Are Contractors in War Zones Above the Law?

Numerous private civilian contractors have died in Iraq under KBR's watch, yet the firm is immune from U.S. law.

In January of 2008, Staff Sgt. Ryan Maseth, 24, was electrocuted while showering in his Baghdad barracks. His death prompted last week's congressional report concluding that defense contractor KBR, (until a year ago a subsidiary of the oil services giant Halliburton) was well aware that the electrical system in Maseth's complex was faulty. An accident like this, the report found, was bound to happen. But this report also now raises a larger and thornier question about military defense contractors: can they be held legally liable for their actions -- or inactions? Will anyone be held responsible for Maseth's death?

This is an increasingly important question as the U.S. government hires ever more military contractors to do work that used to be done by U.S. soldiers. The war in Iraq has already involved more outsourcing of military functions than any previous war in American history. An estimated 180,000 civilian contractors now work in Iraq and Afghanistan to support the U.S. government there. They do everything from guard U.S. officials and dignitaries to truck fuel, food and other supplies to military bases -- all jobs that used to be done by soldiers.

Private contractors operating in Iraq are not subject to U.S. military authority, or to U.S. or Iraqi law. Their employees are not subject to the rigors of Army basic training; and their superiors are not held to the strict rules and ethics that apply to the U.S. military. As a result, notes Peter W. Singer, a senior fellow at the Brookings Institution, in his book, "Corporate Warriors: The Rise of the Privatized Military Industry," "When the means of security are privatized, certain mechanisms of moral hazard and adverse selection might lead firms astray. Just as in the rest of commerce, war is business where nice firms do not always finish first."

Indeed, whistle-blowers at these companies run the risk of being fired. In 2007, shortly after one KBR electrician reported to a defense contracting agency official that logs were being created to make it appear that nonexistent electrical safety systems at the base were working properly, he lost his job, according to The New York Times. Another employee "said his KBR bosses mocked him for raising safety issues."

Yet, the Pentagon inspector general's interim report provided to the House Oversight Committee on July 28 said it "has not found any credible evidence that representatives from KBR were aware of imminent, life-threatening hazards" in Maseth's complex prior to his death. This is despite that fact that the Army itself had issued an urgent bulletin (pdf) in 2004 warning soldiers of the threat.

Of course, the Pentagon may have an interest in protecting its contractors. The Defense Dept. indicated, in a 2006 review, that it intends to increase its reliance on private military companies and other outsourced support services. Its handling of the death of Maseth certainly suggests that the Pentagon is defensive on the subject: the soldier's mother, Cheryl Maseth, was originally told that her son had carried an electrical appliance into the shower.

As of January, more than 1,000 private civilian contractors -- including 110 KBR employees -- had been killed in Iraq, and another 13,000 wounded. Deaths of American soldiers in battle, meanwhile, have climbed to more than 4,100. So what happens when the military contracting companies themselves are to blame for the deaths? For years now, KBR and other military contractors have argued that as a matter of law, regardless of the circumstances, they are not responsible. As government contractors, they say, just like the military, they're immune from legal suits. That's been KBR's defense in a series of cases over the past few years when the company has been accused of knowingly sending unarmed civilian employees into active combat zones -- sometimes to their deaths.

In a case I wrote about in January for The American Lawyer, KBR denied responsibility for sending an unarmed convoy of trucks down a dangerous road under active insurgent attack. In what's come to be known as the Good Friday Massacre, in April 2004, six KBR drivers were killed and 14 were wounded. One driver is still officially missing, and presumed dead.

Now KBR could be facing many such claims. According to the Defense Dept.'s own inspector general, as of July 10, there have been 16 deaths due to faulty electrical wiring on U.S. military bases that KBR was supposed to be maintaining. Companies like KBR rely on a range of legal defenses when accused of wrongdoing, but the gist is always the same: working for the U.S. military means they're beyond the authority of the U.S. courts -- therefore immune from U.S. law.

