Could Israel Be Charged With War Crimes?

RAMALLAH, Jan 7 (IPS) -- Israel has committed war crimes and should be prosecuted in an international court, says Raji Sourani, head of the Palestinian Center for Human Rights (PCHR) in Gaza.

"The repeated bombing of clearly marked civilian buildings, where civilians were sheltering, crosses several red lines in regard to international law," Sourani told IPS.

Palestinian Authority (PA) delegate to Britain Professor Manuel Hassassian has said the PA will launch legal proceedings against Israeli leaders it says are responsible for war crimes in Gaza, according to a Palestinian news report.

Another 22 Palestinians were killed Wednesday morning in bombing and shelling as Israel's Operation Cast Lead entered day 11. The dead included four people killed in the shelling of a children's playground near a mosque in the Sheikh Radwan neighborhood of Gaza city.

Six Israelis were treated for shock as several rockets from Gaza hit Israel.

Hassassian's comment came in the wake of Israeli shelling of a UN school in Jabaliya refugee camp Tuesday afternoon which killed over 40 Palestinians. Several other UN schools in the Gaza Strip were also hit in the last few days, resulting in a number of casualties.

The UN called for an investigation, stating that prior to the current operation the Israelis were given the precise coordinates of all UN institutions in Gaza.

The International Committee of the Red Cross (ICRC) has already condemned an Israeli attack on two members of the Palestinian Red Crescent (PRC) last week. The ICRC said the medics were wearing fluorescent jackets, their ambulances were clearly marked, and their flashing lights were on.

Nihal Al-Akras, chairman of the Palestinian Health Care Committees, asked the international community to pressure Israel to stop firing on medical facilities and workers in the Gaza Strip.

Akhras's comments followed Tuesday's bombing of the Ad-Dura hospital in the Rimal neighbourhood of Gaza city. Three mobile clinics provided by a Danish NGO, DanChurchAid, were also destroyed.

"We've been able to help the wounded and suffering so far because our vehicles have been present and ready inside Gaza. This possibility of emergency aid is now in ruins," said Henrik Stubkjær, secretary general of DanChurchAid.

"We are deeply shocked that the Israeli air strikes directly prevent the humanitarian aid effort," he added.

According to DanChurchAid the clinics were clearly marked with red crosses and were parked in the Union of Healthcare headquarters.

"One Palestinian doctor and three medics have been killed during Israel's bombing campaign which began on December 27," Sammy Hassan, spokesman for Gaza's Shifa Hospital told IPS.

While Israel has denied that it deliberately targets civilians, reading between the lines of reports in the Israeli media and admissions by military leaders would suggest that the lives of Palestinian civilians are secondary to saving Israeli soldiers.

Israel is guilty of war crimes without question but don't expect anyone in America to do anything about it.

Did anyone anywhere do anything when they dropped cluster bombs into civilian areas in Lebanon? Of course not.

Stay tuned for another episode of simple answers to simple questions.

And for the author - the US will never be held to account for the war crimes it has committed. So neither will Israel. Why? Because the US is the big dog on the block and the only bigger dogs that might actually do something about it (Russia, China) give even less of a shit about human rights and lives than the US does.

We used to have honor and integrity. We used to fight for the freedom of the oppressed. We even used to have justice at one point. Now Honor and Integrity and Freedom are all just buzz words used to allow us to commit unspeakable acts and ignore or condemn others who commit unspeakable acts at our whim and Justice is available only to those who tow the party line or have enough money to pay for it.

How sad that the Zionists are now doing to the Palestinians what the Nazis did to their predecessors years ago. As an atheist I do not recognise their claim that some long silent entity told them to occupy anothers country. It was a political move by the British government to partition Palestine that has caused such suffering. Being a Jew in the 21st century is not enough to justify occupation of Palestine. Judaism is a belief, not a nationality.

First, NO one will be charged with anything for defending it's own country..that is an absurd notion.

Where are the criminal charges against Hamas for firing rockets into Israel every day and firing those rockets from hospitals and schools drawing fire into those places! THAT is the real crime. Hamas uses children as human shields... it's a cowardly group like any other terrorists group!

