Screw the autoworkers.

They may be crying about General Motors' bankruptcy today.  But dumping 40,000 of the last 60,000 union jobs into a mass grave won't spoil Jamie Dimon's day.

Dimon is the CEO of JP Morgan Chase bank.  While GM workers are losing their retirement health benefits, their jobs, their life savings; while shareholders are getting zilch and many creditors getting hosed, a few privileged GM lenders - led by  Morgan and Citibank - expect to get back 100% of their loans to GM, a stunning $6  billion.

The way these banks are getting their $6 billion bonanza is stone cold illegal.

I smell a rat.

Stevie the Rat, to be precise.  Steven Rattner, Barack  Obama's 'Car Czar' - the man who essentially ordered GM into bankruptcy this morning.

When a company goes bankrupt, everyone takes a hit:  fair or not, workers lose some contract wages, stockholders get wiped out and creditors get fragments of what's left.  That's the law.  What workers don't lose are their pensions (including old-age health funds) already taken from their wages and held in their name.

But not this time.  Stevie the Rat has a different plan for GM: grab the pension funds to pay off Morgan and Citi.

Here's the scheme:  Rattner is demanding the bankruptcy court simply wipe away the money GM owes workers for their retirement health insurance.  Cash in the insurance fund would be replaced by GM stock. The percentage may be 17% of GM's stock - or 25%.  Whatever, 17% or 25% is worth, well … just try paying for your dialysis with 50 shares of bankrupt auto stock.

Yet Citibank and Morgan, says Rattner, should get their whole enchilada - $6 billion right now and in cash - from a company that can't pay for auto parts or worker eye exams.

Preventive Detention for Pensions

So what's wrong with seizing workers' pension fund money in a bankruptcy?  The answer, Mr. Obama, Mr. Law Professor, is that it's illegal. 

 

In 1974, after a series of scandalous take-downs of pension and retirement funds during the Nixon era, Congress passed the Employee Retirement Income Security Act.  ERISA says you can't seize workers' pension funds (whether monthly payments or health insurance) any more than you can seize their private bank accounts.  And that's because they are the same thing:  workers give up wages in return for retirement benefits. 

The law is darn explicit that grabbing pension money is a no-no.  Company executives must hold these retirement funds as "fiduciaries."  Here's the law, Professor Obama, as described on the government's own web site under the heading, "Health Plans and Benefits."

            "The primary responsibility of fiduciaries  is to run the plan solely in the interest of participants and beneficiaries  and for the exclusive purpose of providing benefits."

Every business in America that runs short of cash would love to dip into retirement kitties, but it's not their money any more than a banker can seize your account when the bank's a little short.  A plan's assets are for the plan's members only, not for Mr. Dimon nor Mr. Rubin.

Yet, in effect, the Obama Administration is demanding that money for an elderly auto worker's spleen should be siphoned off to feed the TARP babies. Workers go without lung transplants so Dimon and Rubin can pimp out their ride. This is another "Guantanamo" moment for the Obama Administration - channeling Nixon to endorse the preventive detention of retiree health insurance.

As history's largest rip-off continues to unfold in Detroit and on Wall Street, some establishment economists are issuing dour warnings that the feds' massive borrowing is -- gasp! -- unsustainable. The timing of these rumblings -- coming just as Congress prepares to hammer out a national health care program -- bodes ill for taxpayers. I suspect the weasels in Congress will use this sudden concern over deficit spending as an excuse to deep-six the proposed public health care plan. Of course, the expected massive subsidies for insurance companies would be approved anyway. If that happens, it will be official: The Obama administration is the biggest bait-and-switch operation ever pulled on the American people.

Obama should have removed the "legacy costs", the healthcare commitments from GM, and used it as a seed for developing a single payer health care system. That would have taken care of two birds with one stone. GM's costs would have been in line with Toyota and Honda, not that they would not continue building gas guzzlers.

I can't for the life of me figure out why they are keeping Buick and Cadillac. There are some Buicks on my street, but no Caddys. There are Saturns, and Pontiacs galore though.
Oh, and when that 40,000 dollar Volt is available, I hope to have a Prius in my garage.

