Obama Is Keeping Bush's Worst "War on Terror" Policies Firmly In Place

Thanks to behind-the-scenes maneuvering by the Obama administration, a bipartisan majority has approved legislation that seems to abandon hope of reining in the Patriot Act.

We know the rules by now, the strange conventions and stilted Kabuki scripts that govern our cartoon facsimile of a national security debate. The Obama administration makes vague, reassuring noises about constraining executive power and protecting civil liberties, but then merrily adopts whatever appalling policy George W. Bush put in place. Conservatives hit the panic button on the right-wing noise machine anyway, keeping the delicate ecosystem in balance by creating the false impression that something has changed. We've watched the formula play out with Guantánamo Bay, torture prosecutions and the invocation of "state secrets." We appear to be on the verge of doing the same with national security surveillance.

Last week, the Senate Judiciary Committee seemed to abandon hope of bringing any real change to the Patriot Act. A lopsided and depressingly bipartisan majority approved legislation that would reauthorize a series of expanded surveillance powers set to expire at the end of the year. Several senators had proposed that reauthorization be wedded to safeguards designed to protect the privacy of innocent Americans from indiscriminate data dragnets -- but behind-the-scenes maneuvering by the Obama administration ensured that even the most modest of these were stripped from the final bill now being sent to the full Senate.

In September the Senate got off to a promising start. Only three provisions are actually slated for "sunset" this year: "lone wolf" authority to wiretap terror suspects unconnected with any foreign terror group; "roving" wiretaps that can follow a suspect across an indefinite number of phone lines and Internet accounts; and "Section 215" orders that can be used to compel third parties to turn over any "tangible thing" investigators believe may be relevant to a terrorism investigation. Yet several Democrats had signaled a desire to use the renewal process to undertake a much broader review of the post-9/11 surveillance architecture, including National Security Letters (NSLs) -- a controversial tool that permits the mass acquisition of financial and telecommunications records without court order -- and last year's sweeping amendments to the Foreign Intelligence Surveillance Act (FISA), which permit the executive branch to authorize broad interception of Americans' international communications with minimal court oversight. Democratic Senator Russ Feingold proposed an ambitious and comprehensive reform bill called the JUSTICE Act -- which still would have reauthorized roving wiretaps and 215 orders -- while Democratic Senator Patrick Leahy offered a more modest bill that nevertheless sought to narrow the nearly unlimited scope of NSLs and Section 215.

The renewal of the expiring provisions was always a fait accompli, though Fox News and some conservative columnists falsely claimed that Democrats were scheming to eliminate them entirely. Feingold had recommended permitting the as-yet-unused "lone wolf" provision to lapse, but at hearings on renewal last month Democratic Senator Sheldon Whitehouse didn't believe there was "any doubt" about the reapproval of all three. Rather, Whitehouse explained, the question was whether any "further refinements" might be needed to check potential abuses.

In public, the administration declared its openness to such "modifications." As well one might expect, considering that President Obama himself had co- sponsored legislation in 2005 containing many of the very same safeguards now in Feingold's bill. Even when, during the campaign, Obama had disappointed many of his supporters by voting for the very FISA Amendments Act he pledged to filibuster, he reassured them that as president he would revisit that "imperfect" bill. Civil libertarians understood that the more limited Leahy bill would provide the template for reform but had reason to hope some of the key provisions of Feingold's JUSTICE Act might be incorporated during markup.

The NSA has sought the power to data mine average Americans for years and when 9/11 occurred they leaped at the opportunity to finally have their way.

Here are excerpts from a 2006 USAToday article describing the highly secret program:

"The National Security Agency has been secretly collecting the phone call records of tens of millions of Americans, using data provided by AT&T, Verizon and BellSouth, people with direct knowledge of the arrangement told USA TODAY.

The NSA program reaches into homes and businesses across the nation by amassing information about the calls of ordinary Americans — most of whom aren't suspected of any crime..."

"It's the largest database ever assembled in the world," said one person, who, like the others who agreed to talk about the NSA's activities, declined to be identified by name or affiliation. The agency's goal is "to create a database of every call ever made" within the nation's borders, this person added.

For the customers of these companies, it means that the government has detailed records of calls they made — across town or across the country — to family members, co-workers, business contacts and others."

How does this differ from "Big Brother is watching"? This is frightening on so many levels.

For years the FBI, for instance, ran a shadow government under J. Edgar Hoover based upon his ability to blackmail anyone who got in his way.

During his tenure, for example, Hoover tried to harass then blackmail Martin Luther King into abandoning his work on civil rights.

In the ensuing decades the FBI would target environmental activists and anti-war protesters with illegal surveillance, harassment and state terrorism, examples of which I will post separately.

