'Stunning': Missouri GOP AG’s failed Trump request would’ve received greenlight from Thomas and Alito
05 August 2024
The majority conservative US Supreme Court on Monday denied Missouri Attorney General Andrew Bailey's request to block Manhattan District Attorney Alvin Bragg's prosecution of Donald Trump on Monday — shocking some legal experts.
In a statement earlier this year, the Republican attorney general filed a lawsuit against Bragg "for violating Missourians’ First Amendment right to hear from a presidential candidate in the 2024 presidential election."
Politico reports, "In a one-page order, the justices denied Missouri’s request without explanation. Justices Clarence Thomas and Samuel Alito indicated they would have allowed Missouri to file a formal complaint with the high court, 'but would not grant other relief,' the court’s order said."

Several political and legal experts responded to the High Court ruling via social media.
St. Louis Post Dispatch metro columnist Tony Messenger commented: "Another frivolous legal filing by @AGAndrewBailey ends up in the wastebasket of history."
Just Security report Adam Klasfeld added: "Only Thomas and Alito publicly noted they would given Missouri’s case the green light to proceed. They did the same after Texas filed its 2020 election lawsuit, citing their expansive view of original jurisdiction."
Former FBI counsel Andrew Weissmann wrote: "Even this Court had to reject this. And they have already inflicted a near death blow."

MSNBC legal correspondent Lisa Rubin noted: "It's stunning that Thomas and Alito would have allowed Missouri to file suit against New York due to the gag order in the hush money case, especially given a unanimous court's tough talk on standing in the mifepristone case."
