Supreme Court Refusal to Hear Troy Davis Case "Truly Shocking"

Amnesty International USA (AIUSA) decried today's U.S. Supreme Court decision to deny a new hearing for Georgia death-row inmate Troy Anthony Davis. The Court had granted Davis a stay of execution just hours before he was scheduled to be put to death while it decided whether to hear the case. In denying Davis' petition for a writ of certiorari, the Court has effectively ended a longstanding battle to have new evidence in Davis' favor heard in a court of law.

"The Supreme Court's decision is truly shocking, given that significant evidence of Davis' innocence will never have a chance to be examined," said Larry Cox, executive director for AIUSA. "Faulty eyewitness identification is the leading cause of wrongful convictions, and the hallmark of Davis' case. This was an opportunity for the Court to clarify the constitutionality of putting the innocent to death –- and in Davis' case, his innocence could only be determined with a new hearing or trial."

"It is disgraceful that the highest court in the land could sink so low when doubts surrounding Davis' guilt are so high," Cox added.

The U.S. Supreme Court denied Davis’ petition for writ of certiorari that was submitted on constitutional grounds of due process and cruel and unusual punishment violations if an individual is put to death despite significant claims to innocence. Davis’ attorneys filed the petition after the Georgia Supreme Court’s narrow 4-3 ruling to deny Davis an evidentiary hearing last March; the ruling was based on technicalities rather than basic questions of guilt and innocence.

Davis was convicted in 1991 of killing Savannah police officer Mark Allen MacPhail. Authorities failed to produce a murder weapon or any physical evidence tying Davis to the crime. In addition, seven of the nine original state witnesses have since recanted or changed their initial testimonies in sworn affidavits. One of the remaining witnesses is alleged to be the actual perpetrator.

Since the launch of its February 2007 report, "Where Is the Justice for Me? The Case of Troy Davis, Facing Execution in Georgia," Amnesty International has campaigned intensively for a new evidentiary hearing or trial and clemency for Davis, collecting well over 200,000 clemency petition signatures and letters from across the United States and around the world. To date, internationally known figures such as Pope Benedict XVI, Archbishop Desmond Tutu and former U.S. President Jimmy Carter have all joined the call for clemency, as well as lawmakers from within and outside of Georgia.

I believe it was Justice Scalia who did something like this once before . His excuse at the time was that the request was too late . Didn't matter to Antonin that the poor bastard might be INNOCENT . It is remarkable that with such a narrow loss in the Georgia Supreme Court the Supreme's would DEny the man a hearing when it certainly raises doubts as to his guilt .
I certainly think this and many other cases make the idea of Life without Parole more and more attractive as opposed to the Death Penalty . We have seen far too many cases of wrongful convictions , convictions that later were found to be incorrect based on DNA evidence , to have such an irreversibe outcome .

What were the "technicalities" that caused the US Supreme Court to deny another trial on the Troy Anthony Davis case? It is unfathomable! The article claims that the "substance of the case" was not the reason for denial. What was the vote count on the Court? It had to at least been 5 to 4, don't you think? If McCain gets elected, G-d help us! We will have more of this kind of injustice, because you know he'll appoint ultra-conservative justices, that will spend the rest of their lives screwing things up for the rest of us.

I am truly appalled at the US Supreme Court's decision on the Troy Davis case. They won't even comment on their decision of turning down Mr. Davis appeal. Is it just politics or lining someone else's pocket. How can they just turn their backs and not give this man a new trial especially when seven out of nine witnesses have recanting their testimonies. To execute this man is a disgrace and a complete example of un-justice. What does America stand for not fair trials or justice anymore.

Why is anybody surprised ? It's been established for some years now that many persons cannot get a fair trial in America, an officially declared terrorist state - the Bush regime ensured that the judges of many of these courts remained corrupt and above the law - the whole scenario of allowing bush to be appointed President of the United States on the basis of a rigged election speaks for itself. The people in the free world outside America are not stupid - they can see with their own eyes what is going on. But you, the American people, by continuing to do nothing, condone this behaviour. This is corruption on a grand scale and it can only get worse under the goons currently running for the highest office in your land eg outside America someone like Sarah Palin would find it difficult, with her lack of education and experience to get a job even as a cleaner .... and yet she has been mandated to run for one of the highest positions in the land !!!! Maybe a reality check by the American people might be a good idea some time soon ???? You have had eight years of corruption, deceit, fraud and murder under the disgusting clintons regime.....and after that another 8 years of fascism and corruption under bush......what's for the next 8 years ...McPalin and Cain ????

