Raped in the Military? You May Have to Pay for Your Own Forensic Exam Kit

Editor's note: a correction was made to this story since publication. The uncorrected version stated incorrectly that the military doesn't cover forensic exam kits for the 20 percent of rape victims treated on military bases.

Sarah Palin's decision not to pay for rape kits when she was mayor of Walsilla was an issue in the campaign for the White House. But allow me to introduce the large pink elephant that has been sitting quietly in the corner of the room:

At the Winter Soldier Investigation in March, Spec. Patricia McCann, who served in Iraq with the Illinois Army National Guard from 2003-4, read a memo issued to all MEDCOM commanders clarifying that "SAD kits"-- which are forensic rape kits--"are not included in TRICARE coverage." *

TRICARE, the United States Department of Defense Military Health System that covers active duty members, will only pay for rape kits if the victim is seen in a military or a VA facility.

But the Pentagon acknowledges that 80 percent of military rapes are never reported. And that 80 percent who go off-base to protect their anonymity (and/or their careers) are on their own. If a soldier is on leave, or is five-hours from the nearest VA, or if a soldier is simply delivered to the nearest hospital by the local ambulance driver, their rape kits are not covered under TRICARE. Neither are other forensic exams that might be used in domestic violence situations.

Front-line treatment shouldn't be conditional on where a rape occurs or where the nearest treatment is available. This is not only a parity issue, but a further obstacle to treatment and justice.

Women in the military are twice as likely to be raped as their civilian counterparts. In fact, "women serving in the U.S. military today are more likely to be raped by a fellow soldier than killed by enemy fire in Iraq," Congresswoman Jane Harman, D-Calif., told the House Subcommittee on National Security and Foreign Affairs in May.

Harman said, "The scope of the problem was brought into acute focus for me during a visit to the West Los Angeles VA Health Center where I met female veterans and their doctors. My jaw dropped when the doctors told me that 41 percent of the female veterans seen there say they were victims of sexual assault while serving in the military, and 29 percent said they were raped during their military service."

In July, a House Oversight and Government Reform subcommittee hearing subpoenaed Kaye Whitley, director of the Pentagon's Sexual Assault Prevention and Response Office (SAPRO), to explain what the department is doing to stop the escalating sexual violence in the military. Her boss, Secretary of Defense Robert M. Gates, ordered her not to appear.

Whitley was finally made available to the committee on Sept. 10, but only after having been threatened with a contempt citation.

Whitley first informed the committee that the DoD was conducting a "crusade against sexual assault."

She then sought to reassure the committee with an accounting of all the heroic measures the Pentagon is planning to implement in the very near future.

But finally, she had to admit that in 2007 there were 2,688 sexual assaults in the military, including 1,259 reports of rape. Just 8 percent (181) of those cases were referred to courts martial, compared to a civilian prosecution rate of 40 percent. And almost half of those cases were dismissed without investigation. (And I say Whitley "had to admit" the number of cases because in 2004, Congress woke up to the fact that the DoD was blowing off the issue and required the military to make yearly reports on all matters relating to sexual assault in the Armed Forces. But those reports did not indicate either prioritizing or progress -- hence the hearings.)

Rep. John Tierney, D-Mass., asked the committee if anyone thought that "ordering its employees to ignore subpoenas to discuss the topic" sounded as if DoD was taking any of this seriously. "Let me be very clear. Preventing and responding to sexual assault perpetrated against our soldiers is simply much too important to be playing a game of cat and mouse." He later told Stars and Stripes that there are only seven people on Whitley's staff to devise and implement the military's sexual assault program for the entire military. That number speaks for itself.

This is not news. As far back as 1995, Reuters reported that "Ninety percent of women under 50 who have served in the U.S. military and who responded to a survey report being victims of sexual harassment, and nearly one-third of the respondents of all ages say they have been raped."

Furthermore, the Pentagon acknowledges that 80 percent of military rapes are not reported in the first place, suggesting that the actual number, if it were known, would be astronomical.

Cat-and-mouse games may sound like kid stuff, but refusing to pay for a rape kit is anything but. It implies that the victim is to blame. It does not encourage victims to come forward. And it makes it far more likely that soldiers will interpret the permissive climate as institutionally sanctioned misogyny.

In her Winter Soldier testimony, McCann noted, "The assistant secretary of defense is soliciting legislative changes to TRICARE benefits which will include these kits within covered TRICARE supplies."

I have been in touch with the office of the assistant secretary, S. Ward Casscells, M.D. It seems that he has indeed solicited such legislation, and it is due to go into effect in December as an amendment to the John Warner National Defense Authorization Act for fiscal year 2007. The amendment contains some "background" that is worth sharing.

Currently, forensic examinations are not covered for beneficiaries in civilian health care facilities through TRICARE medical plans because TRICARE "may cost share only medically or psychologically necessary services or supplies. Forensic examinations are not conducted for medical treatment purposes, but for the preservation of evidence in any future criminal investigation and/or prosecution."

