Has 'America's Toughest Sheriff' Lost It?

Last week, the Obama administration announced that it  was renewing some of Maricopa County (Arizona) Sheriff Joe Arpaio's federal immigration authority, even as Arpaio openly defied the feds' decision to strip him of street-level immigration enforcement.

The sheriff, who on Friday launched a major anti-immigrant sweep in the Phoenix suburbs, arresting 66 people, will continue to act as a federal immigration agent in the county jails.

Since 2007, Arpaio has been authorized to carry out immigration enforcement under an agreement known as 287(g), which contracts out immigration enforcement to local law enforcement agencies and which, in theory, is supposed to target "criminal illegal aliens."

The problems with such agreements have been well documented: With woefully inadequate federal oversight, the program's "largest impact has been on law-abiding immigrant communities," according to a watchdog group's recent report, and it has also resulted in "reluctance among immigrants to contact police if they are victims or witnesses of crimes because of the risk of being jailed or deported themselves."

Such problems have been particularly glaring in Arpaio's immigrant hunts; the sheriff is being investigated by the Department of Justice over allegations of racial profiling. In light of the sheriff's record of abusing his 287(g) authority, Arpaio recently found out that under his new contract with the feds, he would no longer be authorized to carry out street-level immigration enforcement.

The self-proclaimed "toughest sheriff" in America quickly denounced his Department of Homeland Security partners, calling them "liars," and vowed to continue to arrest "illegal aliens" even if he was no longer permitted to do so on behalf of the Immigration and Customs Enforcement agency: "If ICE refuses to take 'em," he declared at a press conference, "then I'll take a little trip to the border."

On CNN, he boasted to a bewildered Wolf Blitzer of having "tricked" DHS by signing the new 287(g) agreement. He also declared on CNN that now he "w[ould]n't have to worry about the feds looking over my shoulder." Oh, and all this in the wake of the sheriff telling GQ that he thinks Mexican migrants are "dirty."

Perplexingly, Arpaio has repeatedly claimed that he still has federal authority to carry out immigration enforcement on the streets, 287(g) or no. However, all the Maricopa County Sheriff's Office offered to inquiring journalists such as the Phoenix New Times’ Stephen Lemons to back up the claim was an interpretation that originated with the Federation on American Immigration Reform -- an organization classified as a hate group by the Southern Poverty Law Center. The "law-and-order" sheriff's blatant disregard for the actual laws that limit his power is so striking that even his ally Glenn Beck couldn't help but giggle at the contradiction.

This is no longer the early 1900s. America no longer has large plots of land to give away to anyone willing to settle it.

America has double digit unemployment. Are you really telling me that Americans refuse that clean hotel rooms or work in construction? Bullshit. If companies where unable to illegal deprive US workers of jobs by giving those to criminal trespassers, Americans would be paid at least the minimum wage.

While you’re at it, it is time to stop allowing Indians and Pakistanis to steal our computer and engineering jobs. Americans will do those jobs if they’d be paid the 67 – 80k they’d be able to rightfully demand. Instead you parrot the lie “while we just can’t find the Americans to fill those jobs.

Mexico is in the top 10% of wealthy nations. They have more than enough resources to support their populations. Instead the wealthy, White European descended aristocracy hands the illiterate Brown Aztecs a comic book on how to violate US immigration laws.

It is no secret that illegals commit a disproportional amount of violent and property crime. They also import their 3rd world birth rates which forces. Putting an illegal into the public school system steals resources and dims the future of the American kids.

Supporters of Mexican immigrants are Pro Racist, Pro Aristocracy and Anti Worker.

Where does the Sheriff get his power?

I don't know what the Federal Government is going to do about the Good Sheriff. Sheriffs are Constitutional officers, not U. S. Constitution but State Constitution.

The states created the Constitution which empowers the Federal government. Also, the Tenth Amendment reserves to the states respectively, or to the people, any powers the Constitution did not delegate to the United States, nor prohibit the states from exercising.

The office of sheriff is created by the Constitution of the Great State of Arizona. The sheriff is bound by the oath to uphold the Constitution of the state and answerable only to the people of the county NOT the Federal Government. The office of sheriff IS a part of the checks and balances of the United States of America. It is there to prevent the Federal Government from doing what it is trying to do today.

So what is the Federal Government going to do? Amend the Arizona State Constitution? I think not.

It's not as simple. This sheriff and this case are tantamount to one grain of sand on a Cape Cod sand dune when it comes to the illegal immigration issue.

