Bush Undermines Democracy with Attack on 200,000 New Ohio Voters

George W. Bush's request, if honored, could be politically explosive. It would remind voters of the Department of Justice's partisan abuses of power in the scandal surrounding the firing of seven U.S. attorneys in 2006 who did not deliver 'voter fraud' convictions.
It could be a big distraction, drawing attention away from issues that call for legitimate DOJ intervention, such as shortages of voting machines in minority precincts in Virginia and Pennsylvania, compared to nearby white precincts. That disparity would violate existing civil rights law.
Or it could interject a complicating dynamic into the already heavily litigated Ohio general election, by adding the Department's weight to GOP legal claims that pre-emptively question the legitimacy of a close vote count in a key battleground state.
Either way, the Department must choose if it will remain silent or get involved in an action that would go well beyond its historic role of quietly monitoring elections and avoiding messages to voters.
"This is taking the politicization of this to a new level, and the last thing we need is for the elections officials and voters of Ohio to be put in a chaotic situation in the last days before the election," Jon Greenbaum of the Lawyers' Committee for Civil Rights Under Law, told the Washington Post, reacting to the White House request.
The White House, according to the same Post report, described its actions as a routine referral to a federal agency as requested by a member of Congress, House Minority Leader John Boehner (R-OH). Boehner had written to Mukasey early last week but received no response.
The Obama campaign reaction was to send the fourth letter this month to Mukasey urging he ensure the Department does not interfere "to satisfy desperate partisan political demands."
"For the Department now, in response to the intense politics of the moment, to abruptly intercede in the current work of state and local officials would inflict incalculable damage -- further and irreparable damage -- to your office and to the reputation of senior federal law enforcement," said Robert Bauer, Obama campaign counsel.
Bauer's "further" damage was a reference to media leaks by FBI officials confirming it was investigating ACORN, a low-income advocacy group, for voter registration issues. That disclosure violated Department rules and Bauer asked Mukasey to instruct a special prosecutor in the U.S. attorney firing scandal to investigate the leak. Like Beohner's request, Mukasey also did not respond to Bauer's request.
The Real Issue
At issue in the White House pressure tactics is how the GOP may be able to contest the vote count if the results are close.
Republicans in several battleground states have sought to challenge the validity of hundreds of thousands of voter registrations using a gray area of federal election law and error-prone databases.
The Help America Vote Act of 2002 (HAVA) instructs states to use Social Security and driver's license databases to verify voter registrations, but leaves it up to states how to specifically do that. In Ohio, for example, the Secretary of State, Democrat Jennifer Brunner, has issued for local officials to follow.
The absence of specific federal guidelines on using the Social Security and state motor vehicle databases to verify registrations is compounded by another factor: the fact that these records, especially Social Security data, have error rates as high as 28.5 percent when used for verifying voter registrations.
These factors are behind the GOP's assertions that key battleground states like Ohio and Pennsylvania are facing major ballot security crises that threaten the legitimacy of the vote.
In various lawsuits, the GOP has argued that registrations that did not match these databases be segregated and treated as a separate class of voters. The GOP said these voters should receive provisional ballots, which would have to be verified before being counted.
But, so far, most state and federal courts have rejected the GOP's legal arguments. Late last week, a Wisconsin court told that state's attorney general, a McCain campaign co-chair, that he did not have the authority to sue on this issue. Moreover, in Ohio, the GOP's lawsuit went all the way to the U.S. Supreme Court, where it sided with Brunner. The Ohio secretary of state, a former judge, said her office had met HAVA's requirements by promulgating its own procedures to verify voter registrations.
Soon after the Supreme Court ruling, several Republican House members started lobbying the Justice Department to intervene. At the same time, Brunner issued new directives -- which have the force of law -- telling Ohio's 88 county election boards they count not bar anyone from voting because of 'no-match' voter registration issues.
The White House then asked the Justice Department to intervene after Brunner's latest directives.

