The 13 Bush Officials Who Made Torture Possible

The Bush administration's Torture 13. They authorized it, they decided how to implement it, and they crafted the legal fig leaf to justify it.

On April 16, the Obama administration released four memos that were used to authorize torture in interrogations during the Bush administration. When President Obama released the memos, he said, "It is our intention to assure those who carried out their duties relying in good faith upon legal advice from the Department of Justice that they will not be subject to prosecution."

Yet 13 key people in the Bush administration cannot claim they relied on the memos from the DOJ's Office of Legal Counsel. Some of the 13 manipulated the federal bureaucracy and the legal process to "preauthorize" torture in the days after 9/11. Others helped implement torture, and still others helped write the memos that provided the Bush administration with a legal fig leaf after torture had already begun.

 

 

The Torture 13 exploited the federal bureaucracy to establish a torture regime in two ways. First, they based the enhanced interrogation techniques on techniques used in the U.S. military's Survival, Evasion, Resistance and Escape (SERE) program. The program -- which subjects volunteers from the armed services to simulated hostile capture situations -- trains servicemen and -women to withstand coercion well enough to avoid making false confessions if captured. Two retired SERE psychologists contracted with the government to "reverse-engineer" these techniques to use in detainee interrogations.

 

 

The Torture 13 also abused the legal review process in the Department of Justice in order to provide permission for torture. The DOJ's Office of Legal Counsel (OLC) played a crucial role. OLC provides interpretations on how laws apply to the executive branch. On issues where the law is unclear, like national security, OLC opinions can set the boundary for "legal" activity for executive branch employees. As Jack Goldsmith, OLC head from 2003 to 2004, explains it, "One consequence of [OLC's] power to interpret the law is the power to bestow on government officials what is effectively an advance pardon for actions taken at the edges of vague criminal statutes." OLC has the power, Goldsmith continues, to dispense "get-out-of-jail-free cards." The Torture 13 exploited this power by collaborating on a series of OLC opinions that repeatedly gave U.S. officials such a "get-out-of-jail-free card" for torturing.

 

 

Between 9/11 and the end of 2002, the Torture 13 decided to torture, then reverse-engineered the techniques, and then crafted the legal cover. Here's who they are and what they did:

 

 

1. Dick Cheney, vice president (2001-2009)

On the morning of 9/11, after the evacuation of the White House, Dick Cheney summoned his legal counsel, David Addington, to return to work. The two had worked together for years. In the 1980s, when Cheney was a congressman from Wyoming and Addington a staff attorney to another congressman, Cheney and Addington argued that in Iran-Contra, the president could ignore congressional guidance on foreign policy matters. Between 1989 and 1992, when Dick Cheney was the elder George Bush's secretary of defense, Addington served as his counsel. He and Cheney saved the only known copies of abusive interrogation technique manuals taught at the School of the Americas. Now, on the morning of 9/11, they worked together to plot an expansive grab of executive power that they claimed was the correct response to the terrorist threat. Within two weeks, they had gotten a memo asserting almost unlimited power for the president as "the sole organ of the Nation in its foreign relations," to respond to the terrorist attacks. As part of that expansive view of executive power, Cheney and Addington would argue that domestic and international laws prohibiting torture and abuse could not prevent the president from authorizing harsh treatment of detainees in the war against terror.

 

 

But Cheney and Addington also fought bureaucratically to construct this torture program. Cheney led the way by controlling who got access to President Bush -- and making sure his own views preempted others'. Each time the torture program got into trouble as it spread around the globe, Cheney intervened to ward off legal threats and limits, by badgering the CIA's inspector general when he reported many problems with the interrogation program, and by lobbying Congress to legally protect those who had tortured.

 

 

Most shockingly, Cheney is reported to have ordered torture himself, even after interrogators believed detainees were cooperative. Since the 2002 OLC memo known as "Bybee Two" that authorizes torture premises its authorization for torture on the assertion that "the interrogation team is certain that" the detainee "has additional information he refuses to divulge," Cheney appears to have ordered torture that was illegal even under the spurious guidelines of the memo.