1. Illegal immigrants fall into various categories. Not all Mexicans are illegal immigrants. Many are legal. Not all illegal immigrants are from Mexico. Many illegal immigrants come from Europe, Africa, Asia and S.America.

2. The majority of illegal immigrants that get into the US, cross over land, either from Canada or Mexico.

3. Illegal immigrants from other countries are usually ones that use fake credentials, tourists who come here and stay, business people or workers who come and stay, etc.

4. Instead of tackling the symptoms, we should be tackling the problem. What causes illegal immigration on such scale?

5. The answer is, sure, there are always going to be people who will enter any country illegally, but, in the case of the US and Mexico, the roots of the problem can be traced back to the 1990s - namely NAFTA. I'll get back to that in a moment.

6. The current immigration system is broken. It's a huge mess that needs to be dealt with through fundamental changes across the board. But, every time this issue is brought up in Congress, the media goes into a feeding frenzy and every moron on the House floor starts shooting his mouth off trying to please his or her own constituents without taking the interests of the entire nation into consideration.


7. NAFTA created an economic and trade imbalance between the US and Mexico resulting in the collapse of middle class in Mexico. The lower class went from surviving to barely being able to buy food. That resulted in many coming to the US and looking for higher paying jobs (relatively).

8. Finding a long term solution would involve looking into changes or reform in trade agreements. The problem is that corporate America benefits from the current situation and so they put pressure on the government to maintain the status quo.

9. If you want change, you should start with your elected officials, senators, representatives, and governors. Get in touch with them, send letters make phone calls and start petitions.

10. Otherwise, we'll continue to bee bogged down by such cases that this article discusses. In the grand scheme of things, this sheriff and this case is trivial. You could put the sheriff in prison or do the opposite and give him 100 federal agents to work with, but that won't solve any of the problems I mentioned.

AI documented allegations of unjustified, inappropriate, disproportionate, unnecessary, and/or excessive force, not torture.

AZ human smuggling law does appear to give Arpaio a loophole.

I think we should clone Sheriff Joe--we need guys like him in more places in the country.

This would cause the pro-illegal crowd to go into a tizzy of froth-at-the-mouth rage.

I think Joe has lots of support--not only in his home state but across the country.

I don’t get it! This Sheriff’s Dept had only weeks ago received several millions of stimulus grant dollars to do just this type of enforcement in his dept. Home Land Security says they are worried about illegal aliens in the country and coming in as they could be worse terrorists then we natural Americans. Additional the dept is enforcing laws that are being broken and doing a good job at it. He and his officers have a good track record for years. This area is near a border that is known to have illegal crossings all the time. If he drops his guard, this boarder will become the most crossed very fast, by just the ones that endanger the whole country, we are told daily they are and always will be after us to kill us, Then what? Is HLS then going to complain that he isn’t doing his job? This mans past positions were in areas that he would have been exposed as a racists or profiling long before now, if it were truth. HLS should be forced to sit in some of his training on how to protect the country, he seems to care about it far more then Washington ever has. Look what they want us as legal American’s to go through, It is called a National ID program, when really it is a Global ID program, and we are legal! We have the laws in place (that may not be perfect) to allow someone to become legal here, if they don’t work, go through the process and legally change them, do not ignore them just because we don’t like how they work. that’s exact ally what is happening that is taking away Legal American’s rights and freedoms. America’s are threatened by illegal’s period, either jobs, crime, economically, physically or countless other threats. We were told it was 19 illegal’s that caused 9/11 and oh how we had to go to war (based on many lies) and fight terrorism and protect our homeland, Why then is the government Not protecting illegal’s from entry? Looks to me that we never will “be safe” if we cannot control illegal’s coming in or already here! Why do we give Washington money or any support to control this and enforce this if they are not doing it? It is broken and we as American’s (the Bosses) need to do some housekeeping in Washington and fire our employees who refuse to do the jobs they are receiving compensations and millions of dollars to do, they are not doing their jobs!

