The Case for Establishing a Truth Commission for Bush's Torture and Spying Crew

Co-Host Gonzalez: On Capitol Hill, debate has begun over forming a truth commission to shed light on the Bush administration’s secret polices on detention, interrogation and domestic spying. A hearing on the issue was held Wednesday, two days after the Obama administration released a series of once-secret Bush administration Justice Department memos that authorized President Bush to deploy the military to carry out raids inside the United States. The author of the memos, John Yoo, said Bush could disregard the First and Fourth Amendments of the Constitution.

During a Senate Judiciary Committee hearing on Wednesday, committee chair Patrick Leahy said the newly released memos highlight the need for a truth commission.

    Sen. Patrick Leahy Vice President Dick Cheney and others from the Bush administration continue to assert that their tactics, including torture, were appropriate and effective. I don’t think we should let only one side define history on such important questions. It’s important for an independent body to hear these assertions, but also for others, if we’re going to make an objective and independent judgment about what happened and whether it did make our nation safe or less safe.

     

    Just this week, the Department of Justice released more alarming documents from the Office of Legal Counsel demonstrating the last administration’s pinched view of constitutionally protected rights. The memos disregarded the Fourth and First Amendment, justifying warrantless searches, the suppression of free speech, surveillance without warrants, and transferring people to countries known to conduct interrogations that violate human rights. How can anyone suggest such policies do not deserve a thorough, objective review?

     

    I am encouraged that the Obama administration is moving forward. I’m encouraged that a number of the things that—number of the issues we’ve been stonewalled on before are now becoming public. But how did we get to a point where we were holding a legal US resident for more than five years in a military brig without ever bringing charges against him? How did we get to a point where Abu Ghraib happened? How did we get to a point where the United States government tried to make Guantanamo Bay a law-free zone, in order to deny accountability for our actions? How did we get to a point where our premier intelligence agency, the CIA, destroyed nearly a hundred videotapes with evidence of how detainees were being interrogated? How did we get to a point where the White House could say, “If we tell you to do it, even if it breaks the law, it’s alright, because we’re above the law”?

 

Amy Goodman: Senator Patrick Leahy, the chair of the Senate Judiciary Committee. At Wednesday’s hearing, several Republican senators and witnesses opposed the creation of a truth commission. This is attorney David Rivkin.

    David Rivkin: There’s another large problem that looms in my view. It’s important to recognize that the commission’s most deleterious and dangerous impact would be to greatly increase the likelihood of former senior US government officials being tried overseas, whether in courts of foreign nations or through international tribunals. And the reason for it is because the matters to be investigated by the commission implicate not only US criminal statues but also international law and which are arguably subject to claims of universal jurisdiction by foreign states.

    I have no doubt that foreign prosecutors would eagerly seize upon the supposedly advisory determination that criminal conduct occurred, especially if it is the only authoritative statement on the subject by an official US body as a pretext to commence investigations and bring charges against former government officials. If they were clever, and most of them are, they would argue that the mere fact that the commission was established vividly demonstrates that grave crimes must have been occurred and interpret UN non-prosecution of individuals concerned through formal prosecutorial channels as a mere technicality to be repaired by their own broad assertions of jurisdiction.

 

Goodman: Human rights attorney Michael Ratner joins us now in the firehouse studio, president of the Center for Constitutional Rights, author of the book The Trial of Donald Rumsfeld, among others.

Welcome to Democracy Now! I want to talk about the secret memos. Let’s start with this hearing that has been called by Patrick Leahy, chair of the Senate Judiciary Committee, calling for an investigation into Bush administration crimes.

Michael Ratner: You know, I won’t say I’m exactly biased here, but I think essentially that the Leahy commission is an excuse for non-prosecution. It’s essentially saying, “Let’s put some stuff on the public record. Let’s immunize people. And then,” as he even said, “let’s turn the page and go forward.” That’s really an excuse for non-prosecution. And in the face of what we’ve seen in this country, which is essentially a coup d’etat, a presidential dictatorship and torture, it’s essentially a mouse-like reaction to what we’ve seen. And it’s being set up really by a liberal establishment that is really, in some ways, in many ways, on the same page as the establishment that actually carried out these laws. And it’s saying, “OK, let’s expose it, and then let’s move on.”

