Will Gun-Toting Vigilante Get the Justice He Deserves?

Arizona rancher Roger Barnett became an anti-immigration icon by claiming to have detained 12,000 border-crossers. Then he terrorized a family of U.S. citizens.

Cochise County, Ariz. -- Crouching low, Ronald Morales and his 11-year-old daughter moved quietly and quickly, hoping to escape detection. Stealth was vital as they crept around the boulders and scrub brush that clutter the Sonora desert just north of the Mexican border.

It was Oct. 30, 2004. Morales, a 37-year-old Department of Defense employee, was deer hunting with his father, Arturo, and three little girls: his daughter, Vanese, who was then 11, her little sister Angelique, 9, and Emma English, a friend who was also 11. All were Mexican-Americans -- U.S. citizens since birth.

The way Ron Morales tells the story, around 4 p.m. he and his eldest daughter left the rest of the party at his truck to stalk a buck they had spotted.

Vanese had the deer in her crosshairs when the sound of a distant ruckus in the direction of the truck alarmed her father. Morales took the rifle, slung it over his shoulder, and they hurried back.

They arrived to find another truck parked near their own. Next to it, Morales says, an angry white man with a pistol strapped to his side paced back and forth, shouting obscenities. "You're fucking trespassing! You guys need to get the fuck out of here!"

"I have a hunter's permit, I have a map," Morales protested as he walked to his vehicle, set down his rifle, grabbed a Bureau of Land Management map, and tried to reason with the man.

Morales, a Navy veteran, says he addressed him as "sir" and asked his name. The man reached in the cab of his truck, yanked out an AR-15 assault rifle, and gave Morales his answer.

"My fucking name is Roger Barnett! If you don't get off my property, I'm gonna shoot you and shoot you and shoot you!"

Then, Morales says, Barnett chambered a round and pointed his weapon at Morales' chest.

The clash

Two years later, Ron Morales and Roger Barnett met again, two men sitting stoically at opposite ends of Judge James Conlogue's stark courtroom in Cochise County, which ends at the Mexican border in southeastern Arizona. Outside, November winds whipped the streets with impunity.

It was to be a momentous confrontation, probably the most dramatic yet seen between anti-immigration hard-liners and those who oppose them. Closely watched by reporters and other observers from near and far, the clash would unfold at ground zero of the increasingly virulent battle over illegal immigration.

More people trudge across this ruggedly beautiful part of Sonoran Desert, which stretches from Mexico north into Arizona, than any other section of the 2,000-mile-long border. It is here that Roger Barnett brought national attention to the immigration situation with his loud and public complaints about illegal migrants who trespass on his sprawling ranch. It is also here that Barnett, a man who boasts of having personally apprehended 12,000 border-crossers, effectively sired the entire citizen's border patrol movement -- a movement once characterized as "vigilante" by President Bush, a Texan intimately familiar with the borderlands.

A rancher since 1996, Barnett's a swaggering, silver-haired, ruddy-faced product of the desert sun whose militant reputation -- like the vigilante movement he inspired -- stretches far beyond Cochise County.

"Humans, the greatest prey on earth," Roger Barnett told a reporter from London's Independent in May of 2000, six months after he was photographed for Time magazine brandishing an M-16 -- and a full 16 months before Chris Simcox would leave his California kindergarten classroom to form the Arizona militia that would eventually become the Minutemen, now the best-known citizen group to carry weapons to the border in an effort to halt illegal immigration.

"A vigilante goes out, rounds up people, holds a trial and executes them. I haven't done that yet," Barnett told USA Today that same year. "But bloodshed could happen."

Failure to prosecute

While there's no hard evidence Barnett has drawn blood, reports of Barnett and his brother Donald holding illegal immigrants at gunpoint, chasing them on ATVs, and using their dogs to intimidate and attack, have trickled into the Cochise County Sheriff's Office for years. Four months before the Morales incident, for instance, a group of immigrants reported that Barnett held them at gunpoint, yanked a woman by her hair and stuck a pistol in her ribs. Another member of the group said the rancher threw him over the front rack of his ATV and sicced a dog on them.

Yet Cochise County Attorney Ed Rheinheimer has repeatedly declined to file criminal charges against the wealthy, gun-toting rancher, stating that Barnett is well within his rights to use the threat of deadly force to prevent or terminate a criminal trespass. "We try to avoid getting caught in the middle of political issues," Rheinheimer said. "If Roger Barnett crosses the line and we get a prosecutable case, we won't hesitate to prosecute him." Even if that's true, the local atmosphere is hardly conducive to such a prosecution.

The government enforcing the law. America is not Mexico’s welfare program.

Imagine the audacity of Barnett using “words no children should here” when people are on his property with a rifle for the second time.

