'Substantial trouble': George Conway believes Trump is facing grim legal possibilities and should 'remain silent'

George Conway, the co-founder of the anti-Trump organization The Lincoln Project, recently offered his take on the uphill legal battle former President Donald Trump is facing amid the latest developments surrounding the U.S. Department of Justice's (DOJ) classified documents probe.

On Friday, November 18, Conway appeared on CNN's "AC360" where he spoke with guest host John Berman. During the segment, Berman asked Conway his thoughts on U.S. Attorney General Merrick Garland announcing the appointment of a special counsel for the cases.

Since 2021, Trump has been under investigation for his role in the U.S. Capitol insurrection and most recently for classified documents that were removed from the White House when he left office.

“So, George, what does the appointment of a special counsel tell you about the former president’s legal situation in regards to these two cases?” Berman asked.

Earlier in the day, Garland announced the appointment of Special Counsel Jack Smith, a former Justice Department official and lead prosecutor at the International Criminal Court (ICC) in The Hague, Netherlands.

According to Conway, Trump has the "right to remain silent" and should exercise that right. However, Conway believes history has proven that Trump might not be likely to do so.

“Well, he has the right to remain silent,” Conway answered. “He probably should exercise that right tonight, but he won’t. I think he’s in substantial peril. I’ve thought that he’s been in substantial peril for quite a long time. But I think the fact that Attorney General Garland has appointed a special counsel kind of puts a highlight on that.”

Conway also weighed in on the reports about Trump possibly making public remarks about the investigations he's currently facing.

“I think what’s driving this much as anything is the fact they have a very, very strong case in Mar-a-Lag documents investigation,” Conway continued. “We don’t know all the evidence, but the public evidence sure looks like he does not have the defense to the Espionage Act charge or to obstruction charges or even to a potential perjury charge for at least suborning it. So he’s in substantial trouble, and there’s no question that this is not going to help him.”