Do you want to know why I love Jesse Ventura so much? Because he makes EVERYBODY angry. The other night on Larry King Live, Jesse said, "I'll tell you what: you give me a waterboard, Dick Cheney and one hour, and I'll have him confess to the Sharon Tate murders." I can top that one easily. Just give me two hours with the hideous thug and I'll have him confessing that he was part of the Lincoln Assassination conspiracy. Oh, hell - give me three hours and he'll be saying that he framed Judas! And speaking of Judas....

NOTE TO THE RELIGIOUS RIGHT: Jesus Christ was crucified on a cross. You folks might want to rethink your position on torture. Just a thought.

Ah, Dick Cheney! As the clock was counting down on the final hours of the Bush administration, I have to confess that I was feeling kind of blue. It would never again get half as weird or one tenth as entertaining as it was when Richard Bruce Cheney held center stage. I just assumed that the dirty old dingbat would slither away into that good night of ignoble obscurity and that would be that. But he didn't go away. Not only that, at a time when the GOP is desperately trying to mend its image and undo the irreparable damage that was done to it by the Bush Mob, our old pal Cheney is in the final stages of pounding the nails into the GOP's coffin. He knows he's in big trouble and is looking at a very long stretch in federal prison. He's out there talking as loudly as he possibly can to as many interviewers he can con into letting him into their studios. It is pitifully obvious that he is trying to contaminate any potential jury pool. You think such a blatantly opportunistic ploy is beneath him? Think again.

This may be pure paranoia on my part, but could it be that Cheney, as a result of his former position, received official intelligence that another attack is just around the corner and that he is positioning himself to say, "I told you so!"? Don't put it past him. Don't put it past him.

According to this article he "Now, on the morning of 9/11, they worked together to plot an expansive grab of executive power that they claimed was the correct response to the terrorist threat."

And according to "Secretary of Transportation Norman Mineta reported to the 9/11 Commission in 2003 that, when he arrived in the PEOC at about 9:20, Cheney was already there. Mineta then gave the following account of a conversation he witnessed:

“During the time that the airplane was coming in to the Pentagon, there was a young man who would come in and say to the Vice President, ‘The plane is 50 miles out.’ ‘The plane is 30 miles out.’ And when it got down to ‘the plane is 10 miles out,’ the young man also said to the Vice President, ‘Do the orders still stand?’ And the Vice President turned and whipped his neck around and said, ‘Of course the orders still stand. Have you heard anything to the contrary?"

Minetta's testimony was still on Youtube the last time I looked.

So Cheney was not only co-ordinating the 9/11 attack (response) or (none response - to be more accurate) in real time, but also the long term political response.

All on the morning of 9/11?

That's highly impressive.

Dick Cheney and his daughter need to stay home & quit running from one talk show to the next. He is guilty and he damn well knows it. Ask John McCain about torture. Whatever name you change it to, torture is illegal.

Cheney is proving that there is no need for harsh interrogation methods, merely a live camera.
Granted having a friendly person to allows him to feel comfortable, superior and then vindicated- but truely not necessary.Cheney has been providing taped confessions for the last few months- everytime he steps on a soundstage or up to a podium.
Freely admits he authorized torture. Brazenly admits he has no remorse and would do it again. Hell bob Schiffer got him to admit he had usurped the powers of the Presidency- W "Basically" knew? Is it not the requirement of ALL his staff to keep him fully informed. "Basically" indicates not everything reached the Oval Office, some held back by the VP office. Who is Cheney to determine what a War President must know and not know? sounds like Cheney Decided' what he 'Decider' was allowed to Decide on.
Cheney then goes to AEI (notice the 'Terrise' behind his head- how appropo), Bastardizing 9/11 with the litany of lies He used to justify an illegal inasion- WMD? Saddam/AQ connection? Anthrax?...I couldn't believe there was not One laugh or shrill of outrage from the audience- how stupid are you at AEI?
Funny he also just admitted the CIA was inept- wrong about WMD's,Wrong about a Connection and Wrong about the Anthrax origination. Hell apparently under the Bushies we couldn't even keep our Own WMD's safely contained- anthrax and that Plane with a nuclear Warhead flying across country!! And considering the numerous foreign coutnries who fell vicitme to terrorist attacks, their methods uncovered absolutely nothing about up coming events (Madrid). How many American (and others) died as a result of lack of intell around the world? And Please after attacking the WTC, the Pentagon and Potentially DC- the Terrorist decided to hit a Library in LA. That's the best target they could find on the West Coast- Not the TransAmerica building, The Space Needle, The Golden Gate Bridge, LA Port,Hollywood studios, Disneyland anyone of numerous Military Bases? And the Best they could come up with was some obscure Library? Bullshit! Hell it might as well have been Coit Tower- same design and as UNsymbolic.