Any "investigation" with ANY immunity given will simply be a means to avoid prosecution of these criminals and will allow future administrations (including the present administration) to use these methods. They want to investigate the torture "to see if it was effective"? Then what? Use torture freely if they conclude it was?
With respect to prosecutions in Europe, they don't need the results of any investigation to file criminal charges as there is more than enough evidence in the public record already.
Under the Nuremberg Principles every legislator that voted to give the President the authority to launch the war is guilty of a war crime- and they ALL knew the intelligence was bad, they have more access to intelligence than we do and WE all knew it was bad.
Under the Geneva Conventions almost every act the US carried out in Iraq was a violation of international law and U.S. law.
This is going to get swept under the rug if the American people don't demand prosecutions, and then our only comfort will be that none of these people will ever dare set foot in Europe.

Amy, how can you ask us to support you in your fight to bring justice to Bush/Cheyney, when you avoid the issue that brought us all of their crimes? These crimes you talk about will never be resolved as long as 9/11 is ignored.
How can you talk about all of the daughter problems that 9/11 brought, and never go to the glaring lies of 9/11?
You brought to me the truth of WMD, when no one else in the media was telling us about it. You told us about the prisons and torture, the wiretapping. You dedicated yourself to the truth, no matter what the consequences. You were the voice against tyrrany.

But when you came up the the facts of the day of 9/11, you backed off. I KNOW you know the truth of 9/11, the coverup, the work done by people like David Ray Griffin, Steven Jones, Kevin Ryan, Richard Gage and others. How easy to present their work. Each of these people should have been on your show several times for interviews. But you avoid it all. Why?

I know you realize that 9/11 was an inside job. It is impossible that you have not seen the contradictions, the impossibilities, the improbabilities of the official story. You have gone after far less obvious lies in any other issue. And yet, after seven and a half years, not really a single mention, where there should have been many shows completely dedicated to 9/11 truth.

To deny us the truth, the whole truth, especially when you constantly tell us how you and Juan give us all of the truth when no one else will, is terrible. It is a conspiracy, really, with the rest of the alternative media. I don't know how you can do it.
Are there threats to you all, with government agents saying to you that you can go anywhere BUT 9/11 truth? Or are there financial supporters, big ones, that threaten to take away the money? Whatever, but it is treason to purposely deny us truth that will stop the bleeding of our people and our treasury, and stop the move toward tyranny and torture and the Patriot Act.

You could stop it all instead of just whining about it all. Expose 9/11 to your millions of listeners, and it will begin an avalanch of awakenings, and the end of all of the crimes of Bush. The work is done, the proof is in. But we need more. We need the American people to demand trials with penalties for perjury. The truth will come pouring out.

It is up to you, Amy. Not to do so is treason. But to move on this, well, you could change the world.

We are depending on you. We can't do it. Time is running on, and we don't have the exposure to the people. You do. And you KNOW. Tell us what you know. Present the people that can tell us all they know.

Truly the future of America is in your hands. Don't deny us the truth about the biggest and most important story of all time. Please!

Notice that the crime of election theft, the mother of all this evil, is not even being discussed. This could be a fatal mistake.

If you put election theft into the equation (which no one but me seems to do), America's situation is more radical than just about anyone is willing to admit.

Election theft is not an act of brutality, like war crime. But it may affect the future of our republic even more vitally. And election theft made possible all those war crimes in the first place.

Although they were probably too stupid to know it, the Pubs have put our nation in a truly precarious situation. Even if we succeed in convicting the current crop of malefactors, America's health will remain critical--simply because more Republican will quickly steal their way back in and start committing more war crimes.

America in a state of undeclared civil war. I can't figure it any other way.

I assume my fellow progressives know this, but are loathe to think the situation through. In my opinion, this is a failure of nerve that could cost us dearly.

I mean...after all those trials and convictions, Jeb Bush could waltz into the White House in four short years. This would open the door to still more wars and war crimes.

On Tuesday 10 March the Parliamentary Joint Committee on Human Rights will discuss whether or not to hear my evidence on the UK government's policy of using intelligence from torture. They discussed whether to hear my evidence on 3 March but failed to reach a conclusion.

The government is lobbying hard for my exclusion. I need everybody to send an email to jchr@parliament.uk to urge that I should be allowed to give evidence. Just a one-liner would be fine. The evidence I am trying to give is this:

I wish to offer myself as a witness before the Joint Commission on Human Rights on the subject of the UK government's policy on intelligence cooperation with torture abroad.

