After Alito: What Now?

"It was a good week for Republicans," chuckled New York Times' house conservative David Brooks with a shit-eating grin, as he welcomed the likely confirmation of Judge Samuel Alito Jr. on Friday's "News Hour." His "liberal" debate partner, Mark Shields, was there to agree in yet another PBS program cleaving to the right while giving the appearance of being in the center.

The judge handled himself well, Brooks noted; he was not the angry ideologue pictured by the Democrats. Shields concurred, expressing admiration for his "judicial temperament."

And so, in media outlet after media outlet, yet another administration-supporting consensus was reached, in part, because of the way the media framed the story.

They had bought and sold the pre-hearing hype that this would be the ultimate ideological "showdown." When Alito was left standing -- after what was (falsely) pictured as his race through a gauntlet -- he was proclaimed the winner.

The Democrats Were Predictable

The Democrats were predictable in baiting Alito and trying to use comments he made in the 1980s, as well as his dense judicial record, against him. Like many generals, they were fighting the last war against court nominee Robert Bork, who took on his attackers, but whose arrogance and argumentative approach eventually did him in.

When Bork himself was asked to comment on Alito's well-choreographed but evasive performance, he said, "The object nowadays is to get confirmed. People will say pretty much [anything] -- or avoid saying pretty much anything in order to get confirmed."

Didn't the Dems realize Republicans would anticipate their knee-jerk approach, and then neutralize this dated and poorly executed confrontation strategy? Why weren't they on alert for dirty tricks, like the phony crying spell by Alito's wife, which was publicized by the same firm that promoted the Kerry-smearing Swift Boat veterans?

Weren't they aware that Alito would be well-coached (including by Sen. Graham, a member of their own committee), trained not to play to type and to conceal more than reveal? He followed the lead of Judge Roberts by saying as little as possible and acting as thoughtful and reasonable as he could.

What Republicans and their legions of spinners understood -- and Democrats do not -- is that the hearings are not so much about issues, but impressions; not about politics, but personalities; not about reality, but perception.

A Media Exercise

The hearings are a show-and-tell exercise put on for the media and through the media; they have become exercises of calculated denial and avoidance.

"Senate hearings on Supreme Court nominees are close to the point of having no point," says Martin Flaherty, a professor of constitutional law and history at Fordham Law School. "The nominees say nothing, and the Senate doesn't make them say anything. It was evident in the Roberts hearings [for chief justice], but is reaching absurd levels with Alito."

Writing in the Baltimore Sun, Stephen Kiehl and Abigail Tucker proclaimed the GOP strategy "practicing the art of saying little."

"Alito has been practicing, with varying degrees of success, the art of the nonanswer answer," Kiehl and Tucker explained. "Employed by politicians, business executives and others facing public scrutiny, the nonanswer has become particularly routine to those seeking judicial confirmation since 1987."

Despite this reality, many bloggers and other lefties urged the senators to focus on the details and play it tough (but not necessarily smart). They were peeved when the senators didn't crucify him. Being hostile and aggressive on small points can only be effective when you also recognize how the nature of the game has changed.

What can we do besides bitching at the Democrats?

I have no idea how anyone could get these judicial candidates to say anything important. Like Bush they say nothing important. The article does say getting mad at democrats does not do any good and I agree. There were even articles in the Houston Chronicle that stressed the rule of unity and the danger of an imperial presidency. They usually do not even cover anything but the far right point of view. There has to be a better way. I am getting where I am so tired of everyone blaming those elected democrats for not trying harder. It makes me feel like just giving up and since there is never any good news or good ideas, just the bitching. Most people just turn off when everything sounds like s**t everyday where ever you turn. I do not get off on bitching, as it never solves anything.

Senate Democrats ought to be embarassed that they (and we) got Swift Boated again. Imagine people feeling sorry for poor Mrs. Alito rather than the scores of minorities and women whose cases have been rejected by the judge. This is not just a temporary political loss, as Senator Reid seems to be signalling, but what could be the straw that breaks the back of our democracy. Scalia, Thomas, Roberts and Alito will have the power to change the law as we know it. I say call in every communications expert we can find to make that clear to the American people—and the media.

won't cut it, and fails to take into account the ones most likely to defeat Alito.