Ruin the 'torture 13'

We need to personally ruin the 'torture 13'. Any getting any Government pensions or benefits except for Secret Service and related security must have them suspended. All should have their passports revoked. For Bush, suspend all funding and the ability to raise monies for his Presidential Libary. Yoo should be fired by UC-Berkley and Rice at Stanford without any benefits as they bring shame to those institutions. We should suspend the licenses of any who are lawyers and put them on the 'no-fly' lists along with terrorists. The IRS ought to intensively audit all of them to see any illegal income. Groups of people ought to protest in front of their homes, workplaces and otherwise make their and their family's lives miserable. Perhaps sic the papparzi on them rather than on far less dangerous clelebs.
I want them to face harasment and the ruin of their lives to realze the horrible damage they have done to America.

That's not enhanced interrogation, or even torture. It's murder!

As for Rumsfeld and his "I stand for 8 to 10 hours a day" statement, he is being deliberately dense--or he's incredibly stupid, as standing was not what these detainees were made to do. They were made to sit, squat, stand, hang, etc. in stress positions. I'd like to see how long Rumsfeld could even hold his arm out in a a straight, but elevated manner--as if he were pointing at a plane. My guess is that he wouldn't last five minutes, but I would bet a 1000 dollars he couldn't make it to 10 minutes. Yet, he thinks four hours of this kind of torture, or at the very least torment--do this yourself and draw your own conclusions--was being "soft."
It's just unbelievable.

To anyone who supports torture, you represent the very worst of our species. You have no humanity. I actually feel sorry for you, for when you realize what you have done, there will be no balm for such suffering. The demons of the Bardo shall rip thy flesh off piece by piece, and you will feel all the pain, physical and psychological, that accompanies torture.There will be gnashing of teeth.

I blame Hollywood, and especially that TV series "24," especially. Did you know that, recently, Keifer Sutherland, an actor I once liked, head-butted some fashion photographer at some party because he claimed the man had touched, in an offensive manner, Brook Sheilds (sorry if that's mispelled). Later, Brook Sheilds said that no one had touched her. Sutherland was arrested. I guess he forgot you have to be a banker or a politician to be above the law! And, onviously, he's let the whole 24 thing goto his head, just as it has gone to the empty heads of so many others.
Urgent notice: It's not real!!! Torture is a poor method for gaining intelligence! It is used to gain false confessions (like that there was a link between al-Qaida and Iraq) and is a method of sadism.