I appeared as a witness in person before both the European Parliament and European Council's enquiries into extraordinary rendition. My evidence was described by the European Council's Rapporteur, Senator Dick Marty, as "Compelling and valuable".

- I was British Ambassador in Uzbekistan from 2002 to 2004.
- I learned and confirmed that I was regularly seeing intelligence from detainees in the Uzbek torture chambers, sent me by the CIA via MI6.
- British Ministers and officials were seeing the same torture material.
- In October/November 2002 and January/Februray 2003 I sent two Top Secret telegrams to London specifically on the subject of our receipt of intelligence gained under torture. I argued this was illegal, immoral and impractical. The telegrams were speciifically marked for the Secretary of State.
- I was formally summoned back to the FCO for a meeting held on 7 or 8 March 2003 specifically and solely on the subject of intelligence gained under torture. Present were Linda Duffield, Director Wider Europe, FCO, Sir Michael Wood, Chief Legal Adviser, FCO, and Matthew Kydd, Head of Permanent Under-Secretary's Department, FCO.
- This meeting was minuted. I have seen the record, which is classified Top Secret and was sent to Jack Straw. On the top copy are extensive hand-written marginalia giving Jack Straw's views.
- I was told at this meeting that it is not illegal for us to obtain intelligence gained by torture, provided that we did not do the torture ourselves. I was told that it had been decided that as a matter of War on Terror policy we should now obtain intelligence from torture, following discussion between Jack Straw and Richard Dearlove. I was told that we could not exclude receipt of specific material from the CIA without driving a coach and horses through the universality principle of the UK/US intelligence sharing agreement, which would be detrimental to UK interests.
- Sir Michael Wood's legal advice that it was not illegal to receive intelligence got by torture was sent on to me in Tashkent

In conclusion, I can testify that beyond any doubt the British government has for at least six years a considered but secret policy of cooperation with torture abroad. This policy legally cleared by government legal advisers and approved by Jack Straw as Secretary of State.

Focus on 9/11 . . .

The evil power brokers in Wall Street and in our government are probably feeling pretty smug now.

More than a month into the Obama presidency the 9/11 coverup continues as if Bush were still in office.

Richard Gage and David Ray Griffin are still out there giving talks at universities about the lies and ommissions of the 9/11 Commission.

If there are other operations underway to get the truth before the public we may not hear about it because the media (including Alternet) will not cover it.

In 1934 powerful members of Wall Street attempted to overthrow FDR and install a Fascist government.

They may have succeeded if they had not chosen General Smedley Butler to lead the coup.

Butler, a true patriot exposed their plot and a Congressional Committee was assigned to investigate.

The Committee determined that there had indeed been an attempted coup but took no action to indict or prosecute anyone.

The names of the families backing the coup included the Rockefellers, the Du Ponts, The J. P. Morgans, the Mellons and the Pews, to name a few.

Congress concluded that these people were just too big to prosecute. Congress was Wall Street's gatekeeper in 1934 just as they are 74 years later.

If they had been prosecuted, we may have avoided 9/11.

If we don't investigate and prosecute those behind 9/11, their crimes will escalate, if they haven't already (trillion dollar payouts to the banks).

Dear Senator Leahy,

While I greatly appreciate the political delicacy of your compromise suggestions regarding Truth & Reconcilliation, I believe the result is foreordained: Bush, Cheney, Rumsfeld, Wolfowitz, Rice et al - will get out of jail free. They won't even see jail. We will honor their Good Intentions which led us and the Iraqi and Afghanistan peoples into the Hell of their "self-will run riot", the windfall of their war-profiteering.

We put Clinton in a million dollar dock for a blow-job, and now, cash-strapped, we are going to be ever so delicate, tiptoeing through the tulips lest we upset DVD sales for W and The Dark Knight. There are minefields in the tulip field. Pre-war sanctions 'R' us. We have met the enemy and he is US.

I cannot sign your petition.

seems to be the direction we take after all these years..a "truth commision", there is nothing new here that has to be added to the already evidence of broken laws...after all we were all in this country over the last 8 years watching all this take place in real time... so the memos or justification of it really is unnecessary for prosecution etc.. we saw the crimes taking place.. the ACLU has spent endless time and energy trying to protect our consitution and the "rule of law".. when will we get that one little crazy president, was not the problem... it was far greater, for more scary.. it was congress, these very same people who put forth this "commision" who are equally guilty for standing by and failing to uphold their oath of office to ensure, through balance of power which they already have, that this one little crazy man not be allowed to trash the constitution.. they didn't and now they want to sweep it under the carpet with this commision.. as if we are indeed, not already a nation, a republic with the "rule of law".

