Democrats in the House of Representatives are closing the shop down tonight, until a week from Monday… leaving President Bush twisting slowly in a wind of his own creation.

Our third story on the Countdown: the FISA bill — and the retroactive immunity for the telecom giants that helped Mr. Bush illegally eavesdrop on Americans — will thus just sit there, unacted upon, not even a temporary extension which the Republicans and Mr. Bush refused, despite the President’s threats that if the bill isn’t passed by Saturday, there’d be a breakdown in counter-terrorism surveillance and plagues of locusts and stuff.

A Special Comment, in a moment.

First the details.

House Democrats, in essence, calling the Republicans’ bluff.

They staged a walkout at mid-day… led by John Boehner, who in one act managed the cheesy political theater, and managed to get out just as Representatives were to vote on Contempt of Congress citations against Harriet Miers and Joshua Bolten.

That the Republicans just happened to walk to a stand-full of microphones… pure coincidence.

The President had started all this, with his now-daily message of fear, with what he apparently sees as a threat, to postpone his scheduled trip to Africa.

The House should not leave Washington without passing the Senate bill. I am scheduled to leave tomorrow for a long-planned trip to five African nations. Moments ago, my staff informed the House leadership that I’m prepared to delay my departure, and stay in Washington with them, if it will help them complete their work on this critical bill. The lives of countless Americans depend on our ability to monitor terrorist communications.

Having lost, he now says he’s going to Africa — another threat, or promise, unfulfilled.

Now, as promised, a Special Comment.

A part of what I will say, was said here on January 31st.

Unfortunately it is both sadder and truer now, than it was, then.

“Who’s to blame?” Mr. Bush also said this afternoon, “Look, these folks in Congress passed a good bill late last summer… The problem is, they let the bill expire. My attitude is: if the bill was good enough then, why not pass the bill again?”

You know, like The Gulf of Tonkin Resolution.

Or Executive Order 90-66.

Or The Alien and Sedition Acts.

Or Slavery.

Mr. Bush, you say that our ability to track terrorist threats will be weakened and our citizens will be in greater danger.

Yet you have weakened that ability!

You have subjected us, your citizens, to that greater danger!

This, Mr. Bush, is simple enough even for you to understand.

For the moment, at least, thanks to some true patriots in the House, and your own stubbornness, you have tabled telecom immunity, and the FISA act.

You.

By your own terms and your definitions — you have just sided with the terrorists.

You got to have this law or we’re all going to die.

But practically speaking, you vetoed this law.

It is bad enough, sir, that you were demanding an Ex Post Facto law, which could still clear the AT&Ts and the Verizons from responsibility for their systematic, aggressive, and blatant collaboration with your illegal and unjustified spying on Americans under this flimsy guise of looking for any terrorists who are stupid enough to make a collect call or send a mass e-mail.

But when you demanded it again during the State of the Union address, you wouldn’t even confirm that they actually did anything for which they deserved to be cleared.

“The Congress must pass liability protection for companies believed to have assisted in the efforts to defend America.” Believed?

Don’t you know?

Don’t you even have the guts Dick Cheney showed in admitting they did collaborate with you?

Does this endless presidency of loopholes and fine print extend even here?

If you believe in the seamless mutuality of government and big business — come out and say it!

There is a dictionary definition, one word that describes that toxic blend.

You’re a fascist — get them to print you a t-shirt with “fascist” on it!

What else is this but fascism?

Did you see Mark Klein on this newscast last November?

Mark Klein was the AT&T Whistleblower, the one who explained in the placid, dull terms of your local neighborhood I-T desk, how he personally attached all AT&T circuits — everything — carrying every one of your phone calls, every one of your e-mails, every bit of your web browsing into a secure room, room number 641-A at the Folsom Street facility in San Francisco, where it was all copied so the government could look at it.

Not some of it, not just the international part of it, certainly not just the stuff some spy — a spy both patriotic and telepathic — might able to divine had been sent or spoken by — or to — a terrorist.

Everything!

Every time you looked at a naked picture.

