Tipping the Scales of Justice in Jena

The tree at Jena High School has been cut down, but the furor around it has only grown.

"What did the tree do wrong?" asked Katrina Wallace, a stepsister of one of the Jena Six, when I interviewed her at the Burger Barn in Jena, La. "I planted it 14 years ago as a tree of knowledge."

It all began at the start of the school year in 2006, at a school assembly, when Justin Purvis asked if he could sit under the schoolyard tree, a privilege unofficially reserved for white students. The next morning, three nooses were hanging from its broad, leafy branches.

African-American students protested, gathering under the tree. Soon after, the district attorney, Reed Walters, came to the school with the police, threatening, "I could end your lives with the stroke of a pen." Racial tensions mounted in this 85 percent white town of 4,000. In December, a schoolyard fight erupted, and the district attorney charged six African-American high school students, the soon to be dubbed Jena Six, with second-degree attempted murder.

I recently visited Billy "Bulldog" Fowler in his office. He's a white member of the LaSalle Parish School Board. He says Jena is being unfairly painted as racist. He feels the hanging nooses were blown out of proportion, that in the high school setting it was more of a prank: "This is the Deep South, and [older] black people know the meaning of a noose. Let me tell you something -- young people don't."

That night, I went to see the Baileys in their mobile home in Ward 10, one of the black neighborhoods in Jena. Two of the Jena Six, Robert Bailey and Theo Shaw, were ironing their clothes. I asked them what they thought when they saw the nooses. Robert immediately said: "The first thing came to mind was the KKK. I don't know why, but that was the first thing that came to my head. I used to always think the KKK chase black people on horses, and they catch you with rope."

Theo said he thought the students who hung the nooses "should have got expelled, cuz it wasn't no prank. It was a threat." School principal Scott Whitcomb thought the same. He recommended expulsion of those who hung the nooses, but the superintendent overruled him, imposing three days of suspension. Whitcomb resigned.

The African-American teens were dealt with differently. They were expelled, but appealed to the school board. The school district had conducted an investigation, but the school board was not allowed to review it. The school board's lawyer was none other than the prosecuting district attorney, Reed Walters.

Board member Fowler recalls the January meeting: "Our legal authority that night was Mr. Walters."

I asked, "And he told you, you couldn't have access to the school proceedings, or the investigation?"

Fowler replied: "That's right. [Walters said] it was a violation of something." The board voted, without information. Fowler recalls: "It was unanimous. No, no it wasn't. There was one board member who voted no, and that was Mr. Worthington." Melvin Worthington, the only African-American on the school board, voted against upholding the expulsion of the black students.

Asked if he felt that Walters had a conflict of interest that night, Fowler replied, "Well, I'm assuming that Mr. Walters knows the law."

Louisiana's 3rd Circuit Court of Appeals doesn't agree. The court just overturned Walters' first conviction in the Jena Six case (by an all-white jury), that of Mychal Bell, ruling that he should have been tried as a juvenile. Walters pledges to challenge that ruling in the Louisiana Supreme Court, while continuing to pursue the other five prosecutions.

Bell remains in jail, where he has been since last December. Although yet to be tried, the others were jailed as well. Theo Shaw just got out earlier this summer. Imprisoned with adults who were maced repeatedly, Theo's asthma was triggered, and he was hospitalized.

National organizations like the NAACP have called for a major march in Jena on Sept. 20, the day Bell was to be sentenced. Although his conviction has been overturned, the march will happen, with thousands expected.

Do GOP administrations by their actions bring racism out of people? Or has the USA simply remained so terribly racist?

Thank you Amy for a good explanation of what happened. All Americans should be up in arms over this.

It's advisable to look at the components of such a situation.

Original request to sit under the tree. The principal could have set up a student committee to discuss. Was this done?

The stringing up of the nooses that night. This escalated the situation like a match to tinder whether it was malicious or just thoughtless. Again, was there a serious attempt to bring the students into a discussion of the issues?

The fight and the criminal charges of attempted murder. Another escalation. Was there any evidence of criminal intent?

Racial tensions can exist anywhere there is a "racial" minority. This could have been a useful learning experience for all the students if handled properly and expediently.

Obviously, it would have been better to have prevented the situation in the first place. I wonder if the principal resigned because he had failed to do this.

Give me a break. A group of the black kids jumped one white kid, beat him unconscious, and kicked him while he was down and knocked out. You gave no detail about the crime, for which they've been convicted, and focused completely on the 'noose incident'. An investigation in the case has revealed that the attack occurred 3 months after the noose was hung, and that the two events weren't even connected.

