Ex-NYPD commissioner subpoenaed in Trump Georgia case demands total immunity from prosecution

Former New York City Police Commissioner Bernard Kerik has been subpoenaed by Fulton County District Attorney Fani Willis' office in connection with her criminal case against former President Donald Trump.

Kerik isn't among the 18 Trump allies who is listed as a co-defendant in Willis' indictment. But Kerik's attorney, Tim Parlatore, CNN reports, wants to make sure he won't become one.

According to CNN reporters Paula Reid and Zachary Cohen, Parlatore "says Kerik will invoke his Fifth Amendment rights and refuse to answer questions unless he receives written assurance that he will not be prosecuted."

In a letter to Willis' office, Parlatore wrote, "(No) competent criminal attorney would allow Mr. Kerik to testify absent a grant of immunity."

Willis' office, Reid and Cohen report, told Parlatore, "If we wanted to indict Mr. Kerik, we would have already done so." But Parlatore wants it in writing.

"Fulton County prosecutors allege Kerik took part in several meetings with lawmakers in Pennsylvania and Arizona — states Trump was contesting after the 2020 election," Reid and Cohen explain. "That included the meeting Kerik attended at the White House on November 25, 2020, with a group of Pennsylvania legislators, along with Trump, then-White House Chief of Staff Mark Meadows and former Trump lawyers Rudy Giuliani and Jenna Ellis."

The reporters add, "Kerik previously sat for an interview with special counsel Jack Smith's office to answer questions related to the 2020 election aftermath and the January 6, 2021, insurrection.