That's exactly the tack KBR appears to be taking in the case of Maseth, whose mother has sued KBR, claiming that the company knew of the danger and was responsible for fixing it, but didn't. In other words, KBR, she asserts, could have prevented her son's death.

Either KBR is responsible for maintainence or its not... If it is then it has to accept responsibility for the work that it carries out as well as the payment for doing the job. Surely you can't have one without the other.

IF poor maintainence was the reason was why the soldier died then its responsible and should face the repercussions for its actions.

So, this is what the US Dept of Labor says about injured Federal workers:

"The Federal Employees' Compensation Act (FECA) (5 U.S.C. 8101 et seq.) is administered by the Office of Workers' Compensation Programs (OWCP) of the U.S. Department of Labor. It provides compensation benefits to civilian employees of the United States for disability due to personal injury sustained while in the performance of duty or to employment-related disease. The FECA also provides for the payment of benefits to dependents if the injury or disease causes the employee's death. Benefits cannot be paid if the injury or death is caused by the willful misconduct of the employee or by the employee's intention to bring about his or her injury or death or that of another, or if intoxication (by alcohol or drugs) is the proximate cause of the injury or death."

So, are people who work for private firms with government (Pentagon) contracts covered as Federal employees? Or, has the privatization of military support (and some military functions) exempted civilians from coverage? Are the employees of KBR "contractors" themselves and therefore "self-employed"?

These are different questions from third party liability -- that is, a soldier who is injured by faulty work by a government contractor should be able to make the contractor accountable, even if he or she can't sue their military employer.

Before Cheney got his hands on the military (this time round), Gore had been re-inventing government with privatization and the use of contractors, paving the way for the vacuum in accountability. That's not to say that the clever Cheney/Halliburton didn't seize the opportunity when he/they had a chance.

WHINSEC Remains Open: Congress Narrowly Fails to Halt Funding the Former School of the Americas
On Thursday June 21, 2007 at 11:52 p.m., Congress voted on the McGovern/Lewis Amendment curtailing funds to the former School of the Americas (SOA), now known as the Western Hemisphere Institute for Security Cooperation (WHINSEC) after PR consultants suggested a name-change to improve its image. With an outcome of 214 to 203, the school survived by a slender margin of six votes, leaving the amendment defeated and the military school open. Of Democrats voting, only 42 out of 180 cast ballots to continue funding the institute, while 172 Republican Representatives voted against the measure.

According to the School of the Americas Watch (SOAW), a human rights organization and advocacy group founded in 1990 by Father Maryknoll Roy Bourgeois, “the WHINSEC PR machine and high ranking Pentagon officials used taxpayer money to put a lot of pressure on members of Congress.” Thus, Congressional representatives—who initially had committed themselves to cut funding to the WHINSEC—succumbed to these Pentagon pressures and shifted their votes.

Revelation, the last book in the New Testament, is filled with bizarre, violent and terrifying images. Its origins are unclear and its content is controversial. Some say it is the work of St John but many others believe he could not have been the author. But whoever wrote it, described apocalyptic visions of plagues, famines, wars, devils, wild beasts and rivers of blood. It is so strange and complex that scholars down the centuries have continually reinterpreted its message and meaning.

Today, though, a growing number of American evangelical Christians reckon they have cracked the code. These End Timers believe that every weird word of Revelation predicts real events. Like a Hollywood sci fi movie they say that any time now the world will end. And when it does, true believers in Christ will be whisked up to heaven in an event called The Rapture while non-believers are left behind on earth to face famine, war, terror and destruction as the forces of good and evil fight to the bitter end.

Undermining Africa

Now End Time beliefs are now spreading to Africa, with dire consequences. Uganda's President, Yoweri Museveni, is a born again Christian who is lionised by American End Timers. An American preacher in the capital, Kampala, says that the answers to Uganda's problems are not political, economic or educational, but can be found in the Bible, which he describes as 'God's constitution for the planet'.

