Verdict Against Holy Land Charity Could Have a Chilling Effect on the Muslim Community

On Monday afternoon, a jury in Dallas, Texas found five Palestinian men guilty of more than 100 charges in the nation's largest terrorism financing trial since 9/11.

But was this case about prosecuting terrorism, or the Bush administration's "war on terror?"

Prosecutors never argued that the charity, the Holy Land Foundation for Relief and Development, or any of its officials were ever involved in violence, either through funding it or directly participating in it. Instead, they told the jury that the charity sent money to schools, hospitals and social welfare programs that were controlled by Hamas, a group listed as a terrorist organization by the US State Department since 1995.

Edward Abington, the former number two intelligence official at the State Department (and ex-US consul in Jerusalem), told jurors he was never told that the Palestinian charity committees supported by Holy Land were part of Hamas in the daily intelligence briefings he received. In fact, these same charities, or "zakat committees," still receive donations from the U.S. Agency for International Development and the International Red Cross.

This was the second trial against Holy Land. Last year, the government's case ended in embarrassment and defeat when jurors returned after 19 days of deliberations with no guilty verdicts. At least one of the defendants would have been completely acquitted had a juror not changed her mind at the eleventh hour, backing out of her decision to acquit when the judge polled the panel about their votes. Another juror later said she refused to discuss the evidence during deliberations, simply explaining that she relied on her "feelings."

The stark differences between the two juries became apparent at the conclusion of the second trial. "Twelve good American citizens in the first trial didn't convict anyone of anything," Linda Moreno, one of the defense attorneys on the case, told the Associated Press. "And 12 good American citizens in the second trial convicted everyone of everything. If you can make sense of that  explain it to me." (Ms. Moreno was an attorney for my father, Sami Al-Arian, in his 2005 trial).

Over fervent objections from the defense, the judge in the Holy Land trial allowed the prosecution to present testimony from an anonymous Israeli intelligence agent. This bizarre episode marked the first time in American legal history that testimony has been allowed from an expert witness with no identity. If the witness, who was introduced to the jury simply as "Avi," lied or committed perjury, he faces no consequences. He is officially non-existent, after all.

Though the prosecution ostensibly limited their case to Palestinian charities operating in the present day, most of the evidence presented to the jury involved the general activities of Hamas, and dated back decades. With its propaganda-like quality, the evidence was clearly intended to provoke an emotional response. For example, jurors were repeatedly shown videos of grisly suicide bombings that none of the defendants were in any way connected to, or accused of planning.

founded by terrorists, one of whom was the incoming chief of staff's father.

"Change" they can deceive with.

The war on terror is a fraud, brothers and sisters, pull the curtain back and take a long, hard look.

The truth shall set us free. Love is the only way forward.

I wonder if this were a Christian organization, if we would be hearing about all the supposed "skeletons in the closet".

Seems to me, the USg government, is more guilty than any organization, of supporting violence throughout the world.

Muslim's are just the latest in a number of other cultures that have been attacked by the xenophobes who run the USgov.

We will all be better off when all the old white men die off like the dinos that they are.

That pretty much sums up the entire neocon charade for the last ten years. It's what got us into wasteful wars across two nations overseas and our own country teetering on the verge of economic collapse. Hardcore evidence takes a backseat to faith-based "feelings".

We have entered a shameful chapter in U.S. history, matched by the "red scare" paranoias of the early 1920s and 1950s.

The main architects of the current disastrous state of the American nation and enablers of the most prolific & horrendous acts of terrorism worldwide will (supposedly) be leaving office soon...and good riddance to them all! However, their like-minded minions in the judiciary, in Congress, and especially in the military/industrial/'et al' complexes are still in place and will continue to wreck havoc unless the bad apples are tossed away. I'm one American that does not want us in the 'empire' business with the constant lies, secrecy, criminal interference, and, especially, the uncalled for wars. "They lied" and hundreds of thousands of people have died. And now Obama says he doesn't want to look back and cause "bickering"! Neither do I; I want prosecution, punishment, and some long overdue revenge and retribution! (Guess I'm a pretty typical 'Yank' afterall.)