You guys don't have a clue.............I was in the court room when the witnesses testified against Davis. They were sure! (I'm Mark's Sister)
The recantings are not believable, because it worked liked this:
They gave their statements and then 2 YEARS later they testified in court validating their written statements. 2 years time passed and their testimony did NOT change. It was only several years later did they decide they might have reservations on what they said. C'mon...................If you could pick a time that the witnesses should be believed, when would be? The time of the crime, 2 years later when they swore under oath they were telling the truth or many years later when they decide they may not be sure?
Troy Davis has run through every single possible defense in an effort to get out of this:
He has claimed, failure of due process, poopy attorney, failed to blame another earlier because “he didn’t want to be a snitch”, he has been railroaded re: a racial thing, he is innocent and all of those eye witnesses were wrong, now all of the witnesses are correct since they are recanting. The question reverts back to how innocent is a man pistol whipping an unarmed homeless guy for a can of beer at 1:00am?
There WAS blood evidence, in 1989 there was no DNA testing available, when the prosecution (not the defense) insisted on testing the old blood, it was degraded and the sample was used up in the test. So no results were generated. The blood came from Troy Davis’s shorts that were found in his mother’s washing machine. How many folks do you know that wash clothes between 1:00am 6:00am? The earlier shooting that Davis committed (he was involved in 2 that night) resulted in the same ballistic match as the ammo at the Police Officer's murder, while Troy was the common denominator at both locations. Go to the website for ALL of the facts. Ever wonder why the defense doesn't offer facts on their website?
These recanting witnesses have been interviewed by the Pardons and Parole Board and apparently found lacking in credibility.

But Chatham County prosecutors have long expressed confidence that Davis is a cop killer.

On Tuesday, District Attorney Spencer Lawton accused Davis’ supporters of manipulating the legal process, using the news media and waging a public relations campaign to undermine confidence in the court system, all at the expense of MacPhail’s family.

“While an 80 percent recantation rate…may seem to some as overwhelmingly persuasive, to others of us it invites a suggestion of manipulation, making it very difficult to believe,” Lawton said in a lengthy statement.

He noted that each of the recanting witnesses was vigorously cross-examined at trial as to whether they were pressured by police to point the finger at Davis. “All denied it,” Lawton said.

The justice system, Lawton added, has been “painstakingly indulgent” of Davis’ claims, not dismissive as his advocates contend.

In the meantime, MacPhail’s family has endured “a seemingly endless succession of new technical and substantive legal threats to their faith and hope,” he said. “It should be obvious that the PR campaign intensifies the agony of the victim’s family.”

Davis’ lawyers had asked the U.S. Supreme Court to declare that the Eighth Amendment’s ban on cruel and unusual punishment bars the execution of the innocent and requires at least a court hearing to assess the recantation testimony.

The Rev. Al Sharpton announced the court’s decision at a get-out-the-vote rally Tuesday at Morris Brown College. The crowd let out a collective groan.

Sharpton contended Davis’ case is another example of the of the unfair treatment that African-Americans experience. “You don’t have to go back in the day,” he said. “We’re still in the day.”

Davis had been scheduled to be put to death by lethal injection on Sept. 23. But, with less than two hours to spare, the high court halted the execution to give the justices time to consider whether to hear his appeal.

In July 2007, the state Board of Pardons and Paroles had halted Davis’ execution less than 24 hours before it was to be carried out. Last month, after meeting again, the parole board denied Davis’ request for clemency.

....., our token Nazis, who somehow denied the hearing. They themselves should be given a fair trial on the grounds of crimes against humanity. The trial, to be fair, would have to last at least five minutes and be conducted by a bunch of ex-marine Hell's Angels with their shotguns loaded and pointed.

It appears that this case is much like the convicted and affirmed murderer Mumia Abu Jamal who over the last 25 years has lost every appeal...only one more to go

I dont understand why if the prosecution is so sure it has the facts on its side why they dont want to hear about the recanted testimony and subject it to cross examination. A new trial should have been granted because so many eye witnesses recanted and one who didnt may have committed the crime. The Governor of Georgia or President Bush should commute the sentence like they would for their cronies like Karl Rove.

I dont know the facts the pro vengence poster is asserting but if I had blood all over my clothes I would try to wash it right away before the stain sets. Moreover, I frequently wash my clothes at night so I can put on line during the day.

Doubt will remain in this case unless all the testimony is heard and reconsidered. I urge executive branch to intervene for sake of justice.

I assume you are referring to my response as to the above article. I have read the response of the Prosecutor and during the trial ALL witnesses were asked, "are you sure" and now you have those who recant. Sounds fishey to me and not grounds for a new trial as in the Mumia Abu Jamal affirmed murder case. For the facts as to this please go to danielfaulkner.com for the TRUE facts.

Whatever the merit's of Troy Davis's case, it's not exactly strengthed by letters of support from people like Jimmy Carter, a knee-jerk ultra-liberal, who like so many others knee jerkers, proclaim anyone who kills a cop, automatically innocent.