Not the liberal left, but the libertarian and conservative right, who see Alito's vision of an all-powerful president as counter-constitutional, and dangerous to all democratic republics. The few "swing" votes needed to defeat Alito must be gotten from Red States, not Blue ones.

Those are the votes which need our attention if we are to defeat Alito. Make certain that enough votes from the "rights/right" are "nays" to acccount for a "Lieberman" or other Dem "no-show-apologists".

It is time to make those from both parties who call themselves patriotic protectors of our constitution and bill of rights to stand up and be counted by their vote against Alito.

We are going to have an Imperial Presidency and this will be the final hammer on this Constitutional Republic. I have tried to tell everyone that we don't have time for small long term stuff as solutions to our problems if we wanted to stop this. Even posters here who know full well what is going on were suggesting solutions that ignored the urgency of the situation. You can not solve a problem through a system that is eroding, crumblings and disappearing. Now we will find that out first hand shortly. I suspect we will see it fully by election time, or at least what would have been the scheduled election time.

Soon, the options we have will be few as will the real dissidents who promote REAL change. As in Nazi Germany they will soon disappear under any number of laws passed for just such eventuality.

250 years of the greatest experiment in freedom is now a fading memory. As for the Dems, well, what can anyone say, the whole congress consists of either weak kneed pathetic reps or flat out greedy corrupt crooks. In either case the end result is the same.

Lets all move to Vermont, join their seccession from the union and form our own country based on the Constitution with a recall feature in it for anyone trying to install an imperial Presidency.

Think of the irony of all of this. An unelected President placed in office by corruption, is now going to be the first royal in American history. And did we get someone with compassion, conscience, integrity???? NO, we got a psychopath. OH, my its almost too funny!

How can anyone be surprised that the media monopoly supports the corporatocracy? How can anyone be surprised that PBS is afraid of losing its government funding? How can anyone be surprised that the Democrats, who are financed by the same good folks who finance the Republicans more generously, roll over and play dead? Anyone who expects the Republican Lite Democrats to represent the working class is living in the past. It is painful to admit that our government is not controlled by the citizens but the evidence is clear. Ask yourself, "When was the last time I voted FOR a candidate rather than voting AGAINST his opponent?". Voting for the lesser evil out of fear of the alternative has become a way of life. .... you can do. Everyone get on the phone to your Senators and tell them to support a fillibuster and keep the man off the Supreme Court now. If they ignore you NOW when its election time, then they will ignore you using his system, that will end that and we can move on to what will work.

Here are some suggestions we can each do........

1. Pull your accounts from national banks as they support the war with their deposits. They lend to multinational corporations including drug companies that are poisoning children.

2. Form LLC's and corporations for your income. Take advantage of the system set up for the elite. They can'T discriminate and you can have your checks for your pay made out to your corporations and pay yourself dividends. You also can write off deductions when you file taxes on your LLC that you can't do as an individual wage earner .
(remember the tax breaks were on dividends). Also, its virtuallly impossible to track the owner of the stock through state public records as I found out. LOL That way your checking account and all banking records are in the name of the LLC and you have protected your right to privacy and anonymity.

3. Mess with the system when they ask for your social security number (for nonmonetary purposes) mess up their data base, give them your LLC tax id number. That is a lot of fun. Give your name backwards, middle name first, last name in the middle etc.
Remember, garbage in, garbage out. This data base they are developing on us only works if we cooperate.

4. Refuse to sign up for the National ID. Take a stand and take it here.
When you do renew your drivers license and they tell you not to smile, smile really big and keep on doing it until the clerk just gets frustrated and does your pic with the smile, why???? Because a digital copy of your photo will be taken and put in the data base and a smile distorts the shape of your face. It messes up the recorded picture, I love this one. SMILE, SMILE, SMILE!!!! There is much more if anyone is interested.

If you refuse to do anything that messes with the system than you are part of the system and accept it and own it. I say its the beginning. None of this can work for them if we don't cooperate. CIVIL DISOBEDIENCE IS THE ONLY THING LEFT WE CAN DO AND IT WILL TAKE COURAGE, DO YOU HAVE IT?????

