No More 'Enemy Combatants' -- But Is Obama Merely Rebranding Bush's 'War on Terror'?

Words matter, as Obama said on the campaign trail. But when it comes to his detention and counterterrorism policies, his actions are speaking louder.

The most pervasive early criticism of Barack Obama, aside from his inexperience, was that he was all rhetoric, no substance, an allegation he eloquently dismissed.

"Don't tell me words don't matter," Obama declared on the campaign trail last February. " 'I have a dream.' Just words? 'We hold these truths to be self evident, that all men are created equal.' Just words?" (That particular turn of phrase led to cries of plagiarism, but that's another story.)

Arriving in the Oval Office, Obama immediately announced a number of executive orders whose language carried enormous promise. He pledged to close Guantanamo. He suspended the military commissions process. He reiterated that the United States does not torture.

At the same time, he moved away from the discredited terminology of the Bush administration. In January, the Associated Press reported that, with a sole exception, Obama had not uttered the term "war on terror" since assuming the presidency. "Obama has made it clear in his first days in office that he is … making what is at least a symbolic shift away from the previous administration's often more combative tone," it reported.

Then, last week, the Obama administration announced that it was getting rid of the label Bush used to brand terrorism suspects -- good news, it would seem, if it weren't for the context: "The Obama administration said Friday that it would abandon the Bush administration's term 'enemy combatant' as it argues in court for the continued detention of prisoners at Guantánamo Bay, Cuba, in a move that seemed intended to symbolically separate the new administration from Bush detention policies," reported William Glaberson of the New York Times.

But in a much anticipated court filing, the Justice Department argued that the president has the authority to detain terrorism suspects there without criminal charges, much as the Bush administration had asserted. It provided a broad definition of those who can be held, which was not significantly different from the one used by the Bush administration.

According to the court filing, which was filed in a Washington federal court, "the United States bases its detention authority as to such persons on the Authorization for the Use of Military Force," which grants the president "authority to detain persons who he determines planned, authorized, committed or aided the terrorist attacks that occurred on Sept. 11, 2001, and persons who harbored those responsible for the Sept. 11 attacks. The president also has the authority under the AUMF to detain in this armed conflict  those persons whose relationship to al-Qaida or the Taliban would, in appropriately analogous circumstances in a traditional international armed conflict, render them detainable."

The AUMF, of course, is the measure passed almost unanimously by Congress one week after 9/11, which granted broad executive powers to the president. The court filing lifts the exact language from the AUMF, which declared that the president "is authorized to use all necessary and appropriate force against those nations, organizations or persons he determines planned, authorized, committed, or aided the terrorist attacks … or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons."

You want all this crap to stop, Alternet??? You KNOW what you have to do!
Expose the lies of 9/11. Bring 9/11 truth to your readers. It's that simple.
Anyone, any decent journalist, could look at the facts of 9/11 and realize it was an inside job.
And once you present that to your readers, ALL the facts and evidence, with many articles exposing the lies and contradictions of 9/11, other alternative sites will be pressured to do the same.
And soon even msm will do the same.
And then all of the crap from 9/11: the Patriot Act, the torturing, the rendition, the wars and occupations, the bleeding of our treasury, the hatred of arabs and Moslems by the Amrican people.........ALL of it would end.
SNAP! just like that.

But you avoid the topic of 9/11 truth. You have censored it. You have joined the conspiracy to defraud the American people about 9/11. WHY????? You won't tell us. Is it threats? Threats of taking away financial support? Is it pressure from certain powerful groups or agencies? What the HELL could it be???
This is the biggest story of all time. The evidence is proven and it is there for the taking........great Americans like David Ray Griffin, Kevin Ryan, Steven Jones, Richard Gage, and others have done all the work and would love to supply you with the facts and proof. But Alternet refuses to present it.

I don't know if it is criminal or treason to purposely conspire to lie to the American people. I do know that presenting this information would change the world forever, and for the good of all of us. It would bring hope back for the future.

Is that not what you all at Alternet want? Or am I wrong? Is there really another agenda. I hope not. I hope some of you at Alternet read this and finally decide to do the right thing.

How did you determine this?

Why has no credible evidence ever been presented to the public?

The American people would like to know and your own FBI has yet to complete a real investigation into the events of 9/11/01.

This is what every journalist should be asking Mr. Obama at every press conference and photo op.

