The Whole (Jena 6) Story?

My class was all-white, except for this Vietnamese kid named Q. And me. We were playing kickball in gym class and Q wasn't very good. About a half-dozen of my classmates started taunting an extremely meek and seriously scared Q with chants of "gook."
Now that I think about it, Q had probably immigrated to America with his family after his people were "liberated" by soldiers like my (step)father who had voluntarily served with a USMC tank battalion in Vietnam several years before our little scapegoat game on the playground.
I don't know if the biblical prophets I began learning about in church had already started to influence me but like Jeremiah, I had a fire shut up in my bones, burning in defense of Q. I told my classmates that if they didn't stop calling Q a "gook," I was "gonna kick they ass."
They didn't stop and I delivered on my threat.
But I didn't get charged with attempted murder like the Jena 6. I didn't even get in "trouble;" at least, not by-the-book "trouble." Instead, karma came back to me -- hard. Not long after the Q incident, we were playing softball. I was catching, standing too close to the plate, and one of the kids I beat up in the name of Q caught me with his backswing -- right in the jaw. (I can still see that green wooden bat today).
I went to our gym teacher moaning about the nurse's office. "I told you to back up. That's what you get. Now, go over there and sit down," he said.
Too bad my gym teacher isn't the District Attorney in Jena, Louisiana. He might not be the ideal man for the job but at least he allowed my classmates to learn a real-world lesson in the wrath that white supremacy evokes while sparing me certain school (and maybe legal) discipline.
He also saw the poetic (and painful) justice of me getting cracked in the jaw by a kid who had been a victim of my retaliatory violence.
The Jena 6 were initially charged, as adults, with attempted murder for a playground butt-whoopin' after a series of racial incidents that included the ugly American spectre of nooses. Predictably, the story has quickly devolved into one that pits two polarized camps arguing about "justice."
One side, many of whom I'd bet are purveyors of "color-blindness," can only see black criminality in this case, while downplaying (or ignoring) the existential threat nooses represent to black folk. The other side -- rightfully calling attention to a clear-cut case of white-skin privilege -- wrongly sees the Jena 6 as the beginning of 21st century civil rights movement.
Of course, both camps have a point. The Jena 6 haters, despite their evident historical amnesia of the lynching terrorism African-Americans endured for nearly a century (and that was tolerated by "Christian" America until less than 50 years ago) are right: you can't claim the moral high ground in the struggle for racial justice with a beat-up white kid at the bottom of the pile.
The Jena 6 defenders are also right: sending any of those young brothers involved in the fight to jail, without considering the "mitigating circumstances," would be an injustice that should be easy to see in a so-called Christian country. "A false balance is abomination to the Lord: but a j8ust weight is his delight," declares the book of Proverbs.
Certainly, the charges in the Jena 6 case are a "false balance."
It's not just my Glassbrook experience that makes me sympathetic to the Jena 6, my sympathies are also based on the recognition, as Karl Menninger observed his classic analysis of America's penal system The Crime of Punishment, that "in practice, justice does not mean fairness to all parties. To some people the law is an inexorable, inscrutable Sinai -- the highest virtue is to submit unquestioningly. But to others law and the principle of justice should ... 'embody the plasticity and reasonableness that Aristotle praised in his famous description of equity."
"He said: 'Equity bids us to be merciful to the weakness of human nature; to think less about what he said than about what he meant; not to consider the actions of the accused so much as his intentions, nor this or that detail so much as the whole story..."

About the nooses: that was no "prank" - it was a terroristic threat. I am no judge as to whether the punishment meted out was just - it does seem minimal in the absence of other facts.
Imagine the outcry if six white boys had savagely beaten a black kid over a racial incident. You can bet the same people who are calling this a "schoolyard fight" would be screaming "HATE CRIME!"
Now white supremacist groups are getting involved, the names and addresses of the black parents have been published and more terroristic threats issued.
It is time for the Justice Department to step in - ain't it great we can have faith that wise and measured steps will be taken?
If the right moves aren't made by somebody and soon - this may be the beginning of the problem - not the end.