I offer a new hope, even if it means following a disastrous course: Surely Bush (and policies and followers) will be defeated the next election, andl hopefully a Democrat (or some form of true Liberal) will be elected. Then with him (or her) as the new king, they can change the rules, fire the members of the Supreme Court and appoint all yes-men...much like Bush is doing now!

See the danger here??? The system is broken, lets fix it with action, not just words. I have asked for others to provide ideas outside the box and am more than willing to listen. I have provided some of my own and I think we should all start to THINK DIFFERENTLY.

Its hard I know. There is a little thing called "cognitive dissonance" and its when your internal reality doesn't match your external reality. We know "intellectually" that weird things are happening, but internally we see the system as working when its not. So we come up with solutions that are geared toward the internal reality rather than the external reality. ITs why I have been so frustrated. Even like minded people can't agree because of that cognitive dissonance.

We are coming into uncharted waters like no one before us. We are the generation who will make or break this nation and we have an incredible burden placed upon us like no generation before us. The question is, "are we up to it"?

I think we are. We just have to dig down VERY DEEP and pull up our genetic pioneer, freedom loving, courageous spirit and let it lose and take the risks and see this as a great opportunity and adventure. Is it fearful? Yes, and it should be. We don't know what any action we take will bring to us and our families. THIS IS WHERE COURAGE is discovered. Do we have it??? If your worried about your loved ones, let me assure you, nothing is worse than what is coming down for them in the next few years. NOTHING!!!! If we don't do something now, they will be the lost ones. Rent 1984 and you will see what is in store for your children if you don't GET THIS NOW. We will lay the foundation for their future that could result in slavery of unprecedented horrors. Lets fight back while we still can.

LETS ROCK AND ROLL!!!!!

The GOP is doing poorly in polls and candidates are looking to distance themselves from Bush. This is the first "good week" they've had in a long time, as poor David Brooks can say.

I was on the Dem. blog last night. They use it like a chat room. And God forbid, that they should be asked to post anything current, relevant, or about change, or holding the Party accountable!
I triede a post about Alito, on the open-thread...questions like: Does anyone know what a Unitarian Executive is?
Why according to a statement made by Durbin, was any questioning of Alito's membership in the Federalist Society 'off-limits'? (One person responded the Federalist Society is like a think-tank).
Why is Bush pushing so hard, to get Alito confirmed? The Supreme Court doesn't reconvine till the end of Feb.? (Could it have anything to do with getting Alito confirmed Before, Conyers Censure Bill, and the Senate investigation into Illegal wiretap?

I'm going to use things like what the National Bar Assoc. said, that this is the first time in 40 years, the Sierra Club has opposed a nominee, and the American Assoc. of University Women, have a writting campaign going on against him. You probable know about the Campus Progressives.

All of these solutions will prove futile. The fate of the Republic is really in the hands of the most corrupt congress in history. Anybody remember knee-capping that took place in Europe some years ago? Think about it. Desperate times require desperate measures.

Common people getting wise, it is the only threat to their comfy reality. The consolidation of power is complete now. So the fear of the middle class has been addressed. Consolidation of wealth, ownership of mass media, and control of the election process through religion has given the upper crust the impetus it needed to proceed at an even more rapid pace toward a system that exploits the mass's and gives the new plutocracy world domination dreams.
Unless we educate and try to show those that have bought the talking heads lies that we are all going to be better off someday that that someday will never come, and that The only thing that is going to trickle down is misery and despair for the proletarians of the new world plutocracy.
Yes they fear us because if the common man ever figures out that we are letting them do this to us and we rise up and do something about it we could stop what is going on and put this nation back on a course that all the people of the world would willingly follow.