I don't have a problem with Israel being charged with having committed war crimes IF, and only if Hamas and its thugs are tried for war crimes first. They started eight years ago and never stopped: launching rockets and mortars over civilian areas without any way of controlling that it would hit only bona fide military objectives, as required by international law. Otherwise, it is a war crime. Some 8,000 such war crimes later, I think the Palestinians have priority in front of the International Criminal Court. Then they need to be tried for the repeated war crime of putting their own civilian population intentionally in harm's way in the hope of gaining PR points with the retarded and easily manipulated international media. After that, if there are any left and still walking free, they'll need to meet justice for putting stocks of weapons and rockets in mosks, hospitals, schools and civilian houses, all of them major war crimes. Once we have taken care of all these, it will be time to examine what war crimes were actually committed by the Israelis. Given that all the objectives destroyed were hiding weapons caches, their attacks were entirely legitimate, and the jury will handily declare them not guilty.

Hi Everyone

Hamas should be charged with war crimes as they lit the proverbial fuse to start the war; hence, are TOTALLY, responsible for all that follows. In order order to understand what this struggle is all about, one must understand Hamas' goals, largely derived from its ideological paternity to the Egyptian Muslim Brothehood. As a Sunni extremist offshoot of the Brotherhood, Hamas' raison d'etre is Israel's destruction -- nothing less will do. Despite my instinctive belief that one should try to negotiate a way out of this dilemma no matter the odds, I have concluded that the only way out of this mess is to separate Hamas' entire military and political leadership from the oppressed citizenry of Gaza (and yes, it is absolutely a mischaracterization of fact to assert that Hamas is the legitimate ruler of Gaza). Easier said than done you say. But as long as Hamas rules Gaza, no amount of cajoling is going to end the vicious cycle of terror that Hamas is inflicting first and foremost on its own beaten-down Palestinian victims as well as on Israel.

Simple solution, STOP sending rockets into Israel, and accept monitors instead of crying when Hamas is responsible for ALL since they lit the proverbial fuse – get real and correctly place the blame where it belongs – ON HAMAS.

Why is Israel allowed to murder people? Because their leaders allowed the holocaust to happen so they could create their "jewish state"? When you know the truth of the history of how the state of Israel was created, you'll understand that from that moment on, the US was controlled by the zionists. Their goal?- World domination by military force. It is a fact the Jewish Council during WWII refused to move the poor jews out unless they were guaranteed the Palestinian territory. Hitler offered to move the jews to a different area of Europe at a cost of $250/person, the Jewish leaders refused, so he sent them to the gas chambers. The zionist leaders didn't care that they got gassed, because the quest for the Palestinian state was more important! The zionist government of Israel DOES need to be dismantled, just like Sadaam Husseins regime. A terrorist regime is a terrorist regime. The people in Gaza are just fighting against their imprisonment by the Israelis and we need to start standing up for justice. The zionists STOLE their land and they should be given it back and released from their prison. And the Israeli leaders should be prosecuted for war crimes along with George Bush! Let’s get real and stop falsely accusing Israel of creating a humanitarian crises when it is Hamas that has done so. Hamas could bring a halt to this crisis immediately if it wanted to! All it has to do is stop firing rockets at Israel, provide assurances with monitors that it will NEVER do so again, and return the kidnapped Israel soldier and his kidnappers – the war situation would them abruptly STOP. So let’s get real.

Wars should be eliminated and at present one religion is responsible for over 90% of the violence on earth as pointed out by an Australian newspaper as follows:

"Did you know that 90-95% of the conflicts in the world today are Muslims fighting non-muslims or each other? " [source - The Weekend Australian, November 26-27, 2005 AD]"

I am getting very tired of hearing Palestinians and other Ishmaelite crying crocodile tears and always trying to put the blame for what they do on others such as their conspiracy weavers tried to do about who did 9/11/2001 attack on the World Trade Center, etc. Screaming against what they call wrongful occupations when they are guilty of occupying Byzantine territory, Palestine which belongs to the Israelites [see Numbers the 34 th. Chapter in any Bible for proof of this, and their outright greed as they have over 98% of the Middle East, but still greedly want the less than 2% belonging to their sister tribe Israel] - its time we get real and put an end to this so the world can stop experiencing continuous Ishmaelite induced strife such as shooting rockets at Israel.