Well, considering that white were also lynched, does it give them the right to go beat up someone when they see a noose??
The students may have been charged wrongly as adults but this is a case of discrimination on the part of the blacks..The white student civil rights were violated.
In a similar case in Woodside Queens NYC, a few white teens attacked with bats a few black teens as the blacks tried to steal a car. They were tried and jailed for violating the blacks civil rights by calling them racial names during the attack!
If the law is good for the whites it must be good for the blacks. If not racial justice in this country will never come!

In my hometown, three teenage women were attacked and beaten on Halloween by a mixed group of young African-Americans. Fortunately our local court had a judge with juvenile experience of long-standing.
Neither side was pleased with his decision to be lenient--assigning guilt but placing the guilty on probation and limited after-school freedom. The parents of the guilty promised to appeal. The friends and family of the victims attempted to force a recall of the judge. So far as I know, neither was followed through on.
The whole community acted injured by the incident, yet most of us realize it is the reality of life on our streets today. Aristotle also said that it is who rears us that give us our values, for each generation must be taught anew. We must learn the lesson of human respect over and over, so we dare not take the hard-won lessons for granted.

How can so many miss the obvious point? The point is that UNCHECKED EVIL TENDS TO ESCALATE! The Initial white aggression in Jena (that included physical intimidation), escalated because it was unchecked, until blacks got physical.
The issue is WHY WAS WHITE AGGRESSION UNCHECKED AND BLACK AGGRESSION CHECKED SO SEVERELY? We all know the answer?
The new issue is WHY CAN"T WE LIBERAL ALTERNET-TERS DEAL WITH THE TRUTH? We expeect this type of small-minded malignancy from the Rush Limbaugh crowd. But we thought Alternet readers could handle the truth. Maybe not?
Jena 6 happened precisely because white aggression was UNCHECKED, by those with the responsibility to check it. If those of you commenting were intelligent and unbiased you would have known that. You may have even had the integrity and decency to comment on the real issue.
This conversation is akin to the moral outrage whites felt against Nat Turner. How could that evil Nat have killed those poor whites? Would you agree, today - that was a ridiculous question? Your comments are the same.
While we're on the point of our liberal brothers not getting it: Michael Vick proves massive racial delusions, also. The point Blacks were making in the Michael Vick case is that while Mr. Vick was wrong, NO Other human, in the history of Dog-Fighting has ever suffered for their mistake (and it was a mistake) to the extent Mr. Vick has. To date he has lost almost a Hundred Million Dollars, his career, and quite possibly his freedom. He lost all of this as a result of doing what pit-bulls were bred in ENGLAND to do. Mr. Vick did not start the phenomenon known as dog-fighting. He is not the biggest dog-fighting concern ever established in America. And you will not make him out to be the equivilent of a serial killer, or slave-holder just becasue you make shrill comments about destroying him. You only reveal the same sickness that has existed too long in too many Ameican citizens - racism. You can deny ot until Jesus returns, but the punishment far exceeds the crime, and the only reason we are comfortable wit that obvious fact is racism. To deny that is to demean yourself because we ALL really know the truth.
There is a case of kidnapping, rape, and torture in West Virginia that has received comparatively little attention from the liberal Alternet readers. The victim is a black woman. Is she valued as much as a dog? So where's the moral outrage? Trust me. IF you try hard - YOU CAN HANDLE THE TRUTH.
Anyone comfortable seeing the punishment Mr. Vick is subjected to, by definition, must be sad, vindictive, cold-hearted and troubled, much more so than even Michael Vick, whom we so zealously point the finger at with our "moral outrage."
The simple truth is that underlying Jena, Michael Vick, Iraq, and America, et al - there is something else, much more sinister, UNSPOKEN, and evil that we had better root out before it destroys us all.
Like Martin Luther King, let the real men and women - the real HUMAN BEINGS be about the business of finding, and dealing with the simple truth. It seems my Liberal Alternet Brothers struggle with truth, when it comes to race as much as my Rush L brothers.