Until we get a real investigation into the events of 9/11, the American people will continue to lose confidence in the federal government and revolutionary change will be the people's only recourse.

The truth shall set us free. Love is the only way forward.

Obama now inherits Dubya's mess so it's his now. Either fix it or get a pink slip by 2012 !

It was already clear that Obama would continue Bush's mess for the most part back when he was campaigning and still voters fell for his hope and change lies. If you wanted a real moderate, a real independent, and a real centrist in addition to a real progressive and liberal in one, Nader was the choice to rescue America. I'm afraid it's gonna be too late now. Already Obama's falling flat and looking worse than even Jimmy Carter. Oh well, it's gonna be Obama's fault should things get worse.

call them what you want - they are still enemies of this country and it seems pretty clear that some should not be released - ever!


If Lincoln is Obama's hero then maybe Obama should follow his lead regarding Habeas Corpus and the supreme court decision.
If he can't see his was clear to make a difficult decision such as that then send them to Aghanistan.

O-blah-blah can call the War, the illegal detainees and himself whatever the f*$@ he want but it CHANGES NOTHING. We are still conducting and EXPANDING an illegal and immoral war. We are still holding INNOCENT people FOREVER. O-blah-blah is still a CORPORATE SHILL.

Obama must appoint a Special Prosecutor as he said "no one is above the law".

A Special Prosecutor must be appointed
for Bush, Cheney and their lawbreaking appointee lawyers.


The truth needs out and the guilty must be punished or it all will happen again and again, and eventually bring our democracy down.

Critics of the Bush administration have said that a truth commission inquiry would probably be a half-measure.

Michael Ratner, president of the Center for Constitutional Rights, said in a radio interview earlier this month "This is not about mistakes. This is about fundamental lawbreaking, about the disposal of the Constitution, and about the end of treaties".

A US Congressman is calling for an investigation of the Seymour Hersch allegations that former Vice President Cheney controlled a secret US Military squad that carried out assassinations of foreigners.

This is against US Law and President Ford's executive order prohibiting any US citizen from doing so. This Must Be Investigated by a Special Prosecutor.

How far outside US law did Cheney go?

Did Cheney use the assassination squad inside the United States?

WE Must all work together to push Congress to investigate, Attorney General Holder to appoint a Special Prosecutor, and Obama to get out of the way and allow the Rule Of Law to prevail.

National security should not be at odds with the law

Attorney General Holder is quoted as calling for "a new policy to govern detainees ... in a manner that strengthens our national security, is consistent with our values and is governed by law."

How is that possible when the Obama administration seems hell-bent on adopting the Bush/Cheney crime syndicate's view of national security as diametrically opposed to civil rights and the rule of law?

We need to throw out the 9/11 panic mentality that let the Bush White House get away with dismantling the Constitution. The rule of law IS our national security. It is the only way we can ensure that innocent people are not trampled in the rush to find the guilty, or anyone who may look guilty.

Is that goddam piece of unconstitutional, illegal paper, the "Patriot Act". One would've thought by now that president Obama should've dropped that like a hot potato, pretty early on. Why the delay? This is, to say the least, disconcerting.

Yet again, discussion on a serious issue is completely swamped by comments pro and anti a purported 9/11 conspiracy. I'm not passing any comment on the theory itself, but merely noting that this article discussed something that is key to the here and now as well as the immediate future. Has Obama, when push come to shove, got any more respect for American values and the American Constitution than Bush?

But no real discussion happens because we have rehashes of the the same old arguements for and against a great conspiracy. If Obama were contemplating continuing Bush policies by other means, he would be very grateful for the diversion tactics.

This was what i was most concerned about when bush was able to walk away without being held accountable for his violations of the Constitution. It's not that the Obama administration doesn't know it's violating the law by holding anyone indefinitely, it seems that for some reason they don't care! I voted for and supported Obama strongly, but i don't support this! This is wrong and Barack Obama of all people should know this!

Especially with people who can't read or remember.

The Administration removed the term "enemy combatants", with the concomitant unconstitutional tribunals and overreaching executive-derived power to hold the detainees without charge, so that men who have little or no evidence against them can be freed more easily.

There are still men who do have some evidence against them. For some, the evidence won't stand up to a habeas hearing, and they will be closer to whatever half-life they have after leaving Guantanamo.