When will people wake up to the fact that it is not about Democrats versus Republicans, liberals versus conservatives but about the military-industrial oil private central banking complex against us.
Money and power corrupt and the Federal Reserve Bank has all the money it needs and wants and therefore has the capability of absolute power. The Federal Reserve Bank is a private for-profit cartel of banks that prints the money for this country and then lends it to us and earns interest. This cartel of banks control the supply of money and the interest rate. It is not a federal agency and the United States government has no control or power over it.

John F. Kennedy was attempting to diminish the power of the Federal Reserve Bank bypassing an Executive Order six months before he was killed by the CIA. These bankers let all future presidents know to keep their hands out of their business.

Obama not only knows this but he is in their pocket.

The fact that Obama likes the term "Tsar", or "Czar" tells you where his head and loyalties lie--And it is not with the working class. He is continuing the policies of gutting workers rights, union busting, closing plants while telling us he is different and for "change". He isn't. He suckered all of us in and we are now paying the price. When he is done, there will only be the wealthy and everyone else will be slaves or drones.

are over, in the private and public sectors, as a part of the new world order. There's no need for any conspiracy when things are done in the open. Airline workers have lost their pensions too, as their irresponsible employers have gone into and out of bankruptcy. Social programs have been targeted in EU countries in the past decade as well. Giant multinational corporations see it as a matter of competition.

None of this would bother me so terribly if our so called leaders stopped handing over taxpayer funded welfare to these global feudal lords, aiding them in their global expansion and their oppression of the working class.

Obama's "car czar", another neo-con shill.

the major metro stations across the country ? The more workers there are for metro, the faster our public transportation infrastructure can be improved and made more affordable and the less drivers on the roads to clog up the highways in the suburbs and inner cities. Let GM fail and burn in hell and eat its own crow !

The news just keeps getting better, doesn't it?

They finally found a way to bust the United Autoworkers Union, all the way down to and through their pensioners, something GM wanted very badly to be rid of, and eliminate some pesky brands, like Saturn, that GM has wanted to shed for years. Boy! THIS is change General Motors can believe in!

(And in my state, California, our Terminat ... uh ... Governator is solving our fiscal problems the old fashioned way: by going after the elderly, the disabled, children's healthcare, the school systems, and our state parks – with nary a mention of forcing corporations to pay their fair share of state income taxes.)

The "Shock Doctrine" strikes again!

But, back to Obama ...

Massive, no-strings-attached bailouts for the same financial firms that originally stole from us. Nothing to bail out the American Worker.

Watered-down "credit card reform" that doesn't take effect for a year or more, giving companies plenty of time to figure out how to skirt the new laws or use their concubines in congress to get them rescinded.

No direct help for forclosed homeowners, but plenty of help for the BANKS that are ripping them off.

Talk, but no movement to close Guantanamo; a bulls**t explanation that "We don't know what to do with these DANGEROUS TERRORISTS! (How about: send them home?)

The "war" (say: contractor gold rush) in Iraq drags on; talk of a permanent presence there; NO TALK of curtailing the contractor Gravy Train that's gone on for years and continues, or prosecuting for past abuses and theft by contractors that totals billions of dollars. The "war" in Afghanistan is expanded (by the way, how is the oil and gas pipeline from the Caspian Sea to China and the Western Pacific coming along?)

An Obama healthcare summit festooned with executives of private insurers; the single-payer alternative not represented or even considered, as Obama promised during his campaign; a chilling remark by Obama that premiums may have to be RAISED to cover the cost of universal insurance!

Bush secrecy concerning damaging documents continued; absolutely no movement by the Obama administration to prosecute Bush and his ilk for some of the most heinous and constitution-shredding crimes in our nation's history.

I'm going to say something that's painful for me (after voting for the guy): I am coming to the belief that Barak Obama is a Trojan Horse.

