Anthony Kennedy Could Be Swing HCR Vote
With two judges striking down the ACA and two upholding it, it looks like the matter may end up being put t o rest before the Supreme Court and its perennial swing voter, Anthony Kennedy.
Over atWashington Post's The Plum Line blog, Greg Sargent talks with a constitutional law professor at Georgetown Louis Seidman, who critiqued the latest decision in Florida, but said constitutional squabbles ultimately, it all will be lain at Kennedy's feet, and he could go either way based on previous rulings. He will be swayed by the political climate, Seidman said.
"He's likely to be affected by what the political atmosphere is at the time," Seidman told Sargent. "It's going to matter to him whether it looks like the whole law is a mess and needs to be put out of its misery, or whether it looks like it's actually starting to work."
