Texas GOP-er Proposes Law Allowing Teachers to Kill Students Who Threaten School Property

Texas Republican State Representative Dan Flynn has introduced legislation that would allow teachers to shoot and kill students who they believe are threatening school property.


Flynn's “Teacher's Protection Act” would “allow educators to use force or deadly force if they feel they need to protect themselves against a student or anyone else on school grounds. It also allows teachers to use deadly force to protect school property, and to avoid prosecution 'for injury or death that results from the educator’s use of deadly force.'”

Although the legislation is ostensibly designed to defend the rights of teachers and their schools, the state's largest association of educators – the Association of Texas Professional Educators – does not support it. “We understand he’s trying to carve out some liability protections. But, we can’t see that the liability protection in that particular bill is any different than the protection that exists in law for a regular citizen,” said ATPE's lobbyist Monty Exter.

“Educators in Texas actually do have some legal protections that do allow them to use physical force to protect themselves and protect others, as long as the use of physical force is reasonable,” added ATPE attorney Paul Tapp.

Flynn has long been an advocate for increased gun ownership, telling his constituents that “the more guns in the hands of honest, well trained, law-abiding Texans, the less crime.”