So, there is no justice in the Jena six being in jail or charged with anything. If we go to the beginning, the superintendent, school board, prosecuting attorney should all be charged with inciting violence and the contributing to the delinquency of minors. The idea that these adult caretakers of the legal, social and educational institutions of Jena should use their status to promote a double standard in the law, enforce their racist (yes racist) concepts onto the public square and discourse is criminal.
They missed an opportunity for the children to learn to handle their disagreements and to talk about race, inequality and racism BECAUSE of their own personal and profound racism against non-whites.
We need to push for a federal department of justice, civil rights and homeland security as well as Congressional investigation what motivated of these "adult" to create this type of injustice and think they could get away with it.
If we expose them and focus on their actions we will help the Jena 6 and millions of other Americans of all races to understand and appreciate that we the people must stand together and say ENOUGH WITH THE RACISM ENOUGH.
These were kids fighting within the racist context and reality constructed by the adults and power holders in Jena. The kids could have easily been directed in another way, if the adults were responsible people.
Just for fun, listen to Democracy NOW's interviews with the white member of the Jena School Board -- listen to the coded conversation about blacks keeping their place, not pushing for things that they can't get or are not priviledged to have. He refered to the blacks as "our." Then listen to the Mother of one of the jailed youth. Her response to the noose incident, in a response to her son's question about what the nooses on the tree meant, she replied that it was something form "slavery" time. Listen to the black man who had been part of the school system, principal???, who spoke in total code as though he could not come out and speak what was the truth from his heart. FEAR was in the voices of both black people, they are terrorised in Jena.
Our reality as northerners, racial justice seekers, etc. should not blind us to the fact that for many parts of America, racism is a RIGHT of whites over all people of color.
We thank the Jena 6 for their heroic sacrifice to send out a clarion call to all of us, the fight is still on! Dr. King's beloved community is no where near, his dream requires real work, not simply waking up from sleep.

TIMELINE
2006
Sept. 1 - Students arrive at Jena High School to find three nooses hanging from a tree in the center of the campus. Earlier in the week, some black students had asked whether they could sit under the tree alongside the white students.
Sept. 7 - Three white students are recommended for expulsion by the Jena High School principal after being accused of hanging the nooses.
Sept. 8 - The white superintendent said, "Adolescents play pranks," the superintendent told the Chicago Tribune, "I don't think it was a threat against anybody," and gave them a three day suspension instead..
Nov. 30 - Fire destroys the main academic building at Jena High School and is ruled the work of an arsonist. Later that night, a fight is reported at the Fair Barn in Jena at a private party.
Dec. 1- a black student, Robert Bailey attends a “white party” and is beaten and has a bottle broken over his head. One person was later charged with simple battery for the beating and given probation. This charge came after the black students were charged.
Dec. 2 - A fight is reported at the Gotta Go convenience store in Jena in which investigators say three students including Bailey, confronted another white man and took his shotgun. The man with the shotgun had participated in the beating of Bailey the previous night and drew the shotgun on the 3 blacks. The students wrestled the gun away from the man and took it to the police station and reported the incident. Later these kids, Shaw, Bailey and Ryan Simmons, 17, were all arrested on charges of theft of a firearm, second-degree robbery and disturbing the peace in connection with this incident.
Dec. 4 - Jena High School reopens, white student Justin Barker is attacked by several
students, knocked unconscious and punched and kicked while he was down he regained consciousness and was rushed to LaSalle General Hospital. The LaSalle Parish School Board declares a state of emergency after the fire. Justin Barker is treated and released and later that same evening attended a school function. The shoes that were worn and used in the kicking incident, were later named as the weapons in the aggravated assault, and the attempted murder charge.
By law there must be a weapon used for the aggravated assault charge.
Dec. 5 - It is announced that four people have been arrested in the December 4 fight -- Carwin Jones, 18, bail set at $100,000.00 Robert Bailey Jr., 17, bail set at $138,000.00 Theo Shaw, 17, bail set at $130,000.00 and an unnamed juvenile later identified as Jesse Ray Beard -- and charged with aggravated second-degree battery. Also, Shaw, Bailey and Ryan Simmons, 17, are arrested on charges of theft of a firearm, second-degree robbery and disturbing the peace in connection with the Dec. 2 fight. Deputies arrest Justin Sloan, 22, of Jena, in connection with the November 30 fight and also implicate Bailey in that fight.
Dec. 6 - It is announced that another unnamed juvenile has been arrested in the December 4 fight.
Dec. 7 - The LaSalle Parish District Attorney's Office announces that the charges against the six students arrested in the December 4 case have been upgraded to attempted second-degree murder and conspiracy to commit second-degree murder. One of the unnamed students is identified as Bryant Purvis, 17, Bail set at $70,000.00.

