In this clip from Democracy Now! Amy Goodman speaks at length with Michael Ratner of the Center for Constitutional Rights about the state of Guantanamo, the guilty plea from Australian David Hicks and the president's repeated runaround of Supreme Court decisions.

Most of Gitmo's 300+ prisoners have been held for years without access to a lawyer or the right to face the accusations.

According to Democracy Now, David Hicks was initially charged with "conspiracy to commit murder, conspiracy to engage in acts of terrorism, attempted murder and aiding the enemy but only ended up charging him with a single crime -- providing material support for terrorism."

It's a long clip but it's one of the greatest ongoing travesties of justice under the Bush administration orchestrated by embattled Attorney General Alberto Gonzales....

A snippet:

Ratner: You have a man there for five years and the first thing that’s said after he takes this guilty plea is that he's going to be able to serve his sentence in Australia. So you have to say to yourself, how do you get out of Guantanamo? You get out either becuase your country fights hard to get you out, which in this case Australia did not put up a very big battle to get David Hicks out....
...So Hicks is sitting there saying, well how do I get back? I mean that’s my imagination, I’m imagining that’s what the lawyers have essentially said. This is a way -- this sentence will be served in Australia is what it appears, and therefore he will get back to Australia. Otherwise he's sitting there, conceivable could get a long sentence, whatever he gets and have to serve it in Guantanamo. So this is a way back to Australia and it’s a way out of Guantanamo which as far as I can see right now, most people still don't have.

How can this be?

Is anyone else having trouble sleeping nights. . .I am beyond outrage. Are there people being held prisoner and possibly being tortured by The United States government?? I want to know who they are. I want to know what their crimes are. I want this madness to end. Saddam Hussein was publicly tried and held accountable with the right to speak out for himself. What have these 380+ people done that their very humanity has been striped away? I feel responsible somehow. How can we allow this administration to go on for another two years?? I wonder what 2 more years must seem like to the detainees Michael Ratner is describing in this video. I want to be able to sleep again . . .

In Australia, the right-wingers are claiming this is proof of David Hicks' guilt. One particularly vile piece tries to pull at Australian heart-strings with this piece of pseudo-journalism:

"It's worth remembering that on February 17, 2002, an Australian SAS soldier, Sergeant Andrew Russell, was killed in Afghanistan after an anti-tank mine exploded. While his death occurred two months after Hicks's capture, it nevertheless highlights Australia's very real exposure on the front line."

Disgusting!

I'd like to see what these people would be willing to do if they received 5 years of the same treatment David Hicks has received.

It seems America has been sleeping just fine. We watched them fly the detainees to Gitmo with sacks over their heads Watched them being led around like dogs and WE KNEW that his was wrong, But who spoke up. Now everyone is enraged. Congress both republican and democrat knew how they were being treated and they did nothing. All the law and order types did nothing but vote for the suspension of Habeas Corpus on the authority of a fool, served by fools. We have lost our way and if one fool got all this done what will happen when the children of the fools are in charge.