What is it about trespassing that the author here doesn't understand? Look it up in the dictionary. Without private property rights, there are effectively no individual rights. Ask the people of Eastern Europe about "collective" farms and other forms of "social" property.

Barnett is an obvious asshole. He could have asked for ID,he could have called the police.
There has to be an easier way for people who want to work in the US to come here.
American enjoys the fruits of this cheap labour.
Unless you are a native American your family came here at some point.
Immigration to areas with more resources have always gone on.
It will not stop. It is as stupid as trying to make prostitution or drugs illegal; the situation becomes worse for all concerned.
If I pulled a gun on someone tresspassing on my land i would rightfully go to jail.
If Americans help improve the situation in mexico there will be less immigration ,legal and otherwise.
Corruption,especially involving drugs is a big problem in Mexico(as it is everywhere) so it would improve things greatly were drug prohibition ended.
The US should also stop influencing elections in mexico to favor politicians who are more concerned with being pro-US business then helping solve the peoples problems.

Attacking one's own ancestors. A particular individual donning the mask of Law and re-presenting it is law-less, and an extremely dangerous political, economic, social and cultural act, regardless of the pre-text.

Am I mistaken or did the article state 1) these are American citizens, 2) they were not on "his" land at the time they were on public land; they only had to cross his land previously.

Secondly, I assume, like many large ranchers, the government lease is for cattle grazing. I'm no lawyer and I certainly don't know anything about the ins and outs of lease law, but civility seems to be absent here.

Third, I know you city folks, and you who can't imagine that a family might supplement their diet with the occassional deer by HUNTING one -- as opposed to putting cattle through a slaughter house which is terrifying to the animal and cruel besides -- think that the Morales' are evil for teaching their daughters how to hunt. No, it is NOT traumatizing to kill the food that you eat. You want trauma, go check out the slaughter houses that provide you with your beef.

I am sick to death of people calling for rights for the ILLEGAL ALIEN INVADERS. They have no rights. They are invading our country. They do not belong here. Let them enter the country legally like everyone else, and let them become Americans the right way.

I suspect the case will be appealed and I suspect Mr. Barnett will win on appeal. Although Mr. Morales wasn't an illegal alien, he and his party were armed trespassers whom according to testimony were belligerent at best. Calling Mr. Barnett's legal and authorized AR-15 an M16 was just another attempt at making Mr. Barnett intimidating.

This article was so biased and incredibly slanted. I could identify such blatant key words and phrases that were designed to twist the entire story and make a law-abiding rancher appear to be a monster. Well, let me tell you something, this kind of trash falls on deaf ears in 2007. "We're mad as hell and we're not going to take it any more."

These are not "immigrants" they are at best illegal invaders, and Mr. Barnett is doing what the government won't do. Mr. Barnett has the right and obligation to defend his land, his country, and when confronting armed trespasses he acted accordingly.

You traitors who believe we should simply open the borders and let them in won't live to see the day when the United States of America is destroyed but your children might. There will be a special place in hell for you, if there is "any justice". These illegal invaders are really a fifth column, slowly but surely taking over our country. They are using our own laws against us when they have their anchor babies and this has got to stop.

I live in New Mexico and people like Mr. Barnett are under seige on their own land by hordes of infiltrators bringing in the worst third world scum, tons of illegal drugs and most likely even terrorists who are planning attacks on our country.

Most of us living near the border carry semi-auto AK-47's, AR-15's and have to live under the threat of attack at any time on our own property. People who don't live out here do not understand, but the day will come when you will wish you had.

It's very telling that the SPLC is now getting involved in these cases and people should really be asking why this is happening. What is their real agenda?

Nice work if you can find it. Go hunting, trespass over private property, have your young daughters testify and collect.

Why does the BLM issue permits for hunting on land that can only be accessed by trespassing? For that matter, why would they enter into leases that leave unleased sections of public land as inaccessible islands?

I have mixed feelings about the case described in the article, but what about this other "property rights" issue: BLM is giving away the commons.

If you haven't seen it, go and see it. I'd like to see that rich spoiled rancher, with his government-sponsored land leases, try and walk across the Sonoran desert so that he could make a few more dollars. He probably sells his cattle to the very same slaughterhouses that employ the illegal immigrants he complains about - what a hypocrite.

This is pretty common behavior, though - wealthy ranchers in bed with local politicians - he's probably good friends with the DA, which is why the DA won't file charges. Everywhere across the American West, you find cattle ranchers in bed with local government.

What's just ridiculous is that the very right-wing political machine that this rancher supports are the ones responsible for the rapid rise in immigration - their trade rules have resulted in thousands of Mexican farmers losing their land due to subsidized corn imports from the US, and then it's either work in a sweatshop for pennies or sneak over the border to do the dirtiest jobs in the US. Does this guy even understand what's going on?