We can not really blame the DEMS for this as they are so low on the power p[ole they ccould not even light a 12 volt nite lite. The Media has put in these fools and continue to mis-lead and false report everything for the Neocons and Bush. They are the Asses of EVIL. The Media, The Congress and The Executive branch. They are in control and seek power and more control. They want Dictatorship as they can put the words in the Puppet Bush's mouth. So I look at it this way. We need to ensure they destroy Our nation, civil rights, The Bill of Rights and the Constitution. The whom have backed these Fascists will start singing a different tune when they wake up and see they voted for this. The outrage will be our way to take back our country in the Media and the Political ways that will ensure that the nation will never ever see these type of Thugs and Cons ever regain a foothold in our country again. It is importantant that we just not get them to quit and to profit and re-organize. We must Ensure that All from the TOP as such Bush, Cheney and Company, The Congress that is so bought and paid for. The Corporate Elitest that are run amuk in Control of people and the Govt. We need to ensurte that THEY WILL DO PRISON TIME for THEIR CRIMES. With the Executive Branch in front of the WORLD TRIBUNAL in NUREMBERG and to face the same fate as their NAZI Heroes whom they have replaced as the Worlds Evil Ones. Then all the others that hurt the People and Citizens in The USA to do their time in a Nice Federal Prison like Gitmo whom they say is such a great place. They will all look so cute in their orange jump suits. We must not let them walk away with a hand slap. We need to kick them squarely in the ass. The people here are slow and more centered on their own ways and as long as they donot feel the bite of the rabid dogs they will do nothing. So we must let these animals run the gauntlet and as they continue it will close in on them. Let us Encourage them to keep breaking the laws and ruination of our nation. The healing will be quicker and easier as we will never will have to deal with them again. Let them Hang themselves for good!

Long before other European countries, Poland had a history of literacy and of "democracy" insofar as this concept was understood centuries ago. Subsequently it was stongly influenced by the principles of the American Revolution which inspired Poland's constitution, only the 2nd written constitution in the world. Yet within a lifetime of that constitution, Poland was being divided between its neighbors until it no longer existed.

Why? The people in power were so concerned about keeping power and control in their own hands and siphoning the wealth of the country to themselves that they sabotaged not only their constitution, their history of freedom and fairness for all its citizens, but also the very existence of their country. Poland not only disappeared, but attempts were made, by those who swallowed up sections of that country, to wipe out its history, its culture, its language, its religion.

There is a lesson to be learned here. Any country can lose everything unless the constitution and the rights of its citizens are respected and protected, not only by the citizens, but also those in power.

The hearings?! Hell, this is what the whole damn political process is about these days! Why can't the Democrats see that? Or is it that they know full well, but will do nothing that might spill their own gravy?

To paraphrase another...phrase, congressional committees would confirm a ham sandwich. The outcome was a foregone conclusion from the get-go, and all the stuffed-shirt postering by the Dems was just eye- and earwash for the American people (that is, those who could stand to tune in). After all, what really runs the country? MONEY! And nobody in Congress – real or faux Republicans or Democrats (Republicrats? Democans?) – wants to bite the hand that feeds them: corporations. Until the american people realize that – and that what they think is real is really propaganda by those same corporations – they will continue to voice their support out of one end while being screwed in the other. I'm not holding my breath for that epiphany; I'm buying stock in Vaseline.

Stock in vaseline does seem like a sensible plan of action - all others seemed to have failed. The pathetic showing the dems made at Alito's confirmation hearing leaves no doubt that we have only a shell of a democracy left. Until folks wise up and actively begin to participate even semi-intelligently in the political process, we are all screwed. Hope we all last that long....Dubya and cronies apparently are intent on destroying everything and everyone even vaguely different from themselves.

If we had a 'real' free press in this country instead of this fountain of disinformation that passes for one,BUSH WOULD'NT HAVE GOTTEN IN. That's the whole of it. Our oress,far from keeping us informed on the things we need to know as a People,to keep the crooks out,supports them. That's TYRANNY. Govt controlled by the rich,the press supporting their efforts,being backed by Police and Military is
TYRANNY. Liberty's tree is being hewn into sawdust. For it to be strong and bear fruit we MUST remove these anathmas to Freedom and restore Liberty to the People.
Al Gore isn't going to do it. He left a black sharecropper woman live in a hovel until the press made something out of it. Neither will any 'progressive' repub. The only thing that will
make a difdfrence will be Govt. run by the People. Not one that runs over the People

IS anyone else bother by this comment, they are selecting a man for a lifetime appoint to the highest court in the land. Supreme Court cases are decided on consitutional principals and in depth questioning of legal philosophy is more then called for. The hearings are not for the benefit of the general public, but for the Senate who is about to vote on the appointment.