Every time you bid on eBay.

Every time you phoned in a donation to a Democrat.

“My thought was,” Mr. Klein told us last November, “George Orwell’s 1984. And here I am, forced to connect the big brother machine.”

And if there’s one thing we know about Big Brother, Mr. Bush, is that he is — you are — a liar.

“This Saturday at midnight,” you said today, “legislation authorizing intelligence professionals to quickly and effectively monitor terrorist communications will expire. If Congress does not act by that time, our ability to find out who the terrorists are talking to, what they are saying, and what they are planning, will be compromised…You said that “the lives of countless Americans depend” on you getting your way.

This is crap.

And you sling it, with an audacity and a speed unrivaled even by the greatest political felons of our history.

Richard Clarke — you might remember him, sir, he was one of the counter-terror pro’s you inherited from President Clinton, before you ran the professionals out of government in favor of your unreality-based reality — Richard Clarke wrote in the Philadelphia Inquirer:

“Let me be clear: Our ability to track and monitor terrorists overseas would not cease should the Protect America Act expire. If this were true, the president would not threaten to terminate any temporary extension with his veto pen. All surveillance currently occurring would continue even after legislative provisions lapsed because authorizations issued under the act are in effect up to a full year.”

You are a liar, Mr. Bush, and after showing some skill at it, you have ceased to even be a very good liar.

And your minions like John Boehner — your Republican congressional crash dummies who just happen to decide to walk out of Congress when a podium-full of microphones await them — they should just keep walking, out of Congress and if possible, out of the country.

For they — and you, sir — have no place in a government of the people, by the people, for the people.

The lot of you, are the symbolic descendants of the despotic middle managers of some banana republic, to whom “Freedom” is an ironic brand name, a word you reach for, when you want to get away with its opposite.

Thus, Mr. Bush, your panoramic invasion of privacy is dressed up as “protecting America.”

Thus, Mr. Bush, your indiscriminate domestic spying becomes the focused monitoring, only of “terrorist communications.”

Thus, Mr. Bush, what you and the telecom giants have done, isn’t unlawful, it’s just the kind of perfectly legal, passionately patriotic thing for which you happen to need immunity!

Richard Clarke is on the money, as usual.

That the President was willing to veto this eavesdropping, means there is no threat to the legitimate counter-terror efforts underway.

As Senator Kennedy reminded us in December:

“The President has said that American lives will be sacrificed if Congress does not change FISA. But he has also said that he will veto any FISA bill that does not grant retroactive immunity.

No immunity, no FISA bill. So if we take the President at his word, he’s willing to let Americans die to protect the phone companies.”

And that literally cannot be.

Even Mr. Bush could not overtly take a step that actually aids the terrorists.

I am not talking about ethics here.

I am talking about blame.

If the President seems to be throwing the baby out with the bathwater, it means we can safely conclude… there is no baby.

Because if there were, sir, now that you have vetoed an extension of this eavesdropping, if some terrorist attack were to follow…

You would not merely be guilty of siding with the terrorists…

You would not merely be guilty of prioritizing the telecoms over the people…

You would not merely be guilty of stupidity…

You would not merely be guilty of treason, sir…

You would be personally, and eternally, responsible.

And if there is one thing we know about you, Mr. Bush, one thing that you have proved time and time again… it is that you are never responsible.

As recently ago as 2006, we spoke words like these with trepidation.

The idea that even the most cynical and untrustworthy of politicians in our history — George W. Bush — would use the literal form of terrorism against his own people — was dangerous territory. It seemed to tempt fate, to heighten fear.

We will not fear any longer.

We will not fear the international terrorists — we will thwart them.

We will not fear the recognition of the manipulation of our yearning for safety — we will call it what it is: terrorism.

We will not fear identifying the vulgar hypocrites in our government — we will name them.

And we will not fear George W. Bush.

Nor will we fear because George W. Bush wants us to fear.

Digg!

No Bill of Attainder or Ex Post Facto law shall be passed. U.S. CONST. art. I, sec. 9, cl. 3.

