Federal judge rules in favor of GOP lawmaker being allowed to question former prosecutor

A federal judge has ruled that House Republican lawmakers will be allowed to question a former Manhattan prosecutor in reference to the investigation and criminal charges being brought against former President Donald Trump.

According to HuffPost, U.S. District Judge Mary Kay Vyskocil delivered a favorable ruling for Republicans when she denied Manhattan District Attorney Alvin Bragg's request for a temporary restraining order. Vyskocil insists Rep. Jim Jordan (R-Ohio) arguments are within legislative guidelines.

The ruling allows the committee chair to move forward with questioning.

In a 25-page opinion, Vyskocil, a Trump-appointed, shared details to explain the reasoning behind her decision.

“It is not the role of the federal judiciary to dictate what legislation Congress may consider or how it should conduct its deliberations in that connection,” Vyskocil wrote. “Mr. Pomerantz must appear for the congressional deposition. No one is above the law.”

Acknowledging the "political dogfights" surrounding the case, the judge said in her ruling that she "does not endorse either side’s agenda." She encouraged both sides to speak and "reach a mutually agreeable compromise" on how Pomerantz’s deposition will proceed. Jordan is seeking to question him Thursday morning in Washington.

Weighing in on Vyskocil's decision, Jordan's spokesman Russell Dye, released a statement.

“Today’s decision shows that Congress has the ability to conduct oversight and issue subpoenas to people like Mark Pomerantz, and we look forward to his deposition before the Judiciary Committee,” Jordan’s spokesperson said.
