As legal experts note the lack of merit and legitimacy of the indictments of former FBI Director James Comey, a bombshell piece of evidence further bolsters Comey's defense.
Comey was indicted Thursday on charges of making a false statement to Congress and obstruction of a congressional proceeding in 2020 regarding an investigation into Russian interference in the 2016 election.
Comey has maintained his innocence, saying in an Instagram video that while his "heart is broken for the Department of Justice," he had "great confidence in the federal judicial system," adding, "I'm innocent. So, let's have a trial and keep the faith."
On Friday morning, MSNBC justice and intelligence correspondent Ken Dilanian posted a page of the Comey indictment on his X account, saying, "The indictment appears to attribute to Comey words he never uttered. In answering Sen. Cruz, Comey said he stood by his 2017 testimony. He did not say in the 2020 hearing that he had not 'authorized someone else at the FBI to be an anonymous source in news reports.'"
Glenn Kirschner — who was an assistant U.S. attorney in the District of Columbia under both Democratic and Republican presidents — said Comey's legal team has multiple tools at their disposal to get the charges dismissed.
"If you look at the Richter scale on a scale of one to 10 on the prosecutorial misconduct, on the vindictive prosecution front, this is not even on the charts," Kirschner said. "It's a 28 on a scale of one to 10. And I think what we're about to see . . . is the most robust motion to dismiss that we have ever seen in the history of our courts."
