Your Time Is Up, Mr. President -- the National Guard Is Coming Home

Guess what, Mr. President? Your authority to keep state National Guard troops in Iraq has expired. So says a new bill introduced this week to the Vermont Legislature by Rep. Michael Fisher and Sen. Peter Shumlin. It is supported by 30 of their colleagues.

"It is clear that the mission that Congress authorized no longer exists," said Fisher. "Unless Congress grants a new authorization, the Vermont Guard should revert back to state control." The Vermont bill states:

The Authorization for the Use of Military Force of October 16th, 2002, having expired, the General Assembly declares that all members of the Vermont National Guard should be promptly and expeditiously withdrawn from Iraq, subject only to the conditions of time and manner specifically required to assure their safety and well-being during removal operations … The General Assembly calls on the Governor of Vermont to take prompt steps as the Commander-in-Chief of the Vermont National Guard to effectuate these purposes.

The Guard are the mainstay of America's national defense, and as with other American institutions, the Guard's duties are distributed between the states and the federal government. Unless called into national service, each unit and each individual member of the Guard remains in the service of their respective states.

Five years ago, George Bush called the Guard into national service pursuant to the 2002 Authorization to Use Military Force (AUMF) against Iraq. The AUMF, passed by Congress in its rush to war, established a limited mission: First, the removal of Saddam Hussein from power; second, enforcement of preceding United Nations Security Council resolutions regarding the elimination of alleged Iraqi WMDs and ballistic missiles. The Vermont bill recognizes that those two mission objectives are complete and that the national service of the Vermont Guard is over; the bill recalls the Guard to state control.

And Vermont is not alone. State legislators in Minnesota, New Hampshire, Pennsylvania and Rhode Island plan to sponsor similar legislation. And legislators in several other states, including Maryland, Maine and Wisconsin, have openly declared that they are examining the issue and considering following suit.

This latest chapter in Democracy v. Empire illustrates one of the most significant and perhaps most underreported aspects of the tragedy which is the occupation of Iraq: The wisdom of the American people. For a public that has all but given up hope for congressional action to end the war, this new state-based legal approach takes advantage of a surge of another kind ...

In the runup to the ill-fated U.S. invasion of Iraq in March of 2003, nearly 200 municipalities passed symbolic resolutions stating all of the reasons that the United States should not invade: The war would be too costly; it was the wrong priority for federal funds that could be better spent in our own crumbling communities; there was no evidence of an imminent threat from Iraq; there was insufficient evidence of WMDs; U.N. weapons inspectors needed time to finish doing their job; hope lay with multilateralism, not unilateralism; and above all, the potential was great for devastating and unnecessary loss of life on all sides.

Unfortunately, the wisdom from Main Street U.S.A. proved vastly better than the "intelligence" propagated by 1600 Pennsylvania Avenue.

In these last five years of occupation, we have seen estimates of the war cost rise to between $500 billion and $3.5 trillion, depending on the source. Four thousand U.S. soldiers and over half a million innocent Iraqi civilians -- men, women and children -- have lost their lives; hundreds of thousands of others have been seriously wounded. Iraq no longer exists as an independent or intact nation.

In the face of the horrific war toll, world and domestic public opinion have turned sharply against both the foolish presidency and the cowardly Congress. Over 300 cities, towns, counties and states have expressed opposition to continuing the war. Fully half of the U.S. population either affirmatively voted in popular referenda for withdrawal from Iraq, or are represented by elected city councils, town boards or state legislatures that voted for withdrawal. The wisdom of the American people continues unabated.

Now, with the Vermont legislation, the public wisdom may become a reality. Those same legislators who passed anti-war resolutions can now cast votes recalling the Guard from Iraq. Vermont has, once again, led the way. And many other states have been quick to follow.

Mr. President, your time is up. Your authority is over. The people have said their piece. Now they are beginning to bring the women and men of the National Guard home.

seriously.

I think we can and should help people. We got them into this mess, (and out of one with Saddam). It is the right thing to do. We must finish what we started. Otherwise, the consequences are unbearable. My mother says "why not someone else" I reply, "there are hundreds of thousands like me, who know the truth, and what honor really is. It is serving and protecting your fellow man."

And just for anyone who asks, I am a warfighter. 11B10, graduated in 2005, class #5522, Sand Hill.

This is a real challenge to the Presidents power to wage war on an extended scale - I just wonder why this hasnt been done before! This war's objectives were "won" long ago!

Leave it to Vt to come up with this. I'm usually totally against the mindless mountain of illogical liberal thought - any state that favores child moletsers over the child should be banned from the union. But I have to hand this to them. I'll bet the ACUL is steaming over this that they didnt come up with it first

War is no different, particularly a costly and illegal one. As a combat veteran of Vietnam ('67-'68), I can say that our staying there was no different than Bushes "staying the course" in Iraq - stupid, destructive and eventually non-productive. Get out with diplomatic ties in place to help Iraq if they want it. Find BushCo and the war profiteers to pay reparations for fucking over a country that did nothing to the US and pose no threat to us. Impeach Bush/Cheney and publicly flog them and then imprison them in a country that allows torture - oh, that would be us under their "leadership".

But I'm pretty sure that the chain of command for government is federal first then state. Therefore the Vermont state legislature doesn't have any authority to tell the federal government what to do with the national guard. Not once they've been called to active duty anyway.

This is just a plublicity stunt.

