Judge Finds Abusive Gitmo Interrogations Yield False Confessions, Bad Info

A judge's recently-released opinion opens a window on Gitmo's harsh interrogation techniques, and the bad intel they yield.

A few weeks ago, the U.S. District Court for the District of Columbia released a declassified version of a judge’s ruling in the case of Al Rabiah, a Kuwaiti citizen who has been held at Guantanamo for seven years. The judge, Colleen Kollar-Kotelly, found that the government could not credibly support its allegation that Al Rabiah was part of the Taliban or al-Qaida, and that the evidence against him wasn’t sufficient to justify his continued detention. She ordered the government to release Al Rabiah "forthwith."

But the judge’s opinion is more than a legal document; it’s also a window into the interrogation process at Guantanamo and the risk that "enhanced interrogation techniques" will produce false information. Excerpts from the opinion are below; you can also read the whole document.

Al Rabiah’s background.

Kollar-Kotelly describes Al Rabiah as a 50-year-old father of four, who graduated from the Air Service Training school at Perth College, Scotland, with a degree in aviation maintenance in 1981. He then went to Kuwait Airways, where he worked until his detention in 2001. At the time Al Rabiah was captured, he was an overweight man in his 40s, with "various medical ailments such as high blood pressure and chronic pain in his neck and lower back]" and no military training, save for two weeks of compulsory training in the Kuwait Army until he was discharged for a knee injury.

Al Rabiah often used his vacations to perform humanitarian work in impoverished or war-torn countries, the judge writes, and it was to perform the same kind of work that he traveled to Afghanistan in October 2001—an explanation that Kollar-Kotelly writes is supported by the evidence. After he tried to leave the country via Iran, whose border guards denied him entry, Al Rabiah tried instead to cross the Pakistani border, but he was captured by villagers and turned over to the Americans, who later transferred him to Guantanamo.

The government’s evidence against Al Rabiah was "surprisingly bare."

The government’s case against Al Rabiah initially rested on two main pillars: allegations made against him by fellow detainees and his own confessions. But in the judge’s opinion, neither held any weight.

The judge’s ruling cites four detainees who made allegations against Al Rabiah. The names of his accusers are redacted, as are the specifics of their allegations, but Kollar-Kotelly explains her reasons for rejecting them. The first accuser made statements that were incorrect; the second made statements that changed over time, and which the judge called "demonstrably false"; the third seems to have made statements about someone who was not Al Rabiah; and the fourth made his allegations only after one week of sleep deprivation, exceeding the military’s own guideline prohibiting sleep deprivation for more than four days, "and he did not repeat this allegation either before or after."

Kollar-Kotelly notes that the government itself "withdrew most of its reliance" on the witnesses against Al Rabiah during the course of the trial. She writes that their allegations are unreliable, writing, "the Court finds that none of the alleged eyewitnesses have provided credible allegations against Al Rabiah." However, she calls it "very significant that Al Rabiah’s interrogators apparently believed these allegations at the time they were made, and therefore sought to have Al Rabiah confess to them." That brings her to those confessions.

First of all, Americans need to realise, what the vast majority of people across the World who are in any way involved in Justice, consider to be True. Guantanamo Bay and other directly or indirectly American controlled facilities across the World, are considered to be equivalent or even worse of Concentration Camps set up by German Nazi's.

War Criminals in NAZI Germany, considered that they would always be immune from Prosecution, because they had the Protection of The German NAZI State.

War Criminals in NAZI America also consider that they would always be immune from Prosecution, because they had the Protection of The American NAZI State.

War Criminals in NAZI Israel are now becoming increasingly worried that they will be arrested and charged with War Crimes Against Humanity, and have cancelled plans to travel for Fear of Arrest.

War Criminals who escaped Justice from NAZI Germany were pursued long into old age and were eventually prosecuted.

There is Significant Evidence that War Criminals from both the USA and the UK, are now becoming increasingly worried, that they will eventually be arrested and prosecuted.

The evidence against them is phenomenal and extremely well documented. Large numbers of people in Justice systems across the World are compiling evidence for Prosecution.

If you get to be older than that it is best forgotten...

So I don't mind when people forget my Birthday...

But My Muslim Friend Does...

It is Really Important to him, that we remember his Birthday.

I always forget, but My Wife Remembers.

He is Looking After a Very Old Friend of Mine, who Just Happens to Be a Roman Catholic Priest.

Some People Might think That I DESPISE Catholic Priests.

I Never Remember his Birthday, but sometimes I remember him at Christmas and send him a nice little present - like some money he will probably give away - despite me insisting he goes down the pub with it and chat up a nice Lancashire Lass

He must be well into his 80's by now - maybe 90's.

We shall have to go and see him again in Lancashire.

He's still as Bright as a Button and writes me the most wonderful letters once or twice a year.

He's a Holy Man Full of Love and Peace For Everyone

Except The Israeli's Who He DESPISES

George W. Bush has said repeatedly, that his motive for invading Iraq in the first place was one of fulfilling Biblical prophesy. The Middle East was supposed to be the site of Armageddon, and the Muslims were supposed to be the "last" enemy of the Christians, before they assended into Heaven in the "Rapture." The French President of the time had a great account of a truly wierd phone conversation with our "President" in the push for the Iraq War, in which he said he was sent by god to vanquish the Middle East.

With nuts like that in charge of things, it is sheer relief to see the Judiciary now holding them to their word. The Judiciary is logic-based, and they won't fall for the same nonsense that's taken the rest of the establishment. The interrogaters don't even believe the man's confessions themselves, so what do they do? Why they push him all the harder, for a "confession" that they will be able to "believe." It really MAKES NO SENSE! And they take him into court, (where they don't want to be AT ALL) saying that he's guilty of all the things they themselves don't believe he's guilty of? Whaaaat???

This process is taking far too long, and ruining far too many lives; and all for the insane cult ramblings of a President who should never have even been elected in the first place. No wonder the world now laughs at America's posturings.

Do not understand why Holder & Obama are delaying a full investigation of all of those who conspired to torture in violation of our Federal Anti-Torture Laws?

Are they waiting for the statute of limitations to run out so they can avoid having to do their job? Aren't they for Enforcing our Federal Laws?

Make them do it soon!

Put yourself out for the Truth.
Get out in the streets in front of your Congressional Representative's office and raise hell.
