop planning exercises, they identified exactly what the scientific evidence showed would take place. Where there is no vision, the people perish.

It's not only that there is no vision; it's that there has been a misguided vision. One of the principle philosophical guides for this administration has been the man who said famously that he wants to render the government of the United States so weak and helpless that you can drown it in a bathtub. There were warnings three years ago from the last director in the Clinton-Gore administration of FEMA that FEMA was being rendered weak and helpless, unable to respond in the event of a catastrophe. The budget was cut, the resources sent elsewhere.

Carl [Pope] said he was embarrassed. The word is a tricky word. What did you feel after the invasion of Iraq when you saw American soldiers holding dog leashes attached to helpless prisoners, 99 percent of whom, by the way, were innocent of any connection to violence against our troops, much less terrorism -- innocent prisoners who were being tortured in our name -- what did you feel?

I don't know the words. I don't know the words but I want you to draw a line connecting the feelings you had when you saw the visual images providing evidence that our soldiers, acting in our name, with our authority, were torturing helpless people and that it was a matter of policy. Now, they pointed fingers at the privates and corporals that were in charge, but I want you to draw a line between the emotions that you felt when you absorbed that news, and the emotions that you felt over the last 10 days when you saw those corpses in the water, when you saw people without food, water, medicine -- our fellow citizens left helpless.

And of course in both cases the story is complex and many factors are involved, but I want you draw a line connecting the feelings that you had then and now. And I want you to draw another line, connecting those responsible for both of those unbelievable tragedies that embarrassed our nation in the eyes of the world.

There are scientific warnings now of another onrushing catastrophe. We were warned of an imminent attack by Al Qaeda; we didn't respond. We were warned the levees would break in New Orleans; we didn't respond. Now, the scientific community is warning us that the average hurricane will continue to get stronger because of global warming. A scientist at MIT has published a study well before this tragedy showing that since the 1970s, hurricanes in both the Atlantic and the Pacific have increased in duration, and in intensity, by about 50 percent.

The newscasters told us after Hurricane Katrina went over the southern tip of Florida that there was a particular danger for the Gulf Coast of the hurricanes becoming much stronger because it was passing over unusually warm waters in the gulf. The waters in the gulf have been unusually warm. The oceans generally have been getting warmer. And the pattern is exactly consistent with what scientists have predicted for 20 years. Two thousand scientists, in 100 countries, engaged in the most elaborate, well-organized scientific collaboration in the history of humankind, have produced long-since a consensus that we will face a string of terrible catastrophes unless we act to prepare ourselves and deal with the underlying causes of global warming. [applause]

It is important to learn the lessons of what happens when scientific evidence and clear authoritative warnings are ignored, in order to induce our leaders not to do it again and not to ignore the scientists again and not to leave us unprotected in the face of those threats that are facing us right now. [applause]

The president says that he is not sure that global warming is a real threat. He says that he is not ready to do anything meaningful to prepare us for a threat that he's not certain is real. He tells us that he believes the science of global warming is in dispute. This is the same president who said last week, "Nobody could have predicted that the levees would break."

It's important to establish accountability in order to make our democracy work. And the uncertainty and lack of resolution, the willful misunderstanding of what the scientific community is saying, the preference for what a few supporters in the coal and oil industry -- far from all, but a few -- want him to do -- ignore the science -- that is a serious problem. The President talked about the analogies to World War II -- let me give another analogy to World War II.

Winston Churchill, when the storm was gathering on continental Europe, provided warnings of what was at stake. And he said this about the government then in power in England -- which wasn't sure that the threat was real -- he said, "They go on in strange paradox, decided only to be undecided, resolved to be irresolute, adamant for drift, solid for fluidity, all powerful to be impotent." He continued, "The era of procrastination, of half measures, of soothing and baffling expedience of delays, is coming to a close. In its place we are entering a period of consequences."

Ladies and gentlemen, the warnings about global warming have been extremely clear for a long time. We are facing a global climate crisis. It is deepening. We are entering a period of consequences.

Churchill also said this, and he directed it at the people of his country who were looking for any way to avoid having to really confront the threat that he was warning of and asking them to prepare for. He said that he understood why there was a natural desire to deny the reality of the situation and to search for vain hope that it wasn't really as serious as some claimed it was. He said they should know the truth.

And after the appeasement by Neville Chamberlain, he sad, "This is only the beginning of the reckoning. This only the first sip, the first foretaste, of a bitter cup which will be proffered to us year by year -- unless by a supreme recovery of moral health and martial vigor, we rise again and take our stand for freedom."

It is time now for us to recover our moral health in America and stand again to rise for freedom, demand accountability for poor decisions, missed judgments, lack of planning, lack of preparation and willful denial of the obvious truth about serious and imminent threats that are facing the American people. [applause]

Abraham Lincoln said, "The occasion is piled high with difficulty and we must rise with the occasion. As our case is new, we must think anew and act anew. We must disenthrall ourselves and then we shall save our country."

We must disenthrall ourselves with the sound-and-light show that has diverted the attentions of our great democracy from the important issues and challenges of our day. We must disenthrall ourselves from the Michael Jackson trial and the Aruba search and the latest sequential obsession with celebrity trials or whatever relative triviality dominates the conversation of democracy instead of making room for us as free American citizens to talk with one another about our true situation, and then save our country. We must resist those wrong lessons.

Some are now saying, including in the current administration, that the pitiful response by government proves that we cannot ever rely on the government. They have in the past proposed more unilateral power for themselves as the solution for a catastrophe of their own creation, and we should not acquiesce in allowing them to investigate themselves and giving them more power to abuse and misuse, the way they have so recently done. The fact that an administration can't manage its own way out of a horse show doesn't mean that all government programs should be abolished. FEMA worked extremely well during the previous administration. [applause]

A hundred years ago, Upton Sinclair wrote, "It is difficult to get a man to understand something when his salary depends upon him not understanding."

Here's what I think we here understand about Hurricane Katrina and global warming. Yes, it is true that no single hurricane can be blamed on global warming. Hurricanes have come for a long time, and will continue to come in the future. Yes, it is true that the science does not definitively tell us that global warming increases the frequency of hurricanes -- because yes, it is true there is a multi-decadal cycle, 20 to 40 years that profoundly affects the number of hurricanes that come in any single hurricane season.

But it is also true that the science is extremely clear now, that warmer oceans make the average hurricane stronger -- not only makes the winds stronger, but dramatically increases the moisture from the oceans evaporating into the storm, thus magnifying its destructive power -- makes the duration, as well as the intensity of the hurricane, stronger.

Last year we had a lot of hurricanes. Last year, Japan set an all-time record for typhoons: 10. The previous record was seven. Last year the science textbooks had to be rewritten. They said, "It's impossible to have a hurricane in the South Atlantic." We had the first one last year, in Brazil. We had an all-time record last year for tornadoes in the United States: 1,717. Largely because hurricanes spawned tornadoes. Last year we had record temperatures in many cities. This year 200 cities in the Western United States broke all-time records. Reno: 39 days consecutively above 100 degrees.

The scientists are telling us that what the science tells them is that this -- unless we act quickly and dramatically -- that Tucson tied its all-time record for consecutive days above 100 degrees. This, in Churchill's phrase, is only the first sip of a bitter cup which will be proffered to us year by year until there is a supreme recovery of moral health. We have to rise with this occasion. We have to connect the dots.

When the Superfund sites aren't cleaned up, we get a toxic gumbo in a flood. When there is not adequate public transportation for the poor, it is difficult to evacuate a city. When there is no ability to give medical care to poor people, its difficult to get hospitals to take refugees in the middle of a crisis. When the wetlands are turned over to the developers then the storm surges from the ocean threaten the coastal cities more. When there is no effort to restrain the global warming pollution gases then global warming gets worse, with all of the consequences that the scientific community has warned us about.

My friends, the truth is that our circumstances are not only new; they are completely different than they have ever been in all of human history. The relationship between humankind and the earth had been utterly transformed in the last 100 years. We have quadrupled the population of our planet. The population in many ways is a success story. The demographic transition has been occurring more quickly than was hoped for, but the reality of our new relationship with the planet brings with it a moral responsibility to accept our new circumstances and to deal with the consequences of the relationship we have with this planet.

And it's not just population. By any means, the power of the technologies now at our disposal vastly magnifies the average impact that individuals can have on the natural world. Multiply that by six and a half billion people, and then stir into that toxic mixture a mindset and an attitude that says its okay to ignore scientific evidence, that we don't have to take responsibility for the future consequences of present actions, and you get a collision between our civilization and the earth.

The refugees that we have seen -- I don't like that word when applied to American citizens in our own country, but the refugees that we have seen could well be the first sip of that bitter cup because sea-level rise in countries around the world will mobilize millions of environmental refugees. The other problems are known to you, but here is what I want to close with:

This is a moral moment. This is not ultimately about any scientific debate or political dialogue. Ultimately it is about who we are as human beings. It is about our capacity to transcend our own limitations; to rise to this new occasion; to see with our hearts, as well as our heads, the unprecedented response that is now called for; to disenthrall ourselves; to shed the illusions that have been our accomplices in ignoring the warnings that were clearly given; and hearing the ones that are clearly given now.

Where there is no vision, the people perish. And Lincoln said at another moment of supreme challenge that the question facing the people of the United States of America ultimately was whether or not this government, conceived in liberty, dedicated to freedom, of the people, by the people, and for the people -- or any government so conceived -- would perish from this earth.

There is another side to this moral challenge. Where there is vision, the people prosper and flourish, and the natural world recovers, and our communities recover. The good news is we know what to do. The good news is, we have everything we need now to respond to the challenge of global warming. We have all the technologies we need, more are being developed, and as they become available and become more affordable when produced in scale, they will make it easier to respond. But we should not wait, we cannot wait, we must not wait, we have every thing we need -- save perhaps political will. And in our democracy, political will is a renewable resource. [sustained applause]

I know that you are debating as an organization and talking among yourselves about your own priorities. I would urge you to make global warming your priority. I would urge you to focus on a unified theme. I would urge you to work with other groups in ways that have not been done in the past, even though there have been Herculean efforts on your part and the part of others. I would urge you to make this a moral moment, to make this a moral cause.

There are those who would say that the problem is too big and we can't solve it. There are many people who go from denial to despair without pausing on the intermediate step of actually solving the problem. To those who say it's too big for us, I say that we have accepted and successfully met such challenges in the past. We declared our liberty, and then won it. We designed a country that respected and safeguarded the freedom of individuals. We freed the slaves. We gave women the right to vote. We took on Jim Crow and segregation. We cured great diseases. We have landed on the moon. We have won two wars in the Pacific and the Atlantic simultaneously.

We brought down Communism, we brought down apartheid, we have even solved a global environmental crisis before -- the hole in the stratospheric ozone layer -- because we had leadership and because we had vision and because people who exercise moral authority in their local communities empowered our nation's government "of the people by the people and for the people" to take ethical actions even thought they were difficult.

This is another such time. This is your moment. This is the time for those who see and understand and care and are willing to work to say this time the warnings will not be ignored. This time we will prepare. This time we will rise to the occasion. And we will prevail. Thank you. Good luck to you, God bless you. [sustained applause]

A Serious Threat to Democracy

Following is the full text of a speech by former Vice President Al Gore to the American Constitution Society at Georgetown University on June 24.

When we Americans first began, our biggest danger was clearly in view: we knew from the bitter experience with King George III that the most serious threat to democracy is usually the accumulation of too much power in the hands of an executive, whether he be a king or a president. Our ingrained American distrust of concentrated power has very little to do with the character or persona of the individual who wields that power. It is the power itself that must be constrained, checked, dispersed and carefully balanced, in order to ensure the survival of freedom. In addition, our founders taught us that public fear is the most dangerous enemy of democracy because under the right circumstances it can trigger the temptation of those who govern themselves to surrender that power to someone who promises strength and offers safety, security and freedom from fear.