You go Keith. You do more for "keeping them honsest" in one Special Comment than CNN has ever done since this cabal of criminals stole the elections.

Bush is the worst President ever. He is a traitor and war criminal. 6 years of this constant fear-mongering saps the souls of most Americans. I for one am sick and tired of it. And if he attacks Iran in the spring (see Scott Ritter's interview in today's Alternet) then we will have more and more of the same.

Hold the telecoms responsible. Because if they are let off the hook, then other companies (think Infragard) will do the same. We have to stop this rising tide of Fascism.

Dems get off your wussy butts and take back our Constitution.

Repukians are the goat-shit descendants of the despotic middle managers of any medieval corporation. The two biggest communications crap-houses, AT&T and Verizon, are pocketing exorbitant fees for phone and cable service while pleading for immunity from spying on us. We're way past 1984 and it doesn't feel good!.

Dipshit cretin Bush constantly begs that he is “protecting America.” To do this, he is probably going to have to start on Guantanamo Bay II right here in America. Bastard Bush, first does the unlawful thing, then puts pressure on congress to legalize it. What part of 1984 "New Think" is this?

There is no threat to "legitimate" counter-terror efforts. He is blatantly attempting to protect Big Phone & Cable from citizen reprisal in court. Any Congress person who votes to grant retroactive immunity should be escorted out of congress at the first opportunity. Note... I refrained from my tendency toward medieval justice and did not ask that he/she be drawn and quartered on the Capitol steps. No immunity, no FISA bill! So if we take BushTurd at his word, he’s willing to let Americans die to protect the assets of the phone & cable companies. Dragging this asshole through a mile-long ditch of runny human feces would be too good for him.

Nah, just slowed a bit. After reading Naomi Klein's "Shock Doctrine," one of the most painful books I have ever had to read, the plan has been made clear. Everything Bu$hCo has been doing is according to the old "get-rid-of-democracy, gut-the-Constitution, get-rid-of-the-New Deal, destroy-the-middle-class, elevate-"free markets"-to-word-of-God(Milton Friedman)status. Funny that Friedman sounds so much like freed man when what his system creates is slavery on a global scale.

I don't have cable or even a TV. (And I have dial-up, so I didn't load the video.) So I have never heard or seen Keith Olbermann. But, dang. He slapped down Bush GOOD! Olbermann is so right, too. Bush WOULD have Americans die for the good of Big Telecom.

I think people should email this transcript around, in case people don't have cable. How did this slip past the Mainsteam Media censors? I mean, really. How did it?

peddling of fear to the American people are turned on it's head! Thank you, Keith, once again for a laser-accurate analysis of what "The Worst President in History" is up to this time!

What kind of President would terrorize his own people to try to save his own political ass?

...As Senator Kennedy reminded us in December:

“The President has said that American lives will be sacrificed if Congress does not change FISA. But he has also said that he will veto any FISA bill that does not grant retroactive immunity.

No immunity, no FISA bill. So if we take the President at his word, he’s willing to let Americans die to protect the phone companies.”

That statement is not only true, if you can follow the pretzel-logic of this President, but it's absolutely disgraceful. Why is it so important to grant retro-active immunity if the telecoms did nothing wrong to begin with, as Bush has stated more than once?

It's all about trying to retro-actively cover his own ass from future prosecution, and he would use ANYTHING to try to scare us into believing him. He's so disgraceful that I simply can't find words anymore to convey my disgust.