He was sent in to ameliorate the growing anger of the American People by making positive changes on the periphery, while at the same time continuing the core policies of previous administrations designed to consolidate the power and wealth of a moneyed elite at the expense of everybody else. It is a story as old as history itself, and one that our system of democracy was designed to prevent: the making of kingdoms and empires. It is happening once again, right under our noses – and all of the pretty-but-empty speeches and grandiose articulation serve only to paper over what is emerging as a not-so-pretty picture of the new administration: a possibly innocent, well-groomed but feckless enabler for rich and powerful controlling interests. It hurts me to believe this. I had great hopes for the new administration after the nightmare of the last eight years, but my hope is fading. I wish that something could change my belief; but this latest outrage only serves to strengthen it.

Is a failure to communicate". So said the warden to the prisoners after Paul Newman was captured after escaping in the movie "Cool Hand Luke". President Obama just doesn't seem to get it, or if he does, he's keeping it a secret:
1. Most of us want government-run single-payer universal health care, not the bullshit, half-assed crap he's pushing.
2. Most of us want out of Iraq and Afghanistan, today. NOW. We don't want to hear "speeches" from someone who's almost certainly dead or lame excuses for foot dragging.
3. We don't want to hear how important it is to revive the economy by rewarding the crooks who wrecked it in the first place. We want to see the assholes in JAIL.
4.We want to see the bush crime family brought to JUSTICE. Never mind the crap about "looking forward". We can't go forward as a nation of laws if we continue to ignore multiple capital crimes and grand theft, which are in plain sight, for all the world to see.
Are you listening, Mr. President, or are we failing to communicate with you?

I railed against his candidacy because I knew that he is simply Bush-lite. He has surrounded himself with too many of the same criminals and refuses to evoke the dire change he was elected to pursue. In Calif. we have 400 judges that get paid by Los Angeles county $46,000/yr. over and above their $178,000/yr. state salary, which they continue to receive for retirement, and for what? So they can run things their own way, disregard the laws they swore to uphold, yet, thousands of teachers get laid off, what a sick joke of a government we have.
It's ironic, the first laydee said after her ol man won "for the first time, I'm proud to be an American", as for me, "for the first time, I'm ashamed, and embarrassed, to be American". What a piece of crap we have here.

Welcome to the truth. While the US media portrays the two main parties as diametrically opposed, this is not entirely true. In a more global context, the Democrats and Republicans both live on the right side of the political spectrum.

The objectives of either party when ruling in Washington is to fill the pockets of the companies which put them there.

When the economy is going well, the government works to funnel as much to the companies as possible. When the economy is not well, the government whips out its tit.

This is obvious to anyone who thinks about things for more than a moment. But Americans seem more comfortable spouting slogans about birth certificates and socialized medicine. They deserve what they get.

The fact that Obama likes the term "Tsar", or "Czar" tells you where his head and loyalties lie--And it is not with the working class. He is continuing the policies of gutting workers rights, union busting, closing plants while telling us he is different and for "change". He isn't. He suckered all of us in and we are now paying the price. When he is done, there will only be the wealthy and everyone else will be slaves or drones.

are over, in the private and public sectors, as a part of the new world order. There's no need for any conspiracy when things are done in the open. Airline workers have lost their pensions too, as their irresponsible employers have gone into and out of bankruptcy. Social programs have been targeted in EU countries in the past decade as well. Giant multinational corporations see it as a matter of competition.

None of this would bother me so terribly if our so called leaders stopped handing over taxpayer funded welfare to these global feudal lords, aiding them in their global expansion and their oppression of the working class.

Obama's "car czar", another neo-con shill.

the major metro stations across the country ? The more workers there are for metro, the faster our public transportation infrastructure can be improved and made more affordable and the less drivers on the roads to clog up the highways in the suburbs and inner cities. Let GM fail and burn in hell and eat its own crow !

The news just keeps getting better, doesn't it?

They finally found a way to bust the United Autoworkers Union, all the way down to and through their pensioners, something GM wanted very badly to be rid of, and eliminate some pesky brands, like Saturn, that GM has wanted to shed for years. Boy! THIS is change General Motors can believe in!

(And in my state, California, our Terminat ... uh ... Governator is solving our fiscal problems the old fashioned way: by going after the elderly, the disabled, children's healthcare, the school systems, and our state parks – with nary a mention of forcing corporations to pay their fair share of state income taxes.)