It is an extraordinary blessing to live in a nation so carefully designed to protect individual liberty and safeguard self-governance and free communication. But if George Washington could see the current state of his generation's handiwork and assess the quality of our generation's stewardship at the beginning of this 21st century, what do you suppose he would think about the proposition that our current president claims the unilateral right to arrest and imprison American citizens indefinitely without giving them the right to see a lawyer or inform their families of their whereabouts, and without the necessity of even charging them with any crime. All that is necessary, according to our new president is that he – the president – label any citizen an "unlawful enemy combatant," and that will be sufficient to justify taking away that citizen's liberty – even for the rest of his life, if the president so chooses. And there is no appeal.

What would Thomas Jefferson think of the curious and discredited argument from our Justice Department that the president may authorize what plainly amounts to the torture of prisoners – and that any law or treaty which attempts to constrain his treatment of prisoners in time of war is itself a violation of the constitution our founders put together.

What would Benjamin Franklin think of President Bush's assertion that he has the inherent power – even without a declaration of war by the Congress – to launch an invasion of any nation on Earth, at any time he chooses, for any reason he wishes, even if that nation poses no imminent threat to the United States.

How long would it take James Madison to dispose of our current president's recent claim, in Department of Justice legal opinions, that he is no longer subject to the rule of law so long as he is acting in his role as commander in chief.

I think it is safe to say that our founders would be genuinely concerned about these recent developments in American democracy and that they would feel that we are now facing a clear and present danger that has the potential to threaten the future of the American experiment.

Shouldn't we be equally concerned? And shouldn't we ask ourselves how we have come to this point?

Even though we are now attuned to orange alerts and the potential for terrorist attacks, our founders would almost certainly caution us that the biggest threat to the future of the America we love is still the endemic challenge that democracies have always faced whenever they have appeared in history – a challenge rooted in the inherent difficulty of self-governance and the vulnerability to fear that is part of human nature. Again, specifically, the biggest threat to America is that we Americans will acquiesce in the slow and steady accumulation of too much power in the hands of one person.

Having painstakingly created the intricate design of America, our founders knew intimately both its strengths and weaknesses, and during their debates they not only identified the accumulation of power in the hands of the executive as the long-term threat which they considered to be the most serious, but they also worried aloud about one specific scenario in which this threat might become particularly potent – that is, when war transformed America's president into our commander in chief, they worried that his suddenly increased power might somehow spill over its normal constitutional boundaries and upset the delicate checks and balances they deemed so crucial to the maintenance of liberty.

That is precisely why they took extra care to parse the war powers in the Constitution, assigning the conduct of war and command of the troops to the president, but retaining for the Congress the crucial power of deciding whether or not, and when, our nation might decide to go war.

Indeed, this limitation on the power of the executive to make war was seen as crucially important. James Madison wrote in a letter to Thomas Jefferson, "The Constitution supposes, what the history of all governments demonstrates, that the Executive is the branch of power most interested in war, and most prone to it. It has accordingly with studied care, vested the question of war in the legislature."

In more recent decades, the emergence of new weapons that virtually eliminate the period of time between the decision to go to war and the waging of war have naturally led to a reconsideration of the exact nature of the executive's war-making power. But the practicalities of modern warfare which necessarily increase the war powers of the president at the expense of Congress do not render moot the concerns our founders had so long ago that the making of war by the president – when added to his other powers – carries with it the potential for unbalancing the careful design of our Constitution, and in the process, threatening our liberty.

They were greatly influenced – far more than we can imagine – by a careful reading of the history and human dramas surrounding the democracies of ancient Greece and the Roman republic. They knew, for example, that democracy disappeared in Rome when Caesar crossed the Rubicon in violation of the Senate's long prohibition against a returning general entering the city while still in command of military forces. Though the Senate lingered in form and was humored for decades, when Caesar impoliticly combined his military commander role with his chief executive role, the Senate – and with it the Republic – withered away. And then for all intents and purposes, the great dream of democracy disappeared from the face of the Earth for 17 centuries, until its rebirth in our land.

Symbolically, President Bush has been attempting to conflate his commander in chief role and his head of government role to maximize the power people are eager to give those who promise to defend them against active threats. But as he does so, we are witnessing some serious erosion of the checks and balances that have always maintained a healthy democracy in America.

In Justice Jackson's famous concurring opinion in the Youngstown Steel case in the 1950s, the single most important Supreme Court case on the subject of what powers are inherent to the commander in chief in a time of war, he wrote, "The example of such unlimited executive power that must have most impressed the forefathers was the prerogative exercised by George III, and the description of its evils in the declaration of independence leads me to doubt that they created their new Executive in their image ... and if we seek instruction from our own times, we can match it only from the Executive governments we disparagingly describe as totalitarian."

I am convinced that our founders would counsel us today that the greatest challenge facing our republic is not terrorism but how we react to terrorism, and not war, but how we manage our fears and achieve security without losing our freedom. I am also convinced that they would warn us that democracy itself is in grave danger if we allow any president to use his role as commander in chief to rupture the careful balance between the executive, the legislative and the judicial branches of government. Our current president has gone to war and has come back into "the city" and declared that our nation is now in a permanent state of war, which he says justifies his reinterpretation of the Constitution in ways that increase his personal power at the expense of Congress, the courts, and every individual citizen.

We must surrender some of our traditional American freedoms, he tells us, so that he may have sufficient power to protect us against those who would do us harm. Public fear remains at an unusually high level almost three years after we were attacked on Sept. 11, 2001. In response to those devastating attacks, the president properly assumed his role as commander in chief and directed a military invasion of the land in which our attackers built their training camps, were harbored and planned their assault. But just as the tide of battle was shifting decisively in our favor, the commander in chief made a controversial decision to divert a major portion of our army to invade another country that, according to the best evidence compiled in a new, exhaustive, bipartisan study, posed no imminent threat to us and had nothing to do with the attack against us.

As the main body of our troops were redeployed for the new invasion, those who organized the attacks against us escaped and many of them are still at large. Indeed, their overall numbers seem to have grown considerably because our invasion of the country that did not pose any imminent threat to us was perceived in their part of the world as a gross injustice, and the way in which we have conducted that war further fueled a sense of rage against the United States in those lands and, according to several studies, has stimulated a wave of new recruits for the terrorist group that attacked us and still wishes us harm.

A little over a year ago, when we launched the war against this second country, Iraq, President Bush repeatedly gave our people the clear impression that Iraq was an ally and partner to the terrorist group that attacked us, Al Qaeda, and not only provided a geographic base for them but was also close to providing them weapons of mass destruction, including nuclear bombs. But now the extensive independent investigation by the bipartisan commission formed to study the 9/11 attacks has just reported that there was no meaningful relationship between Iraq and Al Qaeda of any kind. And, of course, over the course of this past year we had previously found out that there were no weapons of mass destruction in Iraq. So now, the president and the vice president are arguing with this commission, and they are insisting that the commission is wrong and they are right, and that there actually was a working cooperation between Iraq and Al Qaeda.

The problem for the president is that he doesn't have any credible evidence to support his claim, and yet, in spite of that, he persists in making that claim vigorously. So I would like to pause for a moment to address the curious question of why President Bush continues to make this claim that most people know is wrong. And I think it's particularly important because it is closely connected to the questions of constitutional power with which I began this speech, and will profoundly affect how that power is distributed among our three branches of government.

To begin with, our founders wouldn't be the least bit surprised at what the modern public opinion polls all tell us about why it's so important particularly for President Bush to keep the American people from discovering that what he told them about the linkage between Iraq and Al Qaeda isn't true. Among these Americans who still believe there is a linkage, there remains very strong support for the president's decision to invade Iraq. But among those who accept the commission's detailed finding that there is no connection, support for the war in Iraq dries up pretty quickly.

And that's understandable, because if Iraq had nothing to do with the attack or the organization that attacked us, then that means the president took us to war when he didn't have to. Almost 900 of our soldiers have been killed, and almost 5,000 have been wounded.

Thus, for all these reasons, President Bush and Vice President Cheney have decided to fight to the rhetorical death over whether or not there's a meaningful connection between Iraq and Al Qaeda. They think that if they lose that argument and people see the truth, then they'll not only lose support for the controversial decision to go to war, but also lose some of the new power they've picked up from the Congress and the courts, and face harsh political consequences at the hands of the American people. As a result, President Bush is now intentionally misleading the American people by continuing to aggressively and brazenly assert a linkage between Al Qaeda and Saddam Hussein.

If he is not lying, if they genuinely believe that, that makes them unfit in battle with Al Qaeda. If they believe these flimsy scraps, then who would want them in charge? Are they too dishonest or too gullible? Take your pick.

But the truth is gradually emerging in spite of the president's determined dissembling. Listen, for example, to this editorial from the Financial Times: "There was nothing intrinsically absurd about the WMD fears, or ignoble about the opposition to Saddam's tyranny – however late Washington developed this. The purported link between Baghdad and Al Qaeda, by contrast, was never believed by anyone who knows Iraq and the region. It was and is nonsense."

Of course the first rationale presented for the war was to destroy Iraq's weapons of mass destruction, which turned out not to exist. Then the rationale was to liberate Iraqis and the Middle East from tyranny, but our troops were not greeted with the promised flowers and are now viewed as an occupying force by 92 percent of Iraqis, while only 2 percent see them as liberators.

But right from the start, beginning very soon after the attacks of 9/11, President Bush made a decision to start mentioning Osama bin Laden and Saddam Hussein in the same breath in a cynical mantra designed to fuse them together as one in the public's mind. He repeatedly used this device in a highly disciplined manner to create a false impression in the minds of the American people that Saddam Hussein was responsible for 9/11. Usually he was pretty tricky in his exact wording. Indeed, Bush's consistent and careful artifice is itself evidence that he knew full well that he was telling an artful and important lie – visibly circumnavigating the truth over and over again as if he had practiced how to avoid encountering the truth. But as I will document in a few moments, he and Vice President Cheney also sometimes departed from their tricky wording and resorted to statements were clearly outright falsehoods. In any case, by the time he was done, public opinion polls showed that fully 70 percent of the American people had gotten the message he wanted them to get, and had been convinced that Saddam Hussein was responsible for the 9/11 attacks.

The myth that Iraq and Al Qaeda were working together was no accident – the president and vice president deliberately ignored warnings before the war from international intelligence services, the CIA, and their own Pentagon that the claim was false. Europe's top terrorism investigator said in 2002, "We have found no evidence of links between Iraq and Al Qaeda. If there were such links, we would have found them. But we have found no serious connections whatsoever." A classified October 2002 CIA report given to the White House directly undercut the Iraq/Al Qaeda claim. Top officials in the Pentagon told reporters in 2002 that the rhetoric being used by President Bush and Vice President Cheney was "an exaggeration."

And at least some honest voices within the president's own party admitted as such. Sen. Chuck Hagel, a decorated war hero who sits on the Foreign Relations Committee, said point blank, "Saddam is not in league with al-Qaida ... I have not seen any intelligence that would lead me to connect Saddam Hussein with Al Qaeda."

But those voices did not stop the deliberate campaign to mislead America. Over the course of a year, the president and vice president used carefully crafted language to scare Americans into believing there was an imminent threat from an Iraq-armed Al Qaeda.

In the fall of 2002, the President told the country "You can't distinguish between Al Qaeda and Saddam" and that the "true threat facing our country is an Al Qaeda-type network trained and armed by Saddam." At the same time, Vice President Cheney was repeating his claim that "there is overwhelming evidence there was a connection between Al Qaeda and the Iraqi government."

By the Spring, Secretary of State Powell was in front of the United Nations claiming a "sinister nexus between Iraq and the Al Qaeda terrorist network."

But after the invasion, no ties were found. In June of 2003, the United Nations Security Council's Al Qaeda monitoring agency told reporters his extensive investigation had found no evidence linking the Iraqi regime to Al Qaeda. By August, three former Bush administration national security and intelligence officials admitted that the evidence used to make the Iraq/Al Qaeda claim was "tenuous, exaggerated and often at odds with the conclusion of key intelligence agencies." And earlier this year, Knight-Ridder newspapers reported "Senior U.S. officials now say there never was any evidence" of a connection.