Both Hamas and Hesbollah are intent on establishing a Global Caliphate under Islamic Sharia law. Such intent spits in the face of a republic that is built on the separation of church and state: a law that protects all faiths and religions. Unmentioned in this article is the fact that some of these donations went to families of suicide bombers who perished in acts of terrorism. That, to me, is explicit support for terrorism.

If we have any brains at all -- and I doubt this more by the day -- we would stop all immigration from Islamic Countries into the US. Actually all Legal and Illegal Immigration should stop immediately given the fact that 10 MILLION Americans are now out of work.

Let's face it, the real culprits in this farce are the tens of millions of Americans, and the U.S. Supreme Court, who put Bush into power in the first place. Those voters later ratified Bush's killings by voting for him again in 2004. They are all, as with their German predecessors, accomplices after the fact. They have ratified Bush's killings. They, along with Bush, are guilty of crimes against humanity.

It's a big gray area. The social arm of Hamas is also the propaganda arm of Hamas. They dangle charity in front of a destitute population in exchange for support for their ideology. This is the oldest trick in the book.

Besides, the money might be meant for Hamas-controlled schools and hospitals, but is it actually getting there?

the first time i saw a billboard for the Holy Land Foundation south of Dallas, i couldn't tell if it was a Christian so called charity; so i looked it up and to my surprise i found that it was a Palestinian charity, my thought at the time: no way will They allow them to use such a name, the Jews and Christians have the patent on Holy when it comes Palestine.
the other thing we all forget is that the Party of God and Hamas were started by the US and Israel, sometimes your enemies are not really enemies at all. the fatigues that worn by the girl who blew herself and killed the Marines in Lebanon were US Army Surplus given to Israel to "donate" to their cronies.

there wouldn't be this mess in that state. I hope you people know that more than any white Democrat, Obama has won far more votes and for the first time broke the 3.5 million barrier. No Democrat before him could even make it to 3 million. TX will have a better chance of turning Democrat not because of the hispanic population growth but because more Texans are waking up to being hurt by the economic scams the GOP whacked against them. The Democrats would be foolhardy to write this state off yet again.

Unfortunately they advertise what will work which is not always the purpose of the charity. The same old rule applies. Check them out thorougly before making a donation. The ones who want your old car are not all what they present themselves to be. Gotta be careful. Anna

Common generic enemy...check
Economic downturn and public hardship...check (and going to get worse)
Sense of fear in the population...check
Event to catalyze a nation...???

These were the same steps that led to the rise of Fascism in Germany and Italy. And all the pieces are in place in the USA.

Let's pray the last domino doesn't fall.

Follow the money

Let us get a few things straight. Hamas is a terrorist organization; it is a fact not an opinion. Hamas is designated as such by the UN and the European Union.

To end a conflict you have to stop the funding of the terrorist organizations. Without money you cannot by weapons, political influence etc.

When Bill Clinton put IRA on the US terrorist list i.e. it became a crime to give moneys to IRA the flow of money stopped. So what happened, IRA had to come to the negotiating table, the hardliners were set aside and the moderates understood that their armed struggle was over, they had to negotiate a and only resort to non violent political means.

It is the same with Hamas, cut the flow of money. Having said that, the support by rich Saudis for radical, Islamist madrassas, and support for al Qaeda is no better than the support by the Holy Land Mission The support of the American Jewish community and the American Evangelical movements support for Israeli ultraorthodox militant settlers, I see them as terrorist as Hamas is. In my opinion the Jewish Defense league is virtually a terrorist organization by itself, it condones acts of violence and leading members of the organization ahs committed acts that could be claimed to be of a terror nature.

You might argue that the Holy Land mission only supported schools and charitable work but it is a false argument, these funds free Hamas other funds for militant action. It is for me one of the main concerns in giving aid to underdeveloped countries ruled by dictators, the government can use the aid to help only its own supports and secondly can by arms with monies they otherwise would have purchased food for.

