President Donald Trump on Sunday said he’s unsure whether he has a duty to uphold the U.S. Constitution as president, telling NBC News’ “Meet the Press” he’s has “brilliant lawyers that work for [him].”
Trump was speaking with NBC’s Kristen Welker about several high profile immigration cases during an interview that aired Sunday. Included in the discussion was the case of Kilmar Abrego Garcia, who the Supreme Court last month ruled must be given “due process of law” after the Trump administration claimed he was sent to a prison in El Salvador due to an “administrative error.”
Trump told ABC News’ Terry Moran last week he “could” bring Garcia back from El Salvador, but won’t.
“Are you defying the Supreme Court?” Welker asked Trump.
“I’m not involved in the legality or the illegality, I have lawyers to do that,” Trump said. “That’s why I have a great [Department of Justice] — we have a great one. We had a very corrupt one before, now we have a great one.”
Trump claimed he would have the “power to ask for [Garcia] to come back if [he were] instructed to by the attorney general."
Welker asked Trump if his administration will "seek clarification from the Supreme Court” on what the government must do to “facilitate” Garcia’s return.
“We may do that,” Trump said.
Welker noted Secretary of State Marco Rubio has said all persons in the U.S. are afforded due process, regardless of legal status, asking Trump if he agrees with that notion.
“I don’t know, I’m not a lawyer,” Trump replied.
After Welker explained that the Fifth Amendment of the Constitution grants due process to all persons in the U.S., Trump again insisted he “[doesn’t] know.”
“I don’t know,” Trump said. “It might say that, but if you’re talking about that then we’d have to have a million, or 2 million or 3 million trials. We have thousands of people … some of the worst, most dangerous people on earth.”
“Don’t you need to uphold the Constitution of the United States as president?” Welker asked.
“I don’t know,” Trump replied. “I have to respond by saying again, I have brilliant lawyers that work for me.”
“What you said is not what I heard the Supreme Court said, they have a different interpretation,” Trump added.