George W. Bush was appointed president by the Supreme Court despite losing the popular vote to Al Gore by about 450,000 votes and despite Florida not being allowed to recount. Even the Roberts Supreme Court will be hesitant to appoint McCain / Palin president if Obama leads in the popular vote by 2,000,000, let alone by more than 10,000,000. The chances of a scenario exactly like 2000 playing out are slim, but the chance of the Supreme Court having to get involved after the election cannot be discounted.
This is why it is important to vote early for Obama in non-battleground states. That is why I have already voted early in Houston and this is why you need to vote early in California. Go here for early voting information for Texas and here for early voting information in Harris County.
As far as negativity and doom go, self pity and despair never solved anything. I can see why you may feel like this is hopeless, but this is decidedly not the time for inaction. Obama is winning right now and this election can be won if everyone pitches in. As far as being undecided or feeling that there is no difference between the candidates, please read this by David Sedaris.

Evidence from the crime scene is immediately removed and the unelected regime obstructs investigation into the crime for over one year. Without evidence or trial, foreign patsies are blamed for the crime by a Commission appointed by the unelected president.
The unelected president and his regime relentlessly invoke the memory of this shocking event to justify:

This is not the GOP propaganda machine, not the DOJ. It is ACORN themselves.
1.5 % fraud and 30 % faulty. Any organization that has this kind of margin of error should be immediately banned from doing business, it is bordering on the criminal but it at best grossly negligent.
We are not talking about somebody selling sugar pills on the Internet but we are talking about the most precious we have, our right to vote and the right of knowing that voter fraud has not been perpetuated, that we live in a liberal democracy not in a banana republic.
ACORNs argument and the argument of many on AlterNet is that the likelihood of actual voter fraud being perpetuated is little, slim is a very icky debating point.
If you are trying kill poison 400,000 people and only succeed in killing 10 and making 20,000 seriously ill it is still a very, very serious crime. For me perpetrating voter fraud is as serious as poisoning people.
ACORN needs to be shut down now, until they are thoroughly investigated they should be banned from doing ANY voter registration activity what so ever.

The World is looking for a peacemaker, not a warmonger. They have voiced their opinion Loudly if you search. They laugh at the Palin selection, and the McCain Primary Win.
Yes, he's been involved in Bush's foreign propoganda throughout the World, but he is not respected, he is as corrupt as Bush/Cheney and people really know that, but he has manufactured this 'hero' worship thing with his own politiical agenda and I am so sick of the lives lost and missing still because of his absence of intellect and compassion. He is a 'lone' dweller....not a maverick. He is an opportunist, not a maverick. He is a self-centered pompous, immature, and dangerous man. He will start WWIII.

Is it dislike of the federal system that motivates the American dislike of a uniform, well funded and well organised electoral system? Is it the underlying dislike of the masses that, in many ways, is implicit in parts of your Constitution? After all, you have had plenty of time to ensure your politicians come up with a truly democratic syste.
In most West European states it would be unthinkable that political party workers could interfere within the polling station: they are not even allowed in, even if they have transported the voter to the vote. At the count political activists and candidates can watch the (paper) count and ask for a recount etc. if necessary, but they are not allowed to even touch the voting papers. And for that matter, I find it really weird that you have to say where your political sympathies lie when registering............secret ballot?
Its not rocket science, so why do the people of the self proclaimed "greatest liberal democracy" tolerate a flawed electoral system?

Jessice Wehrman reports on the Dayton Daily News politics blog this afternoon that the Civil Rights Division of the U.S. Department of Justice has been speaking with Ohio Secretary of State Jennifer Brunner for the past week about her implementation provisions of the Help America Vote Act regarding state voter registration databases. Specifically, the federal authorities asked what she was doing to eliminate voter registration applications under the names of dead people and duplicate voter registrations, and she issued directives to ensure that existing precautions in these areas would continue. Spokesperson Jamie Hais said the Department of Justice is “pleased” with Brunner’s cooperation, but will "continue to monitor the situation in Ohio."
This can't be what House Minority Leader John Boehner (R-OH) and other Republican members of the House from Ohio hoped for when they fired off a letter to U.S. Attorney General Mukasey, and then another to George Bush, calling for federal intervention in Ohio. Having castigated Brunner's implementation of HAVA as illegal and tantamount to facilitating voting fraud, this sign of approval is a serious political setback for them."
Hopefully this is a good sign. Not sure what "cooperating" with the DOJ or "continue to monitor" actually means.