Extremely stilted and dishonest reporting.

NAACP thirty-years late

and from the way mlk lll and his sister looked on the news channels, they're not missing a meal either. They had to finally get off their duffs, straighten out their backs, do some stretching to attend this.

Yeah, well, the NAACP is over thirty-years late on that one, and as for jobs for minorities, there over twenty years late on that one, also.

And the wheel of racisim will still spin long after the Jena crowd leaves!!

White people in Jena are terrified of the growing Black population, so they panic and resort to dangling nooses from a favorite tree, then railroading a student to years in prison for a highschool fist fight. Instead, perhaps they should welcome family a planning clinic to Jena where Whites and Blacks together can plan the future of their children according to the jobs and educational opportunities available in the the state and beyond. Then neither race would be a threat to the other because all their human needs would be accomodated.

not only of their racist past but, their racist present as well. Black reaction is always overblown (according to these people) while White inaction is perfectly acceptable. I can't imagine being such a hateful person that I would deny the humanity of others based on the color of their skin. What a pathetic existance that is. Free the Jena 6, and power to the people!

that America has turned the corner on its racist history along comes a story like this.
What is really disturbing is the opinions of reichwhingers who seem to think that in some sense the outlawing of blacks from sitting under a tree should be "discussed".

I dont live in America ( thank god! ) but I wonder how many reichwing news services are denouncing the racists in this town. Your answer to endemic racism in America will lie there.

Bell is violent criminal

JENA — In addition to Mychal Bell's recent felony conviction, his criminal history was revealed Friday to contain four other violent crimes.

Because of that, a LaSalle Parish judge denied a request to reduce the 17-year-old's bail in his current scrape with the law. Bell remains in jail in lieu of a $90,000 bond.

Bell was convicted in June of aggravated second-degree battery and conspiracy to commit that crime for his part in a Dec. 4 incident at Jena High School that left fellow student Justin Barker unconscious.

Bell is one of six black students, known as the "Jena Six," who have been charged in connection with the attack on Barker, who is white.

According to court documents, someone hit Barker from behind, knocking him out, then others began to kick and stomp his "lifeless" body. He spent about three hours in a local emergency room for treatment of injuries to his head and face.

Three months prior to that attack, Bell committed two violent crimes while on probation for a battery Christmas Day 2005, according to testimony. Later that same week, he led the Jena Giants to a shutout victory in a football game against the Buckeye Panthers. Bell was adjudicated — the juvenile equivalent to a conviction — of battery Sept. 2 and criminal damage to property Sept. 3, said Cynthia Bradford, LaSalle Parish deputy clerk.

A few days later, on Sept. 8, Bell rushed 12 times for 108 yards and scored three touchdowns — one of the best performances of the year for the standout athlete.

Mack Fowler, Jena High's football coach at the time, said Friday he hadn't heard about Bell's specific criminal history.

Fowler said that at one point he had a policy in place more severe than the school's when it came to students with discipline problems. But he said he discovered that while he was punishing his players, the school "wasn't doing anything" to them.

Fowler said he decided then that he was going to do the same thing the school did — nothing.

According to Louisiana code, "bail may be allowed" after conviction but before sentencing if the maximum sentence is more than five years' imprisonment. Bell faces as many as 22½ years. The code gives an exception of "when the court has reason to believe, based on competent evidence, that the release of the person convicted will pose a danger to any other person or the community."

LaSalle District Attorney Reed Walters pointed out that Bell was placed on probation until his 18th birthday — Jan. 18, 2008 — after an incident of battery Dec. 25, 2005. After being placed on probation, he was adjudicated of three other crimes, the two in September and another charge of criminal damage to property that occurred on July 25, 2006.



Judge J.P. Mauffray Jr., with the 28th Judicial District Court, went over the factors in Louisiana code used to determine bail, pointing out specifics in Bell's case:

n The seriousness of the offense: "It is a serious offense because it is a crime of violence," he said.

n The weight of the evidence against the defendant: Mauffray said it was "pretty weighty" considering the jury convicted Bell.

n The previous criminal record of the defendant: He said a criminal record was obviously present considering that Bell had been adjudicated on three offenses that were committed while he was on probation and then convicted this year in adult court.

n The nature and seriousness of the danger to any other person or the community that would be posed by the defendant's release: Again, Mauffray pointed out that Bell now has either been adjudicated or convicted of five crimes of violence.