So when the bipartisan 9/11 commission issued its report finding "no credible evidence" of an Iraq/Al Qaeda connection, it should not have caught the White House off guard. Yet instead of the candor Americans need and deserve from their leaders, there have been more denials and more insistence without evidence. Vice President Cheney insisted even this week that "there clearly was a relationship" and that there is "overwhelming evidence." Even more shocking, Cheney offered this disgraceful question: "Was Iraq involved with Al Qaeda in the attack on 9/11? We don't know." He then claimed that he "probably" had more information than the commission, but has so far refused to provide anything to the commission other than more insults.

The President was even more brazen. He dismissed all questions about his statements by saying "The reason I keep insisting that there was a relationship between Iraq and Saddam and Al Qaeda, because there was a relationship between Iraq and Al Qaeda." He provided no evidence.

Friends of the administration tried mightily to rehabilitate their cherished but shattered linkage. John Lehman, one of the Republicans on the commission, offered what sounded like new evidence that a Saddam henchman had attended an Al Qaeda meeting. But within hours, the commissions files yielded definitive evidence that it was another man with a similar name – ironically capturing the near-miss quality of Bush's entire symbolic argument.

They have such an overwhelming political interest in sustaining the belief in the minds of the American people that Hussein was in partnership with bin Laden that they dare not admit the truth lest they look like complete fools for launching our country into a reckless, discretionary war against a nation that posed no immediate threat to us whatsoever. But the damage they have done to our country is not limited to misallocation of military economic political resources. Whenever a chief executive spends prodigious amounts of energy convincing people of lies, he damages the fabric of democracy, and the belief in the fundamental integrity of our self-government.

That creates a need for control over the flood of bad news, bad policies and bad decisions also explains their striking attempts to control news coverage.

To take the most recent example, Vice President Cheney was clearly ready to do battle with the news media when he went on CNBC earlier this week to attack news coverage of the 9/11 commission's conclusion that Iraq did not work with Al Qaeda. He lashed out at the New York Times for having the nerve to print a headline saying the 9/11 commission "finds no Qaeda-Iraq Tie" – a clear statement of the obvious – and said there is no "fundamental split here now between what the president said and what the commission said." He tried to deny that he had personally been responsible for helping to create the false impression of linkage between Al Qaeda and Iraq.

Ironically, his interview ended up being fodder for "The Daily Show With Jon Stewart." Stewart played Cheney's outright denial that he had ever said that representatives of Al Qaeda and Iraqi intelligence met in Prague. Then Stewart froze Cheney's image and played the exact video clip in which Cheney had indeed directly claimed linkage between the two, catching him on videotape in a lie. At that point Stewart said, addressing himself to Cheney's frozen image on the television screen, "It's my duty to inform you that your pants are on fire."

Dan Rather says that post-9/11 patriotism has stifled journalists from asking government officials "the toughest of the tough questions." Rather went so far as to compare administration efforts to intimidate the press to "necklacing" in apartheid South Africa, while acknowledging it as "an obscene comparison." "The fear is that you will be necklaced here (in the U.S.), you will have a flaming tire of lack of patriotism put around your neck," Rather explained. It was CBS, remember, that withheld the Abu Ghraib photographs from the American people for two weeks at the request of the Bush administration.

Donald Rumsfeld has said that criticism of the administration's policy "makes it complicated and more difficult" to fight the war. CNN's Christiane Amanpour said on CNBC last September, "I think the press was muzzled and I think the press self-muzzled. I'm sorry to say but certainly television, and perhaps to a certain extent my station, was intimidated by the administration."

The administration works closely with a network of "rapid response" digital Brown Shirts who work to pressure reporters and their editors for "undermining support for our troops." Paul Krugman, the New York Times columnist, was one of the first journalists to regularly expose the president's consistent distortions of the facts. Krugman writes, "Let's not overlook the role of intimidation. After 9/11, if you were thinking of saying anything negative of the President ... you had to expect right-wing pundits and publications to do all they could to ruin your reputation.

Bush and Cheney are spreading purposeful confusion while punishing reporters who stand in the way. It is understandably difficult for reporters and journalistic institutions to resist this pressure, which, in the case of individual journalists, threatens their livelihoods, and in the case of the broadcasters can lead to other forms of economic retribution. But resist they must, because without a press able to report "without fear or favor" our democracy will disappear.

Recently, the media has engaged in some healthy self-criticism of the way it allowed the White House to mislead the public into war under false pretenses. We are dependent on the media, especially the broadcast media, to never let this happen again. We must help them resist this pressure for everyone's sake, or we risk other wrong-headed decisions based upon false and misleading impressions.

We are left with an unprecedented, high-intensity conflict every single day between the ideological illusions upon which this administration's policies have been based and the reality of the world in which the American people live their lives.

When you boil it all down to precisely what went wrong with the Bush Iraq policy, it is actually fairly simple: he adopted an ideologically driven view of Iraq that was tragically at odds with reality. Everything that has gone wrong is in one way or another the result of a spectacular and violent clash between the bundle of misconceptions that he gullibly consumed and the all-too-painful reality that our troops and contractors and diplomats and taxpayers have encountered. Of course, there have been several other collisions between President Bush's ideology and America's reality. To take the most prominent example, the transformation of a $5 trillion surplus into a $4 trillion deficit is in its own way just as spectacular a miscalculation as the Iraq war.

But there has been no more bizarre or troubling manifestation of how seriously off track this President's policies have taken America than the two profound shocks to our nation's conscience during the last month. First came the extremely disturbing pictures that document strange forms of physical and sexual abuse – and even torture and murder – by some of our soldiers against people they captured as prisoners in Iraq. And then, the second shock came just last week, with strange and perverted legal memoranda from inside the administration, which actually sought to justify torture and to somehow provide a legal rationale for bizarre and sadistic activities conducted in the name of the American people, which, according to any reasonable person, would be recognized as war crimes. In making their analysis, the administration lawyers concluded that the President, whenever he is acting in his role as commander in chief, is above and immune from the "rule of law." At least we don't have to guess what our founders would have to say about this bizarre and un-American theory.

By the middle of this week, the uproar caused by the disclosure of this legal analysis had forced the administration to claim they were throwing the memo out and it was, "irrelevant and overbroad." But no one in the administration has said that the reasoning was wrong. And in fact, a DOJ spokesman says they stand by the tortured definition of torture. In addition the broad analysis regarding the commander-in-chief powers has not been disavowed. And the view of the memo – that it was within commander-in-chief power to order any interrogation techniques necessary to extract information – most certainly contributed to the atmosphere that led to the atrocities committed against the Iraqis at Abu Ghraib. We also know that President Bush rewarded the principle author of this legal monstrosity with a seat on the U.S. Court of Appeals. President Bush, meanwhile, continues to place the blame for the horrific consequences of his morally obtuse policies on the young privates and corporals and sergeants who may well be culpable as individuals for their actions, but who were certainly not responsible for the policies which set up the Bush Gulag and led to America's strategic catastrophe in Iraq.

I call on the administration to disclose all its interrogation policies, including those used by the military in Iraq and Afghanistan and those employed by the CIA at its secret detention centers outside the U.S., as well as all the analyses related to the adoption of those policies.

The Bush administration's objective of establishing U.S. domination over any potential adversary led to the hubristic, tragic miscalculation of the Iraq war, a painful adventure marked by one disaster after another based on one mistaken assumption after another. But the people who paid the price have been the U.S. soldiers trapped over there and the Iraqis in prison. The top-heavy focus on dominance as a goal for the U.S. role in the world is exactly paralleled in their aspiration for the role of the president to be completely dominant in the constitutional system. Our founders understood even better than Lord Acton the inner meaning of his aphorism that power corrupts and absolutely power corrupts absolutely. The goal of dominance necessitates a focus on power. Ironically, all of their didactic messages about how democracies don't invade other nations fell on their own deaf ears. The pursuit of dominance in foreign and strategic policy led the bush administration to ignore the United nations, do serious damage to our most alliances in the world, violate international law and risk the hatred of the rest of the world. The seductive exercise of unilateral power has led this president to interpret his powers under the constitution in a way that would have been the worst nightmare of our framers.

And the kind of unilateral power he imagines is fool's gold in any case. Just as its pursuit in Mesopotamia has led to tragic consequences for our soldiers, the Iraqi people, our alliances, everything we think is important, in the same way the pursuit of a new interpretation of the presidency that weakens the Congress, courts and civil society is not good for either the presidency or the rest of the nation.

If the Congress becomes an enfeebled enabler to the executive, and the courts become known for political calculations in their decisions, then the country suffers. The kinds of unnatural, undemocratic activities in which this administration has engaged, in order to aggrandize power, have included censorship of scientific reports, manipulation of budgetary statistics, silencing dissent, and ignoring intelligence. Although there have been other efforts by other presidents to encroach on the legitimate prerogatives of Congress and courts, there has never been this kind of systematic abuse of the truth and institutionalization of dishonesty as a routine part of the policy process.

Two hundred and twenty years ago, John Adams wrote, in describing one of America's most basic founding principles, "The executive shall never exercise the legislative and judicial powers, or either of them ... to the end it may be a government of laws and not of men."

The last time we had a president who had the idea that he was above the law was when Richard Nixon told an interviewer, "When the president does it, that means that it is not illegal ... If the president, for example, approves something, approves an action because of national security, or, in this case, because of a threat to internal peace and order, of significant order, then the president's decision in this instance is one that enables those who carry it out to carry it out without violating the law."

Fortunately for our country, Nixon was forced to resign as president before he could implement his outlandish interpretation of the Constitution, but not before his defiance of the Congress and the courts created a serious constitutional crisis.

The two top Justice Department officials under President Nixon, Elliot Richardson and William Ruckelshaus, turned out to be men of great integrity, and even though they were loyal Republicans, they were more loyal to the Constitution and resigned on principle rather than implement what they saw as abuses of power by Nixon. Then Congress, also on a bipartisan basis, bravely resisted Nixon's abuse of power and launched impeachment proceedings.

In some ways, our current president is actually claiming significantly more extra-constitutional power, vis-à-vis Congress and the courts, than Nixon did. For example, Nixon never claimed that he could imprison American citizens indefinitely without charging them with a crime and without letting them see a lawyer or notify their families. And this time, the attorney general, John Ashcroft, is hardly the kind of man who would resign on principle to impede an abuse of power. In fact, whenever there is an opportunity to abuse power in this administration, Ashcroft seems to be leading the charge. And it is Ashcroft who picked the staff lawyers at Justice responsible for the embarrassing memos justifying and enabling torture.

Moreover, in sharp contrast to the courageous 93rd Congress that saved the country from Richard Nixon's sinister abuses, the current Congress has virtually abdicated its constitutional role to serve as an independent and coequal branch of government.

Instead, this Republican-led Congress is content, for the most part, to take orders from the president on what they vote for and what they don't vote for. The Republican leaders of the House and Senate have even started blocking Democrats from attending conference committee meetings, where legislation takes its final form, and instead, they let the president's staff come to the meetings and write key parts of the laws for them. (Come to think of it, the decline and lack of independence shown by this Congress would shock our founders more than anything else, because they believed that the power of the Congress was the most important check and balance against the unhealthy exercise of too much power by the Executive branch.)

This administration has not been content just to reduce the Congress to subservience. It has also engaged in unprecedented secrecy, denying the American people access to crucial information with which they might hold government officials accountable for their actions, and a systematic effort to manipulate and intimidate the media into presenting a more favorable image of the administration to the American people.

Listen to what U.S. News and World Report has to say about their secrecy: "The Bush administration has quietly but efficiently dropped a shroud of secrecy across many critical operations of the federal government – cloaking its own affairs from scrutiny and removing from the public domain important information on health, safety, and environmental matters."

Here are just a few examples, and for each one, you have to ask, what are they hiding, and why are they hiding it?

More than 6,000 documents have been removed by the Bush administration from governmental Web sites. To cite only one example, a document on the EPA Web site giving citizens crucial information on how to identify chemical hazards to their families. Some have speculated that the principle threat to the Bush administration is a threat by the chemical hazards if the information remains available to American citizens.

To head off complaints from our nation's governors over how much they receive under federal programs, the Bush administration simply stopped printing the primary state budget report.