Sen. Sherrod Brown, D-Ohio, and five congressional lawmakers, urged Attorney General Michael Mukasey not to intervene in Ohio’s voter registration dispute where Republicans have challenged the integrity of 200,000 new voter registration forms.
“The eyes of the nation are once again on Ohio in the Nov. 4 election in this critical election,” Brown and the congressional Democrats said in a letter sent to Mukasey. “We have confidence in the work that is being done by Ohio’s bipartisan group of election officials and by Ohio Secretary of State Jennifer Brunner. We respectfully request that you refrain from taking any action absent more compelling evidence than partisan political requests.
“According to testimony before the Senate Judiciary Committee last year, Republican members of Congress exerted pressure on the Justice Department two years ago to bring an indictment in a public corruption case against Democratic officials before the November election so as to influence its outcome. To his credit, the U.S. Attorney in question resisted this pressure. You should do no less."

this is a 2 sided coin... one side heavily subsidized by taxpayer money and politics, the other, is more or less a victim of circumstances, be he a true victim or the actual victimizer...
there is definitely a need to start a serious discussion on removing the politicals from the justice equation, as these indirect appointments are the ones that are subverting the constitution for simplistic dogmas which are responsible for subverting the dream that once was America...
think of the concept wars...

They took over 30,000 digital photographs. This is not speculation, Amy. This is a meticulous, careful, specific and conclusive demonstration that John Kerry actually won some 200,000 votes in those eighteen counties only that were taken away from him. Bush's official victory margin, you may recall, was about 118,000. So there is no question about it. Ohio was stolen.

What will happen if Obama wins, but the election gets stolen by the toxic republican tactic combination of voter suppression, disenfranchisement, fixed voting machines and partisan Supreme Court?
It is highly likely, so, what are we gonna do about it if it happens?
Are we gonna whine desperately and hug each other?

When does this end?
I am praying to the aliens that Obama wins, that this is a landslide, that renders the trickery insufficient.
If he wins, one of the (jillion) things to reform will have to be the way we vote and how those votes are counted.

I have been presiding judge at a local precinct in Ohio since 1984. The voter id law as passed by Republicans when they were in control allows an ohio driver license with an incorrect address, but does not recognize an out of state drivers license. It recognizes a military id but not a US passport or a college id; telling distinctions that Republicans wrote into law. It recognizes a utility bill or bank statement as proof of address. since I work student only precinct I have had to ask voters come back if they only had their college id and some did not come back. so bring your id and proof of address to the polls since provisional voters count only 75% of time.

George W. Bush was appointed president by the Supreme Court despite losing the popular vote to Al Gore by about 450,000 votes and despite Florida not being allowed to recount. Even the Roberts Supreme Court will be hesitant to appoint McCain / Palin president if Obama leads in the popular vote by 2,000,000, let alone by more than 10,000,000. The chances of a scenario exactly like 2000 playing out are slim, but the chance of the Supreme Court having to get involved after the election cannot be discounted.
This is why it is important to vote early for Obama in non-battleground states. That is why I have already voted early in Houston and this is why you need to vote early in California. Go here for early voting information for Texas and here for early voting information in Harris County.
As far as negativity and doom go, self pity and despair never solved anything. I can see why you may feel like this is hopeless, but this is decidedly not the time for inaction. Obama is winning right now and this election can be won if everyone pitches in. As far as being undecided or feeling that there is no difference between the candidates, please read this by David Sedaris.

This is not the GOP propaganda machine, not the DOJ. It is ACORN themselves.
1.5 % fraud and 30 % faulty. Any organization that has this kind of margin of error should be immediately banned from doing business, it is bordering on the criminal but it at best grossly negligent.
We are not talking about somebody selling sugar pills on the Internet but we are talking about the most precious we have, our right to vote and the right of knowing that voter fraud has not been perpetuated, that we live in a liberal democracy not in a banana republic.
ACORNs argument and the argument of many on AlterNet is that the likelihood of actual voter fraud being perpetuated is little, slim is a very icky debating point.
If you are trying kill poison 400,000 people and only succeed in killing 10 and making 20,000 seriously ill it is still a very, very serious crime. For me perpetrating voter fraud is as serious as poisoning people.
ACORN needs to be shut down now, until they are thoroughly investigated they should be banned from doing ANY voter registration activity what so ever.

