'It’s not that hard': Retired judge explains why Judge Cannon is 'insecure'

After more hearings in Donald Trump's Mar-a-Lago classified documents case Wednesday, legal experts remain unsure about presiding Judge Aileen Cannon's competence. The judge postponed the trial indefinitely earlier this month due to "unresolved pretrial issues," according to CNN.

CNN's Anderson Cooper asked former Manhattan Chief Assistant District Attorney Karen Friedman Agnifilo and retired US district court judge for the Southern District of New York Shira Scheindlin about the probability of a trial ahead of November.

"It doesn't seem like she is poised to have a trial anytime soon," Agnifilo said. "There's critical hearings that need to happen. Today's hearings were just two of many that have to happen, and the fact that she won't even set a trial date — I don't think she has any plans or any intent tensions have seeing this case go to trial anytime soon."

Scheindlin noted that Trump's lawyers tend to "make motions, of every kind, repeatedly — don't really expect to win them, but they want to tie her up." She added, "That's how I look at it. If they make 30 motions, then that means 30 more reasons to delay."

"And of course [Cannon] should be ruling from the bench on some of these," the former judge said. "They're just frivolous, I mean there's no reason to hold back on them. Just say 'deny.'"

Cooper asked, "What does that mean, ruling from the bench? She should juts be able to make the ruling there?"

The judge replied, "Absolutely. They present the arguments — they're probably letters or briefs — just decide. There's no reason to hold off and reserve on every single motion. I mean, she should know on some of these that they're frivolous. Just frivolous.

"Why would she not be ruling from the bench?" Cooper asked. "Is it just lack of experience?"

"My answer is she's insecure, absolutely," Scheindlin said. "She's insecure. A secure judge who knows what they're doing — like Judge [Lewis] Kaplan, like Judge [Juan] Merchan — the two judges who are able to control Trump. They know what they're doing. They're very experienced, and they're confident. So they rule. We call it 'rule and roll.' And she doesn't 'rule and role,' she rules and reserves, or reserves and doesn't rule. And that's not the way to move a case along."
