Shocker. Roberts has been confirmed as perhaps the most powerful interpreter of law on planet Earth.

Bob Geiger lists the 22 Dems who voted for him (eight of whom face reelection next year), commenting:

"Many of those who voted for Roberts say they 'take him at his word' and one has to wonder what the hell they’re talking about – he didn’t say anything. What it boils down to is that they just handed the worst president in history – and one who has no respect for them or their party – a major victory."

Bill Scher doesn't believe the blame rests solely on Senate Dems. In a recent post, he wrote: "We can't be shocked that so many Senate Dems will vote for Roberts, because so little was done by liberal activists, pundits, bloggers, and politicians to create the conditions for a strong opposition."

His essential argument is that this is a strategic and NOT a substance-based battle. The day Roberts was picked by Bush a friend of mine tsk-ed the near-real-time opposition emails he received, fearing that this was just a knee-jerk reaction.

But the fact is, as Scher argues, the battle to define the candidate in the press and to build support for senators willing to ask probing and uncomfortable questions is far more important than swaying some imaginary group of people who are waiting for some waterfall of objective facts to come roaring in before they make their decisions.
