i am a lesbian living in toronto, and my wife (because we can do that in canada!) gave birth to our son in december 2006. we waited to register his birth until january, when ontario law changed to allow a second non-biological parent be listed on the birth certificate at the time of birth instead of having to go back after the fact and take the time and effort to do a second-parent adoption.

however, on a recent trip to texas to visit my parents on vacation, and we were still made to go through passport control separately - which was inconvenient, to say the least. the baby was on my ticket, but my wife was carrying him in a sling, and i am the "non-biological" mother. thankfully the u.s. customs agent had the grace to be apologetic.

and thankfully nothing happened to put us in an emergency situation where either of our rights or capacities to make decisions on behalf of each other and our child were challenged.

but it can be a nerve-wracking experience knowing that a simple trip to visit our child's grandparents and great-grandparents in the states holds the seeds of tragedy for our family.

congratulations to the court of appeals for their decision!