To muddy the clear consensus of the scientific community on global warming, the White House directed major changes and deletions to an EPA report that were so egregious that the agency said it was too embarrassed to use the language.

They've kept hidden from view Cheney's ultra-secret energy task force. They have fought a pitched battle in the courts for more than three years to continue denying the American people the ability to know which special interests and lobbyists advised with Vice President Cheney on the design of the new laws.

And when mass layoffs became too embarrassing they simply stopped publishing the regular layoff report that economists and others have been receiving for decades. For this administration, the truth hurts, when the truth is available to the American people. They find bliss in the ignorance of the people. What are they hiding, and why are they hiding it?

In the end, for this administration, it is all about power. This lie about the invented connection between Al Qaeda and Iraq was and is the key to justifying the current ongoing constitutional power grab by the president. So long as their big flamboyant lie remains an established fact in the public's mind, President Bush will be seen as justified in taking for himself the power to make war on his whim. He will be seen as justified in acting to selectively suspend civil liberties – again on his personal discretion – and he will continue to intimidate the press and thereby distort the political reality experienced by the American people during his bid for re-election.

War is lawful violence, but even in its midst we acknowledge the need for rules. We know that in our wars there have been descents from these standards, often the result of spontaneous anger arising out of the passion of battle. But we have never before, to my knowledge, had a situation in which the framework for this kind of violence has been created by the president, nor have we had a situation where these things were mandated by directives signed by the secretary of defense, as it is alleged, and supported by the national security advisor.

Always before, we could look to the chief executive as the point from which redress would come and law be upheld. That was one of the great prides of our country: humane leadership, faithful to the law. What we have now, however, is the result of decisions taken by a president and an administration for whom the best law is NO law, so long as law threatens to constrain their political will. And where the constraints of law cannot be prevented or eliminated, then they maneuver it to be weakened by evasion, by delay, by hair-splitting, by obstruction, and by failure to enforce on the part of those sworn to uphold the law.

In these circumstances, we need investigation of the facts under oath, and in the face of penalties for evasion and perjury. We need investigation by an aroused Congress whose bipartisan members know they stand before the judgment of history. We cannot depend upon a debased Department of Justice given over to the hands of zealots. "Congressional oversight" and "special prosecution" are words that should hang in the air. If our honor as a nation is to be restored, it is not by allowing the mighty to shield themselves by bringing the law to bear against their pawns: it is by bringing the law to bear against the mighty themselves. Our dignity and honor as a nation never came from our perfection as a society or as a people: it came from the belief that in the end, this was a country which would pursue justice as the compass pursues the pole: that although we might deviate, we would return and find our path. This is what we must now do.

Gore Burns Bush on Environment

I have made a series of speeches about the policies of the Bush / Cheney Administration towards the major challenges that confront our nation: national security, economic policy, civil liberties, and today: the environment.

For me, this issue is in a special category because of what I believe is at stake. I am particularly concerned because the vast majority of the most respected environmental scientists from all over the world have sounded a clear and urgent alarm. The international community – including the United States – began a massive effort several years ago to assemble the most accurate scientific assessment of the growing evidence that the earth's environment is sustaining severe and potentially irreparable damage from the unprecedented accumulation of pollution in the global atmosphere.

In essence, these scientists are telling the people of every nation that global warming caused by human activities is becoming a serious threat to our common future. I am also troubled that the Bush/Cheney Administration does not seem to hear the warnings of the scientific community in the same way that most of us do.

Even though the earth is of such vast size, the most vulnerable part of the global environment is the atmosphere – because it is surprisingly thin; as the late Carl Sagan used to say: like a coat of varnish on a globe.

I don't think there is any longer a credible basis for doubting that the earth's atmosphere is heating up because of global warming.

The evidence is overwhelming and undeniable. Global Warming is real. It is happening already and the anticipated consequences are unacceptable. But it is important to understand that this crisis is actually just a symptom of a deeper underlying cause.

Yet in spite of the clear evidence available all around us, there are many who still do not believe that Global Warming is a problem at all. And it's no wonder, because they are the targets of a massive and well-organized campaign of disinformation lavishly funded by polluters who are determined to prevent any action to reduce the greenhouse gas emissions that cause global warming, out of a fear that their profits might be affected if they had to stop dumping so much pollution into the atmosphere.

And wealthy right-wing ideologues have joined with the most cynical and irresponsible companies in the oil, coal and mining industries to contribute large sums of money to finance pseudo-scientific front groups that specialize in sowing confusion in the public's mind about global warming. They issue one misleading "report" after another, pretending that there is significant disagreement in the legitimate scientific community in areas where there is actually a broad-based consensus.

The techniques they use were pioneered years earlier by the tobacco industry in its long campaign to create uncertainty in the public's mind about the health risks caused by tobacco smoke. Indeed, some of the very same scientific camp-followers who took money from the tobacco companies during that effort are now taking money from coal and oil companies in return for their willingness to say that global warming is not real.

In a candid memo about political strategy for Republican leaders, pollster Frank Luntz expressed concern that voters might punish candidates who supported more pollution, but offered advice on the key tactic for defusing the issue.

The Bush Administration has gone far beyond Luntz' recommendations, however, and has explored new frontiers in cynicism by time and time again actually appointing the principal lobbyists and lawyers for the biggest polluters to be in charge of administering the laws that their clients are charged with violating. Some of these appointees have continued to work very closely with the outside pseudo-scientific front groups even though they are now on the public payroll.

Two Attorneys General have now publicly accused officials in the Bush White House Council on Environmental Quality of conspiring with one of the outside groups to encourage the filing of a lawsuit as part of a shared strategy to undermine the possibility of government action on Global Warming.

Vice President Cheney's infamous "Energy Task Force" advised lobbyists for polluters early in the new administration that there would be no action by the Bush White House on Global Warming and then asked for their help in designing a totally meaningless "voluntary" program. One of the industry lobbyists who heard this pitch later made an unguarded speech to his peers about the experience and said the following:

"Let me put it to you in political terms. The President needs a fig leaf. He's dismantling Kyoto, but he's out there on a limb."

The White House has routinely gone out on a limb to involve large contributors representing companies charged with violating environmental laws and regulations in the drafting of new laws and regulations designed to let their clients off the hook.

The story is the same when it comes to protecting the American people from pollution. The Bush administration chooses special interests over the public interest, ignoring the scientific evidence in favor of policies its contributors demand. Consider mercury, an extremely toxic pollutant causing severe developmental and neurological defects in fetuses. We know its principal unregulated source is coal-fired power plants. But the Bush Administration has gutted the protections of the Clean Air Act, revoking an earlier determination by the EPA that mercury emissions from power plants should be treated as hazardous air pollutants. Even Bush's own FDA issued warning about mercury in tuna.

Are you all right with that - the President saying that Mercury shouldn't be treated as a hazardous air pollutant?

Consider toxic wastes. The Superfund has gone from $3.8 billion to a shortfall of $175 million. The result is fewer cleanups, slower cleanups, and a toxic mess left for our children. That's because the Bush administration has let its industry friends off the hook; the tax these polluters used to pay to support the Superfund has been eliminated, so that you, me, and other taxpayers are left holding the bill.

Are you all right with that - the country's worst polluters getting off the hook while you and I pay?

And consider the enforcement of environmental laws. For three years in a row, the Bush administration has sought to slash enforcement personnel levels at EPA. Offices were told to back off cases, leaving one veteran EPA servant to say, "The rug was pulled out from under us...You look around and say, "What contribution can I make here?"

Are you all right with that - the EPA being stripped of its ability to protect our air and water?

I'll tell you who's all right with that. A recent review of contributions to the Bush campaign from utility industry executives, lawyers and lobbyists showed that 15 individuals were Bush Pioneers - those who raised at least $100,000 for the Bush campaign.

We've seen this radical change in our parks too. Just ask the coalition of more than 100 retired career park service employees who wrote a letter saying that their mission to protect parks' natural resources has been changed to focus on commercial and special-interest use of parks.

These are not small shifts in policy – they are radical changes that reverse a century of American policy designed to protect our natural resources. Here's what America used to be. Yellowstone Park was created in 1872, in part to preserve its forest, mineral and geothermal resources. Theodore Roosevelt in 1906 championed this philosophy, setting aside millions of acres of forest reserves, national monuments and wildlife refuges. This balanced approach, combining use of needed resources in the short term with conservation for future generations – has been honored by Roosevelt on down the line, president after president – until this one.

In preparing this series of speeches, I have noticed a troubling pattern that characterizes the Bush/Cheney Administration's approach to almost all issues. In almost every policy area, the Administration's consistent goal has been to eliminate any constraints on their exercise of raw power, whether by law, regulation, alliance or treaty – and in the process they have in each case caused America to be seen by the other nations of the world as showing disdain for the international community.

In each case they devise their policies with as much secrecy as possible and in close cooperation with the most powerful special interests that have a monetary stake in what happens. In each case the public interest is not only ignored but actively undermined. In each case they devote considerable attention to a clever strategy of deception that appears designed to prevent the American people from discerning what it is they are actually doing. Indeed, they often use Orwellian language to disguise their true purposes. For example, a policy that opens national forests to destructive logging of old-growth trees is labeled "The Healthy Forest Initiative." A policy that vastly increases the amount of pollution that can be dumped into the air is called the "Clear Skies Initiative."

And in case after case, the policy adopted immediately after the inauguration has been the exact opposite of what was pledged to the American people during the election campaign. The promise by candidate Bush to conduct a "humble" foreign policy and avoid any semblance of "nation building" was transformed in the first days of the Bush presidency into a frenzied preparation for a military invasion of Iraq, complete with detailed plans for the remaking of that nation under American occupation.

And in the same way, a solemn promise made to the country that carbon dioxide would be regulated as a polluting greenhouse gas was instantly transformed by the inauguration into a promise to the generators of CO2 that it would not be regulated at all. And a seemingly heartfelt declaration to the American people during the campaign that he genuinely believed that global warming is a real problem which must be addressed was replaced after the Inauguration by a dismissive expression of contempt for careful, peer-reviewed work by EPA scientists setting forth the plain facts on at global warming.

These and other activities make it abundantly clear that the Bush White House represents a new departure in the history of the Presidency. He is so eager to accommodate his supporters and contributors that there seems to be very little that he is not willing to do for them at the expense of the public interest. To mention only one example, we've seen him work tirelessly to allow his friends to drill in the Arctic National Wildlife Refuge. Indeed, it seems at times as if the Bush-Cheney Administration is wholly owned by the coal, oil, utility and mining companies.

While President Bush likes to project an image of strength and courage, the truth is that in the presence of his large financial contributors he is a moral coward – so weak that he seldom if ever says "No" to them on anything – no matter what the public interest might mandate.

The problem is that our world is now confronting a five-alarm fire that calls for bold moral and political leadership from the United States of America.

With such leadership, there is no doubt that we could solve the problem of global warming. After all, we brought down communism, won wars in the Pacific and Europe simultaneously, enacted the Marshall Plan, found a cure for polio and put men on the moon. When we set our sights on a visionary goal and are unified in pursuing it, there is very little we cannot accomplish.

Instead of spending enormous sums of money on an unimaginative and retread effort to make a tiny portion of the Moon habitable for a handful of people, we should focus instead on a massive effort to ensure that the Earth is habitable for future generations.

If we make that choice, the U.S. can strengthen our economy with a new generation of advanced technologies, create millions of good new jobs, and inspire the world with a bold and moral vision of humankind's future.

We are now at a true fork in the road. And in order to take the right path, we must choose the right values and adopt the right perspective.

My friend the late Carl Sagan, whose idea it was to take this picture of the Earth, said this: "Look again at that dot. That's here. That's home. That's us. On it everyone you love, everyone you know. Everyone you ever heard of, every human being who ever was lived out their lives. The aggregate of our joy and suffering, thousands of confident religions, ideologies and economic doctrines, every hunter and forager, every hero and coward, every creator and destroyer of civilization, every king and peasant, every young couple in love, every mother and father, hopeful child inventor and explorer, every teacher of morals, every corrupt politician, every "superstar," every "supreme leader," every saint and sinner in the history of our species lived there – on a mote of dust suspended in a sunbeam.