There are some men who have evidence against them that will stand, and those will be tried in civil court.

That's still basically it. Be careful that what you're reading as true isn't the OPINION of the journalist who wrote the story, or better yet, the opinion of someone who isn't the journalist who wrote the story, just someone reporting on the story, not the facts.

Remember--opinions are like assholes. Everybody's got one.

Knock yourselves out.

Smoke On The Water a Fire In The Sky

And so on Monday morning when I had a massive hangover - the Smoke Machine arrived.

I was kind of hoping that the people who sent it would sort of wrap it in brown paper.

But no they just put my name and address on the box and sent it

So 3 boxes turned up

But both my wife and daughter interrogated me

Why the fuck have you bought a smoke machine?

And my lad came down

Saw the new laser thing

And I had a fucking awesome hang over and just wanted to go back to sleep

He said why have you bought a smoke machine?

And so I still have not even opened the box containing the smoke machine yet - but I have opened the box containing the fluid

And I know its all fucking mad

But the DMX controller hasn't turned up yet - and I have not yet been in the mood.

However my Wife did ask the band tonight if they could do Smoke on the Water

They declined - but were incredibly good at doing The Pinball Wizard


My logic was quite simple and innocent

To be perfectly honest - I had absolutely no idea that Obama was coming to London - and have read absolutely nothing about it

But my 18 year old daughter told me that Obama is coming to London sometime in April - and there is going to be a Massive Protest about his visit - and that she is going only because She wants to Photograph what happens

I am obviously completely out of tune

I didn't know Obama was coming to London - and if he did I might have naively thought he might get the same sort of welcome he got in Berlin

But apparently Young People in England don't like the fact that Obama is Bombing People Trying to Get Married in Afghanistan and they are so pissed off about it that Hundreds of Thousands are Travelling From All Over England To London To Tell Him That They Think He is a CUNT

Obama's similarity to the most fascist regime in US history is disturbing

Items that might be surprising and in contrast to campaign rhetoric
• No consideration of single-payer for a National Healthcare plane
• Actually citing "Authorization for the Use of Military Force” (AUMF) rather than rescinding it
• Very little change in foreign policy including attacks on Pakistan within weeks of inauguration, continued occupation of Iraq (indefinitely or perhaps only until 2011)
• Plans to continue and escalate the war in Afghanistan (though this was acknowledged during his campaign it looks to be a particularly noxious escalation of the war beyond what voters would have even expected)
• A stimulus plan that includes a supplement to TARP allowing further raiding of the US Treasury by private banks
• Continued use of Presidential signing statements (though slightly improved over Bush's coloring book signing statements they still look pitiful even compared to a Justice Scalia constitutional analysis)
• Disallowing lawsuits for detainees held unconstitutionally by the Bush administration
• Continued use of mercenaries and overuse of private military contractors in general

Items disturbing, but not surprising due to campaign positions:
• No investigation of Bush administration unconstitutional activities and other wrong doings (including possible involvement in the attacks of 9/11)
• TARP support including provisions which allow private banks to raid the US Treasury
• Refusal to end embargo of Cuba which is driven solely by fascist interests within the US policy making community
• Support for telecom immunity and continued bill or rights violations associated with Federal eaves dropping
• Support for coal industries "clean coal" smoke screen to avoid environmentally responsible energy policy
• Support for corn products industries ethanol smoke screen to avoid environmentally responsible energy policy
• Lackluster support for mass transit and intercity bus and rail that could drastically improve transportation efficiency and drastically reduce greenhouse gas emissions
• Continued support for war on drugs (including possibly staged or overblown activities to prove a "threat" from Mexican drug cartels and supposedly requiring US military intervention)
• Continuance of Department of Homeland Security

Improvements:
• incrementally better tax policy in raising taxes on incomes over $250,000 and possibly higher taxes on capital gains and corporate profits
• some stimulus spending on public infrastructure
• willingness to lift travel restrictions and US dollar remittances for Cubans residing in the US

Questions:
• What is Obama up to with Yucca mountain? Why halt the program?What will replace it, especially given Obama's stated support for Nuclear energy continuance and perhaps even expansion?
• What has been done to normalize relations with Iran, North Korea, Venezuela, etc?

I know its early in his administration, but his own hints of the direction he's heading are not encouraging.