That's what's causing immigrants to enter illegally. How many more of these lost folks does America have to keep blindly generating until they realize that it's time to shut the doors on reckless wars for resources and "free" trade? You can only maintain your property rights for so long as long as you turn a blind eye on the real culprits being "free" trade and reckless foreign policies.

People go after illegal immigration because it is the only outlet for a much greater problem: The quality of life in this country will diminish with every rise in the population, and it dosn't matter if that rise come from legal or illegal immigration, migration from other states or a native woman giving birth to three or more childrten. America currently has 300 million people, and by the time it reaches 400 million it will be a disgusting shithole!

However, solving the problem is anything but simple.

How do that is way above my pay grade, but this much I do know. Strapping on a sidearm and hunting down harmless men, women and children who are trying to better their lives is not the answer.

While freedom-loving Americans try to arrive at a humanistic solution to the Mexican migration problem, bullying, gun-toting cowards like Roger “No-balls” Barnett should be spend time picking strawberries where I live in Southern Californian as an underpaid stoop laborer.

Reconquesta! HAHAHA. What happens if Mexicans do become the majority in some places? Corporations will still control everything. Whites and Asians will still make up the skilled white collar labor. When the locusts devour everything they came to this country for in the first place where will they go? Canada? Weren’t the proposing that people applying for citizenship hold at least a 4 year degree? How many tomato pickers do you think will qualify?

While Roger Barnett sounds like a world-class asshole, if indeed the Morales party were on his private property uninvited (it's not entirely clear to me from the article if they were), then it seems to me that he was well within his legal rights to order them off at gunpoint -- especially if they were also carrying firearms.

He may have acted like a dickhead, but that doesn't mean he committed a crime.

by the illegals. Like the endemic drunk driving accidents, the rapes, the murders, the drug crimes, and even the serial killings (they do mention the serial killings in Mexico but not when they cross the border into the US.) It is odd double-standard but understandable considering the corporate demand for unfettered immigration so as to destroy the American middle-class and have a new level of near-slaves to exploit.

Your idolatrous worship of the English Race has led you to claim that the Irish, then the Italian and Polish immigrants, and now the Mexican immigrants, are a part of a Catholic Plot to take America and turn it over to the Pope.

Your claim to the land is made because the United States Army took it at gunpoint from people who have lived here much longer than you. And those who did not submit and lick your jackboots were MURDERED by that same government.

never EARNED the rights to this land.

Because of my Native Ancestry, I am sometimes harassed by the Border Patrol just for "looking Mexican" and now, it seems, I would have to contend with a somewhat less official RACIST MOB for the same "offense".

It's a lose-lose situation. These illegals come here, reproduce like rabbits, siphoning off more of the resources paid by hard-working Americans.
Their anchor babies have no loyalty to US. Soon we'll be a minority.

How can liberals stand for this crap? On one hand you liberals don't want to fight the moslems who are a threat to us and Israelis, and on the other hand you want to let all these illegals come over here from dirt-poor countries with no notion of rule of law.

Personally, I'm saving my duckets to get the hell outta Dodge. The race wars are comin' and I don't want any part of 'em, especially since there are just SO MANY whites with guns and cops to back 'em up!

Doesn't matter who came to the Americas first. Numbers, guns, steel, and GERMS count.

I do not know the solution for the illegal immigration problem. But if I may add to the mix of thoughts and comments we must all remember that Reagan started all of thius when he refused to enforce american immigration laws because he wanted illegals to work for cheap which benefits only US corporations. So once more the republican party has done us all in.
We need international labor unions. Until that time comes this kind of immigration problem will continue.
As far as the Irish are concerned, I am 63yrs old and can easily remember when the supposedly superior Irish were putting down my Italian family members in jobs and on the streets. My dad is 91 and can very clearly remember the fact that if you were Irish you got the jobs and if you were not it was just tough shit and your damned. The Irish have nothing to brag about.
Next we must remember the vicious Irish like Bill O'Reilly, Sean Hannity, Chris Matthews, Tim Russert(so totally self satisfied) Peggy Noonan, William Donohue, Tom Monoghan, et.al. Quite frankly I am sick of Irish Catholic Republicans and what they are doing to America and the entire world. Jesus taught love and all we get from these people is hate and/or intolerance, beginning with Reagan; his father was an Irish catholic drunk. We have Reagan to thank for the deaths of Sr. Dorothy Kazel and her companions as well as the rape and torture of Sr. Dianna Ortiz. So much for Reagan and the entire Bush family of criminals and their complicity with the catholic church which still regards women as second class citizens.
Add that to the mix.