Whose Land Is It? A Study of The Land of Palestine

INTRODUCTION:

Land title research in many areas is a very difficult task. In Mexico, the titles to farm land are so clouded it can take years to adequately search them. In some places the granting of title to land by a legitimate granter can go back over 3,500 years. One such place is the land of Palestine where current occupancy has no relationship to whom holds title.

Even some of the most famous buildings in the land of Palestine are actually squatters on land to which others hold title. The most famous instance of this is the Temple Mount and its squatter mosque that sits on the site of the ancient temple of ancient Hebrew kingdom and belongs to the Hebrews. This mess with many occupying land as squatters for which others hold title makes for an untenable position when the rightful title holder takes back his/her land, especially so when it is centuries later.

The present situation in much of Palestine is like the battle between the squatters and the owners, titleholders of land in the old west in the United States; to wit, squatters wanting to continue to squat and land owners wanting their land back. However, some additional situations enter the picture since many of the land owners - their ancestors - were forced off the their land by the Romans and by later Caliphs. Now of course the rule of law should be applied and the squatters finally brought to their day of reckoning with reality, they have no title to the land they are on.

Neighbor Love Requires Exposing Wrong Beliefs and Actions

Now, with respect Palestine there is a scripture all should consider, 1 Peter 3:11, “Let him eschew evil, and do good; let him seek peace, and ensue it.” (Authorized King James Bible; AV).
But neither the Ishmaelites – Hamas, nor the Hebrews – Israelites are considering it. Strange as they are both descendants of Abraham, one by Ishmael and one by Issac.

Now, even though the Ishmaelites control over 98% of the Middle East, they are greedy for the less than 2% of the Middle East belonging to their brother tribe, the Hebrews – Israelites. This is NOT the way for the descendants of Abraham who walked with Almighty God (YHWH) to act.

Why is this? It is because neither is walking with the TRUE GOD as did Abraham, but both are being mislead by none other than Satan the Devil per 2 Corinthians 4:4, “In whom the god of this world hath blinded the minds of them which believe not, lest the light of the glorious gospel of Christ, who is the image of God, should shine unto them.” (AV).

In fact, the Ishmaelites instead of pursuing peace in accordance with what Jesus (Yeshua) the Son of God said at Matthew 22:37-40 said, “Jesus said unto him, Thou shalt love the Lord thy God with all thy heart, and with all thy soul, and with all thy mind. 38 This is the first and great commandment. 39 And the second is like unto it, Thou shalt love thy neighbour as thyself.
40 On these two commandments hang all the law and the prophets.” (AV).

However, what the world needs is peace, not war. So clearly we can see that the Ishmaelites are in a false religion not walking with Almighty God (YHWH), the God of Abraham; nor are the Hebrews who do not recognize his son, Jesus (Yeshua), anymore than the Ishmaelites.

All need to be showing love for neighbor by exposing false beliefs that are ruining mankind by misleading him from walking with the True God of Abraham, Almighty God (YHWH).

Why do the residents of Gaza keep firing rockets and mortars at Israel if they do NOT like the humanitarian conditions it creates? Is it some kind of irrational insane self induced flagellations. It just does NOT make sense to me.

That makes as much sense as a carpenter who hits his thumb instead of the nail purposely doing it again and again – most would consider this a mental case as I do Hamas’ actions, and those of suicide bombers.

For all those who are too quick to accuse Hamas or other palestinians as being terrorist, could any one of them explain to me how can Israel be allowed to occupy by military force Arab land and systematically cleanse these lands of their original population to form Jewish settlements, then label any palestinians who fight to liberate their land as terrorists?
I am a British citizen but I have been totally embarraced by our poodle ex-prime minister (Blair) and the Texan cowboy Bush's green light policy towards Israel's expansion on account of seizing land ...
I just have a terrifying feeling that if Israel continues this policy that sooner or later some Arab country or other will acquire and drop a nuclear bomb over Israel.
The amount of hate Israel generates every day in the hearts of those who lost a parent or child, seeing them blown to bits ... the hatred is reaching new heights every day, and one day sadly it will end catastrophically.
What is even more freightening is that the inflated arrogant ego's of the Israeli government will not see this coming till it is too late. It is really sad.
