Watch: Mike Pence willing to take subpoena fight to the Supreme Court

Former Vice President Mike Pence on Wednesday condemned ex-President Donald Trump's attempts to subvert the 2020 election and then told NBC News correspondent Vaughn Hilyard that holding Trump accountable would be antithetical to the United States Constitution.

Pence was subpoenaed earlier this week by Special Counsel Jack Smith, whom the Department of Justice appointed to investigate whether Trump committed a crime when he removed classified documents from the White House after his presidency and hoarded them inside his Mar-a-Lago golf club in Palm Beach, Florida.

Regarding the 2020 contest, however, Trump's links to the January 6th, 2021 Capitol insurrection and his subsequent efforts to remain in power are the subjects of ongoing criminal probes by the Justice Department and Fulton County, Georgia District Attorney Fani Willis.

Although Pence has not been accused of wrongdoing and is not a known target of federal and state investigators, he is nonetheless refusing to cooperate.

"Back on January 6th, President Trump was wrong. Uh, as I've said before, his words were reckless and they endangered my family and everyone at the Capitol. I, I had no right to overturn the election. Um, but I would say in this very moment, it's also wrong to establish a precedent where a legislative official could be called into a court by an Executive Branch. That, that runs against literally hundreds of years of not only American law, but, but common law," Pence said.

"We've gotta stand for that principle because it's a separation of powers," he added. "And, and that's why we're, we're prepared to, to take this fight into the court and um, and if needs be taken to the Supreme Court of the United States."