The people who have tortured Americans have NOT been able to use the excuse "I was just following orders," ever! There was no Statue of Limitation for War Crimes committed against us, or our allies; in fact, no War Crimes have ever been under the pressure of a Statue of Limitations, until now! We executed, and imprisoned for life the lawmakers (and these were not just attorneys but judges!)who went along with torture, or tried to justify it; we didthe same to the very highest leaders down to the lowest ranked soldiers. Of course, later, under "Operation Paperclip" many Nazis were released and went to work for our government, especially within the CIA, due to the "new" Soviet Menance. There is always a menace requiring war, because bankers run this country, along with the Military and medical Industrail Complexes(MICs) and this is how they make their money! The job of the CIA is not to bring peace and stability, but to incite rebellion, overthrow governments, and create chaos around the world, so that our true and one industry can flourish: the Arms industry! Weapons are our #1 export. The bankers sit at the top of the pyramid, and they finance both sides of all wars. They make the winner pay the debts of the loser (if they can't pay themselves)and in turn they fund the one they want to lose slightly less, but enough for them to hold out hope and keep fighting for as long as possible. This is why, among other reasons, the central (FED), international, and Wall Street bankers have indebted almost every nation to their eyeballs.
And it's because the federal Reserve has control of the creation of money, interest rates, etc. and no one has any oversight of them. Neither the President nor the Congress currently even have the power to audit the Federal Reserve, which is a unique institution. There's no other like it, really; it's neither a true government agency, but it works for the government, yet it is more like a private corporation, and is set up like a cartel.

The Bush/Chaney Administration was able to succeed where Osama bin Laden failed.

Should the crimes of treason, by the Bush/Chaney Administration, be overlooked, then these crimes of high treason will be repeated in future administrations. The Allies conducted the Nürenberg Trials (in 1945 to 1949) for several reasons:

A) To make aware that these crimes were actually committed,
B) To examine HOW these crimes were able to be committed,
C) Who committed these crimes and
D) To punish the criminals.

Should the guilty not be punished, then, their Criminal Acts would be absolved and could easily be repeated. There would not be any justice.

“The true administration of justice is the firmest pillar of good government.”

Should the Bush/Chaney Administration (alleged) criminals not be prosecuted, not be brought to trial and not found guilty, then, like the Ronald Reagan Republican group, they will be glorified, deified and praised.

With ALL the evidence available: Eyewitnesses, Documents, Dead Bodies, Remnants of Death Camps, Newsreel clips, piles of clothes, piles of shoes, piles of hair, piles of eyeglasses, piles of gold teeth –COLD HARD EVIDENCE-, there are Holocaust Deniers being celebrated, glorified and believed.

So, too, these (alleged) criminals will be praised and glorified for future generations.
We will have not have learned from history –and the American society will repeat this debacle.

It's Time to Focus on Criminal Prosecutions

It's time to focus on criminal prosecutions of these clowns. For now, Obama has to deal with stabilizing the economy and Bush's military debacles. The progressive movement should find a local US Attorney who will take prosecution of at least one of these yokels. In the 80's, the Reagan administration would not prosecute Michael Milken, the "father" of modern Wall Street Rape & Pillage. Into the picture walked Rudy Giuliani who was then US Attorney in New York. Old Rudy-Boy took down Milken all on his own. That's how Rudy came to prominence. The progressive movement needs to find prosecutors who will do the same. That being said, the better thing is to also work on getting these yokels before the Hague so that any conviction can't be pardoned by a future President.

The most ridiculous argument in the World is that that stuff was torture.
Bland diet? That is cruel.
Waterboarding? One guy got it 87 times in one month. Can't be that bad.
Loud, startling noises? That broke them.

This is the non-issue of 2009.

On April 28th Craig Murray, former British Ambassador to Uzbekistan, Provided Evidence on UK Government Complicity in Torture to the Joint Committee on Human Rights at The UK Parliament.

He was understandably nervous before giving evidence. The following day he posted this on his website

Just before I gave my evidence to Parliament yesterday, my sister Celia telephoned me to say that I would be speaking not for myself but for all those thousands who had suffered unspeakable torture around the World in the War on Terror, whose screams and sometimes death rattles were heard only by their torturers. She told me I was speaking for those who could not speak.

She put me into a calm place, and I tried to give my evidence very coolly and professionally, but I believe I did manage once or twice to break through the twisted legalese in which the committee have mummified themselves, to bring home the human cost of torture to them.

But I am completely astonished, and horribly depressed, that there has been almost no mainstream media of this quite sensational information. There has been not one word in any newspaper or on TV. The Today programme on Radio 4 ran a story on it at 6.45am, but did not repeat it. A piece went up immediately on the BBC website

I really cannot understand why no newspaper or TV channel has covered what is quite a startling development in a prominent continuing story on the use of torture in the War on Terror.