He called one of the guys that beat him up a "nigger" at lunch and THATS why there was a fight.
In a perfect, utopian, nonviolent world they would have walked away but given the tensions and the degree to which the institutions of the town failed to do anything to protect the black students for months prior to the fight, the altercation is no suprise.
In almost any town in this country a white guy calling teenaged black men niggers is cause for a fight. Even an uneven one. Lets not let this authors issues deflect attention from what happened...
A white guy called a black teen a nigger in a town where nooses were hung from a tree because they had the nerve to sit where white folk didnt want them to.
and instead of being suspended or expelled for fighting the black men were charged with attempted murder.
While the white kids that had participated in a fight at a house party prior to this incident were charged with nothing.
The situation was caused by the failure of the white run institutions.
The tensions were raised by the nooses hung by white students.
...and the final fight was precipitated by a white man calling the young black man a nigger.
and then the white institutions, instead of correcting their mistake only reinforced the notion that whites can get away with anything but the black student better not respond in kind or their lives will be forfit.
There is no confusion about the moral high ground.

What people never talk about is the stream of fights that happened before the final "BEAT DOWN" where the same student brought a gun to school was threatening the other students and receive a mild punishment. Or how the young man in question who is still in jail was threatened by the DA not to report the "incident" because he had his life in the palm of his hand. Remember when it comes to American Terrorism people always seem to turn a blind eye on justice. Honestly, it is the very same ignorance and oblivion to the truth that keeps the "US" seprated. PLEASE find the time to educate yourselves in full about having an opinion on matters!

-Jena Times does not mention Bailey's beating (with beer bottles!) at the party on Dec. 1st. and states Bailey and others "raided the fair barn party."
-according to the JT, the "victim" of the fight on Dec 2nd was attacked by three black males who robbed him. the theft was the firearm which belonged to the "victim" who wielded it against Bailey and others who were trying to defend themselves.
-according to JT, "one of the most violent attacks in Jena High School's history was orchestrated by seven black students on a lone white student." what ever happened to innocent until proven guilty.
in fact, the whole tone of JT downplayed any racial tension, focused on the "violent past/transgressions" of the black students and failed utterly in holding any of the white students responsible for their comparable acts of harassment.
if you read and hear other reports, they are just as guilty as they fail to mention specific details which give proof to the actual problem: the unfair sentencing of whites and blacks. i'm absolutely frustrated every time i read an article that fails to even mention the fights, along with their unfair sentencing, that lead up to the Jena 6 being charged.
thank you, dj7128, for your timeline and focusing on what needs to be said, which this article and many others have failed to do. and if anyone wants to dispute this, Newsweek's article A Town in Turmoil backs-up dj7128's timeline.

Not that this changes the obvious fact that there seem to be two different sets of laws for these kids. The attempted murder charge is complete BS and many of the white kids who got off with a slap on the wrist should have recieved harsher punishments. I'm just saying that if everybody alters the facts to suit their argument, then every reader can find an argument to suit their opinions, no matter how biased those opinions are.

The u.s. got the rest of the world hating her because of this retarded administration, yet the u.s. gov't and it's white majority can find energy to exude it's habitual racism against it's own citizens instead of trying to repair it's image to the world.
I thought that the KKK were enjoying their retirement since I haven't seen them in the news or read about them on the internet standing along with the minutemen building the wall along the u.s. borders or volunteering their services over in Iraq, Gutamnamo Bay, or Afganistan or protest AIPAC growing power in the u.s. gov't.
African Americans in this country know what the true definition of terrorism really means. I'm quite sure most people of color in this country fear the gov't and the sight of white people than any foreign enemy outside of this country.

