Immigration Officials Try to Deport Dead Man

Seven months after his death, the federal government is still proceeding with the deportation case against Nasin Rivera.

Editor's note: We hear a lot from opponents of immigration reform that the system works just fine. Not a thing in the world wrong with it. Waits of up to 20 years for a government agency to process paperwork are normal, locking up 5 year-olds, depriving detainees of needed healthcare, parading illegal immigrants through towns like animals -- none of those things are in any way indications that the system doesn't work.

The Los Angeles Times reports:

Nasin Mauricio Rivera died in San Bernardino County in August and his body was shipped to his native El Salvador for burial.

Seven months later, the federal government is still proceeding with the deportation case against him. A hearing is scheduled for this summer.

Attorneys for Rivera, an illegal immigrant, said his case is a waste of resources and should be closed.

"To us, it's a matter of principle -- a dead person should not be deported," said immigration attorney Edgardo Quintanilla. At a November hearing in Los Angeles Immigration Court, attorney Alberto Lopez presented a photocopy of Rivera's death certificate. Lopez had obtained the copy from Blanca Ramirez, who was divorced from Rivera but still lived with him in Echo Park.

Lopez said the attorney from U.S. Immigration and Customs Enforcement told him the copy wasn't sufficient.

when he was buried in his native land !!

yikes, what are they gonna do - dig him up, fly him back so he can appear in court, only to return him to the cemetery in el salvador???

and if he's back in el salvador (dead or alive)...isn't the case closed anyway??

The editor's note states that opponents of immigration reform(i.e., people who want to enforce the law and reinforce the idea that borders are still a rational idea) are somewhat irrational. Hm.

What would Altenet editors think if Mr.Obama were booted out in '12, as "unlikely" as that might be, and his successor just decided not to enforce civil rights laws for four years?

I mean, if you don't enforce one set of important laws for a while, why not another? Just pick and choose according to poltical fashion, not legal precedents established by congressional debate and public hearings?

Mr. Bush did not enforce certain civil liberties. That was wrong. He did a miserable job, as did Mr. Clinton, of enforcement of immigration laws. That was wrong. If you don't like the law go to Congress and McCain and Obama will do that later this year to legalize the illegals. And they will be opposed.
