The Great Texas Dildo Wars of 2008

By Amanda Marcotte, Pandagon. Posted March 7, 2008.

One should never underestimate the lengths to which wingnuts will go to control female sexuality.
Battle Over Sex Toys in Texas

Well, I celebrated too soon the new-found legality of female masturbation in Texas (see the classic video to the right about the ongoing sex toy battles in my fine home state). One should never underestimate the lengths to which wingnuts will go to control female sexuality. Texas Attorney General Greg Abbott, who apparently has nothing better to do than to separate women from their dildos, has asked the 5th Circuit Court to rehear the sex toy case.

I'm trying to imagine the mindset of a man who doesn't realize that when you try to take dildos away from women, basically everyone with a brain and/or a sense of humor is going to assume it's because you're afraid you can't handle the competition.

But I am routinely reminded that we face opposition to sexual liberation, the most prominent face of which is the anti-abortion movement that protests clinics and waves bloody fetus signs from street corners. That movement is made up of people who claim to be in it not because they are misogynists who fear female sexuality, nor because they are control freaks who can't stand the idea of someone else having fun. They are in it, they say, because they want to save the unborn babies.

Take, for example, their opposition to making emergency contraception available over the counter. For most of us, this one was a no-brainer: Better contraception access means fewer unintended pregnancies, which translates into fewer abortions. Over-the-counter emergency contraception, then, means the abortion rate goes down -- and since fewer abortions means more "babies saved" in anti-choice-speak, "pro-life" people should embrace it, right?

Wrong. Over-the-counter emergency contraception was framed by reproductive rights opponents as a matter of saving babies, but not in the sense of preventing abortion. Instead, anti-choicers argued that the microscopic fertilized eggs might be sloughed off if you took the pills -- despite the fact that there was no scientific evidence to support this contention, and every bit of research concluded that emergency contraception had no effect on established pregnancies. But no, really, it was all about a "respect for life" instead of a disrespect for female sexuality that manifested itself in an attempt to deprive women of a certain form of contraception. Everything goes back to abortion, we're told.

I realize it's hard to see how a woman masturbating with a dildo is a secret form of abortion. But we promise, this is about the babies and life and stuff. You see, dildos are just so big, and if you stick one up yourself and you've got a fertilized egg banging around in there and don't know it, you could just jostle the little fella and knock him right out. Or at least give the little guy quite a scare. There's no such threat coming from the average wingnut penis, so no need to ban those. Sure, you people with your science and stuff might think that it's impossible to scare a brainless ball of cells, but you have to understand that the good Lord provides little angels for an embryo so they can have all the feelings of fear and prayerfulness and resentment of women's liberation that born wingnuts feel -- at least until the embryos have developed brains and can be trained in Sunday school to hate women all on their very own.

So this is completely, 100 percent about babies. No misogyny, control issues or wariness of female sexuality has any part to play in this.

If that's the case, someone needs to send the attorney general the memo, because he didn't see the need to tie this back to saving babies. But while baby-saving is a killer argument that will obviously convince all cynics that socially conservative anti-choicers have the best of intentions, the attorney general didn't totally flout wingnut standards -- his petition reads like old-fashioned, stodgy slut-shaming. What's a more crucial component of the anti-choice movement than that?

He argues that because criminal laws are generally based on society's moral judgments about right and wrong, the panel majority's decision could invite substantive due process challenges to other, previously uncontroversial criminal prohibitions -- suggesting that laws against incest and bigamy would be the next to go if women are permitted to buy masturbatory aids in Texas.

He should have gone with the saving babies argument. It's all to easy to point to other states that have not seen a complete breakdown of civilization despite large numbers of women hopping on Rabbits in the privacy of their own bedrooms.

Digg!

If dildos are outlawed, only outlaws will have dildos. By the way what is the death toll in Texas from guns?

This IS about the children! All about the children. What if they FOUND a dildo in their mother's dresser?? Or worse, caught their mother USING a dildo??? It could turn a poor child into dangerous criminal, seeing something like that. For example, she could be so traumatized that she runs out, has sex, gets pregnant and gets an abortion all as a result of seeing her mother's dildo! It's best to nip this one in the bud.

I think your writer misses the point. It's not just far right wingnuts who don't want women (or gay men, for that matter) using dildos, it's far right religious wingnuts. There is a specific prohibition against use of artificial phalli in the O.T., and you know, we have to do everything -- and refrain from doing everything -- the Bible tells us. Otherwise, we won't go to heaven.

There are parallels between Biblical proscriptions against eating pork, same sex fornication, and using dildos. The one thing all three have in common is decimation of number. Out there in the desert, on the way to the Cities of the Plain, one's tribe had to be strong and significant in number. The Philistines were just over the dune, and they didn't eat pork, pork their buddy, or wood-pork their cunts or assholes, either.

That's because Yahweh was a smart s.o.b. He knew that pork spoiled and got infested with trichinella; that homosex didn't produce war fodder, and neither would dildo sex. No numbers, no wars won. It's just that simple. Of course, today we have refrigeration, liberation, and imagination. We don't have to worry about all those no-no's in the O.T. But don't go telling THAT to Rev. John Hagee.