The double standard at play can't be denied, and that is what we need to focus on. Let's not forget that those involved, black and white, are kids. Juveniles. As such, they are even more at the mercy of the social systems they live in (school, legal system etc), and those systems catastrohpically failed everyone involved. The outcome is uneven and undeniably disparate in meting out so-called 'justice'.
No one comes out smelling like roses, and the racism endemic to the system continues. It's a sad day for all.

Ask Pat Tillman's family how the gov't treated their son. Ask the other white soldiers and their families how the u.s. gov't treated them when they need medical care and couldn't get any (Walter Reed in Washington D.C. and who knows how many other V.A. hospitals are being ran in the same fashion) or how the congress voted to make filing for bankruptcy harder even for those who are putting their lives on the line to fight in a war based on a big ass LIE.
Better yet, you take yourself over to Iraq or Afghanistan (as a u.s. soldier not as an employee of Blackwater) and come back to the u.s. and see if your gov't open their arms to you and your whiteness.
You whites who aren't rich (that means those who are not in the 3% group who controls 97% of the world’s wealth) will soon see what it means to be an African American in this country.

here's an interesting excerpt that shows what a troublemaker Mychal Bell was and also highlights a legitimate problem a black resident faced in getting a proper police response:
"Huey Crockett, 50, lives with his wife, Carla, 45, in a heavily wooded, predominantly black district just beyond Jena's limits, an area known as "The Country." The Crocketts, who are black, have complained to police that Bell and other youngsters were causing trouble in their neighborhood — scratching cars with keys, breaking the windows of parked cars, spraying property with paint.
The authorities, Crockett says, were always slow to respond.
"But as soon as he had a run-in with a white boy, they came down on him like a hammer. That's not right. If I call the police for an incident here, it may take them an hour, an hour and half to get out here. But they'll be right out in an instant if a white person calls them."

Imagine you were walking down a city street, and someone leapt from behind a tree and hit you so hard that you fell to the sidewalk unconscious. Would you later describe that as a fight?
Only the intervention of an uninvolved student protected Mr. Barker from severe injury or death. There was serious bodily harm inflicted with a dangerous weapon — the definition of aggravated second-degree battery...

About the nooses: that was no "prank" - it was a terroristic threat. I am no judge as to whether the punishment meted out was just - it does seem minimal in the absence of other facts.
Imagine the outcry if six white boys had savagely beaten a black kid over a racial incident. You can bet the same people who are calling this a "schoolyard fight" would be screaming "HATE CRIME!"
Now white supremacist groups are getting involved, the names and addresses of the black parents have been published and more terroristic threats issued.
It is time for the Justice Department to step in - ain't it great we can have faith that wise and measured steps will be taken?
If the right moves aren't made by somebody and soon - this may be the beginning of the problem - not the end.

Well, considering that white were also lynched, does it give them the right to go beat up someone when they see a noose??
The students may have been charged wrongly as adults but this is a case of discrimination on the part of the blacks..The white student civil rights were violated.
In a similar case in Woodside Queens NYC, a few white teens attacked with bats a few black teens as the blacks tried to steal a car. They were tried and jailed for violating the blacks civil rights by calling them racial names during the attack!
If the law is good for the whites it must be good for the blacks. If not racial justice in this country will never come!

In my hometown, three teenage women were attacked and beaten on Halloween by a mixed group of young African-Americans. Fortunately our local court had a judge with juvenile experience of long-standing.
Neither side was pleased with his decision to be lenient--assigning guilt but placing the guilty on probation and limited after-school freedom. The parents of the guilty promised to appeal. The friends and family of the victims attempted to force a recall of the judge. So far as I know, neither was followed through on.
The whole community acted injured by the incident, yet most of us realize it is the reality of life on our streets today. Aristotle also said that it is who rears us that give us our values, for each generation must be taught anew. We must learn the lesson of human respect over and over, so we dare not take the hard-won lessons for granted.

How can so many miss the obvious point? The point is that UNCHECKED EVIL TENDS TO ESCALATE! The Initial white aggression in Jena (that included physical intimidation), escalated because it was unchecked, until blacks got physical.
The issue is WHY WAS WHITE AGGRESSION UNCHECKED AND BLACK AGGRESSION CHECKED SO SEVERELY? We all know the answer?

