'Losing their mind': AOC affirms Biden’s right to shun abortion pill ruling citing GOP history of 'contempt'

Following Texas GOP Judge Matthew Kacsmaryk's ruling against the Food and Drug Administration's (FDA) approval of the abortion pill, mifepristone, Democratic lawmakers and abortion advocates have urged President Joe Biden's administration to oppose the opinion.

Rep. Alexandria Ocasio-Cortez (D-NY) is one of them.

@Acyn shared a clip of AOC's recent MSNBC interview with Anderson Cooper, writing, "AOC: I believe that The Biden Administration should ignore this ruling. The courts rely on the legitimacy of their rulings and what they are currently doing is engaging in an unprecedented erosion of their legitimacy."

On Sunday, the Democratic lawmaker provided one of the reasons behind why President Joe Biden has the authority to block Kacsmaryk's decision.

She doubled down on her point in a response to @Acyn's tweet, saying, "GOP are losing their mind over this, but there's precedent - including their own. Courts ordered Trump to fully restore DACA. They ignored it w/ Republican support. GOP operate in complete contempt for the law until they're in a position to shred Constitutional & human rights."

In 2020, the Supreme Court ordered Trump's administration to restore former President Barack Obama's Deferred Action for Childhood Arrival (DACA) program, which according to NBC, "temporarily shielded certain immigrants from deportation and made them eligible for work permits."

Regarding the Trump administration's choice to ignore the court order, NBC reports:

A senior administration official said that despite the Supreme Court ruling, the White House still viewed the program, formally called Deferred Action for Childhood Arrivals, as illegal and that the court ruling left room for it to pursue other ways to end the program. The Trump administration would 'limit the scope' of DACA while the administration reviews its legality, the official said.

Now, regarding the conservative judge's abortion pill opinion, AOC is arguing Biden has the opportunity to follow in the GOP's footsteps.

The president responded to Kacsmaryk's opinion in a statement, saying, "The Court in this case has substituted its judgment for FDA, the expert agency that approves drugs. If this ruling were to stand, then there will be virtually no prescription, approved by the FDA, that would be safe from these kinds of political, ideological attacks."

He also "vowed his administration would oppose the ruling, but he added that the only way to ensure abortion rights are protected is to elect members of Congress who support a federal law to reimplement the ruling under Roe."

Kate Shaw, contributing writer at The New York Times argued the administration "must forcefully resist" the "medically unsound" ruling, noting "The Justice Department voiced its disagreement with the opinion and said it will appeal."

She added, "The administration is correct to appeal, and if the Fifth Circuit does not rule swiftly, the Justice Department should ask the Supreme Court to intervene."