The Earth is a very small stage in a vast cosmic arena. Think of the rivers of blood spilled by all those generals and emperors, so that, in glory and triumph, they could become the momentary masters of a fraction of a dot. Think of the endless cruelties visited by the inhabitants of one corner of this pixel on the scarcely distinguishable inhabitants of some other corner, how frequent their misunderstandings, how eager they are to kill one another, how fervent their hatreds; our posturings, our imagined self-importance, the delusion that we have some privileged position in the Universe, are challenged by this point of pale light...

The Earth is the only world known so far to harbor life. There is nowhere else, at least in the near future, to which our species could migrate. Visit, yes. Settle, not yet. Like it or not, for the moment the Earth is where we make our stand...

There is perhaps no better demonstration of the folly of human conceits than this distant image of our tiny world. To me, it underscores our responsibility to deal more kindly with one another, and to preserve and cherish the pale blue dot, the only home we've ever known."

Freedom and Security

Thank you, Lisa, for that warm and generous introduction. Thank you Zack, and thank you all for coming here today.

I want to thank the American Constitution Society for co-sponsoring today's event, and for their hard work and dedication in defending our most basic public values.

And I am especially grateful to Moveon.org, not only for co-sponsoring this event, but also for using 21st Century techniques to breathe new life into our democracy.

For my part, I'm just a "recovering politician" – but I truly believe that some of the issues most important to America's future are ones that all of us should be dealing with.

And perhaps the most important of these issues is the one I want to talk about today: the true relationship between Freedom and Security.

So it seems to me that the logical place to start the discussion is with an accounting of exactly what has happened to civil liberties and security since the vicious attacks against America of September 11, 2001 – and it's important to note at the outset that the Administration and the Congress have brought about many beneficial and needed improvements to make law enforcement and intelligence community efforts more effective against potential terrorists.

But a lot of other changes have taken place that a lot of people don't know about and that come as unwelcome surprises. For example, for the first time in our history, American citizens have been seized by the executive branch of government and put in prison without being charged with a crime, without having the right to a trial, without being able to see a lawyer, and without even being able to contact their families.

President Bush is claiming the unilateral right to do that to any American citizen he believes is an "enemy combatant." Those are the magic words. If the President alone decides that those two words accurately describe someone, then that person can be immediately locked up and held incommunicado for as long as the President wants, with no court having the right to determine whether the facts actually justify his imprisonment.

Now if the President makes a mistake, or is given faulty information by somebody working for him, and locks up the wrong person, then it's almost impossible for that person to prove his innocence – because he can't talk to a lawyer or his family or anyone else and he doesn't even have the right to know what specific crime he is accused of committing. So a constitutional right to liberty and the pursuit of happiness that we used to think of in an old-fashioned way as "inalienable" can now be instantly stripped from any American by the President with no meaningful review by any other branch of government.

How do we feel about that? Is that OK?

Here's another recent change in our civil liberties: Now, if it wants to, the federal government has the right to monitor every website you go to on the internet, keep a list of everyone you send email to or receive email from and everyone who you call on the telephone or who calls you – and they don't even have to show probable cause that you've done anything wrong. Nor do they ever have to report to any court on what they're doing with the information. Moreover, there are precious few safeguards to keep them from reading the content of all your email.

Everybody fine with that?

If so, what about this next change?

For America's first 212 years, it used to be that if the police wanted to search your house, they had to be able to convince an independent judge to give them a search warrant and then (with rare exceptions) they had to go bang on your door and yell, "Open up!" Then, if you didn't quickly open up, they could knock the door down. Also, if they seized anything, they had to leave a list explaining what they had taken. That way, if it was all a terrible mistake (as it sometimes is) you could go and get your stuff back.

But that's all changed now. Starting two years ago, federal agents were given broad new statutory authority by the Patriot Act to "sneak and peak" in non-terrorism cases. They can secretly enter your home with no warning – whether you are there or not – and they can wait for months before telling you they were there. And it doesn't have to have any relationship to terrorism whatsoever. It applies to any garden-variety crime. And the new law makes it very easy to get around the need for a traditional warrant – simply by saying that searching your house might have some connection (even a remote one) to the investigation of some agent of a foreign power. Then they can go to another court, a secret court that more or less has to give them a warrant whenever they ask.

Three weeks ago, in a speech at FBI Headquarters, President Bush went even further and formally proposed that the Attorney General be allowed to authorize subpoenas by administrative order, without the need for a warrant from any court.

What about the right to consult a lawyer if you're arrested? Is that important?

Attorney General Ashcroft has issued regulations authorizing the secret monitoring of attorney-client conversations on his say-so alone – bypassing procedures for obtaining prior judicial review for such monitoring in the rare instances when it was permitted in the past. Now, whoever is in custody has to assume that the government is always listening to consultations between them and their lawyers.

Does it matter if the government listens in on everything you say to your lawyer? Is that Ok?

Or, to take another change – and thanks to the librarians, more people know about this one – the FBI now has the right to go into any library and ask for the records of everybody who has used the library and get a list of who is reading what. Similarly, the FBI can demand all the records of banks, colleges, hotels, hospitals, credit-card companies, and many more kinds of companies. And these changes are only the beginning. Just last week, Attorney General Ashcroft issued brand new guidelines permitting FBI agents to run credit checks and background checks and gather other information about anyone who is "of investigatory interest," – meaning anyone the agent thinks is suspicious – without any evidence of criminal behavior.

So, is that fine with everyone?

Listen to the way Israel's highest court dealt with a similar question when, in 1999, it was asked to balance due process rights against dire threats to the security of its people:

"This is the destiny of democracy, as not all means are acceptable to it, and not all practices employed by its enemies are open before it. Although a democracy must often fight with one hand tied behind its back, it nonetheless has the upper hand. Preserving the Rule of Law and recognition of an individual's liberty constitutes an important component in its understanding of security. At the end of the day they (add to) its strength."

I want to challenge the Bush Administration's implicit assumption that we have to give up many of our traditional freedoms in order to be safe from terrorists.

Because it is simply not true.

In fact, in my opinion, it makes no more sense to launch an assault on our civil liberties as the best way to get at terrorists than it did to launch an invasion of Iraq as the best way to get at Osama Bin Laden.

In both cases, the Administration has attacked the wrong target.

In both cases they have recklessly put our country in grave and unnecessary danger, while avoiding and neglecting obvious and much more important challenges that would actually help to protect the country.

In both cases, the administration has fostered false impressions and misled the nation with superficial, emotional and manipulative presentations that are not worthy of American Democracy.

In both cases they have exploited public fears for partisan political gain and postured themselves as bold defenders of our country while actually weakening not strengthening America.

In both cases, they have used unprecedented secrecy and deception in order to avoid accountability to the Congress, the Courts, the press and the people.

Indeed, this Administration has turned the fundamental presumption of our democracy on its head. A government of and for the people is supposed to be generally open to public scrutiny by the people – while the private information of the people themselves should be routinely protected from government intrusion.

But instead, this Administration is seeking to conduct its work in secret even as it demands broad unfettered access to personal information about American citizens. Under the rubric of protecting national security, they have obtained new powers to gather information from citizens and to keep it secret. Yet at the same time they themselves refuse to disclose information that is highly relevant to the war against terrorism.

They are even arrogantly refusing to provide information about 9/11 that is in their possession to the 9/11 Commission – the lawful investigative body charged with examining not only the performance of the Bush Administration, but also the actions of the prior Administration in which I served. The whole point is to learn all we can about preventing future terrorist attacks,

Two days ago, the Commission was forced to issue a subpoena to the Pentagon, which has – disgracefully – put Secretary Rumsfeld's desire to avoid embarrassment ahead of the nation's need to learn how we can best avoid future terrorist attacks. The Commission also served notice that it will issue a subpoena to the White House if the President continues to withhold information essential to the investigation.

And the White House is also refusing to respond to repeated bipartisan Congressional requests for information about 9/11 – even though the Congress is simply exercising its Constitutional oversight authority. In the words of Senator McCain, "Excessive administration secrecy on issues related to the September 11 attacks feeds conspiracy theories and reduces the public's confidence in government."

In a revealing move, just three days ago, the White House asked the Republican leadership of the Senate to shut down the Intelligence Committee's investigation of 9/11 based on a trivial political dispute. Apparently the President is anxious to keep the Congress from seeing what are said to have been clear, strong and explicit warnings directly to him a few weeks before 9/11 that terrorists were planning to hijack commercial airliners and use them to attack us.

Astonishingly, the Republican Senate leadership quickly complied with the President's request. Such obedience and complicity in what looks like a cover-up from the majority party in a separate and supposedly co-equal branch of government makes it seem like a very long time ago when a Republican Attorney General and his deputy resigned rather than comply with an order to fire the special prosecutor investigating Richard Nixon.

In an even more brazen move, more than two years after they rounded up over 1,200 individuals of Arab descent, they still refuse to release the names of the individuals they detained, even though virtually every one of those arrested has been "cleared" by the FBI of any connection to terrorism and there is absolutely no national security justification for keeping the names secret. Yet at the same time, White House officials themselves leaked the name of a CIA operative serving the country, in clear violation of the law, in an effort to get at her husband, who had angered them by disclosing that the President had relied on forged evidence in his state of the union address as part of his effort to convince the country that Saddam Hussein was on the verge of building nuclear weapons.

And even as they claim the right to see the private bank records of every American, they are adopting a new policy on the Freedom of Information Act that actively encourages federal agencies to fully consider all potential reasons for non-disclosure regardless of whether the disclosure would be harmful. In other words, the federal government will now actively resist complying with ANY request for information.

Moreover, they have established a new exemption that enables them to refuse the release to the press and the public of important health, safety and environmental information submitted to the government by businesses – merely by calling it "critical infrastructure."

By closely guarding information about their own behavior, they are dismantling a fundamental element of our system of checks and balances. Because so long as the government's actions are secret, they cannot be held accountable. A government for the people and by the people must be transparent to the people.

The administration is justifying the collection of all this information by saying in effect that it will make us safer to have it. But it is not the kind of information that would have been of much help in preventing 9/11. However, there was in fact a great deal of specific information that WAS available prior to 9/11 that probably could have been used to prevent the tragedy. A recent analysis by the Merkle foundation, (working with data from a software company that received venture capital from a CIA-sponsored firm) demonstrates this point in a startling way:

"In late August 2001, Nawaq Alhamzi and Khalid Al-Midhar bought tickets to fly on American Airlines Flight 77 (which was flown into the Pentagon). They bought the tickets using their real names. Both names were then on a State Department/INS watch list called TIPOFF. Both men were sought by the FBI and CIA as suspected terrorists, in part because they had been observed at a terrorist meeting in Malaysia. These two passenger names would have been exact matches when checked against the TIPOFF list. But that would only have been the first step. Further data checks could then have begun. Checking for common addresses (address information is widely available, including on the internet), analysts would have discovered that Salem Al-Hazmi (who also bought a seat on American 77) used the same address as Nawaq Alhazmi. More importantly, they could have discovered that Mohamed Atta (American 11, North Tower of the World Trade Center) and Marwan Al-Shehhi (United 175, South Tower of the World Trade Center) used the same address as Khalid Al-Midhar. Checking for identical frequent flier numbers, analysts would have discovered that Majed Moqed (American 77) used the same number as Al-Midhar. With Mohamed Atta now also identified as a possible associate of the wanted terrorist, Al-Midhar, analysts could have added Atta's phone numbers (also publicly available information) to their checklist. By doing so they would have identified five other hijackers (Fayez Ahmed, Mohand Alshehri, Wail Alsheri, and Abdulaziz Alomari). Closer to September 11, a further check of passenger lists against a more innocuous INS watch list (for expired visas) would have identified Ahmed Alghandi. Through him, the same sort of relatively simple correlations could have led to identifying the remaining hijackers, who boarded United 93 (which crashed in Pennsylvania)."

In addition, Al-Midhar and Nawaf Alhamzi, the two who were on the terrorist watch list, rented an apartment in San Diego under their own names and were listed, again under their own names, in the San Diego phone book while the FBI was searching for them.