In April of 2008, Amy Goodman interviewed Eric Lichtblau from the NYTimes, who with James Risen first broke the warrantless wiretapping scandal, talking about how the FBI had something like 250 dosiers on as many peaceful anti-war groups. Apparently Der Fuhrer Dick Cheney, following 9/11, instructed all agencies to adopt the attitude that anyone who so much as speaks out against the war is to be considered a potential threat! Further, all aspects of civil society were to be thrown together, watch lists of who is riding what flight to what destination, watch lists and photos of students or anyone else engaging in social activities not deemed desirable by the fascist-in-chief - whatever, there were no limits.

And do not forget the strongarm tactics used during this time period against peaceful protests from New York to Miami, not necessarily even related to protesting the war - use of undercover police and FBI to infiltrate all manner of lawful civil groups and to physically go after them with the intent of disrupting their efforts to peacefully assemble - efforts including mass false arrest, herding protesters into remote fenced-in "camps" out of sight of targeted events, physically blocking access to publicized meeting places with road blocks, targeting and arresting leaders, firing on crowds with rubber bullets and beating people with battons without provocation, spraying pepper spray in the eyes of people who were already in custody under restraint, throwing tear gas canisters into first aid station tents, and so on.

Do we really want these thugs keeping dossiers on every aspect of our lives?

State Terrorism: Environmentalists are considered "terrorists"

Here is an excerpt from an account of the FBI campaign against Earth First! activists by Karen Pickett:

"Thursday, May 24, 1990, is fresh in my memory. Shortly after noon, a pipe bomb exploded in Earth First! activist Judi Bari’s car as she drove through Oakland, California, with Darryl Cherney. They were organizing for Redwood Summer: a season-long campaign modeled after the 1960s civil rights campaign Mississippi Freedom Summer. We hoped to build a resistance that could stand up to the corporate timber beast and rising animosity toward forest activists.

Everything changed the moment the bomb went off. The explosion nearly killed Judi, leaving her disabled for the rest of her life. The time-delayed, motion-triggered, nail-studded bomb was meant to kill her. Within minutes of the explosion, the FBI and Oakland Police Department (OPD) were on the scene, branding Judi and Darryl as terrorists and Earth First! as a known terrorist organization. Within hours and in defiance of all evidence, the cops arrested Judi and Darryl, claiming they were knowingly transporting the bomb.

The bombing followed months of COINTELPRO-style [the FBI’s counterintelligence program] disruption of Earth First! organizing efforts: phony press releases calling for violence; fake terrorism manuals; false media stories; continuous death threats, harassment and surveillance. Even if the FBI had nothing to do with promulgating the threats, slander and violence, they certainly treated what should have been seen as solid leads in the bombing with cavalier indifference, if not a hostile cover-up."

Earth First! won the civil lawsuit and the federal jury awarded the plaintiffs $4.4 million in compensation.

The federal government fought for 11 years to keep the case from going to trial.

Best Place To Live In

Absolute police power exists in every nation. Its existence in the U.S. is only more subtle. There are countless ways an innocent person that is an annoyance to the state can be framed and sent to prison. Of course they will be entitled to a legal defense, which will be a waste of time when the evidence is properly planted. Laws like the Patriot Act and its updates are only attempts to get more money for extra police forces and their administration's. One example of absolute police power is the draconian enforcement against the 100 million users of illegal drugs. 50 thousand police informers most of them drug addicts spy on the movements of all Americans. Many are paid with drugs seized in drug busts. But with all its wrongs the U.S. is still the best place for a freedom loving person to live in. God bless America.

OUR POLICE STATE

It's here and probably to stay. I don't like it, because it casts a wide net and scoops up too many innocent people. The Bush Administration's claim to fame is that they prevented attacks on the U.S. after 9/11. IT's impossible to prove whether they did or didn't. But if we scrap parts of the Patriot Act and something happens, however insignificat, whose fault will that be? This was all done with capable guidance from John Yoo. Executive powers have expanded and authority has trickled down to local police and courts. There are no safe havens. It's fightening but I don't know how to water down the laws that seem to hold us prisoner. I get the feeling that all this was put in place when people dared not object. Now we're stuck with it. When people are given authority over others, they are very reluctant to give it up. I worry most about children growing up with more rules and regulatons than any child should have. I guess that a group of 12 yr. olds hanging out now consitutes and unlawful assembly. That just one of the unintended consequences of trying to find the 'terrorists'. Lastly, it's very expensive to have these rules in place for an indefinite period. How do we define what we have prevented having all these laws inplace? I don't think anyone can prove 'what didn't happen'. ANNA

Obama has failed us every time it matters.