UNBORN BABIES OF INCEST AND SEXUAL ABUSE VICTIMS

I wonder if the “caring for the unborn child" men know how many sexual abuse and incest victims loose their right to bear a child. The physical, emotional, psychological and spiritual powers for conceiving, birthing and caring for a child can be destroyed by the consequences of the villains’ vulgar drive to rape little girls and women.

Ooooooo-kay.... And next Texas will outlaw cucumbers, bananas, certain summer squashes...? Or will that depend on the specific size and shape along with how many purchased? Will we see produce police? And the effect on a cluster of undifferentiated cells of something knocking about in a woman's vagina... Are you willing to outlaw sexual relations with pregnant women? To the Texas legislature and other reactionary, right-wing(nut) anti-choice folks - Stay out of my bedroom - and refridgerator!

And yet we subsidize religion with our taxes . . .
Posted by: Moonray on Mar 7, 2008 6:31 AM
Current rating: 5    [1 = poor; 5 = excellent]
This issue is just one of many examples of how religious-based intolerance wastes money, infringes on our rights and even endangers lives. And yet we not only this to continue, we subsidize religious groups with our tax dollars and permit them to spew their venom over the public airwaves.

"But not all religions are the same," some will say. Well, yes they are, in that they use irrational, unsubstantiated beliefs as core motivators of behavior that at best is misguided and at worst is intolerant, hateful and socially destructive.

Across America, especially in the Bible Belt, a variety of narrow attitudes and wacky laws inflict misery and often physical pain on people whose only crimes are living lifestyles that the religiously warped majority finds unacceptable. We can't change this overnight, but we can start to demand some corrective measures:

-- An end to all government subsidies of religious institutions and activities.

-- Abolishment of all laws, rules and policies based mainly on religious objections or religion-induced squeamishness. (The anti-dildo law is a good example.) Law proponents should have to prove objectively that a controversial item or activity causes substantial harm.

-- Banning religious instruction or indoctrination in public schools, public subsidies of religious schools and any religious instruction, anywhere, of children under 18.

Until we take these and other steps to protect ourselves from religion, the oppression will continue.

Watch TFV --- this is more than just about women

I hadn't seen Dildo Wars --- thanx for posting it. The funniest part is that butt plugs were legal but anal sex was illegal??? Also the law made homosexuality illegal. I wonder if they were only talking about male/male sex? Historically, going all the way back to the Torah, the banning of same sex relationships usually effects men alone. Molly was great in it. Makes me sad she's gone.

Dildos were legal as long as they were used for "educational purposes". Had none of these guys ever gone to a safe sex demonstration? I mean, bananas were always the chosen device to roll the condom on. The goal was always to make it comfortable for the audience. I think a "John Holmes" would frightened many from the room. Those with a peaked interest likely already knew how to do safe sex. As for vibrators, they were invented by doctors to "cure" women of "hysteria". Of course the laws would have to make some "exceptions".

There is a long history of this, going back to the "Comstock laws" of the late 19th Century. These included laws against condoms, criminalizing abortion providers, seizure of literature of a sexual nature (w/ exceptions for medical information --- see a pattern) as well as pornography (including many literary novels), ... The postal service was used as the enforcer. Until the '60's really, many Gay magazines had to hide their content behind innuendo to stay of of trouble w/ the postal service.

These Texas laws were vestiges of Comstock. I will say that the article, by focusing on only the most recent of the Comstock laws to be overturned, misses out on how sexual oppression cuts across identities. Too bad.

This is gender discrimination, since most men masturbate simply by using their hand. And the Texas Attorney General probably does it regularly. Too bad he won't be able to visit Governor Rick Perry and get his handshake on this issue, since, to paraphrase an old Molly Ivins joke, it is illegal in the state of Texas for a prick to get anywhere near an asshole!

. . . abortions DO kill babies. That's what an abortion is. Sure, you can talk about a "fetus" rather than a "baby" to make it seem more palatable, but it's six of one and half a dozen of the other. Now, I'm not saying that abortion should be illegal, but let's not delude ourselves about what it is.

I can't understand, however, what any of this has to do with dildoes. Seems to me that the more sex women have with dildoes (the plastic kind, at least), the less likely they are to have to face the decision of whether to have an abortion or not, which is a good thing all around.

The laws here in Texas reflect the Republican Party platform. It's like a red state on steroids. Big on pushing morals on other people, small on ethics. I had to attend an aids demostration at work, and the gal had all these "educational aids" that we could practice putting condoms on while wearing beer goggles. We weren't allowed to call them dildos.....ha! "A rose by any other name would smell as sweet"...and, whether it's an educational aid, or a dildo, it's still a big plastic dick.

Poor puppies, still can't get over women having as much fun in bed as they do. Really, that's all it is. Look at how tied in a knot they are over it in the Middle East! Imagine, women enjoying sex! How perfectly immoral! Ladies, we have not come as far as we thought, yet. Men still can't get past the loss of control they feel when attracted to a woman. That's the real reason for all the freaky control issues they have. Poor babies need to control everything! And they can't! Not ever. And this issue exemplifies the problem.