Not to put too fine a point on it, but what is needed is better and timelier analysis. Simply piling up more raw data that is almost entirely irrelevant is not only not going to help, it may actually hurt the cause. As one FBI agent said privately of Ashcroft: "We're looking for a needle in a haystack here and he (Ashcroft) is just piling on more hay."

In other words, the mass collecting of personal data on hundreds of millions of people actually makes it more difficult to protect the nation against terrorists, so they ought to cut most of it out.

And meanwhile, the real story is that while the administration manages to convey the impression that it is doing everything possible to protect America, in reality it has seriously neglected most of the measures that it could have taken to really make our country safer.

For example, there is still no serious strategy for domestic security that protects critical infrastructure such as electric power lines, gas pipelines, nuclear facilities, ports, chemical plants and the like.

They're still not checking incoming cargo carriers for radiation. They're still skimping on protection of certain nuclear weapons storage facilities. They're still not hardening critical facilities that must never be soft targets for terrorists. They're still not investing in the translators and analysts we need to counter the growing terror threat.

The administration is still not investing in local government training and infrastructures where they could make the biggest difference. The first responder community is still being shortchanged. In many cases, fire and police still don't have the communications equipment to talk to each other. The CDC and local hospitals are still nowhere close to being ready for a biological weapons attack.

The administration has still failed to address the fundamental disorganization and rivalries of our law enforcement, intelligence and investigative agencies. In particular, the critical FBI-CIA coordination, while finally improved at the top, still remains dysfunctional in the trenches.

The constant violations of civil liberties promote the false impression that these violations are necessary in order to take every precaution against another terrorist attack. But the simple truth is that the vast majority of the violations have not benefited our security at all; to the contrary, they hurt our security.

And the treatment of immigrants was probably the worst example. This mass mistreatment actually hurt our security in a number of important ways.

But first, let's be clear about what happened: this was little more than a cheap and cruel political stunt by John Ashcroft. More than 99% of the mostly Arab-background men who were rounded up had merely overstayed their visas or committed some other minor offense as they tried to pursue the American dream just like most immigrants. But they were used as extras in the Administration's effort to give the impression that they had caught a large number of bad guys. And many of them were treated horribly and abusively.

Consider this example reported in depth by Anthony Lewis:

"Anser Mehmood, a Pakistani who had overstayed his visa, was arrested in New York on October 3, 2001. The next day he was briefly questioned by FBI agents, who said they had no further interest in him. Then he was shackled in handcuffs, leg irons, and a belly chain and taken to the Metropolitan Detention Center in Brooklyn. Guards there put two more sets of handcuffs on him and another set of leg irons. One threw Mehmood against a wall. The guards forced him to run down a long ramp, the irons cutting into his wrists and ankles. The physical abuse was mixed with verbal taunts.

"After two weeks Mehmood was allowed to make a telephone call to his wife. She was not at home and Mehmood was told that he would have to wait six weeks to try again. He first saw her, on a visit, three months after his arrest. All that time he was kept in a windowless cell, in solitary confinement, with two overhead fluorescent lights on all the time. In the end he was charged with using an invalid Social Security card. He was deported in May 2002, nearly eight months after his arrest.

The faith tradition I share with Ashcroft includes this teaching from Jesus: "whatsoever you do unto the least of these, you do unto me."

And make no mistake: the disgraceful treatment suffered by many of these vulnerable immigrants at the hands of the administration has created deep resentments and hurt the cooperation desperately needed from immigrant communities in the U.S. and from the Security Services of other countries.

Second, these gross violations of their rights have seriously damaged U.S. moral authority and goodwill around the world, and delegitimized U.S. efforts to continue promoting Human Rights around the world. As one analyst put it, "We used to set the standard; now we have lowered the bar." And our moral authority is, after all, our greatest source of enduring strength in the world.

And the handling of prisoners at Guantanomo has been particularly harmful to America's image. Even England and Australia have criticized our departure from international law and the Geneva Convention. Sec. Rumsfeld's handling of the captives there has been about as thoughtful as his "postwar" plan for Iraq.

So the mass violations of civil liberties have hurt rather than helped. But there is yet another reason for urgency in stopping what this administration is doing. Where Civil Liberties are concerned, they have taken us much farther down the road toward an intrusive, "Big Brother"-style government – toward the dangers prophesized by George Orwell in his book "1984" – than anyone ever thought would be possible in the United States of America.

And they have done it primarily by heightening and exploiting public anxieties and apprehensions. Rather than leading with a call to courage, this Administration has chosen to lead us by inciting fear.

Almost eighty years ago, Justice Louis Brandeis wrote "Those who won our independence by revolution were not cowards. . . . They did not exalt order at the cost of liberty." Those who won our independence, Brandeis asserted, understood that "courage [is] the secret of liberty" and "fear [only] breeds repression."

Rather than defending our freedoms, this Administration has sought to abandon them. Rather than accepting our traditions of openness and accountability, this Administration has opted to rule by secrecy and unquestioned authority. Instead, its assaults on our core democratic principles have only left us less free and less secure.

Throughout American history, what we now call Civil Liberties have often been abused and limited during times of war and perceived threats to security. The best known instances include the Alien and Sedition Acts of 1798-1800, the brief suspension of habeas corpus during the Civil War, the extreme abuses during World War I and the notorious Red Scare and Palmer Raids immediately after the war, the shameful internment of Japanese-Americans during World War II, and the excesses of the FBI and CIA during the Vietnam War and social turmoil of the late 1960s and early 1970s.

But in each of these cases, the nation has recovered its equilibrium when the war ended and absorbed the lessons learned in a recurring cycle of excess and regret.

There are reasons for concern this time around that what we are experiencing may no longer be the first half of a recurring cycle but rather, the beginning of something new. For one thing, 2this war is predicted by the administration to "last for the rest of our lives." Others have expressed the view that over time it will begin to resemble the "war" against drugs – that is, that it will become a more or less permanent struggle that occupies a significant part of our law enforcement and security agenda from now on. If that is the case, then when – if ever – does this encroachment on our freedoms die a natural death?

It is important to remember that throughout history, the loss of civil liberties by individuals and the aggregation of too much unchecked power in the executive go hand in hand. They are two sides of the same coin.

A second reason to worry that what we are witnessing is a discontinuity and not another turn of the recurring cycle is that the new technologies of surveillance – long anticipated by novelists like Orwell and other prophets of the "Police State" – are now more widespread than they have ever been.

And they do have the potential for shifting the balance of power between the apparatus of the state and the freedom of the individual in ways both subtle and profound.

Moreover, these technologies are being widely used not only by the government but also by corporations and other private entities. And that is relevant to an assessment of the new requirements in the Patriot Act for so many corporations – especially in the finance industries – to prepare millions of reports annually for the government on suspicious activities by their customers. It is also relevant to the new flexibility corporations have been given to share information with one another about their customers.

The third reason for concern is that the threat of more terror strikes is all too real. And the potential use of weapons of mass destruction by terrorist groups does create a new practical imperative for the speedy exercise of discretionary power by the executive branch – just as the emergence of nuclear weapons and ICBMs created a new practical imperative in the Cold War that altered the balance of war-making responsibility between Congress and the President.

But President Bush has stretched this new practical imperative beyond what is healthy for our democracy. Indeed, one of the ways he has tried to maximize his power within the American system has been by constantly emphasizing his role as Commander-in-Chief, far more than any previous President – assuming it as often and as visibly as he can, and bringing it into the domestic arena and conflating it with his other roles: as head of government and head of state – and especially with his political role as head of the Republican Party.

Indeed, the most worrisome new factor, in my view, is the aggressive ideological approach of the current administration, which seems determined to use fear as a political tool to consolidate its power and to escape any accountability for its use. Just as unilateralism and dominance are the guiding principles of their disastrous approach to international relations, they are also the guiding impulses of the administration's approach to domestic politics. They are impatient with any constraints on the exercise of power overseas – whether from our allies, the UN, or international law. And in the same way, they are impatient with any obstacles to their use of power at home – whether from Congress, the Courts, the press, or the rule of law.

Ashcroft has also authorized FBI agents to attend church meetings, rallies, political meetings and any other citizen activity open to the public simply on the agents' own initiative, reversing a decades old policy that required justification to supervisors that such infiltrations has a provable connection to a legitimate investigation;

They have even taken steps that seem to be clearly aimed at stifling dissent. The Bush Justice Department has recently begun a highly disturbing criminal prosecution of the environmental group Greenpeace because of a non-violent direct action protest against what Greenpeace claimed was the illegal importation of endangered mahogany from the Amazon. Independent legal experts and historians have said that the prosecution – under an obscure and bizarre 1872 law against "sailor-mongering" – appears to be aimed at inhibiting Greenpeace's First Amendment activities.

And at the same time they are breaking new ground by prosecuting Greenpeace, the Bush Administration announced just a few days ago that it is dropping the investigations of 50 power plants for violating the Clean Air Act – a move that Sen. Chuck Schumer said, "basically announced to the power industry that it can now pollute with impunity."

The politicization of law enforcement in this administration is part of their larger agenda to roll back the changes in government policy brought about by the New Deal and the Progressive Movement. Toward that end, they are cutting back on Civil Rights enforcement, Women's Rights, progressive taxation, the estate tax, access to the courts, Medicare, and much more. And they approach every issue as a partisan fight to the finish, even in the areas of national security and terror.

Instead of trying to make the "War on Terrorism" a bipartisan cause, the Bush White House has consistently tried to exploit it for partisan advantage. The President goes to war verbally against terrorists in virtually every campaign speech and fundraising dinner for his political party. It is his main political theme. Democratic candidates like Max Cleland in Georgia were labeled unpatriotic for voting differently from the White House on obscure amendments to the Homeland Security Bill.

When the Republican leader in the House of Representatives, Tom DeLay, was embroiled in an effort to pick up more congressional seats in Texas by forcing a highly unusual redistricting vote in the state senate, he was able to track down Democratic legislators who fled the state to prevent a quorum (and thus prevent the vote) by enlisting the help of President Bush's new Department of Homeland Security, as many as 13 employees of the Federal Aviation Administration who conducted an eight-hour search, and at least one FBI agent (though several other agents who were asked to help refused to do so.)

By locating the Democrats quickly with the technology put in place for tracking terrorists, the Republicans were able to succeed in focusing public pressure on the weakest of the Senators and forced passage of their new political redistricting plan. Now, thanks in part to the efforts of three different federal agencies, Bush and DeLay are celebrating the gain of up to seven new Republican congressional seats in the next Congress.

The White House timing for its big push for a vote in Congress on going to war with Iraq also happened to coincide exactly with the start of the fall election campaign in September a year ago. The President's chief of staff said the timing was chosen because "from a marketing point of view, you don't introduce new products in August."

White House political advisor Karl Rove advised Republican candidates that their best political strategy was to "run on the war". And as soon as the troops began to mobilize, the Republican National Committee distributed yard signs throughout America saying, "I support President Bush and the troops" – as if they were one and the same.

This persistent effort to politicize the war in Iraq and the war against terrorism for partisan advantage is obviously harmful to the prospects for bipartisan support of the nation's security policies. By sharp contrast, consider the different approach that was taken by Prime Minister Winston Churchill during the terrible days of October 1943 when in the midst of World War II, he faced a controversy with the potential to divide his bipartisan coalition. He said, "What holds us together is the prosecution of the war. No...man has been asked to give up his convictions. That would be indecent and improper. We are held together by something outside, which rivets our attention. The principle that we work on is, 'Everything for the war, whether controversial or not, and nothing controversial that is not bona fide for the war.' That is our position. We must also be careful that a pretext is not made of war needs to introduce far-reaching social or political changes by a side wind."

Yet that is exactly what the Bush Administration is attempting to do – to use the war against terrorism for partisan advantage and to introduce far reaching controversial changes in social policy by a "side wind," in an effort to consolidate its political power.

It is an approach that is deeply antithetical to the American spirit. Respect for our President is important. But so is respect for our people. Our founders knew – and our history has proven – that freedom is best guaranteed by a separation of powers into co-equal branches of government within a system of checks and balances – to prevent the unhealthy concentration of too much power in the hands of any one person or group.