He has failed us in Torture.
He has failed us in the wars.
He has failed us in health, and is only being saved by a few Congress people that have kept the public option alive. He will then ride their coattails and claim success.
He has failed in creating jobs to end the economic problems of the middle class.

He talks great. His actions don't back it up.

What a shame. He could have been a great President. Instead he going to be a good politician.

I've been writing about this, including writing our chickenshit, corporate-owned Congress, and screaming it, talking about pushing it to anyone who would read or listen, to no avail. Obama is a liar. He's done exaclty what I, and who knows how many others predicted, and retained every stolen presidential power from the Bush administration. People who gather power NEVER let it go unless they're forced to. NEVER. They'll fight to hold onto it, and they'll use it - that's what it's there for.

He doesn't answer that question, but it's pretty obvious: because we keep on voting for non-peace candidates of an imperial party, the Democrats. Well, I don't, but far too many of us do. The Democratic Party's real job in the duopoly has become obvious: co-opting and derailing any movement for peace or social justice. I'm beginning to wonder how many times they'll pull this scam before masses of people catch on.

There IS a party with principles of peace, sustainability, and social and economic justice: the Green Party, www.gp.org.

I'm really wondering when the left in this country will "grow a spine" and start voting its principles and self-interest, instead of its fears. The consequences of gutless voting are now clear enough.

What do we call Cuba with Gulags; what do we call Iran who executes homosexuals among other things; what do we call China; what do we call Russian where execution of reporters takes place etc etc.

So how does one take those that post here as sane. IF we are a police state then we need a new vocabulary to desribe the examples I gave above.

This isn't really a surprise, since Obama voted to reauthorize the PATRIOT Act in the Senate, and flipflopped on FISA to appease AT&T before shaking them down at the DNC.
If you don't want politicians from both corporate-sponsored parties to continue whittling down your civil rights, get active with the Green Party now.

We voters have a heavy responsibility.

Even though we have Federal Laws and a Constitution which prohibited the Bush-Cheney crimes, President Obama and our Congressional Democrats will avoid prosecution at all cost to our republic in the misguided hope of keeping power for a long time. They pretend to offer us great change if they don't have to prosecute,
but stopping presidential (and vice presidential) abuse of power is the one thing that will cause lasting change.

We must have the courage to make them enforce our Federal Laws, especially torture, and prosecute.

In April of 2008, Amy Goodman interviewed Eric Lichtblau from the NYTimes, who with James Risen first broke the warrantless wiretapping scandal, talking about how the FBI had something like 250 dosiers on as many peaceful anti-war groups. Apparently Der Fuhrer Dick Cheney, following 9/11, instructed all agencies to adopt the attitude that anyone who so much as speaks out against the war is to be considered a potential threat! Further, all aspects of civil society were to be thrown together, watch lists of who is riding what flight to what destination, watch lists and photos of students or anyone else engaging in social activities not deemed desirable by the fascist-in-chief - whatever, there were no limits.

And do not forget the strongarm tactics used during this time period against peaceful protests from New York to Miami, not necessarily even related to protesting the war - use of undercover police and FBI to infiltrate all manner of lawful civil groups and to physically go after them with the intent of disrupting their efforts to peacefully assemble - efforts including mass false arrest, herding protesters into remote fenced-in "camps" out of sight of targeted events, physically blocking access to publicized meeting places with road blocks, targeting and arresting leaders, firing on crowds with rubber bullets and beating people with battons without provocation, spraying pepper spray in the eyes of people who were already in custody under restraint, throwing tear gas canisters into first aid station tents, and so on.

Do we really want these thugs keeping dossiers on every aspect of our lives?

Here is an excerpt from an account of the FBI campaign against Earth First! activists by Karen Pickett:

"Thursday, May 24, 1990, is fresh in my memory. Shortly after noon, a pipe bomb exploded in Earth First! activist Judi Bari’s car as she drove through Oakland, California, with Darryl Cherney. They were organizing for Redwood Summer: a season-long campaign modeled after the 1960s civil rights campaign Mississippi Freedom Summer. We hoped to build a resistance that could stand up to the corporate timber beast and rising animosity toward forest activists.

Everything changed the moment the bomb went off. The explosion nearly killed Judi, leaving her disabled for the rest of her life. The time-delayed, motion-triggered, nail-studded bomb was meant to kill her. Within minutes of the explosion, the FBI and Oakland Police Department (OPD) were on the scene, branding Judi and Darryl as terrorists and Earth First! as a known terrorist organization. Within hours and in defiance of all evidence, the cops arrested Judi and Darryl, claiming they were knowingly transporting the bomb.