The decision to treat rape kits as purely evidentiary, ignoring the very real medical and psychological benefits to the victim, is reprehensibly primitive thinking. Making sure that those legislative changes happen as planned would be a long overdue step out of the primal ooze that has slimed our military in the eyes of our citizens and the world.

Speaking to Palin's decision not to pay for rape kits, the former governor of Alaska, Tony Knowles, was quoted in Palin's hometown paper, the Frontiersman, as saying, "We would never bill the victim of a burglary for fingerprinting and photographing the crime scene, or for the cost of gathering other evidence. Nor should we bill rape victims just because the crime scene happens to be their bodies."

When Barack Obama decides who he will appoint to head the Department of Veterans Affairs in his administration, he should consider appointing someone who also understands how important it is that women's bodies, souls, dignity and health be taken seriously. Tammy Duckworth, who is reported to be at the top of his list, certainly has had personal experience with a health care delivery system she has called "a little bit arcane."

Duckworth is now director of the Illinois Department of Veterans Affairs, but in 2004, she was a Blackhawk helicopter pilot in Iraq and lost both of her legs in a crash. She describes the care she received at Walter Reed Army Medical Center as "excellent," but adds, "the comfort package I received contained men's Jockey shorts, and the local VA hospital carried Viagra but not my birth control."

There are currently about 1.7 million female veterans in the United States, and the Department of Defense estimates that there are about 200,000 women, 15 percent of the military, on active duty. Thirty-nine percent of those women return from Iraq or Afghanistan with mental health issues, and, for more than a third who seek VA health care, the precipitating trauma was a sexual assault.

Every VA center now screens both men and women for sexual trauma. That is an improvement. Still, Duckworth says, "I don't think the VA mental health care system is ready for (female veterans)." It would be encouraging to see a VA director who has some understanding of how important that is to fix.

...Americans want to get upset over the treatment of women in some Muslim countries! It's quite obvious that the raping going on in the military - over one-ninth of women! - could not be going on if the attitude in the country as a whole weren't so misogynistic. We need to take care of our own women before complaining about the cultures of other places.

When your son enlists in the Armed Forces, he takes with him the training he recieved at home in the care of his parents. So I put the atrocities that your boys and men do within the circle of "good 'ol boys" club squarely on your shoulders. For the parents of the girls/women the training you have provided for your girls must include hand to hand combat measures.As a rape survivor myself, the criminals were Princess Patricia's Light Infrantry in Calgary, 1957.
Since the time that women demanded equality to serve they have been victimized. During the World Wars 1 and 2 the women who served as nurses and in offices were also abused and attacked. The attitude of men in service is any person with the receptical is fair game. Before the women were there, the pretty boys would suffice. That is why out-of-the-closet-gays are looked down on, because the "big men" do not want anyone to think they swung that way. They always have, especially if they wish to impress authority.
So everyone, the soldiers are what you raised and 99.09% should be ashamed of the job they did.

Wow, after reading that story I found that I had tears streaming down my face. As a person who has been attacked twice by strangers - i won't use the word victim as I beat the shit out of both of my attackers. (And those incidents occured in the early '80's when women were told to be submissive.) I feel enraged at the DoD and that their submissive actions regarding this issue. I certainly hope that whomever is appointed to head the Dept. of Veterans Affairs places this at the top of the to do list. This story also makes me wonder what apalling secrets Robert M. Gates is keeping hidden. The fact that our women warriors are being assaulted by their comrades in such a large percentage is an atrocity and shameful. It also speaks volumes for the type of men that make up today's miltary.

My 11 yr old Daughter just sat down next to me and I shared this story with her. Her response was Why - I thought soldiers were supposed to look out for each other? Yeah honey, so did I.

What a waste of space this article takes up ! What the hell is the matter with these so-called "progressive" and/or "liberal" sites beating dead horses? They sound no different from those self-righteous "conservatives" who always drum up fear and lies about some mythical "liberal boogeyman" ! This article reminds me of the way Bush kept talking down the economy all through 2000 and then made it happen and on foreign policy it was no different. The voters have already soundly REJECTED Mccain/Palin so leave Palin alone at the grave and MOVE ON ! Obama/Biden are gonna take over the White House and they're gonna try to moderate all this Iraq War fiasco. This is just another stupid author who should SHUT UP and get back to business and make the Democrats use their power wisely and STOP allowing them to invent another 2 years of excuses for failing. You don't have Bush to kick around no more and filibusters are less likely than before. If the Democrats cannot learn to frame the issues and make inroads just like the GOP used to do when they were in the minority, then of course they will be perceived as weak ! GAWD !!!

Does every law enforcement agency in the nation provide these kits free? Does every civilian health insurance company in the nation pay for these kits? If so, then the author has a legitimate gripe. If not, why single out the military?