Our framers were also keenly aware that the history of the world proves that Republics are fragile. The very hour of America's birth in Philadelphia, when Benjamin Franklin was asked, "What have we got? A Republic or a Monarchy?" he cautiously replied, "A Republic, if you can keep it."

And even in the midst of our greatest testing, Lincoln knew that our fate was tied to the larger question of whether ANY nation so conceived could long endure.

This Administration simply does not seem to agree that the challenge of preserving democratic freedom cannot be met by surrendering core American values. Incredibly, this Administration has attempted to compromise the most precious rights that America has stood for all over the world for more than 200 years: due process, equal treatment under the law, the dignity of the individual, freedom from unreasonable search and seizure, freedom from promiscuous government surveillance. And in the name of security, this Administration has attempted to relegate the Congress and the Courts to the sidelines and replace our democratic system of checks and balances with an unaccountable Executive. And all the while, it has constantly angled for new ways to exploit the sense of crisis for partisan gain and political dominance. How dare they!

Years ago, during World War II, one of our most eloquent Supreme Court Justices, Robert Jackson, wrote that the President should be given the "widest latitude" in wartime, but he warned against the "loose and irresponsible invocation of war as an excuse for discharging the Executive Branch from the rules of law that govern our Republic in times of peace. No penance would ever expiate the sin against free government," Jackson said, "of holding that a President can escape control of executive powers by law through assuming his military role. Our government has ample authority under the Constitution to take those steps that are genuinely necessary for our security. At the same time, our system demands that government act only on the basis of measures that have been the subject of open and thoughtful debate in Congress and among the American people, and that invasions of the liberty or equal dignity of any individual are subject to review by courts which are open to those affected and independent of the government which is curtailing their freedom."

So what should be done? Well, to begin with, our country ought to find a way to immediately stop its policy of indefinitely detaining American citizens without charges and without a judicial determination that their detention is proper.

Such a course of conduct is incompatible with American traditions and values, with sacred principles of due process of law and separation of powers.

It is no accident that our Constitution requires in criminal prosecutions a "speedy and public trial." The principles of liberty and the accountability of government, at the heart of what makes America unique, require no less. The Bush Administration's treatment of American citizens it calls "enemy combatants" is nothing short of un-American.

Second, foreign citizens held in Guantanamo should be given hearings to determine their status provided for under Article V of the Geneva Convention, a hearing that the United States has given those captured in every war until this one, including Vietnam and the Gulf War.

If we don't provide this, how can we expect American soldiers captured overseas to be treated with equal respect? We owe this to our sons and daughters who fight to defend freedom in Iraq, in Afghanistan and elsewhere in the world.

Third, the President should seek congressional authorization for the military commissions he says he intends to use instead of civilian courts to try some of those who are charged with violating the laws of war. Military commissions are exceptional in American law and they present unique dangers. The prosecutor and the judge both work for the same man, the President of the United States. Such commissions may be appropriate in time of war, but they must be authorized by Congress, as they were in World War II, and Congress must delineate the scope of their authority. Review of their decisions must be available in a civilian court, at least the Supreme Court, as it was in World War II.

Next, our nation's greatness is measured by how we treat those who are the most vulnerable. Noncitizens who the government seeks to detain should be entitled to some basic rights. The administration must stop abusing the material witness statute. That statute was designed to hold witnesses briefly before they are called to testify before a grand jury. It has been misused by this administration as a pretext for indefinite detention without charge. That is simply not right.

Finally, I have studied the Patriot Act and have found that along with its many excesses, it contains a few needed changes in the law. And it is certainly true that many of the worst abuses of due process and civil liberties that are now occurring are taking place under the color of laws and executive orders other than the Patriot Act.

Nevertheless, I believe the Patriot Act has turned out to be, on balance, a terrible mistake, and that it became a kind of Tonkin Gulf Resolution conferring Congress' blessing for this President's assault on civil liberties. Therefore, I believe strongly that the few good features of this law should be passed again in a new, smaller law – but that the Patriot Act must be repealed.

As John Adams wrote in 1780, ours is a government of laws and not of men. What is at stake today is that defining principle of our nation, and thus the very nature of America. As the Supreme Court has written, "Our Constitution is a covenant running from the first generation of Americans to us and then to future generations." The Constitution includes no wartime exception, though its Framers knew well the reality of war. And, as Justice Holmes reminded us shortly after World War I, the Constitution's principles only have value if we apply them in the difficult times as well as those where it matters less.

The question before us could be of no greater moment: will we continue to live as a people under the rule of law as embodied in our Constitution? Or will we fail future generations, by leaving them a Constitution far diminished from the charter of liberty we have inherited from our forebears? Our choice is clear.

Setting It Right

Ladies and Gentlemen:

Thank you for your investment of time and energy in gathering here today. I would especially like to thank Moveon.org for sponsoring this event, and the NYU College Democrats for co-sponsoring the speech and for hosting us.

Some of you may remember that my last formal public address on these topics was delivered in San Francisco, a little less than a year ago, when I argued that the President's case for urgent, unilateral, pre-emptive war in Iraq was less than convincing and needed to be challenged more effectively by the Congress.

In light of developments since then, you might assume that my purpose today is to revisit the manner in which we were led into war. To some extent, that will be the case – but only as part of a larger theme that I feel should now be explored on an urgent basis.

The direction in which our nation is being led is deeply troubling to me – not only in Iraq but also here at home on economic policy, social policy and environmental policy.

Millions of Americans now share a feeling that something pretty basic has gone wrong in our country and that some important American values are being placed at risk. And they want to set it right.

The way we went to war in Iraq illustrates this larger problem. Normally, we Americans lay the facts on the table, talk through the choices before us and make a decision. But that didn't really happen with this war – not the way it should have. And as a result, too many of our soldiers are paying the highest price, for the strategic miscalculations, serious misjudgments, and historic mistakes that have put them and our nation in harm's way.

I'm convinced that one of the reasons that we didn't have a better public debate before the Iraq War started is because so many of the impressions that the majority of the country had back then turn out to have been completely wrong. Leaving aside for the moment the question of how these false impressions got into the public's mind, it might be healthy to take a hard look at the ones we now know were wrong and clear the air so that we can better see exactly where we are now and what changes might need to be made.

In any case, what we now know to have been false impressions include the following:

  1. Saddam Hussein was partly responsible for the attack against us on September 11th, 2001, so a good way to respond to that attack would be to invade his country and forcibly remove him from power.


  2. Saddam was working closely with Osama Bin Laden and was actively supporting members of the Al Qaeda terrorist group, giving them weapons and money and bases and training, so launching a war against Iraq would be a good way to stop Al Qaeda from attacking us again.


  3. Saddam was about to give the terrorists poison gas and deadly germs that he had made into weapons which they could use to kill millions of Americans. Therefore common sense alone dictated that we should send our military into Iraq in order to protect our loved ones and ourselves against a grave threat.


  4. Saddam was on the verge of building nuclear bombs and giving them to the terrorists. And since the only thing preventing Saddam from acquiring a nuclear arsenal was access to enriched uranium, once our spies found out that he had bought the enrichment technology he needed and was actively trying to buy uranium from Africa, we had very little time left. Therefore it seemed imperative during last Fall's election campaign to set aside less urgent issues like the economy and instead focus on the congressional resolution approving war against Iraq.


  5. Our GI's would be welcomed with open arms by cheering Iraqis who would help them quickly establish public safety, free markets and Representative Democracy, so there wouldn't be that much risk that US soldiers would get bogged down in a guerrilla war.


  6. Even though the rest of the world was mostly opposed to the war, they would quickly fall in line after we won and then contribute lots of money and soldiers to help out, so there wouldn't be that much risk that US taxpayers would get stuck with a huge bill.


Now, of course, everybody knows that every single one of these impressions was just dead wrong.

For example, according to the just-released Congressional investigation, Saddam had nothing whatsoever to do with the attacks of Sept. 11. Therefore, whatever other goals it served – and it did serve some other goals – the decision to invade Iraq made no sense as a way of exacting revenge for 9/11. To the contrary, the US pulled significant intelligence resources out of Pakistan and Afghanistan in order to get ready for the rushed invasion of Iraq and that disrupted the search for Osama at a critical time. And the indifference we showed to the rest of the world's opinion in the process undermined the global cooperation we need to win the war against terrorism.

In the same way, the evidence now shows clearly that Saddam did not want to work with Osama Bin Laden at all, much less give him weapons of mass destruction. So our invasion of Iraq had no effect on Al Qaeda, other than to boost their recruiting efforts.

And on the nuclear issue of course, it turned out that those documents were actually forged by somebody – though we don't know who.

As for the cheering Iraqi crowds we anticipated, unfortunately, that didn't pan out either, so now our troops are in an ugly and dangerous situation.

Moreover, the rest of the world certainly isn't jumping in to help out very much the way we expected, so US taxpayers are now having to spend a billion dollars a week.

In other words, when you put it all together, it was just one mistaken impression after another. Lots of them.

And it's not just in foreign policy. The same thing has been happening in economic policy, where we've also got another huge and threatening mess on our hands. I'm convinced that one reason we've had so many nasty surprises in our economy is that the country somehow got lots of false impressions about what we could expect from the big tax cuts that were enacted, including:

  1. The tax cuts would unleash a lot of new investment that would create lots of new jobs.


  2. We wouldn't have to worry about a return to big budget deficits – because all the new growth in the economy caused by the tax cuts would lead to a lot of new revenue.


  3. Most of the benefits would go to average middle-income families, not to the wealthy, as some partisans claimed.


Unfortunately, here too, every single one of these impressions turned out to be wrong. Instead of creating jobs, for example, we are losing millions of jobs – net losses for three years in a row. That hasn't happened since the Great Depression. As I've noted before, I was the first one laid off.

And it turns out that most of the benefits actually are going to the highest income Americans, who unfortunately are the least likely group to spend money in ways that create jobs during times when the economy is weak and unemployment is rising.

And of course the budget deficits are already the biggest ever – with the worst still due to hit us. As a percentage of our economy, we've had bigger ones – but these are by far the most dangerous we've ever had for two reasons: first, they're not temporary; they're structural and long-term; second, they are going to get even bigger just at the time when the big baby-boomer retirement surge starts.

Moreover, the global capital markets have begun to recognize the unprecedented size of this emerging fiscal catastrophe. In truth, the current Executive Branch of the U.S. Government is radically different from any since the McKinley Administration 100 years ago.

The 2001 winner of the Nobel Prize for Economics, George Akerlof, went even further last week in Germany when he told Der Spiegel, "This is the worst government the US has ever had in its more than 200 years of history...This is not normal government policy." In describing the impact of the Bush policies on America's future, Akerloff added, "What we have here is a form of looting."

Ominously, the capital markets have just pushed U.S. long-term mortgage rates higher soon after the Federal Reserve Board once again reduced discount rates. Monetary policy loses some of its potency when fiscal policy comes unglued. And after three years of rate cuts in a row, Alan Greenspan and his colleagues simply don't have much room left for further reductions.

This situation is particularly dangerous right now for several reasons: first because home-buying fueled by low rates (along with car-buying, also a rate-sensitive industry) have been just about the only reliable engines pulling the economy forward; second, because so many Americans now have Variable Rate Mortgages; and third, because average personal debt is now at an all-time high – a lot of Americans are living on the edge.

It seems obvious that big and important issues like the Bush economic policy and the first Pre-emptive War in U.S. history should have been debated more thoroughly in the Congress, covered more extensively in the news media, and better presented to the American people before our nation made such fateful choices. But that didn't happen, and in both cases, reality is turning out to be very different from the impression that was given when the votes – and the die – were cast.

Since this curious mismatch between myth and reality has suddenly become commonplace and is causing such extreme difficulty for the nation's ability to make good choices about our future, maybe it is time to focus on how in the world we could have gotten so many false impressions in such a short period of time.