Newspaper editor Andrew Mwenda is appalled by these Doomsday preachers, who he believes are converting young people and diverting them from fulfilling their potential and pursuing their careers. He says: 'This country is on a highway to hell.'

Uganda was a model in Africa of AIDS education and prevention and the rate of infection was falling. Now Museveni is promoting abstinence rather than safer sex, the number of cases is rising.Teacher Julius Othieno describes children being taken out of school, and not taking medicine when they are ill, in order to hasten their death.

Whoever wrote it sheltered in a cave on the Greek island of Patmos, probably a refugee from Roman occupied Palestine. He is also likely to have consumed the local hallucinogenic magic mushrooms. So rather than taking these bizarre visions literally, it might make more sense to try to understand them in their historical context.

There are some 40 apocalyptic books from this era but this was the only one that made it into the Bible. If the author was writing about the hated Roman Empire, it could be that the seven heads of the beast meant the seven emperors. The mark of the beast could be the head of the emperor on the coins. The dreaded 666 very likely represented three letters indicating the Emperor Nero – representing letters by numbers was, and is, common in Hebrew. If so, instead of being a description of a world in chaos, it could be seen as a book of morality, optimism and faith.

Let's hope the End Timers start to see it like that before their actions really do bring about the end of the world.

In their efforts to promote the "free market" this is exactly what happens! How could these firms not be held accountable, and why are they not responsible? It is unconscionable that these people are doing jobs that the military once did! This is just another example of why the fascists must go! Several years back the GAO reported that KBR had overcharged the military for services that were not performed, and yet they were still allowed to work on the contract!

We the people have allowed ourselves to be lulled into a stupor - thinking that "they" will take care of us and "they" are right. Don't let fear take hold. When these people come home, they will still be mercenaries for hire. It is time this military-industrial-complex be de-funded! It is time for accountability from both the Pentagon and the State Dept. that is "supposedly" overseeing these people.

Another perfect example of why the good ole boy network needs to be booted out of office and into jail-cells with guys named "Tiny"! Another example of why privatizing everything must stop! And when these KBR employees come back with PTSD and a whole host of mental illnesses, then what happens to society? They kill with immunity, and are free from accountability to any laws, is that the legacy that this country needs to have abroad? Is this how low we have sunk?

I don't understand how any laws can be enforced, where is the validity when our invasion was illegal, our occupation is illegal and this so called war is not even a war. It is more like a controlled police action, but call it a "war" and make it appear that the Iraqi's are really putting up one hell of a fight. Where is the justification for this USofA taking over Iraq, (size of California), and stealing all of their resources?

I imagine we are right now eyeballing other little oil rich countries that we can take over too whenever we want or when we can fabricate some bullshit story to justify invading.

THE number of Iraqis expecting to still be alive by lunchtime has risen to an all-time high, an upbeat new survey shows.

In a boost to the American-led occupation, 53% said they were confident or quite confident they would make it to the middle of the day without a major attempt on their lives.

However, the figure drops sharply for later in the day, with only 38% expecting to still be alive in time for Newsround.

Sayid al-Qutb, a shopkeeper from Baghdad, said: “Things is much improve since American Bush arrive.

“I used to fear Saddam’s men come in night, kidnap me, put bag on head, then knock down house and plough salt into ground.

“Now when family disappear, it in big boom at supermarket. That much quicker. Much less worry yes?”

He added: “Also when Americans come take me away, they make me stand on bucket with wires attached to penis, but is not plugged in, like with Saddam. It just for laughs. Much improve.

“Now we get Sky+, but not filthy-dirty channel. I watch Premier League. Manchesters United. Much, much better. Still, even with Keegan, Newcastle is being shit, yes?”

those parasites are paid a 1000$ a day for their criminal activities while an average Iraqi lives on 50$ a month.