I cheer for the article. Yet the Dimocraps are in on it. I’m done with them too.
The Senate vote really nailed it for me. What we have here with the house is more political theater. The courts are loaded with Fascists. Another article in today’s AlterNet makes that clear, See Federal Court Throws Out Torture Lawsuit
We are in deep shit. It may be time to heed T Jefferson’s wisdom, “ a revolution every once in a while may be necessary” or something to that effect. I propose a nation-wide general strike. Nobody go to work or pay their taxes or any medical bill, health Insurance. I’d give it one week. Of course we would have to impeach many and recall many more but they are all in on it or stupid beyond imagination. Hillary says she was misled. If so she is a fool. She certainly doesn’t have the required judgment to lead a small squad of dogcatchers. I was not misled.
Mark these words: the last two elections were stolen and so too will this one be stolen. The bill to pretend to fix those problems is stalled. They are all in on it.

that the dems. are stepping up. but keith olbermann really pisses me off. he's blatantly capitalizing on bush-hatred in a really theatrical way. what's going to happen to his "reporting" when there's a democrat in the white house?

i remember, a month ago, when Kucinich was illegally (and then legally) excluded from MSNBC's Nevada debate. Keith Olberman rants on and on about the need to end the war and impeachment and to hold the Bush administration accountable, yet when the one voice who would have presented these ideas to the world on his own network, on a show that HE himself was "commenting" on, he said nothing.

he's the bill o'reilly of "liberals." i'm sick of his false fury. his show is immature, over-glamorized and sensationalized, and thus, a perfect match for this website.

I watched Keith do this piece live yesterday, and I wanted to jump out of my chair and start waving a freedom banner. Olbermann has been one of my favorite political commentators since he came to MSNBC, but this piece nailed Bush better than anyone that I've ever heard in the past!

King George II was a dangerous loose cannon as governor of Texas and he almost destroyed this state with his incompetence; but he's been off the crazy scale since he went to Washington. Thank God we are finally coming to the end of his reign of terror.

Keep up the great work Keith! It's comforting to hear the truth every now and then!

I love it when Olberman goes off on Bush. Though I think he should stop calling him sir and start calling him 'punk' or 'dumb ass' or something that is a little more descriptive. I've also been thinking that when Bush (and pray that he is) is convicted of all his crimes and locked up in prison, as a part of his punishment, Keith Olberman's lectures on George should be piped into his cell 24/7...unless he is out of his cell for 'waterboarding activities'.

i've just been looking back through his Special Comments. almost all of them are about Bush or his administration. only one of them is about the Democrats for their failure to use their mandate to end the war.

by every measure (look it up if you don't believe me), Olbermann's success has been his attacks against the bush administration.
From Wikipedia:

"Olbermann's Special Comments have generated much attention and controversy, especially on the Internet. They are generally credited with Countdown's uptick in viewership and a re-interest in the show by various news articles. They have been viewed hundreds of thousands of times on YouTube, and, the day after the first special comment, Olbermann's name became the #4 search term on Technorati and his book's Amazon.com ranking jumped from #98 to #19."

Clearly he is capitalizing on the intense disapproval most americans feel regarding the occupants of the executive office. but what is he going to do once they leave? what if a democrat is elected president? he can't attack them from the Left: being a radical progressive on a corporate-owned primetime pop-political news show just isn't going to happen. and it would be weird/pointless to attack them from the Right. that job has already been taken by the worst Worst Person in the World.

maybe someone else has reason(s) to believe otherwise (if they do i'm all ears), but i bet that Olbermann personally would like to have Obama as president over clinton (someone below even suggested they run together.) it's all about style at this point, Obama seems more his style. what's ironic about this is that Olbermann's program is going to have a hell of a hard time finding a new angle to approach the news if neither a Republican nor a hated Hillary Clinton is elected.

aside from the pop-political pageantry and the perfunctory cablenews celebrity bullshit, my main problem with Olbermann comes from his network's disinvitation of Kucinich. as his own company worked through the night in the state supreme court to try to overrule a decision that would have given our democracy a semblence of democracy and allowed kucinich to speak, Olbermann sat there in silence. he sat there in silence even as it was announced that kucinich wasn't going to be participating. if he were the hero, the dissident truth-teller you guys imagine him to be, why, sirs, when there was a necessary occasion for someone to step up and issue a "special comment," was his response "no comment"?

he's not a bad guy, but he's constrained by the market, and i haven't been able to enjoy his gimmicks after that incident.