For years now I've wondered if the outrageously high body count from US military actions was in any way impacted by their high rate of rape of their fellows.

It would seem a reasonable way to solve a devastating problem that the chain of command chooses to ignore.

The problem was rampant when i was in the military in the sixties. the attitude toward women was, you either had to be a bull dyke or a slut if you were a woman in the military. The policies have outwardly changed but the underlying attitudes still persist. Very sad indeed.

Medical and supportive services for victims of sexual assault are payable for TRICARE beneficiaries be they active duty,a dependent family member, or a retiree. The memo (to TRICARE civilian contractors) was strictly to keep law enforcement agencies from attempting to bill DOD for rape kits which should be paid for by law enforcement as they do with any other form of evidence collection. The (thankfully) few law enforcement agencies that bill health insurers for the kits generally do not bill victims if the insurer declines payment.

I just diaried this on a blog and was jumped all over by people correcting me.

TRICARE is for OFF-BASE care!!! On the base, all women can get rape kits. Off base is another story, and the underlying issues are still true.

But really, your readers now think that no woman in the military gets a free rape kit, and that could not be further from the truth.

Armies have always been havens for social misfits. Gays are of course drawn to groups of men, violent men and women are of course drawn to organizations which provide lethal weapons and encourage cathartic slaughter. Nitpicking ethical discussions of such supremely unethical societies are absurd. How can a man's raping a woman completely eclipse their working like lovers the day before to kill villages of innocent humans? Oh my, the rape is so horrible! Why do social commentators continue the inane ethical obfuscation?

War is hell and should be avoided, not sanitized. Suicidal people should be cared for by neighbors, not sent off to war zones to do the dirty work of the rich.

1. As annoyed as I may get with a woman (usually when I've been outsmarted by one, which has been often), I've NEVER thought of harming one in any way.
2. In my opinion, MOST men share view # 1 with me.
3. If a woman is brutalized by a man, she deserves all the help and tenderness she can get. Withholding any of that is almost as bad as the insult she's suffered.
4. If there's any question in your mind as to the infiltration of the heartless corporate mentality into every facet of our lives, including the military, you need to look no further than this article.

The facts are....yes the VA does have all forms of birth control for women. Pills, gel and even the female condom. No one pays for a rape kit. No one at the VA or any military hospitol or clinic pays for rape kits. No one pays for a rape kit. That's the facts and I am sticking to them. I'm a vet, I work at the VA. I was raped while in the service and I get my bc pills from the VA.

This article has no focus on what policy should be regarding these rape kits, except that victims should not get a bill. While that might fix the problem for military women, treating these kits as medical rather than evidentiary is how jurisditions like Wassala, and many many more, defend not paying for the kits for victims. Yelling that it's medical to fix the small problem of military women treated out of system muddies the waters on the big issue. This is evidentiary. It should be paid for by the jurisdiction where the crime occurred. It's a dirty little secret that has gone on for years until Palin's nomination brought it to light that many jurisdictions consider the rape kit medical treatment and therefore not their responsibility. Now, everyone act surprised, the insurance companies disagree with that interpretation, refuse to pay, and leave the bill lying at the foot of the victim's bed. We need Federal legislation to settle this so victims are not left holding the bag.

that I am surprised! The corrupt fingers of the extended Bush Crime Family has invaded every aspect of our culture.

Sexism and crimes against women has always been entertainment for many of the men in our country and elsewhere.

Women raped in the military is especially grievous; since the victims must face their attackers every day and night as a part of their service.

We can turn our backs and pretend that women actually have equal rights; or we can, all women and men of good will, do everything in our power to see to it that our elected reps. know that we know!

I ask, what about the Iraqis?
Anyone committing rape ought to be killed, no excuses.
There is one question that I have, however. Women in the military are trained/competent in the use of firearms. How is it, or why is it that they do not simply shoot the bastard as soon as they have the opportunity to lay hands on a gun?

Rape is a major reason women should stay home instead of go to war. Didnt they just recognize rape as a form of torture for captured female soldiers.

If you can't fight off some horny soldier then you have no business in the trenches with a gun fighting a war, when you cant even defend yourself. And this is coming from a woman.

I have no sympathy for these women who sign up to kill impoverished people so they can better their own lives. They should be grateful they are merely raped and not permanently maimed and killed like their victims. What could you possibly expect when you agree to join an entity which is all about delivering men to points all over the globe to kill and subjugate others?

Perhaps it is because the Pentagon LOWERED their enlistment requiements,and now there are gang members and other unsavory pathetic creatures that are allowed into the Forces. These miscreants will now go back to the US and consider all that they have been taught and use it on the general public. And what is to stop these same miscreants from finding out who ratted them out and then take revenge. I wonder how many other countries are facing the same situtation with their women soldiers?