At first, I thought maybe the President's advisers were a big part of the problem. Last fall, in a speech on economic policy at the Brookings Institution, I called on the President to get rid of his whole economic team and pick a new group. And a few weeks later, damned if he didn't do just that - and at least one of the new advisers had written eloquently about the very problems in the Bush economic policy that I was calling upon the President to fix.

But now, a year later, we still have the same bad economic policies and the problems have, if anything, gotten worse. So obviously I was wrong: changing all the president's advisers didn't work as a way of changing the policy.

I remembered all that last month when everybody was looking for who ought to be held responsible for the false statements in the President's State of the Union Address. And I've just about concluded that the real problem may be the President himself and that next year we ought to fire him and get a new one.

But whether you agree with that conclusion or not, whether you're a Democrat or a Republican – or an Independent, a Libertarian, a Green or a Mugwump – you've got a big stake in making sure that Representative Democracy works the way it is supposed to. And today, it just isn't working very well. We all need to figure out how to fix it because we simply cannot keep on making such bad decisions on the basis of false impressions and mistaken assumptions.

Earlier, I mentioned the feeling many have that something basic has gone wrong. Whatever it is, I think it has a lot to do with the way we seek the truth and try in good faith to use facts as the basis for debates about our future – allowing for the unavoidable tendency we all have to get swept up in our enthusiasms.

That last point is worth highlighting. Robust debate in a democracy will almost always involve occasional rhetorical excesses and leaps of faith, and we're all used to that. I've even been guilty of it myself on occasion. But there is a big difference between that and a systematic effort to manipulate facts in service to a totalistic ideology that is felt to be more important than the mandates of basic honesty.

Unfortunately, I think it is no longer possible to avoid the conclusion that what the country is dealing with in the Bush Presidency is the latter. That is really the nub of the problem – the common source for most of the false impressions that have been frustrating the normal and healthy workings of our democracy.

Americans have always believed that we the people have a right to know the truth and that the truth will set us free. The very idea of self-government depends upon honest and open debate as the preferred method for pursuing the truth – and a shared respect for the Rule of Reason as the best way to establish the truth.

The Bush Administration routinely shows disrespect for that whole basic process, and I think it's partly because they feel as if they already know the truth and aren't very curious to learn about any facts that might contradict it. They and the members of groups that belong to their ideological coalition are true believers in each other's agendas.

There are at least a couple of problems with this approach:

First, powerful and wealthy groups and individuals who work their way into the inner circle – with political support or large campaign contributions – are able to add their own narrow special interests to the list of favored goals without having them weighed against the public interest or subjected to the rule of reason. And the greater the conflict between what they want and what's good for the rest of us, the greater incentive they have to bypass the normal procedures and keep it secret.

That's what happened, for example, when Vice President Cheney invited all of those oil and gas industry executives to meet in secret sessions with him and his staff to put their wish lists into the administration's legislative package in early 2001.

That group wanted to get rid of the Kyoto Treaty on Global Warming, of course, and the Administration pulled out of it first thing. The list of people who helped write our nation's new environmental and energy policies is still secret, and the Vice President won't say whether or not his former company, Halliburton, was included. But of course, as practically everybody in the world knows, Halliburton was given a huge open-ended contract to take over and run the Iraqi oil fields – without having to bid against any other companies.

Secondly, when leaders make up their minds on a policy without ever having to answer hard questions about whether or not it's good or bad for the American people as a whole, they can pretty quickly get into situations where it's really uncomfortable for them to defend what they've done with simple and truthful explanations. That's when they're tempted to fuzz up the facts and create false impressions. And when other facts start to come out that undermine the impression they're trying to maintain, they have a big incentive to try to keep the truth bottled up if – they can – or distort it.

For example, a couple of weeks ago, the White House ordered its own EPA to strip important scientific information about the dangers of global warming out of a public report. Instead, the White House substituted information that was partly paid for by the American Petroleum Institute. This week, analysts at the Treasury Department told a reporter that they're now being routinely ordered to change their best analysis of what the consequences of the Bush tax laws are likely to be for the average person.

Here is the pattern that I see: the President's mishandling of and selective use of the best evidence available on the threat posed by Iraq is pretty much the same as the way he intentionally distorted the best available evidence on climate change, and rejected the best available evidence on the threat posed to America's economy by his tax and budget proposals.

In each case, the President seems to have been pursuing policies chosen in advance of the facts – policies designed to benefit friends and supporters – and has used tactics that deprived the American people of any opportunity to effectively subject his arguments to the kind of informed scrutiny that is essential in our system of checks and balances.

The administration has developed a highly effective propaganda machine to imbed in the public mind mythologies that grow out of the one central doctrine that all of the special interests agree on, which – in its purest form – is that government is very bad and should be done away with as much as possible – except the parts of it that redirect money through big contracts to industries that have won their way into the inner circle.

For the same reasons they push the impression that government is bad, they also promote the myth that there really is no such thing as the public interest. What's important to them is private interests. And what they really mean is that those who have a lot of wealth should be left alone, rather than be called upon to reinvest in society through taxes.

Perhaps the biggest false impression of all lies in the hidden social objectives of this Administration that are advertised with the phrase "compassionate conservatism" – which they claim is a new departure with substantive meaning. But in reality, to be compassionate is meaningless, if compassion is limited to the mere awareness of the suffering of others. The test of compassion is action. What the administration offers with one hand is the rhetoric of compassion; what it takes away with the other hand are the financial resources necessary to make compassion something more than an empty and fading impression.

Maybe one reason that false impressions have a played a bigger role than they should is that both Congress and the news media have been less vigilant and exacting than they should have been in the way they have tried to hold the Administration accountable.

Whenever both houses of Congress are controlled by the President's party, there is a danger of passivity and a temptation for the legislative branch to abdicate its constitutional role. If the party in question is unusually fierce in demanding ideological uniformity and obedience, then this problem can become even worse and prevent the Congress from properly exercising oversight. Under these circumstances, the majority party in the Congress has a special obligation to the people to permit full Congressional inquiry and oversight rather than to constantly frustrate and prevent it.

Whatever the reasons for the recent failures to hold the President properly accountable, America has a compelling need to quickly breathe new life into our founders' system of checks and balances – because some extremely important choices about our future are going to be made shortly, and it is imperative that we avoid basing them on more false impressions.

One thing the President could do to facilitate the restoration of checks and balances is to stop blocking reasonable efforts from the Congress to play its rightful role. For example, he could order his appointees to cooperate fully with the bipartisan National Commission on Terrorist Attacks, headed by former Republican Governor Tom Kean. And he should let them examine how the White House handled the warnings that are said to have been given to the President by the intelligence community.

Two years ago yesterday, for example, according to the Wall Street Journal, the President was apparently advised in specific language that Al Qaeda was going to hijack some airplanes to conduct a terrorist strike inside the U.S.

I understand his concern about people knowing exactly what he read in the privacy of the Oval Office, and there is a legitimate reason for treating such memos to the President with care. But that concern has to be balanced against the national interest in improving the way America deals with such information. And the apparently chaotic procedures that were used to handle the forged nuclear documents from Niger certainly show evidence that there is room for improvement in the way the White House is dealing with intelligence memos. Along with other members of the previous administration, I certainly want the commission to have access to any and all documents sent to the White House while we were there that have any bearing on this issue. And President Bush should let the commission see the ones that he read too.

After all, this President has claimed the right for his executive branch to send his assistants into every public library in America and secretly monitor what the rest of us are reading. That's been the law ever since the Patriot Act was enacted. If we have to put up with such a broad and extreme invasion of our privacy rights in the name of terrorism prevention, surely he can find a way to let this National Commission know how he and his staff handled a highly specific warning of terrorism just 36 days before 9/11.

And speaking of the Patriot Act, the president ought to reign in John Ashcroft and stop the gross abuses of civil rights that twice have been documented by his own Inspector General. And while he's at it, he needs to reign in Donald Rumsfeld and get rid of that DoD "Total Information Awareness" program that's right out of George Orwell's 1984.

The administration hastened from the beginning to persuade us that defending America against terror cannot be done without seriously abridging the protections of the Constitution for American citizens, up to and including an asserted right to place them in a form of limbo totally beyond the authority of our courts. And that view is both wrong and fundamentally un-American.

But the most urgent need for new oversight of the Executive Branch and the restoration of checks and balances is in the realm of our security, where the Administration is asking that we accept a whole cluster of new myths:

For example, the Comprehensive Nuclear Test Ban Treaty was an effort to strike a bargain between states possessing nuclear weapons and all others who had pledged to refrain from developing them. This administration has rejected it and now, incredibly, wants to embark on a new program to build a brand new generation of smaller (and it hopes, more usable) nuclear bombs. In my opinion, this would be true madness – and the point of no return to the Comprehensive Test Ban Treaty – even as we and our allies are trying to prevent a nuclear testing breakout by North Korea and Iran.

Similarly, the Kyoto treaty is an historic effort to strike a grand bargain between free-market capitalism and the protection of the global environment, now gravely threatened by rapidly accelerating warming of the Earth's atmosphere and the consequent disruption of climate patterns that have persisted throughout the entire history of civilization as we know it. This administration has tried to protect the oil and coal industries from any restrictions at all – though Kyoto may become legally effective for global relations even without U.S. participation.

Ironically, the principal cause of global warming is our civilization's addiction to burning massive quantities carbon-based fuels, including principally oil – the most important source of which is the Persian Gulf, where our soldiers have been sent for the second war in a dozen years – at least partly to ensure our continued access to oil.

We need to face the fact that our dangerous and unsustainable consumption of oil from a highly unstable part of the world is similar in its consequences to all other addictions. As it becomes worse, the consequences get more severe and you have to pay the dealer more.

And by now, it is obvious to most Americans that we have had one too many wars in the Persian Gulf and that we need an urgent effort to develop environmentally sustainable substitutes for fossil fuels and a truly international effort to stabilize the Persian Gulf and rebuild Iraq.

The removal of Saddam from power is a positive accomplishment in its own right for which the President deserves credit, just as he deserves credit for removing the Taliban from power in Afghanistan. But in the case of Iraq, we have suffered enormous collateral damage because of the manner in which the Administration went about the invasion. And in both cases, the aftermath has been badly mishandled.

The administration is now trying to give the impression that it is in favor of NATO and UN participation in such an effort. But it is not willing to pay the necessary price, which is support of a new UN Resolution and genuine sharing of control inside Iraq.

If the 21st century is to be well started, we need a national agenda that is worked out in concert with the people, a healing agenda that is built on a true national consensus. Millions of Americans got the impression that George W. Bush wanted to be a "healer, not a divider", a president devoted first and foremost to "honor and integrity." Yet far from uniting the people, the president's ideologically narrow agenda has seriously divided America. His most partisan supporters have launched a kind of 'civil cold war' against those with whom they disagree.

And as for honor and integrity, let me say this: we know what that was all about, but hear me well, not as a candidate for any office, but as an American citizen who loves my country:

For eight years, the Clinton-Gore Administration gave this nation honest budget numbers; an economic plan with integrity that rescued the nation from debt and stagnation; honest advocacy for the environment; real compassion for the poor; a strengthening of our military – as recently proven – and a foreign policy whose purposes were elevated, candidly presented and courageously pursued, in the face of scorched-earth tactics by the opposition. That is also a form of honor and integrity, and not every administration in recent memory has displayed it.

So I would say to those who have found the issue of honor and integrity so useful as a political tool, that the people are also looking for these virtues in the execution of public policy on their behalf, and will judge whether they are present or absent.

I am proud that my party has candidates for president committed to those values. I admire the effort and skill they are putting into their campaigns. I am not going to join them, but later in the political cycle I will endorse one of them, because I believe that we must stand for a future in which the United States will again be feared only by its enemies; in which our country will again lead the effort to create an international order based on the rule of law; a nation which upholds fundamental rights even for those it believes to be its captured enemies; a nation whose financial house is in order; a nation where the market place is kept healthy by effective government scrutiny; a country which does what is necessary to provide for the health, education, and welfare of our people; a society in which citizens of all faiths enjoy equal standing; a republic once again comfortable that its chief executive knows the limits as well as the powers of the presidency; a nation that places the highest value on facts, not ideology, as the basis for all its great debates and decisions.