I hope that this judgment against the Holy Land Mission makes the US government take on the Jewish Defense league and similar charities as well as going after the Saudis, in particular those that have business connections with the US and EU.

by this jury's reasoning, no one should pay taxes to the US Government. The US Govt is, by our own definition, a terrorist organization, most recently by virtue of unprovoked attacks on the peoples of Afghanistan and Iraq. This goes back a long way in our history, Hawaii, Central America, South America, Viet Nam, and on and on, nations in which we have invaded and overturned legitimate governments to benefit the financial interests of US corporations or in which we have trained and supported/sponsored terror from death squads and brutal secret police. So, by this jury's reasoning, our federal tax dollars are funding terrorism, therefore we are all committing a crime when we pay our federal taxes.
We need to put a stop to that.

I saw a show on "Alternate Focus," that was
run on FreeSpeech T.V. and gives the other side of the story--the Palestinian side-which never gets covered in the mainstream media.

I saw 8 and 10 year old children, encouraged
and joined by their parents, bombard two Palestinian women with huge rocks and insults.

Afterwards, the American film crew followed two Israeli youths. They shouted, "Turn that f***ing camera off! We'll f****ing kill you!
We're happy we killed your Christ! You f***ing Nazis!"

It's amazing that the Jews are treating another group of people just as they were treated in the early years of the Nazi takeover. When will the Israelis start calling for "a final solution"?
In the eyes of America, Israel can do no wrong, even though their settlement actions in the West Bank and Gaza have been declared illegal by the International Community!

this link w/the political state of Israel is toxic, dark and diabolic.

It never had to get like this. Israel could have easily dovetailed its standing on the World's stage as an honorable and esteemable player, it chose the darkside, they killed Rabin, now look what you've got.

While this choice is really Israel's remarkably selfish and manipulating pathology, its infected us now too.

WHY IS IT ALWAYS MUSLIMS?

I am not a Muslim. I don't know many Muslims but the one I met seemed OK to me. Of course, that was all before 911!

After all the things that get blamed on the MUSLIMS, is it any wonder that ordinary Americans who don't stop to THINK about what is happening internationally HATE MUSLIMS and will vote to CONVICT them just because it is against the LAW to SHOOT them?

I would like to know what the MUSLIMS think about all of this but I am too afraid to get on their websites to ask them.

Before 911, at least I wrote to the Saudi Embassy and they sent me an OFFICIAL WAHABI English translation of the Holy Quran straight from Mecca! You can't get any more authoritative than that and I read it and checked it out. I could find ABSOLUTELY NOTHING that justified the actions of all of these "MUSLIM TERRORISTS" in there...so they didn't get it from their FAITH.

I am afraid if this terrorism attributed to Muslims keeps up, that MUSLIMS will be deported, mosques and private Muslim schools here will be bulldozed to the ground and Gitmo-like facilities will be set up for them. Like what happened to Japanese in the US during WWII. If Muslims are as bad as they have been depicted and the source of all evil terroists, then WHY does the government let them come here and let them STAY here?

SOMETHING JUST ISN'T RIGHT ABOUT THIS PICTURE!
What do the MUSLIMS have to say about this and why isn't anybody telling their side of the story?

Be glad that you have some financial freedom of choice, because people in other places, like Somalia, don't have access to things like payday loans. Yes, Virginia, pirates. Now when most people these days think pirates, they conjure up images of Johnny Depp and Orlando Bloom, but that isn't what pirates in the modern world are like. Modern pirates use high speed boats, AK-47s, RPG launchers, and GPS equipment. In recent months, a Ukrainian vessel carrying military equipment and a Saudi ship carrying about 2 million barrels of oil have been captured and their cargo and crews held for ransom. This is one of the primary ways for ordinary citizens to achieve some financial independence in that area, and foreign militaries are starting to send in their navies to fight off the pirates.