It's so fun to be a critic, isn't it? In fact, isn't that how democrats won the House and Senate last year, just pointing the finger at the other guy. I just have ONE question; "What is your big plan then for stopping terrorism?" Oh yeah, I forgot. According to democrats, terrorism doesn't exist. 9-11 was an inside job. The war on terror is just a "bumper sticker slogan" isn't it Mr. Edwards? You liberals have your head so far up your butt you can't see what's right in front of you. People want to KILL you. They don't want to "negotiate," nor are they just "misunderstood" Ms. O'donnel! So, instead of comming up with new ways to call Bush a liar and a fascist, why don't you come up with a way to protect our country!

Nixon would be so proud of GW and Cheney, too bad the old guy is 6 feet under. Watergate was the tip of a massive warrantless surveilance, secrecy, Imperial Presidency campaign. Nixon resigned when finally put in the position to be TRIED and CONVICTED for his CRIMES. The FISA situation holds the potential of shelving legal immunity for ALL parties involved. One can only hope and pray.

Thank you Keith, for being a voice in the wilderness on the daily treasonous outrages committed by Bush and his cohorts. You are right on, yet again. I was pumping my fist in the air in a moment of anonamous secluded livingroom glory when you were throwing down with your "fascist" and "liar" remarks. Where were you in 2002 when everyone else was crapping their pants? Nice job. Keep it up.

Okay. Now that FISA exists, I can hardly wait to start spying on my neighbors and turning my daughter in to the authorities. Also, if I can find a time machine, I'll go back to 1944 Germany. That way I can join my aunts and cousins at Dachau.

The declaration "Never Again" is rapidly becoming irrelevant. Maybe I'll use my time machine to Fast Forward to November 4th. Let's hope our congressional leaders can restrain the "shrub" and his cohorts.

Oh, yeah, the next time someone says "I don't vote the Party, but the man," ponder this man, his cabinet and his Supreme Court nominees. Pause and remember...while you're still allowed to do so!

Finally, some raw truth in the midst of a sea of bull-shit media. Thank God if their is one for Keith Olberman and his unique reporting. Bush is indeed a liar and a fascist.

Are there others like myself who find it difficult to wade through this article? It is impossible to know what are quotes and what are Olberman's words. The introduction has no discernible end. Olberman is so difficult to watch; the pitbull snarlings that recall Rash Limberger only without the humor. He is on the progressive side. That is the best that can be said.

Obama's affiliations are many, including the mighty Council on Foreign Relations. I'd like to ignore this and pretend it doesn't matter, but it does matter who he aligns himself with outside of the Senate. People like Dick Cheney, the Clintons, Condoleeza Rice, Paul Wolfowitz, David Rockefeller, &c.

It seems he posted a personal profile on a herpes dating site called herpesmates.com. what happen?

YOU, Sir...MR. O addresses wisely in special comment

I have to appreciate Keith’s use of sir in his special comments. When O refers to Bush in this way, the very word takes on an entirely different meaning. It's not "yes, sir/no, sir" chit chat--we're talking "YOU sir" as spoken by O in a way that points a finger so sharply at a man so undeserving of the title that it makes you want to retch.
Perhaps that's not quite the description I'm looking for...but every time O emphasizes that “sir,” my heart skips an additional 5 beats of hatred for a man I am forced to acknowledge as my country's president.
Of we’d love it if Mr. O could just call him a fucking idiot, which is probably what he IS saying to himself in his head. But “sir” is the point.
There is an interesting dichotomy of that word as spoken, and I'm pretty sure O knows what he's doing by using it. Think of subservient people who have been ordered to refer to their masters, abusers, ignorant teachers/professor, etc. as sir or Madame. Can't you hear that grit in O's voice as he says this? And he adds that all so important "YOU" before the sir for even more emphasis. I think O is referring to the networks "leash" on his show, as well. We all know he HAS to follow some of their asinine rules for broadcasting.
Thankfully he has the balls to refuse doing a special comment every night in lieu of waiting until he is so fed up, so enraged that he MUST make a special comment. And that sirs and Madams, is what makes his voice in the media so very important—especially right now.