The bombing followed months of COINTELPRO-style [the FBI’s counterintelligence program] disruption of Earth First! organizing efforts: phony press releases calling for violence; fake terrorism manuals; false media stories; continuous death threats, harassment and surveillance. Even if the FBI had nothing to do with promulgating the threats, slander and violence, they certainly treated what should have been seen as solid leads in the bombing with cavalier indifference, if not a hostile cover-up."

Earth First! won the civil lawsuit and the federal jury awarded the plaintiffs $4.4 million in compensation.

The federal government fought for 11 years to keep the case from going to trial.

Best Place To Live In

Absolute police power exists in every nation. Its existence in the U.S. is only more subtle. There are countless ways an innocent person that is an annoyance to the state can be framed and sent to prison. Of course they will be entitled to a legal defense, which will be a waste of time when the evidence is properly planted. Laws like the Patriot Act and its updates are only attempts to get more money for extra police forces and their administration's. One example of absolute police power is the draconian enforcement against the 100 million users of illegal drugs. 50 thousand police informers most of them drug addicts spy on the movements of all Americans. Many are paid with drugs seized in drug busts. But with all its wrongs the U.S. is still the best place for a freedom loving person to live in. God bless America.

It's here and probably to stay. I don't like it, because it casts a wide net and scoops up too many innocent people. The Bush Administration's claim to fame is that they prevented attacks on the U.S. after 9/11. IT's impossible to prove whether they did or didn't. But if we scrap parts of the Patriot Act and something happens, however insignificat, whose fault will that be? This was all done with capable guidance from John Yoo. Executive powers have expanded and authority has trickled down to local police and courts. There are no safe havens. It's fightening but I don't know how to water down the laws that seem to hold us prisoner. I get the feeling that all this was put in place when people dared not object. Now we're stuck with it. When people are given authority over others, they are very reluctant to give it up. I worry most about children growing up with more rules and regulatons than any child should have. I guess that a group of 12 yr. olds hanging out now consitutes and unlawful assembly. That just one of the unintended consequences of trying to find the 'terrorists'. Lastly, it's very expensive to have these rules in place for an indefinite period. How do we define what we have prevented having all these laws inplace? I don't think anyone can prove 'what didn't happen'. ANNA

Obama has failed us every time it matters.

He has failed us in Torture.
He has failed us in the wars.
He has failed us in health, and is only being saved by a few Congress people that have kept the public option alive. He will then ride their coattails and claim success.
He has failed in creating jobs to end the economic problems of the middle class.

He talks great. His actions don't back it up.

What a shame. He could have been a great President. Instead he going to be a good politician.

I've been writing about this, including writing our chickenshit, corporate-owned Congress, and screaming it, talking about pushing it to anyone who would read or listen, to no avail. Obama is a liar. He's done exaclty what I, and who knows how many others predicted, and retained every stolen presidential power from the Bush administration. People who gather power NEVER let it go unless they're forced to. NEVER. They'll fight to hold onto it, and they'll use it - that's what it's there for.

He doesn't answer that question, but it's pretty obvious: because we keep on voting for non-peace candidates of an imperial party, the Democrats. Well, I don't, but far too many of us do. The Democratic Party's real job in the duopoly has become obvious: co-opting and derailing any movement for peace or social justice. I'm beginning to wonder how many times they'll pull this scam before masses of people catch on.

There IS a party with principles of peace, sustainability, and social and economic justice: the Green Party, www.gp.org.

I'm really wondering when the left in this country will "grow a spine" and start voting its principles and self-interest, instead of its fears. The consequences of gutless voting are now clear enough.

What do we call Cuba with Gulags; what do we call Iran who executes homosexuals among other things; what do we call China; what do we call Russian where execution of reporters takes place etc etc.

So how does one take those that post here as sane. IF we are a police state then we need a new vocabulary to desribe the examples I gave above.

This isn't really a surprise, since Obama voted to reauthorize the PATRIOT Act in the Senate, and flipflopped on FISA to appease AT&T before shaking them down at the DNC.
If you don't want politicians from both corporate-sponsored parties to continue whittling down your civil rights, get active with the Green Party now.

We voters have a heavy responsibility.

Even though we have Federal Laws and a Constitution which prohibited the Bush-Cheney crimes, President Obama and our Congressional Democrats will avoid prosecution at all cost to our republic in the misguided hope of keeping power for a long time. They pretend to offer us great change if they don't have to prosecute,
but stopping presidential (and vice presidential) abuse of power is the one thing that will cause lasting change.

We must have the courage to make them enforce our Federal Laws, especially torture, and prosecute.