I Don't Understand The Problem Here

The article points out to the fact that the Sheriff is under investigation because of political pressures from advocacy groups--like the ACLU. This is certainly appropriate and is certainly warranted under the controversy that is being generated. Well, "under investigation" should not in and of itself be tantamount to meaning he is guilty. I saw a clip of an interview on CNN and the Sheriff says that Washington has no business telling him how to do his job since he reports to the people that elected him--maybe Obama should take some remedial classes from the Sheriff, since obviously Obama seems to have "strayed."
My point is to stop the incessant whine. If he is guilty of breaking laws, then charge him.
If he is not guilty, then shut up and let him do his job. If you don't like it, than all you Easterners need to move to Phoenix, become residents and vote him out of office. As he says, he has been reelected by his constituents five times. This whiny mentality is what is causing so much furor by the American People. Here we have the Feds trying to muscle a local
politician to conform to Federal practices that are diametrically opposed by those who elected him. This is why there is such a clamoring on the part of Conservatives. Just when Obama should be doing everything in his power to soothe the fears of conservatives about big government encroachment, what does he do?
He pushes the envelope and causes even greater distrust and turns this Sheriff into a national poster boy for thumbing his nose at the Feds. From a tactical standpoint, can you be any more stupid? Talking about shooting yourself in the foot. That's why the Average American doesn't trust Liberals even though their concerns and values are totally noteworthy.

The title of this piece is woefully incorrect. I live in his jurisdiction, so I should know.

It assumes that Sheriff Joe Arpaio ever "had it" to lose...

This pathetic excuse for a law enforcement professional has been a disgusting embarrassment for over a decade now...

The only people worse than Arpaio are the ignorant voters who keep electing him.

Arizona is like the old West

A few years ago I was in Manicopa County, Arizona in a restaurant and two civilians in street clothes came in with guns strapped to their waists. It was startling for a women from Los Angeles. I was told by the waitress that it was allowed but she did talk to the two individuals who walked out and then came back in without their guns. I had accepted her explanation and hadn't asked for them to get rid of their guns. Then I was afraid that they might come after me because the waitress had told them who had mentioned it.
My friend who was sitting with me and is a 100% legal Mexican, and a U.S. patriot, (she came here legally 50 years ago and has done well, and one of her daughters is a policewoman), became afraid because at the time there had been several bodies found in the desert of Mexican descent.
Since then, I've not been so willing to stop in Arizona on my way to see the wonderful sights of the Southwest.
If that is the kind of State those people want, I'm not going there.

Feds Not Doing Their Job

Fact: The federal government has woefully failed at doing their job of controlling the border. Doubt this? Go to any Home Depot parking lot and tell me otherwise. If you say, no then you a blinded by bias; plain and simple. Neither the Republicans (because they want a cheap labor pool) or Democrats (because they want the vote) have been motivated to stop uncontrolled illegal immigration. They are not serving the interests of our country. If you don't think illegal immigration is out of control, then take a visit to Chula Vista, sounth of San Diego, The evidence is there for you to see, in broad daylight. Lastly, the Sheriff is an elected official, voted in by his constituency. Obviously the people of Maricopa County approve of the job he is doing. A noisy group of immigration activists, and their supporters here, do not negate the voice of the people. If you want to cede all your powers to Washington, then be ready to fear the large centralized government you are feeding. The founding fathers gave states their rights on purpose, part of the constitutional balance. You may not like Sheriff Joe, but he is picking up part of the job that the Fed has proven itself unwilling to do. Don't think illegals take jobs? Swing by any construction site and check a quick check. The facts speak for themselves.

In fact, that's what all those righteous-ass conservative bastards need. A few days or months in the can. And then make them have to spend their first six months out of the slammer working for minimum wage and living in a half-way house.

really makes me wander what the Nazis wrote about the Jews prior to WWII. I imagine that some of the comments posted on the message boards of all the newspapers would be pretty much the same as what would be posted about Jews if the Holocaust were happening now.

I live in AZ and this guy is flat out screwed in the head. He treats people like animals and is so drunk with power that he thinks that he can do whatever he wants without repercussions. He needs to be removed from office and charged for the crimes that he has committed for many years now, including but not limited to, torture. Sheriff Joe must go!

I say we put a $500 Bounty on each Illegal Border Jumper and then allow all Citizens to become Bounty Hunters and it's open season to round them up and take them to centers around the USA for swift shipment back to where they came from. That's a stimulus program that would work. No amnesty, no sympathy, trains to Mexico, planes to Africa, what ever it takes. 6 months and we could clean this country up.

I found that I had an illegal Colombian neighbor last year, called Immigration and a couple days later watched as they hauled him away. He was working as a contractor with a crew of illegals. That's stealing from all Americans.

Oh and there was NO country here before the Europeans arrived and built one, just a bunch of wandering tribes without the concept of ownership or central gov't.