The "Shock Doctrine" strikes again!

But, back to Obama ...

Massive, no-strings-attached bailouts for the same financial firms that originally stole from us. Nothing to bail out the American Worker.

Watered-down "credit card reform" that doesn't take effect for a year or more, giving companies plenty of time to figure out how to skirt the new laws or use their concubines in congress to get them rescinded.

No direct help for forclosed homeowners, but plenty of help for the BANKS that are ripping them off.

Talk, but no movement to close Guantanamo; a bulls**t explanation that "We don't know what to do with these DANGEROUS TERRORISTS! (How about: send them home?)

The "war" (say: contractor gold rush) in Iraq drags on; talk of a permanent presence there; NO TALK of curtailing the contractor Gravy Train that's gone on for years and continues, or prosecuting for past abuses and theft by contractors that totals billions of dollars. The "war" in Afghanistan is expanded (by the way, how is the oil and gas pipeline from the Caspian Sea to China and the Western Pacific coming along?)

An Obama healthcare summit festooned with executives of private insurers; the single-payer alternative not represented or even considered, as Obama promised during his campaign; a chilling remark by Obama that premiums may have to be RAISED to cover the cost of universal insurance!

Bush secrecy concerning damaging documents continued; absolutely no movement by the Obama administration to prosecute Bush and his ilk for some of the most heinous and constitution-shredding crimes in our nation's history.

I'm going to say something that's painful for me (after voting for the guy): I am coming to the belief that Barak Obama is a Trojan Horse.

He was sent in to ameliorate the growing anger of the American People by making positive changes on the periphery, while at the same time continuing the core policies of previous administrations designed to consolidate the power and wealth of a moneyed elite at the expense of everybody else. It is a story as old as history itself, and one that our system of democracy was designed to prevent: the making of kingdoms and empires. It is happening once again, right under our noses – and all of the pretty-but-empty speeches and grandiose articulation serve only to paper over what is emerging as a not-so-pretty picture of the new administration: a possibly innocent, well-groomed but feckless enabler for rich and powerful controlling interests. It hurts me to believe this. I had great hopes for the new administration after the nightmare of the last eight years, but my hope is fading. I wish that something could change my belief; but this latest outrage only serves to strengthen it.

Is a failure to communicate". So said the warden to the prisoners after Paul Newman was captured after escaping in the movie "Cool Hand Luke". President Obama just doesn't seem to get it, or if he does, he's keeping it a secret:
1. Most of us want government-run single-payer universal health care, not the bullshit, half-assed crap he's pushing.
2. Most of us want out of Iraq and Afghanistan, today. NOW. We don't want to hear "speeches" from someone who's almost certainly dead or lame excuses for foot dragging.
3. We don't want to hear how important it is to revive the economy by rewarding the crooks who wrecked it in the first place. We want to see the assholes in JAIL.
4.We want to see the bush crime family brought to JUSTICE. Never mind the crap about "looking forward". We can't go forward as a nation of laws if we continue to ignore multiple capital crimes and grand theft, which are in plain sight, for all the world to see.
Are you listening, Mr. President, or are we failing to communicate with you?

In Calif. we have 400 judges that get paid by Los Angeles county $46,000/yr. over and above their $178,000/yr. state salary, which they continue to receive for retirement, and for what? So they can run things their own way, disregard the laws they swore to uphold, yet, thousands of teachers get laid off, what a sick joke of a government we have.
It's ironic, the first laydee said after her ol man won "for the first time, I'm proud to be an American", as for me, "for the first time, I'm ashamed, and embarrassed, to be American". What a piece of crap we have here.

Welcome to the truth. While the US media portrays the two main parties as diametrically opposed, this is not entirely true. In a more global context, the Democrats and Republicans both live on the right side of the political spectrum.

The objectives of either party when ruling in Washington is to fill the pockets of the companies which put them there.

When the economy is going well, the government works to funnel as much to the companies as possible. When the economy is not well, the government whips out its tit.

This is obvious to anyone who thinks about things for more than a moment. But Americans seem more comfortable spouting slogans about birth certificates and socialized medicine. They deserve what they get.
