War Crimes Within War Crimes

Behind the revelations about white phosphorus is the larger reality that every step leading from the invasion of Iraq to the siege of Falluja was illegal.

The media couldn't have made a bigger pig's ear of the white phosphorus story. So before moving on to the new revelations from Falluja, I would like to try to clear up the old ones.

There is no hard evidence that white phosphorus was used against civilians. The claim was made in a documentary broadcast on the Italian network RAI, called "Fallujah: the Hidden Massacre". It claimed the corpses in the pictures it ran "showed strange injuries, some burnt to the bone, others with skin hanging from their flesh ... The faces have literally melted away, just like other parts of the body. The clothes are strangely intact." These assertions were supported by a human rights advocate whom, it said, possessed "a biology degree".

I too possess a biology degree, and I am as well-qualified to determine someone's cause of death as I am to perform open-heart surgery. So I asked Chris Milroy, professor of forensic pathology at the University of Sheffield, to watch the film. He reported that "nothing indicates to me that the bodies have been burnt." They had turned black and lost their skin "through decomposition". We don't yet know how these people died.

But there is hard evidence that white phosphorus was deployed as a weapon against combatants in Falluja. As this column revealed last Tuesday, U.S. infantry officers confessed that they had used it to flush out insurgents. On Tuesday afternoon, a Pentagon spokesman admitted to the BBC that white phosphorus "was used as an incendiary weapon against enemy combatants." He went on to claim that "It is not a chemical weapon. They are not outlawed or illegal." This denial was accepted by almost all the mainstream media. U.N. conventions, the Times asserted, "ban its use on civilian but not military targets." But the word "civilian" does not occur in the Chemical Weapons Convention. The use of the toxic properties of a chemical as a weapon is illegal, whoever the target is.

The Pentagon argues that white phosphorus burns people, rather than poisoning them, and is therefore covered only by the protocol on incendiary weapons, which the U.S. has not signed. But white phosphorus is both incendiary and toxic. The gas it produces attacks the mucous membranes, the eyes and the lungs. As Peter Kaiser of the Organisation for the Prohibition of Chemical Weapons told the BBC, "If ... the toxic properties of white phosphorus, the caustic properties, are specifically intended to be used as a weapon, that of course is prohibited, because ... any chemicals used against humans or animals that cause harm or death through the toxic properties of the chemical are considered chemical weapons."

The U.S. Army knows that its use as a weapon is illegal. In the Battle Book published by U.S. Command and General Staff College at Fort Leavenworth, Kansas, my correspondent David Traynier found the following sentence. "It is against the law of land warfare to employ WP against personnel targets."

Last night the blogger Gabriele Zamparini found a declassified document from the U.S. Department of Defense, dated April 1991, and titled "Possible use of phosphorous chemical". "During the brutal crackdown that followed the Kurdish uprising," it alleges, "Iraqi forces loyal to President Saddam (Hussein) may have possibly used white phosphorous (WP) chemical weapons against Kurdish rebels and the populace in Erbil ... and Dohuk provinces, Iraq. The WP chemical was delivered by artillery rounds and helicopter gunships. ... These reports of possible WP chemical weapon attacks spread quickly ... hundreds of thousands of Kurds fled from these two areas". The Pentagon is in no doubt, in other words, that white phosphorus is a chemical weapon.

There are good evidence that Iraq was no threat to US whatsoever and there are also eveidence that the war against it was a conspiracy for materil gain - oil.

This a simplified version, of course.

The point I would like to make is that Iraq is dirty little colonial war and thus it shouldn't be surprising that it is fought by dirty little means.

Personally, I don't think we saw the worst yet. The longer Iraqi war drags on, the rulling US oligarchy will become more desperate and more willing to win (probably impossible) by any means necessary.

War Criminals

George Monbiot is right on the money. As he correctly points out, the war, the occupation and the attack on Fallujah and other cities are war crimes. The Americans have violated the UN Charter, Geneva Conventions, UN Convention on Torture, the UN Convention on on the Ban of Certain Conventional weapons and the UN Chemical Weapons Convention.

