'Above the law': Jack Smith and DOJ discuss 'how to wind down' Trump cases

Following Donald Trump's early Wednesday morning victory, special counsel Jack Smith and the Department of Justice are discussing "how to wind down" the prosecutor's cases against Donald Trump, CBS News reports.

Smith hit the president-elect with two indictments last year — one for Trump's mishandling of classified documents, and another for attempting to overturn the 2020 election.

Two people familiar with the matter noted, "At the center of the discussions is the Justice Department's longstanding policy against prosecuting a sitting president and the need to enable a smooth transition to a second term in the White House for Trump."

Pleading not guilty on all charges, Trump claims Smith — as well as President Joe Biden — have weaponized the justice Department against him.

The Nation's justice correspondent, Elie Mystal, replied to news of the discussion via X, writing: "That makes sense. Trump won. He’s never going to be held accountable. He is above the law. This is what the country voted for."