So everybody's broke. Can't shop the way they once did. Major debt. So enter the fear and hate mongers. I admit that nooses hanging from a tree in the south is hardly subtle. But look around. Hatred and bigotry are free. And folks are buying, including young people. The new class identity thing in this country is sick. Especially among kids, who are only worth what their parents are worth (sort of). The problem here is lost in the chaos. Thanks, ANNA

6 kids beat a kid senseless, beat him unconscious. That's a savage beating and a crime. Declaring these assailants are some kind of martyrs is ridiculous and racist.

of out-of-control juvenile delinquents? Noose hangers as well as football goons. Jena sounds like it's hosting an open-air production of Lord Of The Flies. What's that you say, no space in America's vast gulags for these cretins? Well, maybe if you release all the non-violent offenders and drug users (half the prison population), there'll be a few spare cells. :o)

Imagine your child was beaten up by 6 thugs. Would you care what color they were?

How can anyone justify 6 people beating up 1?

The incident in West Virginia last month with the white racist sicko bastards kidnapping, raping, torturing, mentally abusing that black lady was horrible. 6 black beating 1 white kid is horrible.

Racism is racism and a hate crime is a hate crime. Obviously putrid people come in all colors.

Hanging a Noose is a DEATH THREAT

I'm a bit pissed off by those saying that hanging a noose to a tree is hurtful, a bad prank, or that it has any other meaning than to threaten the life of black people.

It is plain and simple a death threat!

Threatening to kill people and bringing the tools to accomplish such a feat does not warrant a mere 3 day suspension. With all the school killings going on they should have called off school until the police were able to capture those plotting to kill black students at the school. Those black kids as well as the entire student body should not be required to attend a school where death threats are tolerated.

The school and the community through their elected school board displayed a complete lack of respect for life. This indifferent attitude toward the well being of their students created an atmosphere of violence. Doubtless the students felt that their safety and wellbeing were not going to be protected by the school board, the community, and law enforcement. It is not suprising that some felt they needed to protect themselves in the only manner their could as young an inexperienced people.

Perhaps the federal government ought to consider withdrawing all federal funds from the town of Jena unless they end their racism and tolerance of racism. I certainly think my federal tax dollars could be better spent. Maybe the local enforcement, governmental, school, and prosecutorial agencies all ought to be taken over by federally appointed managers who have been thoroughly pre-screened to weed out racists.

In NYC there is complete turmoil and what would be riotous. if not police crowd controlled, outrage over Ahmadinejad's scheduled talks at the UN and especially Columbia University.
One can easily imagine people-adults-being beat to death or seriously injured in street brawls over this man's appearance, where some people are ready to completely shut down the First Amendment at Columbia ...a University of all places. His 'crime' was allegedly making statements about the Holocaust that were grossly disrespectful-to say the least-to jews.I wonder how many of the racist bastards who soft pedal or dismiss as 'prankish' the 'nooses' would be willing to get in the face of some of the jews and tell them to 'relax'..'get over what he said'...'it's merely words'...'you jews are blowing this ALL out of proportion'..etc.,etc. Any volunteers??

I thank you for keeping the story alive.

Do I understand this correctly? The step-sister of one of the Jena Six planted the tree? Please tell me that is not true. The irony is too stark.

I was devastated when I learned the graceful greenery was destroyed. If the history of this plant is as I think I understand, oh my.

For me, so much of my sorrow is not evident in the focus. People cheer and jeer as though justice might be served in this case or in similar situations. Racism is rampant. Subtle, visible, and invisible, it survives. Indeed, laws strengthen the rights of racially prejudiced persons.

In my mind the school yard fight and the nooses are symptoms of a far greater problem. In America, in the twenty-first century, a human being enrolled in an educational facility feels a need to ask permission before he or she sits under a tree on campus.

I think this speaks volumes. The community claims it is not bigoted, and yet, a young man knows to his core, he must seek the consent of authorities if he wishes to enjoy the shade a woody plant provides.

Even with Administrative approval, young persons are brutally threatened. Lives are endangered, all this, because a few young men chose to take pleasure in the tranquil shadow of a tree.

At the time of the protest, townspeople were interviewed. Jena folk claimed that their community was being unfairly judged [and what of the young men?] The cameras pulled back. Viewers saw the Black side of the tracks, and the white world. These were very different.

In Jena, on the day of the march Confederate flags flew. A truck passed by marchers; two nooses were draped over the edge of the truck bed.

Symbols . . . a "tree of knowledge" and what whites hang from the branches.

the local paper, the jena times, has an extensive timeline of all the events. go to the website and scroll down to see it. this story has taken on the status of an urban legend with all sorts of disinformation. read the timeline if you want the truth.