Jena 6 happened precisely because white aggression was UNCHECKED, by those with the responsibility to check it. If those of you commenting were intelligent and unbiased you would have known that. You may have even had the integrity and decency to comment on the real issue.
This conversation is akin to the moral outrage whites felt against Nat Turner. How could that evil Nat have killed those poor whites? Would you agree, today - that was a ridiculous question? Your comments are the same.
While we're on the point of our liberal brothers not getting it: Michael Vick proves massive racial delusions, also. The point Blacks were making in the Michael Vick case is that while Mr. Vick was wrong, NO Other human, in the history of Dog-Fighting has ever suffered for their mistake (and it was a mistake) to the extent Mr. Vick has. To date he has lost almost a Hundred Million Dollars, his career, and quite possibly his freedom. He lost all of this as a result of doing what pit-bulls were bred in ENGLAND to do. Mr. Vick did not start the phenomenon known as dog-fighting. He is not the biggest dog-fighting concern ever established in America. And you will not make him out to be the equivilent of a serial killer, or slave-holder just becasue you make shrill comments about destroying him. You only reveal the same sickness that has existed too long in too many Ameican citizens - racism. You can deny ot until Jesus returns, but the punishment far exceeds the crime, and the only reason we are comfortable wit that obvious fact is racism. To deny that is to demean yourself because we ALL really know the truth.
There is a case of kidnapping, rape, and torture in West Virginia that has received comparatively little attention from the liberal Alternet readers. The victim is a black woman. Is she valued as much as a dog? So where's the moral outrage? Trust me. IF you try hard - YOU CAN HANDLE THE TRUTH.
Anyone comfortable seeing the punishment Mr. Vick is subjected to, by definition, must be sad, vindictive, cold-hearted and troubled, much more so than even Michael Vick, whom we so zealously point the finger at with our "moral outrage."
The simple truth is that underlying Jena, Michael Vick, Iraq, and America, et al - there is something else, much more sinister, UNSPOKEN, and evil that we had better root out before it destroys us all.
Like Martin Luther King, let the real men and women - the real HUMAN BEINGS be about the business of finding, and dealing with the simple truth. It seems my Liberal Alternet Brothers struggle with truth, when it comes to race as much as my Rush L brothers.

So, there is no justice in the Jena six being in jail or charged with anything. If we go to the beginning, the superintendent, school board, prosecuting attorney should all be charged with inciting violence and the contributing to the delinquency of minors. The idea that these adult caretakers of the legal, social and educational institutions of Jena should use their status to promote a double standard in the law, enforce their racist (yes racist) concepts onto the public square and discourse is criminal.
They missed an opportunity for the children to learn to handle their disagreements and to talk about race, inequality and racism BECAUSE of their own personal and profound racism against non-whites.
We need to push for a federal department of justice, civil rights and homeland security as well as Congressional investigation what motivated of these "adult" to create this type of injustice and think they could get away with it.
If we expose them and focus on their actions we will help the Jena 6 and millions of other Americans of all races to understand and appreciate that we the people must stand together and say ENOUGH WITH THE RACISM ENOUGH.
These were kids fighting within the racist context and reality constructed by the adults and power holders in Jena. The kids could have easily been directed in another way, if the adults were responsible people.
Just for fun, listen to Democracy NOW's interviews with the white member of the Jena School Board -- listen to the coded conversation about blacks keeping their place, not pushing for things that they can't get or are not priviledged to have. He refered to the blacks as "our." Then listen to the Mother of one of the jailed youth. Her response to the noose incident, in a response to her son's question about what the nooses on the tree meant, she replied that it was something form "slavery" time. Listen to the black man who had been part of the school system, principal???, who spoke in total code as though he could not come out and speak what was the truth from his heart. FEAR was in the voices of both black people, they are terrorised in Jena.
Our reality as northerners, racial justice seekers, etc. should not blind us to the fact that for many parts of America, racism is a RIGHT of whites over all people of color.
We thank the Jena 6 for their heroic sacrifice to send out a clarion call to all of us, the fight is still on! Dr. King's beloved community is no where near, his dream requires real work, not simply waking up from sleep.

