UCLA legal scholar explains why it will be 'harder' for GOP to challenge election results if Harris wins

Election law expert and UCLA legal scholar Rick Hasen has had a lot to say about the 2024 presidential race, election denial and voter suppression. But Hasen sounded optimistic during a Tuesday morning, October 29 appearance on MSNBC, where he voiced his concerns about the election but generally sounded optimistic.

The law professor told MSNBC's Ana Cabrera, "There's not just one concern. The idea of individuals committing violence against election officials or against voters is something we need to watch for. It doesn't have to be organized — it could just be a single person. Hopefully, everything will go smoothly on Election Day. I know that people are on the alert."

Hasen noted that former President Donald Trump "may win the election outright," adding, "Right now, it's a coin flip." But he predicted that Trump will claim victory even if the election goes in Vice President Kamala Harris' direction.

Hasen told Cabrera, "Even if it's not a close race, even if Harris appears to be the winner, I expect Donald Trump will claim to be the winner. And we may be in for some dicey days of uncertainty and sewing doubt in the election's integrity yet again."

Hasen, however, doesn't anticipate that frivolous GOP election challenges will get very far.

"If we have a 2000-type election like Bush versus Gore…. then all bets are off, and you don't know what is going to be litigated. But the good news is that the chances of the election being this close, coming down to one state…. the odds of that happening are unlikely."

If Harris wins, Hasen told Cabrera, it will be "harder" for Republicans to make headway in challenging the election results.

"I expect the courts will hold the line again if we see similar weak claims (to 2020) being brought by the Trump side this time," Hasen said.
