'They had two weeks': Legal analyst blames Donald Trump’s legal team for SCOTUS jam

Donald Trump waited to appeal the Colorado Supreme Court's decision to remove him from the Republican primary ballot just one day before the deadline — Thursday, January 4.

The deadline for Colorado Secretary of State Jena Griswold to certify all names and party affiliations of 2024 presidential candidates is Friday, January 5, leaving the US Supreme Court — which is ultimately responsible for deciding Trump's fate — "jammed," according to legal analyst Neal Katyal.

MSNBC's Alicia Menendez spoke with Katyal during the latest episode of Deadline: White House, pointing out, "Here we are. [The deadline] is tomorrow." She asked the analyst, "I wonder if you're surprised we are hours out and do not yet have clarity?"

Katyal replied, "I am a little surprised and I do blame Donald Trump's legal team for this. They had two weeks. They took two weeks to file their petition at the United States Supreme Court. Just as wrong as they say. They shouldn't have taken that time if it's as wrong as i they said and should have T'd this up for the supreme court earlier. Now the court is kind of jammed into this. And Andrew, at the outset, was absolutely right. There are ways for the court to rule tomorrow afternoon on whether to hear the case, and ways to try to undo some of the uncertainty, but the fact is, on January 20th, there's going to be mail-in ballots sent to military and overseas voters, and then on February 12th, active registered voters are going to get their ballots. And so there's is a kind of crying need for the Supreme Court to resolve this as soon as possible. And I do blame the Trump team for taking that long to file that brief, and so now the court is a little bit jammed."