One contributing factor was the absence of the Louisiana National Guard and their amphibious equipment.

"Louisiana National Guard Offers Help By Phone From Iraq

BAGHDAD—The 4,000 Louisiana National Guardsmen stationed in Iraq, representing over a third of the state's troops, called home this week to find out what, if any, help they could offer Katrina survivors from overseas. "The soldiers wanted to know if they could call 911 for anyone, or perhaps send some water via FedEx," said Louisiana National Guard spokesman Lt. Col. Pete Schneider. The Guardsmen also "would love to send generators, rations, and Black Hawk helicopters for rescue missions," but, said Schneider, "we desperately need these in Iraq to stay alive." Defense Secretary Donald Rumsfeld praised the phone support, but noted that it would take months to transfer any equipment from Iraq to New Orleans, saying, "You fight a national disaster with the equipment you have."


Expect more of the same. The most recent power grab by the executive branch was the following bill that gave the President more power over Guard deployments:

John Warner Defense Authorization Act of 2007 H.R. 5122
"Federal law was changed so that the Governor of a state is no longer the sole commander in chief of the National Guard during emergencies within the state. The President of the United States will now be able to take control of a state's National Guard units without the governor's consent. In a letter to Congress all 50 governors opposed the increase in power of the president over the National Guard."

Currently, National Guard units are being sent on their biggest deployments since WWII - see Illinois employers gear up for National Guard deployment, Feb 2008. Off to Afghanistan, off to Iraq - and for what? To secure oilfields and pipeline routes for Exxon and Chevron, who are already making record profits?

Oh - that's why Exxon and Chevron are making record profits! Booked reserves are now worth $100 barrel... prices were at $25 a barrel in 2001, right? When Exxon and Chevron manage to book Iraq reserves, then you'll really see some fat profits! To die for!

Supporting American oil & finance entrepreneurs in their quest for global dominance - what nobler cause is there? Isn't this what they called Manifest Destiny? Or was that Megalomania?

We- the US created a massive problem over there. Nothing is going to change that. Not me, you, Clinton, Obama- nobody. We need to help these people rebuild. That is honor. Imagine for a moment what would happen if we left tomorrow. Doyou think that their nation would just heal itself overnight? No, it would not.

And for those who are makin assumptions about my rank, it is not Private, I am a Specialist. I was promoted 6 months after returning from AIT. I also am considering becoming an officer with the Guard.

And I also am a senior in college who had my education paid for before I joined. I did not do it for the money, fame, or killing. All the males in my family have served, and we will continue to do so. My little brother is joining as well. Maybe it is something you cannot understand.

Also, I take no offense to the comments against me. In fact, most of them are pretty sad. I may be naive, but at least I put my money where my mouth is to help people. Even if I am an infantryman. In my civillian life, I also am a volunteer firefighter and I also work with abused children. Judge me as you may, but I am just an American wanting to help others, even those who have suffered from the mistakes our government has made.

Congress allowed for sending the troops

Only Congress has the power to call up the militia to enforce the laws of the union, put down insurrection and repel invasions.

Congress passed a resolution allowing the bush to initiate an act of aggression on Iraq

Republicans and Democrats passed that unconstitution act of aggression resolution; bush executed it.

R's and D's have lied to the American people by failing to comply with their oaths of office to support the Constitution that only permits defense of this country in the form of repelling invasions. The republican/democratic political system has with complicity and collusion commited crimanal acts of lying under oath by committing and act of aggression resulting in the deaths of millions of Iraqis and American soldiers and others.

14th amendment section 3 all who have taken an oath to the Constitution and rebel against same are no longer elegible to hold any government office. All Republicans and Democrats should have been impeached years ago but who is going to perform that constitutional requirement.

Our political system has betrayed everything we stand for as a nation and stand in definace of the the American people who seek justice by impeachment and trials for crimes against international law.

It is well past time to bring in the US Supreme Court to try this corrupt party system for violations against the Constitution and International law.

If we cant get our country back from the criminals managing (not governing) us it will only get worse, right now all American's standard of living is being lowered and the wealth you have accumulated (American dream) by selling your labor is being attacked. We are all being releveled to fit in with the Global workforce. Did I mention workcamps are being built here in the

Will the American people reelect these same criminals with blood of over a million people on their hands, to governement offices again.

Of course! No differnently that the last election the people stampeded from R to D rule expecting changes but nothing happened, in fact we got more war and more money for war the the new? majority.

We exist in what has degenerated to an immoral sociey, its anarchy, and two class society.

Destroy the party system by never voting for an r or a d or anyone that has ever been an r or a d.

You entire life depends on it, without change your life becomes their life.

The Adminstration is the Enemy of the Constitution

The only way we will get our country back is for the police and military torecognize we are not the enemy and that the President is!! I'm a Vietnam Vet, I took an oath to 'Defend the Constitution from ALL enemies Foreign and DOMESTIC' BUSH and CO. are the Domestic. When the guard comes back they will have two choices.
Help us get the country back or create another Kent State. I hope they help us get our country back.

Every time I see the picture of Bush in uniform I want to gag. This guy knows absolutely nothing about sacrificing for this country or what it is like to be in the armed forces. Remember, this is the guy who used Daddy's influence to give him an easy time in the Guard - he simply dropped out. What would happen if your son or daughter did that? Impeach Bush and Cheney and try them as war criminals.