Is it dislike of the federal system that motivates the American dislike of a uniform, well funded and well organised electoral system? Is it the underlying dislike of the masses that, in many ways, is implicit in parts of your Constitution? After all, you have had plenty of time to ensure your politicians come up with a truly democratic syste.
In most West European states it would be unthinkable that political party workers could interfere within the polling station: they are not even allowed in, even if they have transported the voter to the vote. At the count political activists and candidates can watch the (paper) count and ask for a recount etc. if necessary, but they are not allowed to even touch the voting papers. And for that matter, I find it really weird that you have to say where your political sympathies lie when registering............secret ballot?
Its not rocket science, so why do the people of the self proclaimed "greatest liberal democracy" tolerate a flawed electoral system?

Jessice Wehrman reports on the Dayton Daily News politics blog this afternoon that the Civil Rights Division of the U.S. Department of Justice has been speaking with Ohio Secretary of State Jennifer Brunner for the past week about her implementation provisions of the Help America Vote Act regarding state voter registration databases. Specifically, the federal authorities asked what she was doing to eliminate voter registration applications under the names of dead people and duplicate voter registrations, and she issued directives to ensure that existing precautions in these areas would continue. Spokesperson Jamie Hais said the Department of Justice is “pleased” with Brunner’s cooperation, but will "continue to monitor the situation in Ohio."
This can't be what House Minority Leader John Boehner (R-OH) and other Republican members of the House from Ohio hoped for when they fired off a letter to U.S. Attorney General Mukasey, and then another to George Bush, calling for federal intervention in Ohio. Having castigated Brunner's implementation of HAVA as illegal and tantamount to facilitating voting fraud, this sign of approval is a serious political setback for them."
Hopefully this is a good sign. Not sure what "cooperating" with the DOJ or "continue to monitor" actually means.

Sen. Sherrod Brown, D-Ohio, and five congressional lawmakers, urged Attorney General Michael Mukasey not to intervene in Ohio’s voter registration dispute where Republicans have challenged the integrity of 200,000 new voter registration forms.
“The eyes of the nation are once again on Ohio in the Nov. 4 election in this critical election,” Brown and the congressional Democrats said in a letter sent to Mukasey. “We have confidence in the work that is being done by Ohio’s bipartisan group of election officials and by Ohio Secretary of State Jennifer Brunner. We respectfully request that you refrain from taking any action absent more compelling evidence than partisan political requests.
“According to testimony before the Senate Judiciary Committee last year, Republican members of Congress exerted pressure on the Justice Department two years ago to bring an indictment in a public corruption case against Democratic officials before the November election so as to influence its outcome. To his credit, the U.S. Attorney in question resisted this pressure. You should do no less."

this is a 2 sided coin... one side heavily subsidized by taxpayer money and politics, the other, is more or less a victim of circumstances, be he a true victim or the actual victimizer...
there is definitely a need to start a serious discussion on removing the politicals from the justice equation, as these indirect appointments are the ones that are subverting the constitution for simplistic dogmas which are responsible for subverting the dream that once was America...

They took over 30,000 digital photographs. This is not speculation, Amy. This is a meticulous, careful, specific and conclusive demonstration that John Kerry actually won some 200,000 votes in those eighteen counties only that were taken away from him. Bush's official victory margin, you may recall, was about 118,000. So there is no question about it. Ohio was stolen.

Here is evidence that you're conspiring to commit voter fraud." Now, that effort, that drive went from Nevada to Missouri to Ohio, and now we hear that the FBI is investigating ACORN.The important point here, Amy, is that voter fraud is practically nonexistent. What will happen if Obama wins, but the election gets stolen by the toxic republican tactic combination of voter suppression, disenfranchisement, fixed voting machines and partisan Supreme Court?
It is highly likely, so, what are we gonna do about it if it happens?
Are we gonna whine desperately and hug each other?
Move to Canada?
When does this end?
I am praying to the aliens that Obama wins, that this is a landslide, that renders the trickery insufficient.
If he wins, one of the (jillion) things to reform will have to be the way we vote and how those votes are counted.

I have been presiding judge at a local precinct in Ohio since 1984. The voter id law as passed by Republicans when they were in control allows an ohio driver license with an incorrect address, but does not recognize an out of state drivers license. It recognizes a military id but not a US passport or a college id; telling distinctions that Republicans wrote into law. It recognizes a utility bill or bank statement as proof of address. since I work student only precinct I have had to ask voters come back if they only had their college id and some did not come back. so bring your id and proof of address to the polls since provisional voters count only 75% of time.