If the media covers the hearings they should have a expert break down the argument for the lay person.

I felt that the real issues in the Alito confirmation hearings-aside from the far right's lock on the US Supreme Court-were abortion and reproductive rights, the imperial presidency and unchecked executive authority, and civil rights. This is especially crucial in times of a vague, amorphous "war on terror" which, as Michael Moore states, "isn't actually meant to be won but only to continue indefinitely thus providing justification for the manipulation of people out of fear for dubious causes." Alito's evasiveness on his 1985 statement on Abortion was chilling. One can hardly imagine a return to the old days of back alley suffering of poor women as the wealthy are quietly trucked off to secret offshore locales for treatment. The three issues are disturbingly interwoven. History shows that in the run-up to fascism, a reassertion of male perogative and a strengthening of the patriarchal nuclear family suddenly occurs on a massive national scale. The bashing of gays, single-parent households, and any other non-conformist social unit precipitates a burst of traditionalist frenzy designed to narrow social perspective in favor of the far right and create a fearful and prejudiced atmosphere where only rightist agenda can survive and remain politically feasible. Afterward repression intensifies and civil liberties once taken for granted are now increasingly viewed as a decadent extravegance. The fear generated by post 9-11 terrorism enables this horrific scenario! Judge Alito is an extremist with little regard for stare decisis, civil rights, democracy, or the check on executive power through the balance provided by popular institutions like congress. He has always ruled for "big power" even when they've broken the law repeatedly (the ruling favoring a big chemical company with 144 counts of violating the 1972 Clean Water Act) and against the civil rights of the individual (the strip search of a ten year old girl despite the fact that she was not named in the search warrent for law enforcement's search of the premises) and favors an unlimited scope of power for an executive run amok with its legal latitude for manuevre. We are clearly all in great danger of losing our freedom. Never mind the "terrorists", the bell tolls for thee!

So David Brooks thinks it was a good week for Republicans.
The reality is it was bad week for the country, a bad week for democracy, a bad week for civil rights, and the harm will be bipartisan. Will we extricate ourselves from this incredible mess? Don't count on it. Think about the future of your kids and your grandkids and you'll get sick to your stomach. Three more years with no one, literally no one, to stop him.

Many feel the democrats did not question tough enough, and many feel short changed as Alito got away sort of lightly battered,but they knew what they were doing, and Alito just sidestepped everything and played Judge Roberts roles as sort of the "umpire", well every umpire has a favorite team.

I have racked my brain to figure out what is going on with Bush,Cheney,Rummy &Co and I think I've finally got it. They are severely affected with the mental disorder called megalomania.

1. A mania for grandiose or extravagant things or actions.
2. A mental disorder characterized by delusions of grandeur.

In getting Alito confirmed, they will have the perfect rubber stamp for their craziness in the Supreme Court. Do we really want to have the world's only superpower in the hands of crazy people? Just say NO to megalomania everybody!!

Danny - Say Alito Isn't So!

As so often happens Danny Schechter the Media Dissector cuts to the chase on Alito.

Alito's success is the media's failure. That's absolutely true, although I hope the editors at Alternet were right when they declared it not to late to stop the nominee.

The ideological battle over abortion will no doubt polarize America during an election year. That was the issue that boosted Alito's cause. His twisted take on the role of the President as a "unitary executive" got little or no air time as the media denied us our rights to be informed in a democratic society. I wonder how Americans might poll on the simple question: Do you think Alito's theory of the "unitary executive" is right, wrong, or dangerous?

CNN's Sunday Morning 1/22/06 issued an opening salvo in the media blitzkrig that is sure to come over abortion now. They aired a segment on a protest in California by anti-abortion activists. Thousands of anti abortion activists turned out in the streets to protest abortion in California, was how they began. As the copy about this big protest was read, there was no footage shown of the crowd that had actually protested. Instead, the "news" team showed a logo type drawing of what might have been an anti-abortion group's news release as the news about the demo was read.

I'd love to hear the Media Dissector talk about the possible meaning of that segment and discuss his thoughts on what we might be in for in terms of a media blitz on the abortion issue.