Read what September 11th Advocates Patty Casazza, Monica Gabrielle, Mindy Kleinberg, and
Lorie Van Auken just wrote to Senator Leahy why they're against a new whitewash.
In part:

"The 9/11 Commission, which you want to model your commission after, is a perfect example of that flawed process.

The 9/11 Commission was mandated to follow the facts surrounding the events of September 11, 2001 to wherever they might lead and make national security recommendations based upon those facts. Sadly, prior to even beginning their investigation, like you, the 9/11 Commissioners agreed amongst themselves that their role was to /fact find, not fault find/."...

At the 9/11 Commission hearings, little actual evidence was ever produced. Many individuals were not sworn in, critical witnesses were either not called to testify or were permitted to dictate the parameters of their own questioning, pertinent questions were omitted and there was little follow-up. Whistleblower testimony was suppressed or avoided all together. The National Security Agency, an intelligence agency that is responsible for the collection and analysis of foreign communications and foreign intelligence, was barely investigated at all.

With the narrative of the 9/11 Commission’s final report predetermined and with the preexisting intention to never hold anyone accountable in place, the 9/11 Commission was doomed to fail as a real investigation."


Obviously this nation is afraid to see the evil that we have become, very afraid to stand up to tyrants in our midst, but ignoring this, the single biggest mass murder in our history will only serve to bleed us and our international legitimacy to the slow steady death we're already experiencing... begging other nations to agree with anything we want and that's not working out very well either.

But there are loads of living Politicians who need to be interrogated and investigated

It is entirely possible even likely that George Bush and Tony Blair are simply insane useful puppets and knew absolutely nothing about it.

They just prayed together and got instructins from God - which means they are psycho's - not necessarily intrinsically evil

But Cheney is another kettle of fish altogether.

It ain't going to go away if we continue to ignore it - or blame on a bunch of bearded Muslims planned and executed from a Cave in Afghanistan

In no way am I assuming any guilt of Tony Blair re 9/11 - but if he is sane - there is an extremely good chance that he is guilty of war crimes against humanity and can be proved to be so in a court of law.

If he is innocent - then he should be able to prove his innocence - and if so will be released as a Free Man.

Give me a F*cking break- theri crimes are obvious and well documented, even video'ed confessions of abuse of power and dictatorship 'W's "So" and Cheney's "So What".
I don't see any reason to waste our time & effort on listening to more lies. Congress has far too much work to play 'Catch up' on after nearly 30 yrs of the 'Do Nothing' Attitude of the Repugs. The last so called Dem pres was nothing more than an old Republican who jumped ship in the '80's(f*ckin DLC)- so he spent more time worrying about when he'd get blown next than what the hell the Repugs and their corp co conspirators were up to.
Hell Americans have become very savvy at Judging via technology, this process of prosecuting these High crime criminals should be done in the Style of American Idol- Ya got 2 1/2 minutes to state your case- they we Vote- Up or down. Next constestant. they can even have their Choice of 'Parting gifts'...lethal injection, firing squad, gas chamber, electric chair,...Could be worse you could be barred from choosing and be stuck with a badly tied noose, or an inaccurate swordsmen.They should consider it the ultimate American 'pro choice' doctrine.

it is another tactic to deflect us from proceeding to build a case against the people who perpetrated the heinous acts against humanity. We need prosecutions,not bogus commissions organized by politicians to cover their cronies.

is a full investigation and airing of all the facts surrounding all the Clintons criminal actions over the years. Hillary especially can be indicted on obstruction of justice for destroying documents in the Whitewater scandle.

These people are criminals and should be in jail, not Sec of State!

So while democrats want to convict people BEFORE facts are known and love the political hunts, they are perfectly ok with letting democrat criminals keep their office year after year.. Just ask Ted Kennedy..another person who should have served 20+ years in jail for man slaughter!

We're getting a truth commission instead of prosecution coz Bush and Cheney will bring down the Congressional Dems who were kept in the loop about torture and illegal spying.