In addition, the Americans have violated two very important American laws, namely, the War Crimes Act which prohibits any violations of the Geneva Conventions and Article 6 of the constitution which incorporates all conventions signed by the U.S. into American law.

President Bush and his top officials have violated the above two laws and can be tried in the United States as war criminals. It is ironic that at the very same time that Saddam is being tried as a war criminal for killing 150 people, President Bush remains lily white in terms of war crimes despite the fact that he is responsible for the death of up to 100,000 Iraqis.

The whole system is a war crime

OK Saddam is on trial for using WMD's. Big deal!! The fact is THE US GOVT SOLD HIM THE WMD's TO USE ON IRAN. It was only a problem when he used them on the Kurds. They were our old pals from WW2.
Truth is OUR GOVT 'made' the enemies we now face. Bush 41 'made' Bin Ladin. Set up his 'targets' to build the 'Terrorist'
face,then turned him loose. He also ordered genocidal attacks in Central America.
So when it comes time for Saddam to swing for his alledged
crimes,his co-conspiritors must be counted also. The Govt MUST be held accountable! When they 'create' enemies and
force good men and women to die protecting nothing but the
Govt's conspiracy,THEY ARE CRIMINALS.
If we are going to end this practice we need the help of the police and the military to ARREST the conspiritors. The Pres,the NSC,the CIA and the Joint Chiefs are all guilty of crimes against humanity. The same is true for the Brits too.
They also need to clean house. The conspiracy goes deep and has been brewing for 25 years. The culmination of that plan is the extermination of the poor landowners that have below ground wealth that the 'greed machine' wants.
It's OUR TIME to make things right. As the saying goes;
If not us,then who? If not now,when?

It seems to me that it started after April Glaspie gave the green light from Bush I to take Kuwait, all the way to current day.

I found Juan Cole's "Fisking the war on terror" a great article dating many of the crimes committed by our leadership.

war has existed from the onslought of two instead of zero all present wisdom for the gathering of the dead and wounded souls who are here for what?

The main sources of info for this article come from a nameless "correspondent" and some "declassified document" that looks like something I could have made with Word Notepad.
You would think the liberals would have learned after "MEMOGATE"!
I think it's really funny how the left wing is constantly criticizing those who support the war and our President by saying we are "brainwashed" and "gullible".
Yet anytime some yahoo starts spreading some new rumor or some B.S. body count, the libbies jump all over it and protect it like it's a Madonna CD!
If you really want to read some blogs about what's going on over there, go to Frontlineblogs.com
It's a site with daily and weekly blogs by actual soldiers who are over there in Iraq and Afghanistan right now.
And here's a question for those of you who swallowed this story hook, line and sinker;
Where are all these military members who are angry and "feel duped"? Why haven't we seen them on the news? Why don't we hear from them?
Hmmmm, maybe because they only exist in the minds of the war protesters!

Losing Credibility

The more people like Monbiot spread the half-truths that WP is illegal the more they undercut their credibility. The lack of knowledge about what WP actually is, what it is used for, its historical use, and the definition of chemical weapons is laughable. Some of the stories talk about "indiscriminate" firing of mortar rounds and shows only that the reporters have no clue about how indirect fire weapons are used. It is a joke to anyone who knows anything real about the military.

The only REAL story here is if US forces deliberately targeted civilians with it. Or any other munition actually.

This is one of the more insightful and thoughtful investigations into the US use of White Phosphorus that I have encounter thus far, and I do not think I will hear much more about this issue, since the media's attention span is worse than an 8 year old's who fed his retalin to the family dog during breakfast.
I agree that these riculous perversions of the conventional use of lexicon by the military in order to justify conclusions such as, 2 + 2 = 5, need to be properly stumped upon and relegated to the level of mere nonsense. This article was a breath of fresh that I sorely needed.
