Ex-federal prosecutor reveals MAGA Republicans’ scheme to 'cheat their way back into the White House'

During a Wednesday, September 18 conversation with MSNBC's Nicolle Wallace, Democratic elections attorney Marc Elias warned that if Vice President Kamala Harris wins the 2024 presidential race, MAGA Republicans and supporters of GOP nominee Donald Trump will do everything they can to overturn the election results. Elias is especially worried about the strong MAGA presence on the Georgia State Elections Board, and he fears the possibility of another violent insurrection along the lines of the January 6, 2021 attack on the U.S. Capitol Building.

Another legal expert who has been sounding the alarm about the tricks that Trump supporters may resort to if he loses is University of Baltimore law professor and former federal prosecutor Kimberly Wehle.

In an article published by the conservative website The Bulwark on September 19, Wehle details the ways in which MAGA Republicans could use a "mass voter challenge" to "cheat their way back into the White House."

"A 'mass voter challenge' involves individual voters calling into question the eligibility of hundreds or thousands of voters all at once," Wehle explains. "Frivolous mass voter challenges picked up after the 2020 election…. Rather than focusing on lawsuits over vote counts, private groups with Republican backing are now reportedly preemptively challenging perceived deficiencies in voter eligibility in a bid to 'clean up' voter rolls before the election."

Wehle continues, "From September 2023 to May 2024, there was a 55 percent increase in the number of these challenges in Michigan alone, according to an analysis by Protect Democracy. Forty-five additional states allow them in one way or another."

The former federal prosecutor cites the Election Integrity Network (founded by MAGA attorney Cleta Mitchell) and True the Vote as two examples of pro-Trump groups that are "at the forefront of orchestrating mass voter challenges."

"According to Protect Democracy," Wehle notes, "Georgia, Michigan, and Texas face 'perhaps the highest risk' of being adversely affected by election deniers' mass voter challenges this cycle, with Georgia and Michigan being two of the battleground states that will likely decide this election…. A contested election could toss the decision to House Republicans under the 12th Amendment."

Wehle adds, "Those of us worried about the threat Donald Trump poses to American democracy often think in terms of what he might do once elected or in the aftermath of another lost election. But threat to democracy is already unfolding — now."