TIMELINE
2006
Sept. 1 - Students arrive at Jena High School to find three nooses hanging from a tree in the center of the campus. Earlier in the week, some black students had asked whether they could sit under the tree alongside the white students.
Sept. 7 - Three white students are recommended for expulsion by the Jena High School principal after being accused of hanging the nooses.
Sept. 8 - The white superintendent said, "Adolescents play pranks," the superintendent told the Chicago Tribune, "I don't think it was a threat against anybody," and gave them a three day suspension instead..
Nov. 30 - Fire destroys the main academic building at Jena High School and is ruled the work of an arsonist. Later that night, a fight is reported at the Fair Barn in Jena at a private party.
Dec. 1- a black student, Robert Bailey attends a “white party” and is beaten and has a bottle broken over his head. One person was later charged with simple battery for the beating and given probation. This charge came after the black students were charged.
Dec. 2 - A fight is reported at the Gotta Go convenience store in Jena in which investigators say three students including Bailey, confronted another white man and took his shotgun. The man with the shotgun had participated in the beating of Bailey the previous night and drew the shotgun on the 3 blacks. The students wrestled the gun away from the man and took it to the police station and reported the incident. Later these kids, Shaw, Bailey and Ryan Simmons, 17, were all arrested on charges of theft of a firearm, second-degree robbery and disturbing the peace in connection with this incident.
Dec. 4 - Jena High School reopens, white student Justin Barker is attacked by several
students, knocked unconscious and punched and kicked while he was down he regained consciousness and was rushed to LaSalle General Hospital. The LaSalle Parish School Board declares a state of emergency after the fire. Justin Barker is treated and released and later that same evening attended a school function. The shoes that were worn and used in the kicking incident, were later named as the weapons in the aggravated assault, and the attempted murder charge.
By law there must be a weapon used for the aggravated assault charge.
Dec. 5 - It is announced that four people have been arrested in the December 4 fight -- Carwin Jones, 18, bail set at $100,000.00 Robert Bailey Jr., 17, bail set at $138,000.00 Theo Shaw, 17, bail set at $130,000.00 and an unnamed juvenile later identified as Jesse Ray Beard -- and charged with aggravated second-degree battery. Also, Shaw, Bailey and Ryan Simmons, 17, are arrested on charges of theft of a firearm, second-degree robbery and disturbing the peace in connection with the Dec. 2 fight. Deputies arrest Justin Sloan, 22, of Jena, in connection with the November 30 fight and also implicate Bailey in that fight.
Dec. 6 - It is announced that another unnamed juvenile has been arrested in the December 4 fight.
Dec. 7 - The LaSalle Parish District Attorney's Office announces that the charges against the six students arrested in the December 4 case have been upgraded to attempted second-degree murder and conspiracy to commit second-degree murder. One of the unnamed students is identified as Bryant Purvis, 17, Bail set at $70,000.00.

He called one of the guys that beat him up a "nigger" at lunch and THATS why there was a fight.
In a perfect, utopian, nonviolent world they would have walked away but given the tensions and the degree to which the institutions of the town failed to do anything to protect the black students for months prior to the fight, the altercation is no suprise.
In almost any town in this country a white guy calling teenaged black men niggers is cause for a fight. Even an uneven one. Lets not let this authors issues deflect attention from what happened...
A white guy called a black teen a nigger in a town where nooses were hung from a tree because they had the nerve to sit where white folk didnt want them to.
and instead of being suspended or expelled for fighting the black men were charged with attempted murder.
While the white kids that had participated in a fight at a house party prior to this incident were charged with nothing.
The situation was caused by the failure of the white run institutions.
The tensions were raised by the nooses hung by white students.
...and the final fight was precipitated by a white man calling the young black man a nigger.
and then the white institutions, instead of correcting their mistake only reinforced the notion that whites can get away with anything but the black student better not respond in kind or their lives will be forfit.
There is no confusion about the moral high ground.

What people never talk about is the stream of fights that happened before the final "BEAT DOWN" where the same student brought a gun to school was threatening the other students and receive a mild punishment. Or how the young man in question who is still in jail was threatened by the DA not to report the "incident" because he had his life in the palm of his hand. Remember when it comes to American Terrorism people always seem to turn a blind eye on justice. Honestly, it is the very same ignorance and oblivion to the truth that keeps the "US" seprated. PLEASE find the time to educate yourselves in full about having an opinion on matters!

