GOP strategist slams Trump lawyer claim Kavanaugh will 'step up' on ballot issue — but 'agrees with her'

Conservative commentator Scott Jennings on Friday piled on attorney Alina Habba after she suggested Donald Trump Supreme Court appointee Brett Kavanaugh will “step up” and overturn the Colorado Supreme Court’s decision to disqualify her client, the former president, from the ballot.

Habba told Fox News on Thursday that the former president “went through hell to get [Kavanaugh] into place.”

"It think it should be a slam dunk in the Supreme Court,” Habba said. “I have faith in them.”

“People like Kavanaugh, who the president fought for, who the president went through hell to get into place, he'll step up," Habba added. "Those people will step up — not because they're pro-Trump, but because they're pro-law. Because they're pro-fairness, and the law on this is very clear."

Speaking with CNN on Friday, Jennings called Habba’s remarks “bad.”

“You can’t go on TV, as a lawyer, defending somebody and say, ‘Well, Brett Kavanaugh, he’s going to vote for Trump cause, you know, he likes him.'"

“Terrible, terrible idea,” Jennings continued.

“I tend to agree with her analysis, as a pundit,” Jennings argued, clarifying his opinion was formed “on a legal basis.”

“I don’t think the Supreme Court is going to want to be responsible for throwing a presidential candidate off the ballot in all 50 states,” Jennings said. “But when you go on TV and you start to give political reasons why a Supreme Court justice should vote for you or not, that is a terrible idea.”