I had hoped that my evidence yesterday would be a significant step in ending the policy of obtaining intelligence from torture, and of bringing to account the ministers who approved it. But without any sign of public or media interest, the politicians will feel they can safely ignore the truth I told.

I was trying to speak up for those who have no voice. I feel very strongly that I have let them down.

Only their torturers heard their screams, and hardly anybody else heard my voice either. "

Nice work of connecting the dots. Even for a lay person, the writer makes complex "figleaf law" comprehensible.
The matter of 'authorized torture' will not go away. The legal 'minds' that disingeneously crafted this stinking pile of sh*t rightly deserve our collective scorn and jail time.
As much as I would like to see Dick Cheney shut the f*ck up, as long as he keeps a yapping away, he is digging a very fine hole for himself, along with the rest of the Torture 13. (Kudos to the poster who pointed this little factoid out.)
Torture is wrong. Period. No amount of pretzel logic can change that fundamental fact.

I do think they should have used waterboarding on more than just 3 people, but as long as they kept me and my family from being attacked by airplanes flown by maniac terrorists, I am satisfied.

Chaney is a lying, immoral, criminal who should be behind bars. It is an insult to all Americans to give him air time. As Biden said "he is the most dangerous Vice President we have ever had." He is a dangerous criminal and should not be allowed to speak in public.

You should be ashamed and we would rather listen to NPR

Jesse Ventura is a buffoon. Where was he when the Clinton White House decided to give our captured terrorists up to the tender mercies of the Egyptians? Lost amidst the battle of the Truthy True versus the string pulling Jet Set, is the lost SYMBOLISM of the destruction of the FALLEN TWINS...the Truthers think they are "investigating" a crime and a conspiracy. The Jet Set attempts to ridicule the Truthers. This is a game.

911 was brought about as a RIDDLE. The criminality of it is besides the point. The event was staged "Just For Fun" Apparently, I am not the only one who likes to watch...

Halliburton, Hunt, Weatherford from Houston are getting the oil contracts they coveted soaked in our soldiers' blood and the blood of 1.3 million dead Iraqis. The AEI, White Heritage Foundation, Pentagon, CIA/World Bank did this but they needed a couduit to Big Oil to get them on board because they love OPEC profits. Energy Task Force in March of 2001. A map has been declassifed with an attachment listing foreign oil suitors for Iraqi oil contracts following the invasion, overthrowing of a sovereign government and privatizing its oil which the Iraqis have resisted but the exploration and development has begun with Halliburton "managing" the southern region which includes Block 8 on the Saudi border from the map of March 2001, a nice present for Halliburton and a big check for Dick who gets paid for performance by his Halliburton handlers. Enron was supposed to harvest some of these plums but karma crushed it on the way to the oil rig. It is, was and always will be about oil and empire and jabbing a stick in OPEC. George Schultz on the board of Bechtel, $500 million classified contract for reconstruction of the oil plantation was Daddy Bush's Sec. of Defense and hand picked the boys for the invasion like Bremer from the Kissinger Group. All lies. All for oil and this nation allowed Dick Cheney, a lying, child-bombing oil thief to stand before her and justify torture just before Memorial Day when he never laced a boot for anyone but Halliburton. When you stir the pot, the truth will float to the top. It takes time but the truth about raping our unity after 9-11 into an international oil heist will be told succinctly by historians and they won't be kind. Mark my words. Every one of these sloths comes crawling back begging forgiveness just prior to their imminent demise; George Wallace and Lester Maddox begged forgiveness for their racist intolerance. I believe in my heart, Dick Cheney may be the exception.

What Do Their Professional Associations Say?

Lawyers, physicians, and psychologists have professional associations that go after ethics violations. Where are they in this? For example, physicians have refused to be the individual adminstering the lethal dose at a state execution, in order to avoid prosecution for unethical behavior. It seems as if using a psychologist to help design torture would put that psychologist in a bad position, ethics-wise.