-Jena Times does not mention Bailey's beating (with beer bottles!) at the party on Dec. 1st. and states Bailey and others "raided the fair barn party."
-according to the JT, the "victim" of the fight on Dec 2nd was attacked by three black males who robbed him. the theft was the firearm which belonged to the "victim" who wielded it against Bailey and others who were trying to defend themselves.
-according to JT, "one of the most violent attacks in Jena High School's history was orchestrated by seven black students on a lone white student." what ever happened to innocent until proven guilty.
in fact, the whole tone of JT downplayed any racial tension, focused on the "violent past/transgressions" of the black students and failed utterly in holding any of the white students responsible for their comparable acts of harassment.
if you read and hear other reports, they are just as guilty as they fail to mention specific details which give proof to the actual problem: the unfair sentencing of whites and blacks. i'm absolutely frustrated every time i read an article that fails to even mention the fights, along with their unfair sentencing, that lead up to the Jena 6 being charged.

Not that this changes the obvious fact that there seem to be two different sets of laws for these kids. The attempted murder charge is complete BS and many of the white kids who got off with a slap on the wrist should have recieved harsher punishments. I'm just saying that if everybody alters the facts to suit their argument, then every reader can find an argument to suit their opinions, no matter how biased those opinions are.

The u.s. got the rest of the world hating her because of this retarded administration, yet the u.s. gov't and it's white majority can find energy to exude it's habitual racism against it's own citizens instead of trying to repair it's image to the world.
I thought that the KKK were enjoying their retirement since I haven't seen them in the news or read about them on the internet standing along with the minutemen building the wall along the u.s. borders or volunteering their services over in Iraq, Gutamnamo Bay, or Afganistan or protest AIPAC growing power in the u.s. gov't.
African Americans in this country know what the true definition of terrorism really means. I'm quite sure most people of color in this country fear the gov't and the sight of white people than any foreign enemy outside of this country.

The double standard at play can't be denied, and that is what we need to focus on. Let's not forget that those involved, black and white, are kids. Juveniles. As such, they are even more at the mercy of the social systems they live in (school, legal system etc), and those systems catastrohpically failed everyone involved. The outcome is uneven and undeniably disparate in meting out so-called 'justice'.
No one comes out smelling like roses, and the racism endemic to the system continues. It's a sad day for all.

Ask Pat Tillman's family how the gov't treated their son. Ask the other white soldiers and their families how the u.s. gov't treated them when they need medical care and couldn't get any (Walter Reed in Washington D.C. and who knows how many other V.A. hospitals are being ran in the same fashion) or how the congress voted to make filing for bankruptcy harder even for those who are putting their lives on the line to fight in a war based on a big ass LIE.
Better yet, you take yourself over to Iraq or Afghanistan (as a u.s. soldier not as an employee of Blackwater) and come back to the u.s. and see if your gov't open their arms to you and your whiteness.
You whites who aren't rich (that means those who are not in the 3% group who controls 97% of the world’s wealth) will soon see what it means to be an African American in this country.

here's an interesting excerpt that shows what a troublemaker Mychal Bell was and also highlights a legitimate problem a black resident faced in getting a proper police response:
"Huey Crockett, 50, lives with his wife, Carla, 45, in a heavily wooded, predominantly black district just beyond Jena's limits, an area known as "The Country." The Crocketts, who are black, have complained to police that Bell and other youngsters were causing trouble in their neighborhood — scratching cars with keys, breaking the windows of parked cars, spraying property with paint.
The authorities, Crockett says, were always slow to respond.
"But as soon as he had a run-in with a white boy, they came down on him like a hammer. That's not right. If I call the police for an incident here, it may take them an hour, an hour and half to get out here. But they'll be right out in an instant if a white person calls them."

Only the intervention of an uninvolved student protected Mr. Barker from severe injury or death. There was serious bodily harm inflicted with a dangerous weapon — the definition of aggravated second-degree battery...
